1 Administrative Services Department SUBJECT: First consideration of an Ordinance amending Chapter 90, Article III, Division 2 of the Village s Municipal Code relating to the Commuter Parking AGENDA ITEM: 11. c. MEETING DATE: November 1, 2011 VILLAGE BOARD REPORT TO: Village President and Board of Trustees FROM: Amy Ahner, Director of Administrative Services (847) Brent Reynolds, Public Safety Support Services Director (847) Jody Hellmer, Resolution Center Supervisor (847) THROUGH: Todd Hileman, Village Manager PURPOSE AND ACTION REQUESTED: Staff is requesting Village Board consideration of an Ordinance amending Chapter 90, Article III, Division 2 of the Village s Municipal Code (the Code ), relating to the Commuter Parking. BACKGROUND The Resolution Center ( RC ) and Public Safety Support Services ( PSSS ) have been working together to review the commuter parking permit renewal and enforcement processes. A Request for Bids was released in July in an effort to streamline the collection, administration and fulfillment processes. The Village received only one response that was four times greater than the in-house cost and vendors responded that they were not able to provide competitive pricing due to the low volume. DISCUSSION: Staff continued to look at other opportunities for efficiencies. A Resolution Center 2011 Business Plan goal has been to integrate the stand-alone commuter parking Access database into one of the enterprise system platforms. A PSSS goal has been to look for ways to make commuter parking enforcement and ticketing more effective, especially regarding hang placards. These two goals offer an opportunity to bring the processes together. Page 1 of 11

2 The Village s Munis enterprise software application does not have a parking renewal/enforcement module to manage electronic and/or paper renewals and payment. However, the New World enterprise software application offers the ability to track license plates, vehicles and owners and the Village s e-pay program through the Illinois State Treasurer s Office can be expanded to support renewal and payment through the Village website. Staff is proposing that the commuter parking renewal database be transferred to New World and the renewal and enforcement processes be combined in the Public Safety Support Services Division at the Police Department. The Village will see efficiencies and other benefits by placing the renewal, permitting, ticketing and enforcement processes together in one department including: The New World software will allow multiple license plates to be attached to the parking permit making commuter car and motorcycle usage more manageable; Commuters will be offered the option to complete their application by paper and mail in a check or through the Village website and pay the permit fee on-line (includes a convenience fee of up to $10.00 charged by the credit card merchant); Enforcement officers on the street will have access to current permit data (they currently do not have any information in the field other than a visual placard); Enforcement officers will be able to run a license plate and verify if a valid permit is attached to the vehicle; and Enforcement officers will be able to run a license plate and see if a commuter has forgotten to display their permit. For the Oct. 1, 2010 Oct 1, 2011 period, the Police Department processed 662 tickets for commuter parking. 218 of those related to commuter parking permits. Of those 218 tickets, 75 were non-suited primarily due to the lack of displaying a valid permit or a non-resident parking in resident area. The proposed changes will likely result in a smaller number of tickets being non-suited because of the access to permit holder information in the field. This will also result in a decrease in staff processing time of non-suited tickets through Police Records and the County Courthouse. Enforcement officers also recommend the substitution of a rear window static cling decal for the front mirror hang card in 2012 due to the manual effort required to inspect for compliance. The officer will be able to quickly see a rear window static cling decal. To effect this change, minor changes would need to be made to the Village Commuter Plaza Parking Area division of the Code to correct location permit display information. The proposed Code changes also include clean-up items regarding Village department names, fees, and debit card machines. As a matter of follow-up, the Code does specify for commuters to not back into parking spaces. The purpose of this is to prevent damage to signs, lights or number posts in the Metra lots, prevent damage to landscaping, and prevent blocking of the walkway or sidewalks by the larger vehicle rear wheel overhang. BUDGET: There is no associated budget request with this ordinance. Page 2 of 11

3 RECOMMENDATION: Staff recommends Board approval of the attached Ordinance amending the provisions of Chapter 90, Article III, Division 2 of the Code, relating to the Commuter Parking. 5 ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 90, ARTICLE III, DIVISON 2 OF THE MUNICIPAL CODE, VILLAGE OF GLENVIEW, ILLINOIS WHEREAS, the Village of Glenview ( the Village ) is a home-rule municipality in accordance with the Constitution of the State of Illinois of 1970; WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs that protect the public health, safety, and welfare of its citizens; WHEREAS, from time to time, it becomes necessary for the Village to regulate commuter parking within the Village; and WHEREAS, the corporate authorities have determined it is in the public interest to amend Chapter 90, Article III, Division 2 of the Village s Municipal Code (the Code ). NOW, THEREFORE, BE IT ORDAINED by the president and Board of Trustees of the Village as follows: Section 1: The facts and statements contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this Ordinance. Section 2: Chapter 90, Article III, Division 2, Section of the Code shall be and is hereby deleted in its entirety, and replaced as follows: Sec Issuance of Permits; transferability. (a) Any person desiring a permit for the reserved parking referred to in section shall file an application, in duplicate, with the finance department Village, upon a form provided by the finance departmentvillage, setting forth the name and address of the applicant, a description of the vehicle for which the license is desired and such other information as may be prescribed. Permit applicants must supply proof of residency, which shall include, but is not limited to, a valid State driver's license. (b) Permits for the Downtown Glenview Train Station may be issued in excess of 50 percent of the number of parking spaces provided in such parking area. Permits for the Glen of North Glenview Train Station may not be issued in excess of the number of parking spaces provided in such parking area as set forth in the Agreement for the Construction, Operation and Maintenance of the North Glenview Parking and Station Facility in Glenview, Illinois, dated March 21, It is further provided that the Village Aamtrak ticket agent may issue temporary parking permits and shall keep a record of all such permits issued. Permits issued by such agent shall provide the dates in which the vehicle will be parked in the commuter plaza parking area. All such nofee permits shall be displayed in the rear window of the vehicle. (c) All applications shall be filed by the finance department Village on a waiting list, in the chronological order of their receipt by the finance department Village and permits Page 5 of 11

6 shall be issued in the order that applications are filed. Separate waiting lists for the Downtown Glenview Train Station and the Glen of North Glenview Train Station will be maintained. No application for which a permit is then available or for renewal of an existing permit shall be accepted, unless accompanied by the fee as provided for section An application to be placed on one of the waiting lists may be filed without payment of a fee at the time of filing; provided, however, that no such application shall be considered valid or binding unless the required fee is paid within ten days after written notice is mailed to the applicant at the address shown on the application advising the applicant that a permit is then available. No person shall be permitted to sell, transfer or assign any permit, nor shall any permit issued under this division be displayed, except on in the rear view mirror of the vehicle for which the permit was issued; provided, however, that the owner of any vehicle for which a permit has been issued under this division may transfer such placard permit to any other vehicle under his ownership or care provided that the vehicle information has been submitted to the Village in advance. (d) Commuter parking in both the Downtown Glenview Train Station and the Glen of North Glenview Train Station each has designated permit placards. Permit placards are assigned according to the train station and cannot be transferred between stations. No person in possession of a Downtown Glenview Train Station permit placard shall park in the commuter plaza parking area referred to in section as the Glen of North Glenview Train Station, while no person in possession of a Glen of North Glenview Train Station permit placard shall park in the reserved parking referred to in section as the Downtown Glenview Train Station. Nontransferability supports the regulated allocation of limited parking spaces for each commuter plaza parking area. Section 3: Chapter 90, Article III, Section of the Code shall be and is hereby amended to read as follows: Sec Permit Fees, renewal and reassignment. a) The yearly commuter parking permit fees for persons residing in the corporate limits of the Village shall be $ per calendar year, paid in annual installments or semiannual installments of $ for each six-month period from January 1 of each year to June 30 of the same year, and from July 1 of each year to December 31 of the same year. The yearly commuter parking permit fees for persons residing outside the corporate limits of the Village shall be $ per calendar year, paid in annual installments or semi-annual installments of $ for each six-month period from January 1 or each year to June 30 of the same year, and from July 1 of each year to December 31 of the same year. Permits shall expire on December 31. Permits are not pro-rated. b) The finance departmentvillage shall accept new applications for semi-annual permits on, but not before, the first business day of each December and June, assigning permits in the order of receipt of application and creating a waiting list as set forth in section Page 6 of 11

7 Section 4: Chapter 90, Article III, Division 2, Section of the Code shall be and is hereby deleted in its entirety, and replaced as follows: Sec Display of Permit. Permits issued under this division shall be in the form of a hanging placardmust be displayed in, which shall be displayed by hanging the placard on the rearview mirror of the vehicle parked in the commuter plaza parking area referred to in section as the Downtown Glenview Train Station and the Glen of North Glenview Train Station. No motor vehicle shall be parked or left in the commuter plaza parking area unless such permit is affixed thereto in accordance with this section. For safety reasons, the placard must be removed from the rearview mirror before operating the vehicle. An expired permit placard, or part thereof, shall not be displayed. Hanging placardspermits are used so that the permit holder may park the vehicle they desire at the commuter plaza parking area. It is necessary that placards permits be displayed so that parking enforcement can determine that the vehicle is authorized to use the commuter plaza parking area. Section 5: Chapter 90, Article III, Division 2, Section of the Code shall be and is hereby deleted in its entirety, and replaced as follows: Sec Daily fee zone parking areas. (a) No parking permit shall be required in the areas of the commuter plaza parking area designed for daily fee zones; provided, however, that it shall be unlawful for any person to park or leave any vehicle in the daily fee zone without a $2.00 fee. Both the Downtown Glenview Train Station and the Glen of North Glenview Train Station provide a debit card machine offering commuters a choice of payment options for depositing the $2.00 fee. The $2.00 fee may be paid by either inserting a debit card, a credit card, or by depositing dollars or change into the debit card machine. (b) The $2.00 fee shall permit such vehicle to remain parked during one 24-hour period from 5:00 a.m. 4:00 p.m., unless sooner removed. No person shall deposit, or cause to be deposited, in any debit card machine, any slug or other substitute for the designated debit card, or legal currency in the United States. Section 6: Chapter 90, Article III, Division 2, Section of the Code shall be and is hereby deleted in its entirety, and said Section shall be designated as Reserved. Sec Debit card machine zone areas. (a) The following areas in the commuter plaza parking area at the Downtown Glenview Station are designated as daily fee parking zones requiring usage of the debit card machine requiring a $2.00 fee: (1) The area on the east side of Railroad Avenue, north of Prairie Street, south of Grove Street, consisting of the northernmost five spaces, and such spaces are designated as daily fee parking spaces for residents after 8:30 a.m. Page 7 of 11

8 (2) The area east of the METRA mainline track in the west side of East Railroad Avenue, consisting of the 25 parking spaces north of Linneman Street. (3) The area west of the METRA mainline track on the east side of Lehigh Avenue, consisting of the 25 parking spaces south of Lake Avenue. (b) The area east of Lehigh Avenue and west of John's Drive consisting of 900 parking spaces. Section 7: Chapter 90, Article III, Division 2, Section of the Code shall be and is hereby deleted in its entirety, and replaced as follows: Sec Collection of fess; tampering with credit card machines and parking space number mechanisms. (a) The collection of legal currency from the operation of the debit cardparking machine system shall be under the supervision of the finance departmentvillage. (b) It shall be unlawful for any unauthorized person to deface, tamper with, open willfully, break, destroy or impair the usefulness of any debit cardparking machine or parking space numbering mechanism, including, but not limited to, the posts of signs that may number each space installed under this division. This renewal form is for the 2012 six month and annual permit holders.
