Approve the first reading by title only and subsequent adoption of an ordinance establishing parlcing regulations for electric vehicle charging on city-owned and operated parking facilities. 2. Provide direction to staff about changing the hourly rate for electric vehicle charging on city-owned property. DISCUSSION The City has three electric vehicle charging stations at two locations: two at 255 E. Fifth Street at the Oxnard Transit Center long-term parking lot, and one at 324 South B Street at the downtown parking garage. Staff recommends the parlcing ordinance be amended to allow the City to enforce exclusive use of the parking spaces for electric vehicle charging as authorized by the California Vehicle Code. On July 23, City Council held a public hearing and adopted Resolution No. 14,43 1 establishing a user fee of $2.25 per hour for electric vehicle charging. The charging fee recovers the estimated operational costs (which are the fees from the vendors, annual maintenance, and electricity costs) in accordance with the financial management policies in City Council Resolution No. 14,430. Resolution No. 14,430 states the City Council will recover the costs of providing a private benefit to users through the imposition of user fees and charges. The City Council has declared it establishes all user fees and charges at a level related to the direct and indirect costs of providing services and the degree of public versus private benefit. A public hearing would be required to change the fee from $2.25 per hour. If the City Council wishes to reconsider the fee, then staff would return later with a recommendation and analysis of the potential public versus private benefit.
2 Parking Ordinance Electric Vehicle Charging, Fee September 25,2013 Page 2 FINANCIAL IMPACT The financial impact of enforcing restricted parking for electric vehicles may be an increase for police enforcement costs and may increase revenue from parking fines. The financial impact of a reduced hourly fee for electric vehicle parking will depend on the amount of the change. 3 CITY COUNCIL OF THE CITY OF OXNARD ORDINANCE NO. ORDINANCE OF THE CITY OF OXNARD, CALIFORNIA, AMENDING DIVISION I OF ARTICLE IV OF CHAPTER 8 OF THE OXNARD CITY CODE CONCERNING THE PARKING OF ELECTRIC VEHICLES AND ELECTRIC VEHICLE CHARGING WHEREAS, Section 22511(a) of the California Vehicle Code provides that a local authority, by ordinance or resolution, may designate stalls or spaces in an off-street parking facility owned or operated by that local authority for the exclusive purpose of charging and parking a vehicle that is connected for electric charging purposes; and WHEREAS, Section (f) of the California Vehicle Code provides that Section does not interfere with existing law governing the ability of local authorities to adopt ordinances related to parking programs within their jurisdiction; and WHEREAS, in order to promote and facilitate the use of electric vehicles, the City of Oxnard has provided off-street electric charging stations within city-owned parking facilities for the purpose of refueling electric vehicles; and WHEREAS, an electric vehicle means any car, truck, or other vehicle that does not produce tailpipe or evaporative emissions or is a plug-in hybrid electric vehicle (PHEV), as that term is used by the State Air Resources Board; and WHEREAS, the City wishes to ensure that the electric charging stations are available for the fueling of electric vehicles as defined herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF OXNARD DOES ORDAIN AS FOLLOWS: Part 1. Division I of Article IV of Chapter 8 of the City Code is hereby amended to add Section 8-57 to read as follows: "SEC ELECTRlC VEHICLE CHARGING. No person shall park a vehicle in an off-street parking facility owned or operated by the city in a stall or space designated exclusively for parking an electric vehicle for charging purposes, which is posted in accordance with California Vehicle Code section 22511, as it may be amended or renumbered from time to time, for any purpose other than to charge an electric vehicle. Nor shall any person connect any device, item, equipment, or thing to an electric charger located at such space or stall other than an electric vehicle, as defined herein. As used in this Section 8-57:
4 1. An "electric vehicle" means a plug-in electric vehicle, including an exclusively electric vehicle ("%V9') and a plug-in hybrid electric vehicle ("'PHEV"); 2. An EV means a motor vehicle exclusively powered by an electric propulsion system; and, 3. A PHEV means a motor vehicle primarily powered by an electric propulsion system and secondarily by an internal combustion system, which powers the electric propulsion system when the on-board source of electricity is depleted or discharged." Part 2. Within fifteen days after passage, the City Clerk shall cause this ordinance to be published one time in a newspaper of general circulation, published and circulated in the City.
