20 Carwash location as a marketing tool The CCA is looking to help operators promote their services through its website. Plans are on the drawing board to have phone applications created so that customers can find carwash locations near the current GPS setting of their mobile device. Members can manage their listing by logging into the site, changing their description and uploading a site photo to help in having their site stand out from the rest. Their site listing is available through the Account Settings menu item which appears once logged in.

22 Winter in Canada dealing with ice and snow In Canada, ice and snow obviously create common winter hazards for visitors to premises. The courts have acknowledged that it would be unrealistic to expect you to keep premises totally clear of ice and snow at all times during winter. However, when dealing with ice and snow or any other known danger on the premises, to satisfy the duty of care, the business must have in place an effective system of inspection and maintenance. If no such system is in place, or if there is a system but it is not being carried out properly, then the business will likely face liability Of course, what constitutes an effective system will depend on the circumstances. Generally, it will be necessary to prove that the system involves such things as the following: Regular and frequent inspections (frequency will depend on the size of the area, and the volume of visitors); Inspections and reporting of problems are part of the on-going duties of all staff, not just those designated as inspectors; Responsiveness to changing conditions (i.e. the frequency increases during snowy or hazardous conditions); Inspection personnel should have authority to demand immediate maintenance work to rectify problems; Maintenance work should be carried out immediately after problems are noticed; Where immediate maintenance work cannot be done, warning signs should be posted and efforts made to barricade the area to prevent public access; Responsiveness to complaints and observations from the public or other noninspection staff; The system must function as intended. As indicated, it is up to you to prove that you have in place an effective functioning system of inspection and maintenance. Therefore, documentation is important and a detailed and timely investigation of accidents is crucial.
23 Municipal Sidewalks Often a municipal bylaw will impose a duty on adjacent property owners to clear ice and snow from municipal sidewalks. These bylaws are an attempt by the municipality to transfer onto adjacent property owners the responsibility for inspection and maintenance of public sidewalks (at least as far as ice and snow clearing is concerned). The courts have consistently held that such bylaws do not make the adjacent owner liable for damages suffered by a visitor who slips and falls on the municipal sidewalk. Therefore, even though you as the adjacent owner may be liable for a fine for breaching a municipal bylaw by failing to clear the sidewalk, you would not likely not liable for damages to an injured visitor.

25 How to build your own loss control manual After reading the information about how important it is to document your efforts toward making your business as safe as possible for visitors, we would like to offer these few simple tips on how to build your own Loss Control Manual. The information that is documented in this manual could someday be used as your notes in court, so please remember the person who sues you does not have to prove beyond a reasonable doubt, they only have to prove what is reasonable. Step One Get a binder and clearly identify by labeling the outside cover of the binder as the Loss Control Manual Step Two Print off 12 of each of the following forms from this programme and 3 hole punch and place them in the binder. 1. Inspection and Maintenance Log 2. Slip and Fall Investigation Reports 3. Self Inspection Worksheets 4. General Occurrence Reports 5. Blank paper for extra notes
26 Step Three Tab each section of the binder and place them between the different sheets. Step Four Insure that every staff member is instructed on how to use the manual and insure that it is in a place where everyone on your staff has access to it. We also recommend making this a part of your employee orientation program. Don t just let it gather dust on the shelf, use it and use it regularly as you never know when you will need it. In today s litigious society it is only a matter of time, it is not a question of if, it is a question of when.
