3 CONDITIONS OF SALE FOR THE OFFER TO PURCHASE OF THE MOVABLE ASSETS OF: KAPPA HEAVY ENGINEERING (PTY) LTD (IN LIQUIDATION) ARE AS SET OUT HEREUNDER 1. This offer will close on Friday, 3 February 2017 at 15h00. No late offers will be accepted. All offers must be sent to kim@devco.za.net or hand delivered to Devco Auctioneers & Sales, 8 Greenstone Place, Stoneridge Office Park, Block C, Modderfontein. All offers shall remain open and irrevocable until the 10 February The acceptance of any offer shall be made solely by the Liquidators within 5 (five) working days after the 3 rd of February All offers must be accompanied by a R10, (ten thousand Rand) refundable deposit in the form an EFT. The deposit must be deposited into Devco Auctioneers & Sales, First National Bank, Menlyn Square, Account no The assets for which offers are called for are contained in the documents accompanying this offer. The information contained therein is given in good faith and the Liquidators have established that the assets belong to KAPPA HEAVY ENGINEERING (PTY) LTD (IN LIQUIDATION). 5. The assets are offered voetoets, insitu and as they stand. Neither the Liquidators nor the agents have given any warranties or made any representations either express or implied in regard to description, quality or condition of any asset or suitability thereof for any purpose. 6. Within 2 banking days after acceptance of an offer, the successful offeror will be required to pay the balance of the purchase price to Devco Auctioneers & Sales by EFT to be deposited into Devco s bank account as per the banking details provided. The purchaser will then have until the 24 February 2017 to remove the assets. Failure to do so, will entitle the Liquidators to hold the buyer responsible for any losses incurred. 7. Inspection may take place on Thursday, 2 February 2017 from 09h00 to 16h In the event of the successful offeror not paying the balance of the purchase price as stated (9), the Liquidators reserves the right to cancel the sale and claim damages from the purchaser. The deposit received shall be forfeited and shall contribute to the costs of calling for an auction, the agents (Devco Auctioneers & Sales) commissions as well as any shortfall in the subsequent offer. 9. All unsuccessful offeror s will be refunded their deposits back into the bank account given. 10. The sale is exclusive of Value Added Tax of 14% which will be added to any successful bid as well as a buyer s commission of 10% (ten percent). 11. The Liquidators are not obliged to accept the highest offer or any offer should it not be acceptable or suitable to them. 12. Ownership of all movables sold shall remain vested with the Liquidators until paid in full.
