1 ADOPTED VILLAGE OF GRAND BAY NOV OPEN SESSION NOVEMBER 9, 1987 The Village of Grand Bay Council met in Open Session on November 9, 1987 at 7:36 p.m. with Mayor Kelly presiding. MAYOR'S OPENING REMARKS RECORD OR ATTENDANCE All members were in attendance except Cllr. Wong. D/M Tibbetts moved Cllr. Wong be paid in his absence. D/M Tibbetts assumed the Chair. Cllr. Bormke moved to adjust the wording of minutes of October 29, 1987 regarding letter of October 9, 1987 from McKelvey, MacAuley, Machum Re: Johnson Sales Ltd., and Lancaster Construction Ltd. in that the word maintains is to replace the word "withholds". Cllr. Haynes moved to adopt the minutes of Special Meeting of October 29, Seconded by Cllr. Bormke. Mayor Kelly resumed the Chair. MINUTES OF SPECIAL MEETING OF NOVEMBER Minutes of Special Meeting of November 2, 1987 were read. Cllr. Haynes moved to adopt the minutes of Special Meeting of November 2, MINUTES OF P.A.C. MEETING OF OCTOBER Cllr. Haynes moved to receive and file minutes of P.A.C. Meeting of October 19, Seconded by Cllr. Bormke.

Garland moved to ratify the Telephone Poll of November 5, 1987 for authorization to acquire an easement in the area of Gertrude Street with respect to 1987 General Capital Road work in progress. Seconded by D/M Tibbetts. BILLS FOR PAYMENT Cllr. Garland moved to pay bills enbloc with additions, however, a hold back of $ is to occur regarding item (ii) Bay Enterprises Ltd. RE: PETER CLANCY - OLIVE ROAD SEWER CONNECTION D/M Tibbetts moved the recommendation of Godfrey Associates Ltd. dated October 28, 1987 re: Peter Clancy - Olive Road Sewer Connection, in that Mr. Clancy is to install his connection line from his house, with authorization for the Village to proceed with work as required to lower the existing pipe to meet Mr. Clancy's line. LETTER OF OCTOBER FROM DEPARTMENT OF MUNICIPAL AFFAIRS AND ENVIRONMENT RE: WATER POLLUTION CONTROL GRANT AGREEMENT Cllr. Bormke moved authorization for proper signatures to the proposed agreement between the Village of Grand Bay and the Minister of Municipal Affairs and Environment regarding financial assistance for the Village sewage project. LETTER OF NOVEMBER FROM DOROTHY BROWN Letter of November 3, 1987 from Dorothy Brown was read. D/M Tibbetts moved to table letter of November 3, 1987 from Dorothy Brown to the public hearing of November 23, 1987.

Garland moved to receive and file letter of October 23, 1987 from Town of Richibucto Re: Town Status. DATA OF SEPTEMBER FROM CP RAIL Letter of September 23, 1987 from CP Rail was read. Cllr. Haynes moved authorization for proper signatures to the underground sewer pipe agreement between the Village of Grand Bay and C.P. Rail regarding Mileage on the McAdam Subdivision. LETTER RECEIVED NOVEMBER FROM RESIDENTS RE: SPEED LIMIT AND STOP SIGNS - BAYVIEW ROAD Cllr. McNutt moved to forward a copy of the letter received November 4, 1987 Re: Speeding on Bayview to the Chief of Police for immediate action by the Police Department. LETTER OF NOVEMBER FROM TERENCE PHILLIPS Cllr. Haynes moved to receive and file letter of November 3, 1987 from Terence Phillips regarding dog fines. Seconded by Cllr. Bormke.

Haynes moved the Clerk-Manager be authorized to transfer an amount of $16, from account number , Machinery and Equipment Reserve Fund to account number 1-16, General Fund current account to cover the purchase of a new police vehicle from Brett Motors. D/M Tibbetts cast a dissenting vote. It was noted a written report is pending from Brett Motors to the Police Chief regarding the new police car. MEMO OF NOVEMBER FROM CLERK-MANAGER RE: PRICE QUOTES- LUNCH ROOM REFRIGERATOR Cllr. Garland moved to refer memo of November 5, 1987 from Clerk- Manager Re: Price Quotes - Lunch Room Refrigerator to year end Council discussions. Seconded by D/M Tibbetts. Mayor Kelly departed the meeting due to a stated conflict of interest. D/M Tibbetts assumed the Chair. Haynes moved final approval of Sunny Acres Enterprises Ltd. Subdivison subject to terms outlined in the memo of November 5, 1987 from the Works Commissioner as follows: 1. Submission of final plans with N.B. Power easements 2. Submission of certified cheque in the amount of $3,200 payable to the Village of Grand Bay for money in lieu of public land.

Brandy D/M Tibbetts moved not to proceed with the proposed change of Brandy Point Crescent from two-way traffic to one-way traffic. MEMO OF NOVEMBER 5, 1987 FROM WORKS COMMISSIONER RE: WIDENING OF CUL-DE-SAC ON BAYSONG BLUFF D/M Tibbetts moved to receive and file memo of November 6, 1987 from Works Commissioner Re: Widening of Cul-de-Sac on Baysong Bluff. Haynes cast a dissenting vote. LETTER OF SEPTEMBER 24«1987 FROM VAUGHAN MORRIS/LETTER OF OCTOBER FROM BARRY & O'NEIL RE: VAUGHAN MORRIS- SEWERAGE BYLAW Cllr. Bormke moved to proceed with the application for rezoning with respect to Vaughan Morris property on Inglewood Drive with a public presentation for the proposed rezoning to be December 14, Seconded by D/M Tibbetts. It was noted a staff report will be provided to Council on this item. r LETTER OF OCTOBER FROM CRANDALL & ASSOCIATES LTD. RE; APPROVAL OF COST OF CLEANING DITCHES STREET IMPROVEMENTS Letter of October 29, 1987 from Crandall & Associates Ltd. Re: Ditch cleaning was read. Cllr. Haynes moved to refer letter of October 29, 1987 from Crandall & Associates Ltd. Re: Approval of Cost of Cleaning Ditches, 1987 Street Improvements to a meeting with Crandall & Associates. Carried LETTER OF OCTOBER FROM MARGARET BELL-WATSON D/M Tibbetts moved to refer letter of October 16, 1987 from Margaret Bell-Watson to Godfrey & Associates for a report back to Council. Seconded by Cllr. Bormke.

Haynes moved authorization for purchase and installation of new signs for the Police Department and four Neighbourhood Watch signs be erected around the Village as specified by the Works Commissioner. Seconded by D/M Tibbetts. Cllr. Haynes moved to add an item to the agenda concerning Snow Plowing. Seconded by Cllr. Bormke. Cllr. Haynes moved to add an Eleanor Martin. item to the agenda concerning c Cllr. Garland stated a conflict of interest with the Eleanor Martin item. SNOW PLOWING D/M Tibbetts moved authorization for proper signatures to the Snow Plowing Agreement with Bay Sand & Gravel Ltd.; appropriate correspondence is to be attached. Cllr. Garland departed the meeting due to a stated conflict of interest. ELEANOR MARTIN PROPERTY Cllr. Haynes moved the Clerk-Manager and the Works Commissioner meet with Eleanor Martin concerning her problems with a spring well next to the Garland property and reach a satisfactory conclusion; a release from the Village Solicitor is to be signed pending a Telephone Poll. c Seconded by D/M Tibbetts. Cllr. Garland returned to the meeting.
