2 Memorandum TO: FROM: Burgess Hanson, City Manager Charles DaBrusco, Director of Environmental Services DATE: April 11, 2014 RE: Award of Contract for Retrofitting of Water Plant Generators The purpose of this agenda item is to request City Commission approval to award a contract to Pantropic Power, Inc. for the retrofitting of two (2) Caterpillar Generators located at the Water Plant. The Water Plant has two (2) Caterpillar generators that are on a load sharing program with Florida Power & Light (FPL). The program provides the City with a significant amount of savings in energy consumption costs annually, in the amount of approximately $81,000. The generators are considered a part of the FPL energy network and are therefore required to comply with specific Environmental Protection Agency (EPA) regulations similar to those imposed on FPL. The proposed work will involve the installation of emission lowering devices on the existing generators. Staff of the Purchasing Division have thoroughly researched into vendors who provide the services required to satisfy the EPA requirements and have recommended award of contract to a local Caterpillar dealer, Pantropic Power, Inc. The contract will be based on an existing National Joint Powers Alliance (NJPA) Contract# CAT, the terms, conditions, and prices of which have been reviewed and determined to be beneficial to the City. A memo from the Purchasing Manager is attached. The cost of the proposed work is estimated at $105, and the funds for the subject contract shall be expended from account number , Electric. Staff recommends award of contract to Pantropic Power, Inc. for retrofitting of the Caterpillar Generators located at the Water Plant. 3 RESOLUTION NO. 2014/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA APPROVING THE UTILIZATION OF NATIONAL JOINT POWERS ALLIANCE CONTRACT # CAT TO AWARD A CONTRACT TO PANTROPIC POWER, INC. FOR THE RETROFITTING OF TWO (2) CATERPILLAR GENERATORS LOCATED AT THE WATER PLANT IN THE ESTIMATED AMOUNT OF $105, WHEREAS, the City of Deerfield Beach wishes to utilize the National Joint Powers Alliance Contract# CAT awarded to Pantropic Power Inc.; and WHEREAS, the Water Plant has two (2) Caterpillar generators that are on a load sharing program with Florida Power & Light (FPL) and the program provides the City with a significant amount of savings in energy consumption costs annually; and WHEREAS, the generators are considered a part of the FPL energy network and are therefore required to comply with specific Environmental Protection Agency (EPA) regulations similar to those imposed on FPL; and WHEREAS, the proposed work will involve the installation of emission lowering devices on the existing generators; and WHEREAS, the City Commission finds that it is in the best interest of the City to utilize the National Joint Powers Alliance Contract# CAT awarded to Pantropic Power Inc. which yielded a price that is beneficial to the City of Deerfield Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, AS FOLLOWS: Section 1. 5 TO: FROM: FOR: Charles DaBrusco, Director of Environmental Services David Santucci, Purchasing Manager Commission Approval of Piggyback Contract DATE: February 21, 2014 RE: National Joint Powers Alliance (NJPA) Contract# CAT The Water Plant Operations Divisions approached me with a project that has been mandated by the Environmental Protection Agency (EPA) concerning two Caterpillar (CAT) generators used in the Water Plant operation. The subject generators are on a load sharing program with Florida Power & Light (FPL) that saves the City a significant amount of money in energy consumption costs annually. However, since these generators are in essence a part of the FPL energy network we are required to comply with the same EPA regulations imposed on FPL. In order to meet the EPA requirements, installation of emission lowering devices are required. Since we have an existing CAT maintenance agreement for the generators and the installed devices are CAT products, CAT must perform the work. Moreover, CAT has specific authorized local dealers for purchases, service, and repairs. Our local CAT dealer is Pantropic, who also holds the maintenance agreement. Therefore, essentially this project is a sole source. However, there is an available CAT contract through NJPA that I would prefer we use, rather than claiming sole source (sole source should always be our last resort). The NJPA Contract provides verifiable discount off of list prices and support from the national CAT government accounts representative to ensure the project is in compliance with the favorable terms, conditions, and prices provided in the NJPA contract. The national representative has already reviewed the price proposal provided by Pantropic and found the prices to be better than the minimum discount on the Contract. The total price for this contract is $105, Therefore Commission approval is required. This memo along with the attached contract documents should be included in agenda memo to the City Manager. Please place this on the next available agenda, as I understand there is a deadline date to complete the project and come into compliance. 14 Regular Meeting Minutes of the NATIONAL JOINT POWERS ALLIANCE Board of Directors Tuesday, July 19, 2011 Maple Room Chair Wolden called the meeting to order at 5:30 p.m. with the following members present: Mike Wilson, Randy Pepin, Wayne Wolden, Mike Domin Lane Waldahl, Barb Neprud, and Scott Veronen. Barb Schmitt joined the meeting at 7:00 p.m. Mr. Jessop presented the Risk Management update. Mr. Waldahl moved, seconded by Ms. Schmitt to approve award of RFP # for Group Medical Claims Administrative Services, Group Prescription Drug Claims Administration, and Individual and Aggregate Stop Loss Coverage on a Stand-alone basis or in Any Combination Thereof; and with Related Products and Services to HealthPartners, with an administrative services only contract and a $200,000 Specific Stoploss level, effective January 1, Mr. Lyscio gave a building update and introduced Chris Arenz of Sorenson/Gross Construction who was available to answer questions presented by the Board. Mr. Lyscio reported on the Minnesota Service Cooperatives (MSC) Board Member Conference he attended July th. Ms. Neprud, Mr. Wilson, Mr. Pepin, Mr. Wolden, Mr. Waldahl and Ms. Nanik also attended parts of the MSC conference and reported. The meeting was closed at 8:45 p.m. as permitted by section 13D.05, subdivision 3a to evaluate the performance of the Executive Director. At 9:25 p.m. the meeting was reopened. Mr. Wolden reported on the Executive Director s Evaluation stating there were areas of improvement identified and areas of successes. The determination is that of a satisfactory evaluation.
