2 ALL OFFERS ARE MADE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS: TENDER All items are sold in their present condition as they stand, and the Purchaser accepts them as such. Items are sold with no guarantees or warranties, either express or implied. 2. The Seller and/or its Agent shall have the right to accept or reject any offer received, and all items are subject to a reserve/upset price. 3. The Purchaser warrants that all items have been inspected. 4. The Purchaser hereby waives any right of recourse against the Seller and/or its Agent, who have no duty to repair. 5. The Seller and/or its Agent shall not be responsible for errors in advertising material, and hours/km readings are not guaranteed. 6. Ownership of all items shall remain vested in the Seller until such time as full payment of the purchase price has been received. 7. Risk shall pass to the Purchaser on payment of the full purchase price. 8. There shall be a R deposit payable on submission of all Tender offers. 9. In the event that the Tender offer is unsuccessful, the deposit shall be refunded to the Purchaser within 3 working days of closure date of the Tender. All deposits shall be paid into the designated Deposit banking account as specified hereunder. 10. Invoices shall be payable in full on presentation. 11. The Seller and/or its Agent shall reserve the right to cancel forthwith and without notice all sales in default of any terms hereof, and in such event the deposit shall be forfeited. The Seller and/or its Agent shall have the right to resell such items by public auction, public tender or private treaty. 12. All sales shall attract a 10% buyers premium plus VAT on both the sale price and the buyers premium. 13. Only fully completed Offer Submissions ed to tenders@dunquip.com together with supporting documentation and proof of payment of deposit will be considered. 14. Outcome of Tender submissions shall be notified to the Purchaser per within 3 working days of closure date of the Tender. 15. The Purchaser shall take delivery of the items purchased within 24 hours of receipt of an issued Release Note. The Purchaser shall be responsible for the loading, collection and transportation costs of all items purchased. 16. The Seller and/or its Agent reserves the right to withdraw any item from tender at any time without notice. 17. The signatory hereof binds himself as surety and co-principal debtor for all obligations of the entity that he represents.
