1 State of Minnesota Public Utilities Commission April 7, 2009 To: Service List From: Burl Haar Executive Secretary Re: In the Matter of a Commission Investigation into a Multi-State Tracking and Trading System for Renewable Energy Credits Docket No. E-999/CI In the Matter of a Renewable Energy Certificate Retirement Report for Compliance Year 2008 Docket No. E-999/PR NOTICE OF RENEWABLE ENERGY CERTIFICATE (REC) RETIREMENT PROCESS AND COMPLIANCE REPORT FOR 2008 On December 3, 2008, the Minnesota Public Utilities Commission (the Commission) issued its Third Order Detailing Criteria and Standards for Determining Compliance Under Minn. Stat. 216B and Setting Procedures For Retiring Renewable Energy Credits, in Docket No. E- 999/CI , This Order includes instructions for REC retirement and reporting. Utilities subject to Minn. Stat. 216B.1691 should refer to this Order prior to beginning the transfer of RECs to retirement sub-accounts or the filing of a 2008 compliance report. Take note that in accordance with the above-cited Order, by May 1, 2009, all covered entities are required to retire RECs representing one percent of annual retail sales for calendar year 2008 using the Midwest Renewable Energy Tracking System (M-RETS). Utilities are to follow procedures for REC retirement set out in the above-cited Order, including the establishment of M-RETS retirement sub-accounts that are clearly identified by purpose (e.g. Minnesota REO/RES compliance) and compliance year (e.g. 2008). The retirement sub-accounts should also identify the retail load serving entity for which the RECs are being retired. In setting up sub-accounts, utilities should select the first retirement option under Retirement Type i.e. ;Used by Account Holder for a State-Regulated Utility Renewable Portfolio Standard/Provincial Utility Portfolio Standard.' Also, take note that no later than June I, 2009, covered entities are required to file with the Commission and serve on the Minnesota Office of Energy Security (OES) an annual REC compliance report. 2 No. E-999/PR-09-2S7 and contain information as requested by the Commission in its December 3 Order, including: total Minnesota retail kwh sales in the compliance year and a translation of those sales into the applicable Minnesota renewable energy objective or renewable energy standard for that compliance year a demonstration that the corresponding number of eligible RECs have been transferred to the retirement sub-account(s) an accounting of the number of M-RETS RECs bought and sold during the compliance year, regardless of whether these RECs were used to comply with the Minnesota renewable energy objective or renewable energy standard To demonstrate that RECs have been transferred to retirement sub-accounts, utilities should print out and include in their June 1 compliance report a copy of the M-RETS report entitled 4My Sub-Accounts Certificates Disposition.'
