1 CITY OF SIMI VALLEY MEMORANDUM AGENDA ITEM NO. 3 (1) December 12, 2016 TO: FROM: City Council Office of the City Manager SUBJECT: ADOPTION OF A RESOLUTION RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON THE 8 th DAY OF NOVEMBER 2016, DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW STAFF RECOMMENDATION It is recommended that the City Council adopt the attached resolution (page 3) reciting the fact of the General Municipal Election held on the 8 th day of November 2016, declaring the results thereof and such other matters as are provided by law. CITY MANAGER S RECOMMENDATION The City Manager concurs with staff recommendation for the City Council to adopt the attached resolution. BACKGROUND AND OVERVIEW California Elections Code Section requires the City Elections Official to enter into the records of the City a statement of the election results, setting forth the following information: 1. The whole number of votes cast in the City. 2. The names of the persons voted for. 3. The measures voted upon. 4. For what office each person was voted for. 5. The number of votes given at each precinct to each person and for and against each measure. 6. The number of votes given in the City to each person and for and against each measure. Authorization to prepare this statement of the election results and also to canvass the election returns of the General Municipal Election of November 8, 2016 was provided to the County Elections Official through Resolution No that was adopted by the

2 2 City Council on June 6, The attached resolution and the accompanying official canvass (Exhibit A, Page 6) incorporate the statement of election results as required by Elections Code Section FINDINGS AND ALTERNATIVES The General Municipal Election was held on the 8 th day of November 2016 for the purpose of electing a Mayor and two members of the City Council and voting on Ballot Measure Z (SOAR). The following alternatives are available to the City Council: 1. Adopt the attached resolution (page 3) reciting the fact of the General Municipal Election and declaring the results thereof and such other matters as provided by law; 2. Defer adoption of the attached resolution and provide staff with further direction. SUGGESTED CITY COUNCIL MOTION: I move to adopt a resolution reciting the fact of the General Municipal Election and declaring the results thereof and such other matters as provided by law. SUMMARY Elections Code Section requires the City Elections Official to enter into the records of the City a statement of the election results. It is recommended that the City Council adopt the attached resolution (page 3) reciting the fact of the General Municipal Election held on the 8 th day of November 2016, declaring the results thereof and such other matters as are provided by law. 3 3 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIMI VALLEY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF SIMI VALLEY ON THE 8TH DAY OF NOVEMBER 2016, DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Simi Valley, County of Ventura, State of California, on Tuesday, the 8 th day of November 2016; and WHEREAS, notice of said election was duly and regularly given in time, form, and manner as provided by law; voting precincts were properly established; election officers were appointed; and said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No adopted the 6 th day of June 2016, the County Elections Official of the County of Ventura canvassed the returns of said election and has certified the results to the City Elections Official, said results are received, attached, and made a part hereof as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIMI VALLEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Fifty-eight voting precincts were established for the purpose of holding a General Municipal Election consisting of a consolidation of the regular election precincts in the City of Simi Valley as established for the holding of federal, state, and county elections. SECTION 2. The General Municipal Election of November 8, 2016 was held as required by the laws relating to cities in the State of California for the purpose of electing a Mayor and two members of the City Council. as follows: SECTION 3. The name of the person voted for at the election for Mayor is Bob Huber

4 4 SECTION 4. The names of the persons voted for at the election for member of the City Council are as follows: Keith L. Mashburn Dee Dee Cavanaugh Ken Sandberg Ashley Chelonis Victoria Catherine Wright Thomas J. Hartfield Greg Yacoubian Brian E. Wilson Timothy (T.J.) McInturff Clay McCarter SECTION 5. The number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which these persons were candidates are as listed in Exhibit A attached. follows: SECTION 6. The measure voted upon at said election of said City is as Measure Z: Shall the ordinance extending the City Urban Restriction Boundary Ordinance from December 31, 2020 to December 31, 2050 be adopted? SECTION 7. The number of votes given at each precinct and the number of votes given in the City for and against each measure above named are as listed in Exhibit A attached. SECTION 8. The whole number of votes cast in the City is as listed in Exhibit A attached. SECTION 9. The City Council does declare and determine that: a. Bob Huber was elected as Mayor of the City for a full two-year term, and b. Keith L. Mashburn was elected as a member of the City Council of the City for a full four-year term, and c. Dee Dee Cavanaugh was elected as a member of the City Council of the City for a full four-year term. d. As a result of said election, a majority of the votes cast on Measure Z voted that Measure Z be adopted.

5 5 SECTION 10. The City Elections Official shall enter on the records of the City Council of the City, a statement of the results of the election, showing: a. The whole number of votes cast in the City. b. The names of the persons voted for. c. For what office each person was voted for. d. The measures voted upon. e. The number of votes given at each precinct to each person and for and against each measure. f. The number of votes given in the City to each person and for and against each measure. SECTION 11. Upon compliance by the persons elected with the provisions of Section through Section of the Government Code of the State of California, the City Elections Official shall immediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Elections Official and duly authenticated. The City Elections Official shall cause to be administered to each person elected the Oath of the Office Prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the Office of the City Clerk; and each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 12. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the Office of the City Clerk.
