2 When the Federal Motor Carrier Safety Administration (FMCSA) issued its final rule in December, 2015 requiring the use of electronic logging devices (ELDs) to record hours of service (HOS) for commercial drivers, the agency did more than just demand an equipment change. The new Federal Motor Carrier Safety Regulations came with a long list of requirements necessary for carriers and drivers to meet in order to be compliant. This report answers the most often asked questions regarding the devices, and how the regulations affect you. What is an ELD, and how is it different from the other devices in use? An ELD is a tablet computer used to record driver hours of service (HOS). It replaces paper driver logs and other systems including an Automatic On-Board Recording Device (AOBRD). As a full-function instrument, an ELD automatically records and transmits both driver and vehicle data including the driver s HOS, information the driver inputs, vehicle miles, and more. 3 MANDATE GOES INTO EFFECT DECEMBER 18, 2017: Compliance date use of ELDs in the defined categories is mandatory. DECEMBER 16, 2019: Date for an AORBD operational on or before December 18, 2017 to be upgraded or replaced to meet ELD status. Only ELD compliant devices will be recognized as acceptable forms of capturing duty records. To meet these deadlines: ELDs must be operational on or before the deadline (see box at left). This mandate is vehicle based and not fleet based. It applies to every vehicle in use for commercial carrying as defined in the regulations (see figure previous page). It s important to consider the advance preparations needed to ensure compliance and avoid late penalties: Selection and purchase of equipment Installation and testing Employee training (drivers and office staff) Practice sessions (including contingency plans, repair, and maintenance) The amount of time to ensure compliance required varies depending on factors such as type of business, size of business, and how much training your team might require. Make sure to give yourself plenty of time based on your organizational needs.
4 LEASE, PRIVATE, OR DEDICATED FLEET: Does the ELD rule apply to you? The majority of operations that keep an HOS log are in the ELD Final Rule category. Every driver who uses paper logs or an AOBRD will need to convert or upgrade to the ELD standard in accordance to the two dates defined on the next page. Paper logs will continue to be required and must be maintained as a backup in case of ELD failure. However, record keeping with paper logs is allowed for no more than eight days in a 30-day period. 6 RENTALS: How do I ensure compliance? EIGHT-DAY RENTAL EXEMPTION RYDER RENTAL Ryder in conjunction with the Truck Rental and Leasing Association (TRALA) has and will continue to work with the government on behalf of our customers in order to mitigate challenges presented by the ELD mandate. As a direct result of this work, FMCSA has granted an eight-day exemption to allow paper logs for instances of a vehicle breakdown, seasonal demand, and expansion needs. While operating under this exemption, drivers will remain subject to the standard hours-of-service (HOS) limits, maintain a paper record of duty status (RODS) if required, and maintain a copy of the rental agreement on the vehicle. For all rentals over eight days, drivers and vehicles must comply with the ELD Mandate. COMMERCIAL RENTAL COMPLIANCE WAIVER Ryder, in coordination with FMCSA, secured a 90-day waiver of the December 18, 2017, Electronic Logging Device (ELD) Mandate for the commercial rental industry. The waiver acknowledges the unique needs of commercial short-term rental customers, who need a substitute vehicle, add to their fleet for seasonal demand, or meet other expansion needs, by enabling them to use paper logs for up to 90 days from the December 18, 2017 compliance date. After the 90-day period, those who rent commercial vehicles for nine or more days must comply with the ELD Mandate. Because of the eight-day rule Ryder also helped secure, those who rent commercial vehicles for eight days or less may use paper logs. Whether you need to meet surging capacity demands during peak season, or a substitute vehicle, Ryder s rental fleet of more than 35,000 vehicles is ready to keep you moving. All Ryder rental vehicles over 10,000 GVW are equipped with ELD compliant devices. So, although an exemption to the ELD Mandate is now in place for customers who rent vehicles for eight days or less, you don t have to worry about the ELD Mandate. Use of Ryder s Rental ELD solution is completely optional. Customers and drivers who must comply with the ELD Mandate are welcome to take advantage of our solution to ensure they stay compliant. Customers and drivers may also use their own portable ELD solution to ensure compliance. If customers decide to bring their own ELD, they should ensure that they have the correct adapters to connect to the diagnostic port in advance of receiving the vehicle. 7 Partnering for Supply Chain and Business Success Ryder s breakthrough solution to help commercial rental customers The industry s only comprehensive ELD solution for fleet managers and drivers All Ryder Rental customers will automatically be registered and given access to their own Ryder-provisioned Geotab account. They will also be able to run reports to identify driver violations. The new offering delivers greater flexibility as all customers, fleet managers, and drivers have the option to use Ryder s ELD solution or their own portable ELD equipment. This exclusive, industry leading offering enhances Ryder ChoiceLease, Dedicated, and Rental customers vehicles with a combination of safety and efficiency mechanisms. These technologies enable newer, preventive innovations that aim to reduce the possibility of vehicle accidents, as well as driver fatigue and violations, while also providing a cost benefit to Ryder customers. 8 The Evolution of Shared Assets What are the benefits? Annual savings per driver In addition to improving safety, ELDs are designed to increase efficiency, for drivers and carriers. By not being forced to manage and maintain paper logs, drivers have more time to be productive and complete higher value activities. While drivers may feel their logging time is minor over the year, it adds up, both for them and the carrier. According to FMCSA, paperwork savings of ELDs will amount to $705 per driver each year. 9 Partnering for Supply Chain and Business Success How will the ELD rule affect the industry? According to the FMCSA, the net benefit of the rule will be positive for the nearly three million individual truck drivers who are affected and motor carrier companies alike. A 2016 survey by Transplace found that ELDs have led to a reduction in HOS and logging violations among carriers who have already implemented them, especially large fleet carriers. Eighty-four percent (84%) of large fleets and 56 percent of smaller fleets reported reductions in these violations. OTHER BENEFITS FOR DRIVERS AND CARRIERS INCLUDE: More accurate accounting of a driver s time. For example, paper logs use 15-minute intervals (at minimum) to record activities, even when a particular activity takes just a minute or two. ELDs ensure far more accurate reporting. More accurate and efficient route planning. Carriers and drivers will have much better information on how long it takes a driver to get from one point to another, and can plan accordingly. Reduction in form errors. Less manual intervention means fewer errors. Performance improvement. Carriers will be able to spot and address performance issues and improvement areas more quickly than ever before. A more level playing field between carriers. There won t be some carriers or drivers who are more compliant about HOS than others; everyone will be playing by the same rulebook. Non-compliance sanctions delayed until April. To ease the transition to the ELD Mandate, the Commercial Vehicle Safety Alliance has set April 1, 2018 to begin applying the out-of-service criteria to vehicles not in compliance with the mandate.
