3 General Information Situation Manor Farm is situated on the Alford side of the village of Maltby Le Marsh with access off a sharp corner on the A1104. Maltby le Marsh is 4 miles from Alford, 12 miles from Louth, 29 miles from Boston and 39 miles from Lincoln. The postcode only takes you close to the site so please follow the To the Sale signs that will be erected on the Sale Day. Background A genuine sale as a result of a change in farming policy by G White & Sons. Catering and WC Facilities will be available on sale day. Car Parking An area for car parking is provided (weather permitting), please follow the signs. At all times park clear of the public highway. Registration for Buyer s Number - All intending bidders must register with the auctioneers prior to placing a bid and obtain a "Buyer's Number". New buyers must bring proof of identity. Methods of Payment Payment for all lots purchased including buyer's premium and VAT must be made by the purchaser in full on the day of sale. The methods of payment that are accepted by the auctioneers are: Cash - To a maximum of 10,000; Cheque - A cheque must be supported by either a letter of reference from your bank or a cheque guarantee card to cover the sum of your purchase; Credit and Debit Card (Subject to a satisfactory signal) A 2% charge will be made by the auctioneers on all Credit and American Express cards; Banker's Draft. It is the responsibility of the purchaser to make prior arrangements regarding method of payment before attending or participating in the auction. For persons unknown to the auctioneers, their lots will be impounded until the auctioneers have cleared funds. Buyer's Premium The buyer s premium at this sale is 5% plus VAT (6%) of the purchase price (see online bidding for the Internet Surcharge). VAT will be charged on the hammer price where applicable (at the current rate of 20%). Online Bidding Only the main items in this sale will be listed online (approx. 10 days prior) and sold simultaneously by live and online auction; you will be bidding against real people in real time. The auctioneers cannot be held responsible for any problems with technology, the internet or interruption to the online service provider or human error. Online bidders must accept the Conditions of Sale and are strongly recommended to prior view as the lots are sold as seen, with no warranties whatsoever and the auctioneers will not entertain any complaints regarding faulty or incomplete items. In addition to the buyer's premium, there is an internet surcharge of 3% plus VAT (3.6%) of the hammer price. Commission Bids The auctioneers will be pleased to execute commission bids upon receipt of full written instructions but will not be liable for any errors or omissions. Removal and Loading Away Sold lots may only be collected and removed by the purchaser upon the presentation of a receipted invoice. Loading away facilities will be available on the day of the sale and during the following seven days (subject to arrangement). 10 Conditions of Sale Bidding - At the fall of the hammer the highest bidder shall be the purchaser but if a dispute arises as to the identity of the highest bidder the auctioneers will confirm the identity of the highest bidder or the lot will be put up again and resold. No person will be allowed to retract their bid once accepted by the auctioneers but the auctioneers reserves the right to refuse the bid from any person without giving reason. Reserve Prices - The majority of the lots are unreserved and will be sold to the highest bidder. The auctioneers reserve the right to use their own discretion, acting in the interest of the vendor, for any lot to bid on behalf of the vendor and even withdraw a lot if the auctioneers so decide. Disputes - In the event of a dispute the matter will be referred to the auctioneers whose decision will be final and binding upon all parties. Catalogue, Descriptions, Lotting and Estimates - Whilst every care has been taken in describing the lots in the catalogue, these descriptions must not be regarded upon as fact. Intended purchasers are strongly advised to inspect and check on the availability of any particular lot upon which they intend to bid as the auctioneers act as agent only and do not have personal knowledge of the item. All lots are un-tested, without warranties or guarantees as to serviceability, working order/hours or fit for purpose and are sold "as seen" unless otherwise stated. Any estimates provided are for guidance purposes only. The auctioneers reserve the right to vary the order of sale, combine or divide or withdraw any lot and to generally conduct the auction as the they so decide at the time. Payment of Account - If payment is not made by one of the above methods the auctioneers reserve the right to retain and store all items until satisfactory payment has been made with all removal and storage expenses being charged to the purchaser. In the event that purchaser defaults on payment the auctioneers reserve the right to resell the lot and to charge the purchaser for any expenses and loss incurred or to retain any profit that may arise from the resale. Responsibility for Sold Lots - No lot will become the property of the purchaser or may be removed from the premises until it has been paid for in full. However, at the fall of the hammer, each lot will be at the sole risk and expense of the purchaser and the auctioneers will not be responsible for any damage or loss that occurrs due to fire, theft, accident or otherwise. With any vehicle or trailer purchased from the auction, the purchaser is responsible for complying with all legal requirements including road worthiness of the lot and for ensuring its removal from the premises in a safe manner. A purchaser must not attempt to disconnect any fixed electrical item without first obtaining confirmation from the auctioneers that the mains supply has been turned off. The purchaser is responsible for and must indemnify the auctioneers and owner of the sale premises against any damage caused to buildings or property or any other lots at the auction. Any lot which has been sold but not removed by the purchaser within the required time may be removed by the auctioneers and the purchaser will be responsible for any cost of removal and storage. 10
