3 Part 1 General Regulations 101. DEFINITIONS AND INTERPRETATIONS. Words and phrases when used in this Part shall have the meanings ascribed to them in The Vehicle Code of Pennsylvania, as now in force, or as hereafter amended, enacted or reenacted. The singular shall include the plural, and the masculine shall include the feminine. The word highway shall include all public thoroughfares for vehicles in the Township, including, but not limited by enumeration to, streets, highways, lanes, alleys, boulevards, avenues, etc. [Ord , 12/14/1987, Art.I, 1] 102. SPECIAL POWERS OF THE CHAIRMAN OF BOARD OF SUPERVISORS a. The Chairman of the Board of Supervisors (or his designated successor in case of his absence) shall have the following powers to regulate traffic and parking temporarily and in times of emergency. i. In the case of fire, flood, storm or other emergency, to establish temporary traffic and parking regulations. ii. In the case of emergency or to facilitate public works or in the case of the conduct of processions and public events, to restrict or prohibit parking or traffic in limited areas for periods of not more than twenty-four (24) hours. Such temporary and emergency regulations shall be enforced by the Police of the Township in the same manner as permanent regulations. b. Any person who shall operate a vehicle in violation of any such regulation shall be liable for the penalty set forth in the law for such violation, and, in case of any violation for which no specific penalty is set forth in the law, to fine of not more than Twenty Five Dollars ($25.00), together with costs of prosecution. [Ord , 12/14/1987, Art.I, 2] 103. AUTHORITY OF POLICE OFFICERS. The Police Officers and Fire Police of the Township are hereby given authority to direct traffic on the highways of the Township and at intersections thereof. [Ord , 12/14/1987, Art.I, 3] 104. MOTOR VEHICLES NOT TO BE DRIVEN ON SIDEWALKS. No person shall operate any motor vehicle longitudinally or diagonally upon any sidewalk in the Township; nor shall any person operate any vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley either at such locations where the curb, if such sidewalk is curbed, shall have been cut down for the purpose or at such location, if not curbed, as shall provide the most direct access. Any person who shall violate any of the provisions of this section shall, upon conviction, be sentenced to pay a fine of not more than Twenty-Five Dollars ($25.00), together with costs of prosecution. [Ord , 12/14/1987, Art. I, 4] 105. REPORTS OF ACCIDENTS REQUIRED. The operator of any motor vehicle involved in an accident in the Township of Clay and required by law to report such accident to

4 any department or agency of the Commonwealth of Pennsylvania, or any other person required to make such report, shall, at the time of making such report to the Commonwealth, make a written report to the Chief of Police of the Township containing the same information. Any person failing to make such report as hereby required shall, upon conviction, be sentenced to pay a fine of Twenty-Five Dollars ($25.00) and costs of prosecution. [Ord , 12/14/1987, Art.I, 5]

5 Part 2 Stop Signs and Yield Intersections 201. DESIGNATION OF THROUGH STREETS AND STOP STREETS. The following intersections are hereby established as stop intersections in accordance with the Pennsylvania Motor Vehicle Code, and official stop signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named street (through street) upon the first-named street (stop street) in the directions hereby indicated. It shall be unlawful for all vehicles approaching any such intersection upon the first-named street, in the direction or directions hereby indicated, to not come to a full stop, within a reasonable distance, before entering any such intersection: STOP THROUGH DIRECTION STREET STREET OF TRAVEL 1. Any driver of a vehicle who shall violate any provision of this Section 201 hereof, shall, upon conviction before any district justice of competent jurisdiction, be sentenced to pay a fine of Twenty-Five Dollars ($25.00), together with costs of prosecution. The following intersections are hereby established as yield right-of-way intersections and official yield signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named street (through street) upon the first-named street (yield street). All vehicles approaching any such intersection upon the first-named street shall yield the right-of-way to any vehicle in the intersection or approaching on the second-named street so closely as to constitute an immediate

PENALTY. At the following intersections, official traffic signals shall be installed and maintained: At the intersection of Durlach Road (T856) and Wood Corner Road (T648) with U.S. Route 322. [Added by Ord , 03/09/1998, 1] 251. School Warning Signs with Flashers. School Warning Signs with Flashers shall be installed and maintained on Clay School Road (T-885) at the following locations: approximately 165 linear feet eastwardly from the Clay School Road/Snyder Lane intersection facing eastbound traffic and approximately 470 linear feet eastwardly from the center line of Tulip Circle facing westbound traffic, a distance of 1,200 linear feet apart as more fully set forth in a Plan for the installation of School Warning Signs with Flashers dated December 19, 2002." 10 Part 3 Speed Restrictions 301. Fifteen Mile Per Hour Zones. The following streets are hereby designated as fifteen (15) miles per hour speed limit zones. Official speed limit signs shall be erected (or are hereby ratified if heretofore erected) upon said streets. Any person driving on the following streets shall not drive at a speed greater than fifteen (15) miles per hour: a. Maple Street (T642) from Hopeland Road (S.R. 1026/90) to Hopeland Road (S.R. 1026/90). [Ord , 12/14/1987, Art.III, 1] b. During the hours of operation of School Warning Signs with Flashers on Clay School Road (T-885) from approximately 165 linear feet east of the intersection of Clay School Road/Snyder Lane eastbound to approximately 470 linear feet east of the center line of Tulip Circle. [amended by Ordinance No , 3/10/03, 2] Penalties. The penalty for violation of the new 301b shall be as set forth in the Pennsylvania Motor Vehicle Code at 75 Pa. C.S.A. 3365(b) as incorporated in Part 3, 306 of the Code of Ordinances of the Township of Clay. [amended by Ordinance No , 3/10/03, 3] 302 Twenty-Five Mile Per Hour Zone. The following streets are hereby designated as twenty-five (25) miles per hour speed limit zones. Official speed limit signs shall be erected (or are hereby ratified if heretofore erected) upon said streets. Any person driving on the following streets shall not drive at a speed greater than forty (40) miles per hour: a. Forest Hill Road (T857) from East Mt. Airy Road (S.R. 1026/100) to Kleinfeltersville Road (S.R. 1035/140). b. Furnace Hill Road (T640) and (T985) from Forest Hill Road (T857) to

12 Girl Scout Road (T648). [Ord , 12/14/1987, Art.III, 4] 306. Forty-Five Mile Per Hour Zone. The following streets are hereby designated as forty-five (45) miles per hour speed limit zones. Official speed limit signs shall be erected (or are hereby ratified if heretofore erected) on said streets. Any person driving on the following streets shall not drive at a speed greater than forty-five (45) miles per hour: a. Durlach Road (T856) from U.S. Route 322 to East Church Road (T646) b. Indiantown Road (T855) from Township Line to Durlach Road (T856). [Added by Ord , 02/13/1995, 7] c. Clay School Road (T855) from U.S. Route 322 to Durlach Road (T856). Any person who shall operate a vehicle at a speed in excess of that established in this Part for, upon any highway or portion thereof as specified in this Part, shall, upon conviction thereof, be sentenced to pay a fine of Thirty-Five Dollars ($35.00) together with costs of prosecution, and, for exceeding a maximum speed limit by more than five (5) miles per hour, shall pay an additional fine of Two Dollars ($2.00) for each mile per hour in excess of five (5) miles per hour over the maximum speed limit. 13 Part 4 Parking Regulations 401. Parking. The following areas shall be considered No Parking areas within the Township. Except in an emergency, no person shall park nor allow to be parked any motor vehicle in any place hereinafter set forth: a. On both sides of Hopeland Road, between the centerline of the South Maple Street entrance to Hopeland Road and the centerline of the North Maple Street entrance to Hopeland Road. [Added by Ord , 03/12/2001, 1] 402. Limited Parking. The following areas shall be considered Limited Parking Areas within the Township. Except in an emergency, no person shall park or be allowed to park any motor vehicle in any place hereinafter set forth during the hours prohibited by this Ordinance and as are hereinafter set forth: a. Hoover Drive from Agape Drive (TR to be established) to Hackman Road (TR 933) on both sides: No parking between the hours of 2:00 a.m. to 6:00 a.m. local time any day of the week Penalty. A person violating the provisions of Part 4, 401, shall be upon conviction, sentenced to pay a fine of Fifteen Dollars ($15.00) for each day of violation and costs of prosecution. 14 Part 5 Vehicle Weight Limitations, Roads and Bridges 501. Limitations. On the following bridges and roads or parts of roads, by authority granted by Section 4902 (a) of the Vehicle Code, 75 P.S. {101 et seq. and based on studies conducted on the roads and bridges as provided in Section 4902 (a) of the Vehicle Code, it shall be unlawful for any person or persons to drive any truck, trailer or semi-trailer having a gross weight (which is defined in {102 of the vehicle code} in excess of the maximum prescribed below for that bridge or road or part of road, as the case may be: Road Maximum Gross Weight T-945 Lime Road (Entire Length) 23 Tons single 40 tons combination T-596 Middlecreek Road (Entire Length) 10 tons single 18 tons combination T-969 Pleasantview Road (Entire Length) 16 tons single 30 tons combination [Ord A, 03/14/1994, 1] 502. Emergency Vehicles and School Buses. Nothing in this section shall prohibit any person from driving any emergency vehicle or school bus on any of those roads, bridges or parts of roads, or from driving on any of those road/bridges or parts of roads a vehicle making irregular local deliveries to or pickups from premises located along those roads or parts of roads. [Ord A, 03/14/1994, 2] 503. Requirements for Overweight Vehicles. Any person who operates overweight vehicles shall be required to: a. Apply for, pay a fee (to be set from time to time by Resolution of the Board of Supervisors), and obtain a Hauling Permit from Clay Township authorizing the use of overweight vehicles over certain roads within Clay Township, as provided for in Section 4902 (c) of the Vehicle Code. b. Submit a Bond to the Township in a form satisfactory to the Township Solicitor, which shall be either cash or with the corporate surety, conditioned upon the faithful compliance with the provisions of this Part and the Guaranty Agreement. The Bond shall be in the principal amount of not less than $50, per linear mile of Township road or in an amount reasonably determined by the Board of Supervisors of the Township to ensure the intent and conditions of this Part. The Bond required by this Part shall be used by the Township to guarantee payment for the repair of any damage to its road caused by the operation of the trucks and equipment of the person or entity required to submit the Bond or their agents. c. Execute a Guaranty Agreement, to guarantee the performance of maintenance and repairs as required within the Guaranty Agreement, and as permitted under 4902 (c) of the Vehicle Code. [Ord A, 03/14/1994, 3] 504. Violations. Any person who violates any provision of this Part shall be

15 prosecuted under Section 4902 (g) (l) of the Vehicle Code, and upon conviction, before a District Justice of competent jurisdiction, be guilty of a Summary Offense and, shall be sentenced to pay a fine of $ plus $ for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight, and costs of prosecution.
