The Buyer number will be valid for this Auction only and may be received in the Auction office. Driver s license or other identification may be required. The Auctioneer reserves his right to withdraw from sale any of the items or to sell at this Auction items not listed, and reserves the right to group one or more lots, or to subdivide into two or more lots. Whenever the best interest of the seller will be served, the Auctioneer reserves the right to sell all the items listed in bulk. If any dispute arises between two or more bidders, the Auctioneer may decide the sale or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the Auctioneer will be absolute. When items are to be sold by estimated count, measure or weight, the purchaser will be billed for and required to pay for the estimated count, measure or weight. If any shortage exists at the time of removal, the Buyer will receive a refund at the rate of purchase. If there is any excess, the purchaser will be required to accept and pay for this excess, at the rate of purchase. The Auctioneer reserves the right to reject any and all bids. On lots, which have a reserve, the Auctioneer shall have to bid on behalf of the Seller. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot and makes no warranties, expressed or implied. No allowance will be made or sale set aside on account of any incorrectness of errors in cataloguing or any imperfection not noted. No deductions will be allowed on damaged articles as all good are being sold AS IS, WHERE IS. All bids must be paid to a representative of the Auction Company in Full on Auction day unless other arrangements have been made. Payments should be in CASH or NYS CHECK (with id). Buyer s Premium: 13% Onsite, 16% Online. No items may be removed until bill has been paid in full. In default of payment or deposit, the Auctioneer may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for nor removed within the time specified herein may be sold at public or private sale without further notice. Any deficiency together with all expenses and cost of resale will be paid by the defaulting purchaser. The buyer shall be responsible for the removal of the articles and such removal must be carried out safely and lawfully. The buyer agrees to insure against and to indemnify the Auctioneer and the Seller against any and all claims arising in respect of injury or damage to person or property whether real or personal, caused by himself, his servants or agents of his principals or employer. The buyer hereby undertakes to ensure that any lot he purchases will be used, moved or displayed whether at the site of the auction or elsewhere only when he has ensured that such use and/or movement and/or display is lawful and safe. Should a buyer, by himself, his servants or agents cause damage in any way to the site of the auction or damage to or loss of any lot thereat, the Auctioneer shall be entitled to exercise a lien in respect of any and all lots purchased by the buyer until such damage or loss has been paid for in full, whether or not the lots or any of them have been paid for in full, such loss and damage to be assessed by the Auctioneer whose decision shall be final and unchallengeable. The Auctioneer's assessed sum shall be paid by the buyer upon receipt of invoice therefore and payment shall be made forthwith, time being of the essence. Neither the Auctioneer nor the Seller are to be responsible for any personal injuries which may occur prior to or during the progress of the sale, or at any time during the removal of the lots, which must be entirely at the purchaser's risk. Any additional terms or conditions of sale added by the Auctioneer shall be announced by the Auctioneer at the start of the Auction. Subject to error and omissions.
