1 TITLE Eco-Design Substances Control DOCUMENT NUMBER DOCUMENT PAGE 1 OF PURPOSE This specification requires disclosure of Banned, Restricted, Exempt, and Reportable substances, and prohibits the content of Banned Substances in Freescale products. This specification provides requirements for Freescale s product material suppliers. 2.0 SCOPE This specification applies to all product materials that are incorporated into Freescale products at any stage of manufacturing operations. In this specification, providers of these materials are classified as Supplier(s) unless otherwise specified. This specification identifies substances that are banned from, or restricted in, Freescale products and any exemptions Freescale authorizes for use of such substances. It also identifies substances that Freescale has designated as Reportable. External die and wafer foundry operations need only comply with the Banned Substances restrictions in Section 5.1, 5.4, and Section 5.6 (except where addressed to Suppliers). Internal die manufacturing operations need only comply with the Banned Substances restrictions in Section 5.1 and RoHS Certificate of Analysis Requirements in Section 5.4. Suppliers submitting parts for NTI/NPI deliverables are required to comply with this specification. The requirements in this specification are in addition to all other requirements in the material specifications, or drawings, for Freescale product materials. The order of precedence for substances restricted by this specification and material specifications or drawings is defined in Section of this specification. 3.0 RULES Freescale semiconductor products shall not contain Banned or Restricted substances in excess of the Maximum Concentration alues unless authorized by an exemption within this specification. To ensure compliance of finished products, and meet customer expectations, Freescale shall require covered entities to: Certify compliance to this specification; Declare the composition of materials; Analyze materials for RoHS substances; Maintain a hazardous substance management program; Maintain a conflict mineral policy; and Provide a conflict mineral declaration. 2 PAGE 2 OF ROLES AND RESPONSIBILITIES Detailed roles and responsibilities for the Freescale Eco-Design Substances Management Program are maintained within specification 12MWS10543D. The table below summarizes the requirements for organizations and functions. 3 PAGE 3 OF PROCEDURE 5.1 Supplier Banned Substance Requirements Freescale Banned substances shall not be contained, or intentionally added, AT THE HOMOGENEOUS MATERIAL LEEL OF any materials that are incorporated into Freescale products in concentrations above the maximum concentration value (MC), unless exempt as described in Section or Appendix B notes EU RoHS and EL Directive Exemptions accepted by Freescale RoHS I RoHS II EL II Exemption Allowed 6 6a 1a Lead as an alloying element in steel containing up 6b 2c to 0.35 % lead by weight, aluminum containing 6c 3 up to 0.4 % lead by weight and as a copper alloy 7a 7a 8e 8h 7b 7b 8a 8b 5 or 7c containing up to 4 % lead by weight. 4 PAGE 4 OF Supplier Reporting Requirements Material Composition Declaration (MCD) Reporting Requirements a) Suppliers shall report on the Freescale Supplier Portal 100% of all substances that remain in their product. Suppliers shall also report any listed Freescale substances contained in concentrations above the Maximum Concentration alue (MC) as specified in Appendix B. Additionally, Freescale Banned substances in Appendix B, Table 1, that are not specifically listed by CAS Number in Appendix C shall have the content declared for the entire Freescale Banned substance group when content exceeds the MC. This reporting shall be completed: 1. Within ten (10) business days [twenty (20) business days for efm] after Supplier is notified that the purchase order has been signed or the date Freescale requests the MCD, whichever comes later or; 2. At least 30 days before any product materials are received by Freescale that have been modified, as described in Section 5.2.2, for which a MCD report was previously reported. b) Suppliers shall report the required information listed in the Freescale supplemental document Freescale Semiconductor Material Composition Declaration Instructions for Suppliers, -02. c) MCD reports are not required for bare bond wire, and bare lead frames, (materials that are of a single substance and not pre-plated with metals other than silver on the die bond flag) under the following conditions: 1. The material contains no Freescale Banned substances in concentrations greater than the MCs listed in Appendix B, or contains banned substances that are exempt (Section 5.1.2); and, 2. The metal type is a common industry standard. For lead frames the supplier shall provide the standard metal trade name (such as CDA 194, C7025, Alloy 42, EFTEC-64T, etc.) in lieu of the MCD. d) Miscellaneous, unidentified, and proprietary substances shall not exceed a cumulative 10% or 100,000 ppm of the total substances reported within a homogeneous material in an MCD. (Miscellaneous, unidentified and proprietary substances are those substances without an assigned CAS number.) Banned and Restricted substances, as well as substances subject to Freescale recognized regulatory exemptions may NOT be included in the maximum 10% miscellaneous, or proprietary substances Product Modification If a supplier s product material is modified in a manner that significantly affects the concentration of listed Freescale substances for that product Freescale requires an updated MCD to be submitted via the Supplier Portal. For these purposes a significant modification of a supplied product material is defined as: a) A change in the concentration of a substance in the product material that had already been reported; b) An addition of a substance in the product material where it was not previously present; or c) An addition of a substance in the product material where it was not previously reported Substance Reporting Format and Instructions Suppliers shall receive the required reporting format instructions with notification of changes from the Freescale Supplier Portal. 5 PAGE 5 OF Weight Reporting Forms, Format and Instructions For finished externally assembled devices, additional information and data listed in Appendix A shall be required of all external final manufacturing operations. Weight template forms for this purpose shall be provided by the Freescale EPP Team. The EPP Team may be contacted at EPPANLST@freescale.com 5.4 Supplier RoHS Certificate of Analysis Requirements (RoHS CoA) The RoHS Certificate of Analysis (RoHS CoA) is a chemical analysis reporting the concentration of RoHS Restricted Substances. The following are the requirements for RoHS CoA Reports. a) A RoHS CoA is required for each product material annually. An analytical report is required for each homogenous or raw material in the product material. b) RoHS CoA analytical reports submitted to Freescale shall be a Portable Document Format (PDF) document. c) If the Supplier s product material is modified, as described in Section of this specification, the Supplier shall perform the required analysis, and submit the RoHS CoA report, before delivery of the first article of the modified product material to Freescale Supplier s RoHS CoA Responsibilities a) Product material suppliers are required to submit RoHS CoA on the Freescale supplier portal to document compliance for RoHS restricted substances at the raw or homogeneous material level. The RoHS CoA requirements are applicable only to RoHS restricted substances. The RoHS CoA report may contain analysis for additional substances other than the RoHS restricted substances, but analysis for additional substances is not required at this time. b) The RoHS CoA analytical report(s) shall be valid for 1 year from the date of report issue. c) The RoHS CoA report shall be made available to Freescale within five (5) business days of request by Freescale [ten (10) business days for efm]. Suppliers shall upload RoHS CoA reports to the Freescale Supplier Portal as a PDF file. d) Suppliers shall be responsible for compiling and storing applicable RoHS CoA reports for a minimum of four (4) years. e) At least one RoHS CoA shall be documented per raw or homogeneous material. Each RoHS CoA report shall correlate to the Freescale product materials in which the raw or homogeneous material is contained. f) efm suppliers are responsible for compiling and maintaining required RoHS CoA reports and providing RoHS CoA reports to Freescale within ten (10) business days of the request. g) efm suppliers that have multiple suppliers for the same part number shall obtain RoHS CoA reports from each supplier. h) Materials that are assigned to multiple Freescale part numbers may reuse the same RoHS CoA to fulfill the requirements for all product material part numbers. i) Suppliers shall submit RoHS CoA reports before delivery of the first article to Freescale. 6 PAGE 6 OF RoHS CoA Reporting Format and Instructions Suppliers shall receive the required reporting format and instructions from the Freescale Supplier Portal. Detailed requirements, instructions, and examples for RoHS CoA reporting format, are contained in Freescale supplemental document Freescale Semiconductor RoHS Certificate of Analysis Instructions for Suppliers, -03. Detailed requirements, instructions and examples for submitting RoHS CoA reports using the Freescale Supplier Portal are contained in Freescale supplemental document Freescale Semiconductor RoHS Certificate of Analysis Portal Instructions for Suppliers, -04. Suppliers shall receive notification of changes to these supplemental documents from Freescale Global Procurement. 5.5 Freescale EPP Self Assessment, EPP Audit, and Banned Substances Certification Freescale uses Audit procedures (12MWS10544D) in conjunction with this specification, () to monitor the quality of Supplier s substance management systems. The Eco-Design Substances Compliance Audit procedures (12MWS01544D) explain the internal Freescale responsibilities and record management procedures. The Freescale EPP Self-Assessment template provides the questions and instructions for Supplier assessments Freescale EPP Self Assessment Suppliers shall complete and submit an EPP Self Assessment upon Freescale request Freescale EPP Audit Suppliers shall support Freescale EPP Audits by reviewing questions and collecting documentation prior to audits. During the audit, Suppliers shall make subject matter experts available to explain documentation, identify process strengths, and weaknesses. Suppliers shall complete the Audit Continuous Improvement Plans if applicable Freescale Banned Substances Certification Suppliers shall complete, and sign, the annually revised Freescale Semiconductor Banned Substances Certification for Product Materials, -01a, or Freescale Semiconductor Banned Substances Certification for Die and Wafers, -01b. a) The -01a form for product materials is incorporated into the EPP Self Assessment and the EPP Audit Assessment templates and shall be submitted to Freescale at EPPAUDIT@freescale.com b) The -01b form shall be provided to Die and Wafer manufacturers by Global Procurement and shall be submitted to Freescale at EPPAUDIT@freescale.com c) A PDF or JPG format copy of the signed Banned Substances Certifications shall be submitted to Freescale at EPPAUDIT@freescale.com, along with the completed Self-Assessment. 7 PAGE 7 OF Substances Banned or Controlled by Regulations and Standards Freescale requires that its products and materials meet, or exceed, the regulatory requirements found in EU RoHS, EU EL and EU REACH as well as the Freescale MC, and reporting, thresholds for Banned and Restricted substances as specified in Appendix B. Freescale encourages its suppliers to develop lead (Pb) free, and halogen free, solutions for volume assembly production. To meet industry standards, suppliers may be required through Freescale specifications, or purchase orders, to deliver lead (Pb) free and halogen free product materials. Upon Freescale request, Suppliers shall provide lead-free, and halogen-free, development plans and conversion roadmaps General Restrictions for Lead (Pb) Compounds, Leaded Glass & Ceramics, and Lead in Metals or Alloys a) Lead compounds are Freescale Banned Substances per Appendix B. Usage exemptions shall not apply. b) Leaded glass and leaded ceramic materials are Freescale Restricted Substances. Supplier shall provide lead-free development plans and conversion roadmaps upon request. c) Metallic lead and lead alloys are Freescale Restricted Substances. Specific restrictions, as discussed in Section 5.6.2, may apply to some product materials. d) Whether present in compounds, glass, ceramics or metals & alloys, Supplier shall report all lead content per Section Lead shall be reported separately from miscellaneous or proprietary substances. Exempted uses per Section may apply. Freescale shall review and disposition Supplier lead exemption requests and shall notify the Supplier about rejections Specific Restrictions and Exemptions for Lead (Pb) Content in Products, Wafers and Die a) When Freescale designates product materialss to be Lead-free (or Pb-Free ) in either design specifications or purchase orders, the materials may not contain intentionally added lead. Unintentional lead may not exceed thresholds in Appendix B. b) When Freescale designates product materialss to be RoHS Compliant in design specifications or purchase orders, the materials may not contain intentionally added lead unless Freescale determines that the specific use of lead is exempt from RoHS Halogen-free Product Materials In August of 2009, Freescale established a roadmap to gradually convert new products to halogen free materials. All NPI materials are expected to be halogen-free in composition. To be halogen-free, the following requirements shall be met: a) In addition to the Banned Substances in Appendix B, the material may not contain intentionally added chlorine or bromine in any form or compounds. b) Any trace contaminants, of any form, of chlorine or bromine shall not exceed 0.09 % (900 ppm) by weight in any homogeneous material. 8 PAGE 8 OF Restrictions for REACH Substances Suppliers shall comply with EU REACH requirements for registration and reporting. This applies to product materials shipped to any Freescale manufacturing site or location. a) Supplier shall monitor the official EU REACH Substance of ery High Concern (SHC) candidate list at the ECHA website: b) Supplier shall notify Freescale when a product material delivered to Freescale contains a candidate SHC in excess of 0.1% by weight per supplied product material. Notification shall meet the requirements established in REACH Regulation 1907/2006, Article 33. c) REACH Annex XI substances are Freescale Banned substances. Supplier may not apply Authorization obtained from ECHA, for specific application of Annex XI substances in supplied product materials, without Freescale approval. d) REACH Annex XII substances with restrictions applicable to supplied product materials, or Freescale products, are Freescale Banned substances per Appendix B. e) REACH substances shall not be included in the miscellaneous, unidentified, or proprietary substances. f) Official REACH notification shall be sent to EPPANLST@freescale.com Tin, tantalum, tungsten or gold (3T&G) from conflict mines or smelters in and around the Democratic Republic of Congo. Supplier shall comply with Section 1502 of U.S. HR 4173 (2010 Financial Reform Bill) and it s implementing regulations promulgated by the U.S, Securities and Exchange Commission (SEC). a) Supplier shall identify any 3T&G in the Freescale MCD of the Supplier product material. b) Supplier shall not include 3T&G in the miscellaneous, unidentified, or proprietary, substances. c) Supplier shall make a reasonable country of origin inquiry to identify the source smelter and/or mine for all 3T&G used in its product materials. d) Supplier shall declare a Conflict Free Mineral status (DRC conflict free, not DRC conflict free or indeterminate) and provide Freescale with smelter and/or mine information, plus documentation necessary to support SEC reporting requirements. e) Supplier shall send 3T&G declarations, smelter and/or mine information to CONFMNLS@freescale.com Rare Earth Elements Rare Earth Elements (REE) are necessary for production of many semiconductor components. Seventeen elements in the Periodic Table are classified as REE, specifically, those with chemical symbols Sc, Y, La, Ce, Pr, Nd, Pm, Sm, Eu, Gd, Tb, Dy, Ho, Er, Tm, Yb and Lu. Rare Earth Elements (REE) are not Banned substances, but there is an ever present risk of supply disruptions for such elements. Thus Freescale requires Suppliers to identify when REE are contained in product materials. Upon Freescale request, Supplier shall identify the primary country for their REE, and provide information about qualified alternative sources from other countries. 9 PAGE 9 OF Non-Conformance Unless exempt per Section 5.1.2, the intentional use, or the existence, of a Freescale Banned Substance over the maximum concentration value IN ANY HOMOGENEOUS MATERIAL within a product material shall cause the material to be non-conforming and non-compliant to Freescale. Non-conforming product materials shall require a Freescale Material Review Board disposition and/or corrective actions according to standard procedures Other circumstances may cause a material, or component, to be considered non-conforming. a) If a product material is specified by Freescale to be RoHS Compliant but the product material is not RoHS compliant; b) If a product material is specified by Freescale to be lead-free (Pb-free) but theproduct material is not lead-free (Pb-free); c) If a product material is specified by Freescale to be halogen-free but the product material is not halogen-free; d) If 3T&G is identified as a metal originating in and around the conflict region of the DRC. e) If a substance appears in multiple specifications or drawings and does not meet the most stringent of the specified concentration requirements A supplier shall immediately report any product content non-conformance to EPPANLST@freescale.com and copy their Freescale Global Procurement contact. 5.8 Supplier Information Records Management by Freescale EPP shall place Supplier information in a centralized site and shall retain these records as Environmental Data as per SOP Freescale erification of Supplier Information Freescale Supplier Quality may perform incoming analytical screening of product materials to verify that the actual composition is as represented by the certifications, and MCD, submitted by Suppliers. This screening is controlled by Freescale specification 12MRQ90067A, Incoming Piece Parts Sampling and Inspection Procedures for RoHS Banned Substances Freescale Eco-Design Substances a) The lists of Freescale Banned, Restricted, and Reportable, Eco-Design Substances defined by this specification are included in Appendix B and C of this specification. b) Substances listed in Appendix B and C shall be determined by EPP. EPP shall monitor changes in regulations and customer requirements globally, and modify the Eco-Design Substance List as needed. c) When substances are added or removed from the Freescale Eco-Design Substances list, or the maximum concentration values for substances on the list are changed, EPP shall update, record those changes in the revision sheet, and provide access to the revised specification to Suppliers. For acronyms and terms which may not be listed, refer to Freescale Glossary at Acronym / Terms Definition AC Alternating Current Banned Substances Substances that Freescale bans from use in its products in recognition of the fact that at least one Government or customer prohibit use of the substance. CAS Number Also known as CAS# or CAS Registry Number. These are unique numerical identifiers assigned by the "Chemical Abstracts Service" to chemicals and elements described in open scientific literature. CoA Certificate of Analysis Conflict Minerals Tin, tantalum, tungsten and gold (3T&G) that originate from conflict mines or smelters in and/or around the Democratic Republic of the Congo (DRC) DC Direct Current Dopant A substance deliberately introduced in very low concentrations to bring about desirable effects on the structure of materials. Eco-Design Substances Substances that are environmentally harmful create special disposal concerns or may be valuable for reclamation purposes.
