7 INTRODUCTION Four vacancies were created in the Legislative Assembly with the resignations of the following Members: Electoral Division Member Date Calgary-Elbow Alison Redford, Q.C. September 25, 2014 In accordance with sections 39 and 40 of the Election Act (the Act), by order of the Lieutenant Governor in Council, Writs of Election were issued by the Chief Electoral Officer on September 29, 2014, and transmitted to the Returning Officers in each of the four electoral divisions with a vacancy. The Writs of Election indicated an election date of Monday, October 27, 2014, in all four electoral divisions. The electoral division boundaries described in the Electoral Divisions Act (in force on March 26, 2012) were used during the by-elections. 8 APPOINTMENT OF RETURNING OFFICERS The Chief Electoral Officer appointed the following Returning Officers for the four by-elections, pursuant to Section 9(1.1) of the Act: Electoral Division Returning Officer Date Calgary-Elbow Elizabeth Evans August 18, 2014 Calgary-Foothills Merilyn O Bryan August 18, 2014 Calgary-West Curtis Lawson September 17, 2014 Edmonton-Whitemud Barbara Willman September 10, 2014 LEGISLATIVE AMENDMENTS IMPLEMENTED DURING THE BY-ELECTIONS Legislative amendments consequential to the Election Accountability Amendment Act, 2012 which received Royal Assent on December 10, 2012 were implemented in the by-elections. Highlights of the Election Act changes are listed below. Students studying away from home, within Alberta, were permitted to choose the place they reside for their studies as their ordinary place of residence for voting purposes (section 1(2.2)) Nomination day was changed from the 14 th to the 10 th day after writ (section 39(c)) Electors were permitted to inspect nomination papers filed by candidates in their electoral division on application to the Returning Officer (section 59(5)) Persons aged sixteen or seventeen were permitted to be appointed as poll clerks (section 73(1.1)) Returning Officers were permitted to appoint information officers at each polling place to assist electors and maintain peace and order (Sections 1(i) and 75.1) Scrutineers were no longer required to reside in the electoral division in which they were appointed; scrutineers were required to comply with a code of conduct established by the Chief Electoral Officer (section 79) Where an elector was unable to access the polling place due to a physical incapacity, the poll clerk and other election officer(s) were authorized to bring the ballot box to some other place on the polling place site. (section 96(1.1)) The number of days for the Advance Poll was increased from three days to four (section 98(3)) Political parties, constituency associations and candidates were required to comply with extended advertising rules and new guidelines established by the Chief Electoral Officer (section 134) 2 REPORT ON THE OCTOBER 27, 2014 BY-ELECTIONS

9 Persons or organizations which conducted election surveys during the election period were required to comply with new rules and new guidelines established by the Chief Electoral Officer (section ) NEW INITIATIVES The Chief Electoral Officer introduced several new initiatives in the by-elections to improve services and to assist Returning Officers in the performance of their duties. In accordance with section 4.1 of the Election Act, automated vote tabulators were introduced at the Advance Polls to allow for faster, more accurate and detailed reporting of Advance Poll voting results. In accordance with section 4.1 of the Election Act, voter assist terminals were introduced at the Advance Polls to provide disabled electors with an accessible, independent voting option. Vote tabulator operators were hired to operate and maintain vote tabulators at the Advance Polls. Poll clerks were provided election training. Trainer positions were appointed to assist Returning Officers in the scheduling and training of all Advance Poll and Polling Day election officers. Online training resources were created by Elections Alberta and provided to election officers to assist in teaching the proper method of completing Polling Day forms and documentation. Where to Vote cards were mailed to every elector on the Register of Electors and to every residential address that had no electors on the Register, in each of the four electoral divisions. Barcodes containing elector identification numbers were printed on Where to Vote cards that were mailed to electors on the Register of Electors, and in the poll books, allowing for the collection of statistical and demographic information on voter participation. Site monitor personnel were provided upon request at polling places located in schools for added safety and security. NEW INITIATIVES 3

10 THE BY-ELECTIONS CANDIDATE REGISTRATION AND NOMINATION In total, 23 candidates registered with the Chief Electoral Officer in accordance with section 9 of the Election Finances and Contributions Disclosure Act and all 23 registered candidates filed candidate nomination papers in accordance with section 61 of the Election Act, as follows: Electoral Division Number of Candidates Calgary-Elbow five (5) Calgary-Foothills seven (7) Calgary-West five (5) Edmonton-Whitemud six (6) A listing by political party affiliation follows, showing the number of candidates that registered, filed nomination papers and filed financial statements. Only one of the four electoral divisions held the Advance Polls in the returning offices. Each of the four electoral divisions provided a single Advance Poll location with up to four polling stations to process electors within each location. Automated vote tabulators were installed at each Advance Poll location to record votes and store ballots. Voter assist terminals were also provided in each electoral division. Forty-nine election officers were recruited, hired and trained for Advance Polls. Each location had a supervisory deputy returning officer, registration officer, information officer, vote tabulator operator and one deputy returning officer and one poll clerk for each polling station. 4 REPORT ON THE OCTOBER 27, 2014 BY-ELECTIONS

11 A total of 9,701 valid ballots were cast at the Advance Polls over four (4) days, representing 19.57% of all valid ballots cast in the by-elections. For the first time, poll by poll results were produced from the Advance Polls. In addition, Advance Poll staff could be re-allocated by the Returning Officer as election officers on Polling Day. Voter assist terminals provided a private, accessible and independent voting option, giving electors the ability to mark their ballot using a braille-coded keypad, a touch screen, pressure sensitive paddles or a sip and puff method. The introduction of automated vote tabulators and voter assist terminals at the by-elections was highly successful. The tabulators and terminals performed flawlessly throughout the four days of Advance Poll voting. The vendor provided excellent service and support to Elections Alberta and election officers throughout the by-election preparation and Advance Poll election delivery phases of the by-elections. Stakeholders, including registered political parties and media, were invited to demonstrations on the use of the tabulators and terminals prior to their implementation. Positive feedback was received on their use and deployment during the by-elections. The CNIB provided their endorsement for deployment in future provincial general elections. MOBILE POLLS By legislation, mobile polls were held on Polling Day October 27, 2014 in treatment centres and supportive living facilities with ten or more resident inpatients or electors, where consultation with facility staff determine the service to be appropriate. A deputy returning officer and a poll clerk, along with a facility representative, set up a stationary poll in a fixed location, went bed to bed, or both, depending on the situation. Nine mobile polls were held in 17 facilities across the four electoral divisions on Polling Day. A total of 798 valid ballots were cast at mobile polls. THE BY-ELECTIONS 5

12 SPECIAL BALLOT POLLS Special ballot polls were held at returning offices in each of the four electoral divisions throughout the election period, to facilitate voting for electors who were not able to vote at the Advance Poll or on Polling Day. Special ballots may be mailed out as requested by the elector or may be completed in the returning office. A total of 580 valid special ballots were cast. POLLING DAY Polling Day was held on Monday, October 27, There were 313 polling stations in 50 polling locations across the four electoral divisions. Eight hundred and fifty four election officers were recruited, hired and trained. Fifteen of these positions were site monitors that were requested by the schools rented as polling locations. All 50 polling locations opened on time at 9:00 am. On Polling Day, a total of 2,742 electors registered to vote by completing a Declaration of Elector at the time of voting. Polling Day registrations are a good measure of the quality of the List of Electors compiled for use by election officers and political participants. Based on the number of names on the list after declarations were added, only 2.06% of electors were added when compared to the Polling Day list. There were 49,676 ballots cast in the by-elections. Over 94% of those who voted in the by-elections were already registered at their current address. Voter turnout is traditionally low in by-elections and this time was no exception. An average of 37.28% of eligible electors cast their ballots during the four by-elections as follows: Electoral Division Voter Calgary-Elbow 37.16% Calgary-Foothills 36.27% Calgary-West 35.73% Edmonton-Whitemud 39.65% POST POLLING DAY The Returning Officer announced the official results on November 6, The following candidates were declared duly elected: Elected Candidate Mr. Gordon Dirks Mr. Jim Prentice Mr. Mike Ellis Mr. Stephen Mandel Electoral Division Calgary-Elbow Calgary-Foothills Calgary-West Edmonton-Whitemud All four successful candidates represented the Progressive Conservative Association of Alberta party. 6 REPORT ON THE OCTOBER 27, 2014 BY-ELECTIONS

13 Official documents including the Writ of Election and the Returning Officers Certificate and Return certifying each candidate s election were returned to the Chief Electoral Officer. The by-election results were published in the November 29, 2014 issue of the Alberta Gazette. No application was made to the Courts for a judicial recount pursuant to sections 144 or 148 of the Act. All registered candidates met the statutory filing deadline of February 27, 2015, therefore all nomination deposits of $500 were refunded to each of the candidates campaigns. The total cost of the four by-elections was $1,102,243. A cost summary is included on page 49 of this Report. FINANCIAL DISCLOSURE Registered by-election candidates were required to file Campaign Period Financial Statements with Elections Alberta by February 27, Disclosure of the candidates election expenses are available on our website ( in accordance with section 4(1)(d) of the Election Finances and Contributions Disclosure Act (EFCDA). Registered political parties that participated in the by-elections must file audited financial statements by April 27, These statements will list funds received, campaign expenditures and transfer of funds and/or materials. In accordance with section 11 of the EFCDA, all financial statements will be available for inspection in the public files maintained by this Office and will be posted in summary form on the Elections Alberta website. 16 AGE AND GENDER STATISTICS Poll books contained barcodes of each elector s unique identifier to enable the tracking of statistics on voter age and gender and allows for statistical comparisons between voters and registered electors. Age and gender statistics are complete for by-election voters, but there is a gap among registered electors as this information is not currently mandatory. Less than 1% of registered electors in the four by-election electoral divisions are of unknown age and just over 1% are of unknown gender. Table 1-1 below shows the distribution of those who voted by age group and electoral division. Table 1-2 shows the distribution of registered electors (electors that are pre-registered to vote) by age group and electoral division. The age group made up less than 5% of the total number of electors while the over 65 age group made up almost 25%. Looking at registered electors in Table 1-2, the proportion increases until age 54, then decreases. Young voter participation (18-24 age group) was lowest in Calgary-Elbow at 3.41% and highest in Calgary-Foothills at 5.58%. 10 REPORT ON THE OCTOBER 27, 2014 BY-ELECTIONS

17 Table 1-3 below shows the distribution of those who voted by gender in each electoral division. Table 1-4 shows the distribution of registered electors by gender and electoral divisions. In three of the four electoral divisions a slightly higher percentage of women voted (between 3.74% and 4.6% higher). In Calgary-Foothills 0.78% more men voted. OVERVIEW OF RESULTS AND STATISTICS 11
