2 ORDINANCE NO. N.S. AN ORDINANCE AMENDING ORDINANCE NO N.S. RELATING TO PARKING REGULATIONS ON THE CITY STREETS OF THE CITY OF COLVILLE The City Council of the City of Colville, Washington does hereby ordain as follows: SECTION i; Ordinance No N.S., Section i(a), as previously amended, is hereby amended to read as follows: A. No Parking of Vehicles at Any Time. There shall be no parking of vehicles allowed on the following streets and avenues within the City at any time: SECTION 2; 2:0 The north side of 4th Avenue between Oak Street and Main Street, commencing at the Main Street intersection and continuing a distance of 57' to the east. All other provisions of Ordinance No N.S. shall remain in full force and effect. This Ordinance shall take effect and be in full force five (5) days from its passage, approval and publication. All vehicles parked on the streets of the city shall comply with the following requirements: A. Except on such streets or portions thereof, as are particularly mentioned in this chapter, where there is an adjacent curb, vehicles shall be stopped or parked with the right-hand side wheels thereof, parallel to and within 12 inches of the right-hand curb, and on streets with no curb parallel to and within 12 inches of the edge of the roadway. B.1. There is established on Oak Street from the north line of Birch Avenue to the south line of First Avenue, on either side thereof, angle parking areas, designated as such, such areas to be of a width of 20 feet measured from the curb of such street. 2. The traffic engineer is authorized to have such areas so designated marked with parallel diagonal lines at an angle to the curb of 30 degrees eight feet apart. 3. Hereafter all vehicles stopped and parked on such portion of Oak Street shall be stopped and parked at an angle to the curb of 30 degrees and with the right front wheel of such vehicle in contact with the curb and in the space between two of such adjoining parallel lines. C. No person, firm or corporation engaged in the business of selling vehicles shall suffer the same to remain stopped, parked or stored upon any of the streets or alleys of the city, for the purpose of sale, display or storage. (Ord. 798 NS 1, 1979; prior code ) No parking zones and time periods. A. No Parking of Vehicles at Any Time. There shall be no parking of vehicles allowed on the following streets and avenues within the city at any time: 1. The east side of Garden Homes between Hawthorne and Ivy; 2. East of Hofstetter Street between Sixth Avenue and Seventh Avenue; 3. The south side of Sixth Avenue between Wynne and Hofstetter; 4. The south side of Seventh Avenue between Hofstetter and Madison; 5. The north and south sides of Eighth Avenue between Wynne and Lincoln; 6. Along both sides of Main Street between Hawthorne and the south line of Dominion Avenue; 7. Along Highway No. 395 between the west line of Main Street and the north city limits; 8. Along both sides of West Astor Avenue between the east line of the alley extended through Block 1 of Chandler's Addition to the city and Block 12 of the original town of Colville, and the west line of Main Street; 9. On both sides of Third Avenue between Main Street and Oak Street; 10. On Madison Street, between Third Avenue and Seventh Avenue; 11. On the east side of North Main, between Sixth and Seventh Avenue; 12. In front of police station on Astor Street, i.e., on the north side of Astor Street, east of the alley, a distance of 80 feet; except for police and emergency vehicles; 13.a. On the east side of Elm Street between Dominion and a distance of 585 feet south thereof; b. On the west side of Elm Street between Dominion and a distance of 258 feet south thereof; 14. Either side of Silke Road between State Highway 20 and Birch Avenue; 15. Repealed by Ord NS; 16. The north side of Dominion Avenue between Wynne Street and Washington Street; 17. There shall be no parking at any time on that portion of Astor Street, lying east of the alley running north and south through Block 1 of Chandler's Addition to the city and Block 12 of Original Colville and west of Main Street; nn/7fi1

5 Chapter PARKING REGULATIONS Page 3 of The north side of Birch from the corner of Birch and Elm, west a distance of 100 feet, except for police and emergency vehicles; provided, there shall be no parking as set forth in subsection B of this section; 19. The south side of Birch from the corner of Birch and Elm, west a distance of 80 feet, except for police and emergency vehicles; provided, there shall be no parking as set forth in subsection B of this section. 20. The east side of Elm Street between Juniper Avenue and Hawthorne Avenue commencing a distance of 150 feet south of the Hawthorne intersection, except that bus and delivery vehicle loading and unloading shall be permitted. B. Between 3:00 a.m. and 6:00 a.m. There shall be no parking of vehicles allowed between the hours of 3:00 a.m. and 6:00 a.m. on the following streets and avenues within the city: 1. Both sides of Second Avenue between the east line of Wynne Street to the west line of Oak Street; 2. On both sides of Main and Birch Streets, and on both sides of Astor Street, including the center parking meridian between the west line of Wynne Street and the east line of Elm Street, all between the north line of Dominion Street and south line of Fifth Avenue. On both sides of First Street between the east line of Wynne Street and the west line of Oak Street; 3. On Main Street between Hawthorne and south city limits. C. Between 3:00 a.m. and 7:00 a.m. There shall be no parking of vehicles allowed between the hours of 3:00 a.m. and 7:00 a.m. on the following streets and avenues within the city: 1. Both sides of Elm Street between First Avenue and Birch Street; 2. Both sides of Birch Streets between the east side of Elm Street to the west side of Silke Road; and 3. Both sides of Hawthorne Street between the east side of Main Street to the west side of Miner Street. D. Between 7:45 a.m. and 8:15 a.m. and between 2:30 p.m. and 3:00 p.m. There shall be no parking of vehicles between the hours of 7:45 a.m. and 8:15 a.m. and 2:30 p.m. and 3:00 p.m. on normal school days along the east side of Hofstetter Street between Birch Avenue and Astor Avenue, except for school buses loading and unloading. E. Two-Hour Parking Limit. There shall be a two-hour parking of vehicles limit on the following streets between the hours of 9:00 a.m. and 6:00 p.m. and no vehicle shall be continuously parked at such locations in excess of two hours: 1. Both sides of Main Street between the north line of Birch Avenue and the south line of Fifth Avenue; 11/no/2015

6 Chapter PARKING REGULATIONS Page 4 of 8 2. Both sides of Oak Street between the north line of Birch Avenue and the south line of Third Avenue. F. Fifteen-Minute Parking Limit of Vehicles. There shall be a 15-minute limit between the hours of 8:00 a.m. and 6:00 p.m. and no vehicle shall be continuously parked at said locations in excess of 15 minutes on the following streets and avenues: 1. The north 93 feet of the west side of Oak Street and the'block between Birch Avenue and Astor Avenue, approximately in front of the U.S. Post Office property; and 2. On west side of Oak Street between Astor and a distance 80 feet north thereof (in front of City Hall). G. Seventy-Two-Hour Parking Limit. There shall be no parking of vehicles allowed on any street or alley within the city limits of Colville for a continuous period, not to exceed 72 hours. H. Between 2:00 a.m. and 5:00 a.m. There shall be no parking of vehicles allowed between the hours of 2:00 a.m. and 5:00 a.m. on the following streets and avenues within the city: 1. Both sides of Oak between the north line of Birch Avenue and the south line of Third Avenue. I. No Parking of Vehicles During Theater Hours. There shall be no parking of vehicles on the east side of Main Street between a point of 90 feet north of the northeast corner of First Street and Main Street and a point 130 feet north of the corner. Parking shall be prohibited during theater hours and when posted with signs approved by the Colville street department. J. Three-Hour Parking Limit. There shall be a three-hour parking of vehicles limit on the following avenues between the hours of 9:00 a.m. and 6:00 p.m. and no vehicle shall be continuously parked at said locations in excess of three hours: 1. Both sides of First Avenue between the east line of Wynne Street and the west line of Elm Street; 2. Both sides of Astor Avenue between the east line of Main Street and the west line of Elm Street; 3. On the south side of Second Avenue between Oak Street and Main Street; 4. Both sides of Birch Avenue between the east side of Oak Street and the west side of Elm Street. K. Applicability - Variance. 1. Ordinance 1301 NS will be reviewed by the city council within one year from the date of adoption. Accordingly, unless action is taken by the Colville city council to amend or repeal the ordinance, the provisions shall remain in full force and effect. 2. Ordinance 1301 NS shall not apply to any person when serving on jury duty in a judicial proceeding in either Stevens County superior court or Stevens County district court.

The city council or a representative designated by the city council may, upon written application filed with the city clerk, grant a variance from any of the provisions of Ordinance 1301 NS. L Loading/Unloading Zone. There shall be no parking of vehicles except for loading and unloading between the hours of 6:00 a.m. until 6:00 p.m. on the north side of Birch Avenue from a point 85 feet east of Main Street to the alley. In addition, subsection (B) of this section shall remain in full force and effect. (Ord NS 1, 2014; Ord NS 1, 2007; Ord NS 1, 2005; Ord NS 1-5, 2003; Ord. 1167NS 1-4, 1998; Ord NS 1, 1997) Trucks on Main Street. It is unlawful for the owner or operator of any pickup truck, motor truck or combination of motor vehicles licensed to carry a gross weight in excess of 8,000 pounds to remain standing at any point on Main Street between the north line of Birch Avenue and the south line of Third Avenue, except for loading and unloading. (Prior code ) North side of 700 block of East Birch Street - Emergency vehicles. A. There shall be no parking of motor vehicles on the north side of the 700 block of East Birch Street, Monday through Friday; provided, however, this section shall not apply to the loading and unloading of school buses or other official vehicles. B. Official vehicles shall be defined as any emergency vehicle owned by the state, county or city government and including any vehicles owned by Colville School District No C. The minimum penalty for parking in the above restricted areas shall be $ (Ord. 950 NS 2, 1986; Ord. 868 NS 1-3, 1981) Cross-lane parking. The driver of any vehicle on any street or alley within the city limits shall not turn such vehicle and cross an oncoming traffic lane and immediately park such vehicle adjacent to such oncoming traffic lane. (Prior code ) Parking in reserved spaces. A. On all days, 7:00 a.m. to 5:00 p.m., except Saturday, Sunday and holidays, it is unlawful to park any motor vehicle or trailer in spaces clearly designated as "Reserved" either for city employees or on a 24-hour basis for handicapped persons, on property owned by the city, more particularly described as follows: Lots 11, 12, 13, 14, 15, 16, and the East 70 feet of Lot 17 of Block 11 of Colville Original Addition, according to plat thereof on file with the Stevens County auditor in Stevens County, Washington; provided, however, a vehicle may be parked in said location if the vehicle has a current vehicle permit issued by the city clearly displayed. B. Whenever any police officer finds a vehicle or trailer parked in violation of subsection A of this section, such officer is authorized to remove or provide for the removal of said vehicle or trailer. The reasonable costs incurred in the removal of such vehicle or trailer shall be paid by the vehicle's owner 11/30/2015

(Ord NS 2, 1998; Ord NS 3, 1997;0rd. 796NS 1, 1979) City off-street parking areas - Time limits - Penalty for violation. A. It is unlawful to park any motor vehicle or trailer on any off-street parking area owned, leased or operated by the city between the hours of 4:00 a.m. and 7:00 a.m. B. Whenever any police officer finds a vehicle or trailer parked in violation of subsection A of this section, such officer is authorized to remove or provide for the removal of said vehicle or trailer. The reasonable costs incurred in the removal of such vehicle or trailer shall be paid by the vehicle's owner and shall be a lien upon the vehicle or trailer until paid. (Ord NS 4, 1997; prior code ) Diagonal parking. Diagonal parking will be designated from U.S. 395 M.P to M.P once the final design of the U.S. 395/Main Street diagonal parking project is approved by the city of Colville and the Washington State Department of Transportation. It is understood that this is a phased project that will follow the requirements and the timelines as stated in the memorandum of understanding between the city of Colville and the Washington State Department of Transportation. (Ord NS 1, 2012) Enforcement. The police department or the parking enforcement officer, as appointed by the mayor, shall be responsible for the enforcement of this chapter. (Ord NS, 1994) Definitions. The term "vehicle" shall include any vehicle, trailer, truck or recreational vehicle. (Ord NS 5, 1997) Issuance of notices. Any city law enforcement officer, parking control officer, the city street superintendent or street supervisor is authorized to issue notices of infraction for any violation of this chapter (et seq.). Furthermore, said officials are authorized to impound vehicles improperly parked on public property as set forth in this chapter (et seq.). (Ord NS 6, 1997) Impoundment. Any vehicle is subject to impoundment after being left unattended in one of the following public or private locations for the indicated period of time: A. Public Locations. 1. Constituting an accident or a traffic hazard as defined in RCW : immediately. 0/Colvillel /30/2015

When a vehicle is illegally parked in either: (a) 3:00 a.m. to 6:00 a.m.; or (b) 3:00 a.m. to 7:00 a.m. no parking zone, such vehicle may be towed immediately. 3. On a city street and tagged as described in ROW : 24 hours. 4. In a publicly owned or controlled parking facility, properly posted under ROW : immediately. B. Private Locations. 1. On residential property: immediately. 2. On private, nonresidential property, properly posted under RCW : immediately. 3. On private, nonresidential property, not posted: 24 hours. C. All towing operators, etc., shall comply with the provisions of Chapter RCW. D. Any impoundment shall be performed by a licensed operator and in accordance with the provisions of Chapter RCW. (Ord NS 4, 1997) Law enforcement official impound. A. A law enforcement officer or official as set forth in CMC discovering an unauthorized vehicle left within a city right-of-way, shall attach to the vehicle a readily visible notification sticker. The city shall develop a notification sticker that clearly denotes the agency's authorization to impound. The sticker shall also contain the following information: 1. The date and time the sticker was attached; 2. The identity of the officer or official; 3. A statement that if the vehicle is not removed within 24 hours from the time the sticker is attached, the vehicle may be taken into custody and stored at the owner's expense; and 4. The address and telephone number where additional information may be obtained. B. If the vehicle has current Washington registration plates, the officer or official shall check the records to learn the identity of the last owner of record. The officer or official or his/their department shall make a reasonable effort to contact the owner by telephone in order to give the owner the information on the notification sticker. C. If the vehicle is not removed within 24 hours from the time the notification sticker is attached, the law enforcement officer or official may take custody of the vehicle and provide for the vehicle's removal to a place of safety. A vehicle that does not pose a safety hazard may remain on the roadside for more than 24 hours if the owner or operator is unable to remove it from the place where it is located and so notifies law enforcement officers or officials and requests assistance; provided, however, said vehicle must be removed within 72 hours of the original notice. D. For the purposes of this section, a place of safety includes the business location of a registered tow truck operator. (Ord NS 8, 1997).

10 Chapter PARKING REGULATIONS Page 8 of No vehicle maintenance in street right-of-way. No owner or operator of a vehicle shall be allowed to repair, grease, or change oil on any vehicle within the street right-of-way. (Ord NS 9, 1997) Individual not allowed to post "No Parking" signs on public streets. No person, other than a city employee, shall post or place a "No Parking" sign on public streets. (Ord NS 10, 1997) No parking of vehicles on parade routes. There shall be no parking of vehicles on parade routes during periods reserved for parades which have been authorized and approved by the city council. (Ord NS 11, 1997) Penalty. Anyone violating the terms of this chapter shall be deemed to have committed a parking violation and for each such violation shall be subject to a civil penalty. The original penalty for each violation of this chapter shall be the issuance of a parking violation with the fine of $ A. The failure to respond or report as directed for any parking violation within seven calendar days shall result in an additional penalty of $ B. Each day that a violation continues or each time that a violation continues past a parking limitation period or portion thereof in excess of the applicable parking time limitation, it shall be deemed a separate violation subject to civil penalty as set forth above. C. After four violations of this chapter within a period of six months, the violator will be considered habitual, and new violations may be enforced pursuant to the procedure set forth in Chapter 1.10 CMC, Civil Enforcement. AN ORDINANCE RELATING TO PARKING REGULATIONS ON THE CITY STREETS OF THE CITY OF COLVILLE NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLVILLE DOES HEREBY ORDAIN AS FOLLOWS: 1. Former Section of the current Colvflle Municipal Code is hereby repealed and a new Section is hereby adopted to read as follows: No Parking Zones and Time Periods. A. No Parking of Vehicles at Any Time. 12 17) There shall be no parking at any time on that portion of Astor Street lying east of the alley running north and south through Block 1 of Chandler's Addition to the city and Block 12 of Original Colville and west of Main Street. B. Between 3:00 A.M. and 6:00 A.M. There shall be no parking of vehicles allowed between the hours of 3:00 a.m. and 6:00 a.m. on the foeowing streets and avenues within the city: 1) Both sides of Oak Street between the north line of Birch Avenue and the south line of Third Avenue; 2) Both sides of Second Avenue between the east line of Wynne Street to the west line of Oak Street; 3) On both sides of Main, First and Birch Streets, and on both sides of Astor Street, including the center parking meridian between the west line of Wynne Street and the east line of Elm Street, all between the north line of Dominion Street and south line of Fifth Avenue; and 4) On Main Street between Hawthorne and south City limits. C. Between 3:00 A.M. and 7:00 A.M. There shall be no parking of vehicles allowed between the hours of 3:00 a.m. and 7:00 a.m., on the following streets and avenues within the city: 1) Both sides of Elm Street between First Avenue and Birch Street; 2) Both sides of Birch Streets between the east side of Elm Street to the west side of Silke Road; and 3) Both sides of Hawthorne Street between the east side of Main Street to the West side of Miner Street. D. Between 7:45 A.M. and 8:15 A.M. and between 2:30 P.M. and 3:00 P.M. There shall be no parking of vehicles between the hours of 7:45 a.m. and 8:15 a.m. and 2:30 p.m. and 3:00 p.m. on normal school days along the east side of Hofstetter Street between Birch Avenue and Astor Avenue, except for school buses loading and unloading. 13 6) On the south side of Second Avenue between Oak Street and Main Street. F. Fifteen Minute Parking Limit of Vehicles. There shall be a fifteen minute limit between the hours of 8:00 a.m. and 6:00 p.m. and no vehicle shall be continuously parked at said locations in excess of fifteen (15) minutes on the following streets and avenues: 1) The north ninety three (93) feet of the west side of Oak Street and the block between Birch Avenue and Astor Avenue, approximately in front of the U.S. Post Office property; and 2) On west side of Oak Street between Astor and a distance 80 feet north thereof (in front of City Hall). G. Seventy Two Hour Parking Limit. There shall be no parking of vehicles allowed on any street or alley within the city limits of Colville for a continuous period, not to exceed 72 hours. 2. Section is hereby repealed. 3. Section (C) is hereby repealed. 4. Section (C) is hereby repealed. 5. A new section is hereby added as Section , of the Colville Municipal Code and shall read as follows: Definition. The term "vehicle" shall include any vehicle, trailer, truck or recreational vehicle. 6. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Issuance of Notices. Any City of Colville law enforcement officer, parking control officer, the City of Colville Street Superintendent or Street Supervisor is hereby authorized to issue notices of infraction for any violation of this chapter (10.12 et seq.). Furthermore, said officials are hereby authorized to impound vehicles improperly parked on public property as set forth in this chapter (10.12 et seq.). 7. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Impoundment. Any vehicle is subject to impoundment after being left unattended in one of the following public or private locations for the indicated period of time: A. Public locations: 1) Constituting an accident or a traffic hazard as defined in RCW immediately. 2) When a vehicle is illegally parked in either: a) 3:00 a.m. to 6:00 a.m.; or b) 3:00 a.m. to 7:00 a.m. no parking zone, said vehicle may be towed immediately. 3) On a city street and tagged as described in RCW hours. Private locations: 1) On residential property - immediately. 2) On private, nonresidential property, properly posted under RCW immediately. 3) On private, nonresidential property, not posted - 24 hours. C. All towing operators, etc., shall comply with the provisions of RCW Chapter D. Any impoundment shall be performed by a licensed operator and in accordance with the provisions of RCW Chapter A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Law Enforcemen^Official Impound. A. A law enforcement officer or official as set forth in Section above, discovering an unauthorized vehicle left within, a city right of way shall attach to the vehicle a readily visible notification sticker. The City of Colville shall develop a notification sticker that clearly denotes the agency's authorization to impound. The sticker shall also contain the folio-wing information: 1) The date and time the sticker was attached; 2) The identity of the officer or official; 3) A statement that if the vehicle is not removed within twenty four (24) hours from the time the sticker is attached, the vehicle may be taken into custody and stored at the owner's expense; and 4) The address and telephone number where additional information may be obtained. B. If the vehicle has current Washington registration plates, the officer or official shall check the records to learn the identity of the last owner of record. The officer or official or his/their department shall make a reasonable effort to contact the owner by telephone in order to give the owner the information on the notification sticker. C. If the vehicle is not removed within twenty four (24) hours from the time the notification sticker is attached, the law enforcement officer or official may take custody of the vehicle and provide for the vehicle's removal to a place of safety, A vehicle that does not pose a safety hazard may remain on the roadside for more than twenty four (24) hours if the owner or operator is unable to remove it from the place where it is located and so notifies law enforcement officers or officials and requests assistance. Provided, however, said vehicle must be removed within 72 hours of the original notice. D. For the purposes of this section, a place of safety includes the business location of a registered tow truck operator. 9. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Parking Ordinance - Page 4

15 No Vehicle Maintenance in Street Right-of-Way. No owner or operator of a vehicle shall be allowed to repair, grease, or change oil on any vehicle within the street right of "way. 10. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Individual Not Allowed to Post "No Parking" Signs on Public Streets. No person, other than a City employee, shall post or place a "no parking" sign on public streets. 11. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: No Parking of Vehicles on Parade Routes. There shall be no parking of vehicles on parade routes during periods reserved for parades which have been authorized and approved by the City Council. 12. A new section is hereby added as Section of the Colville Municipal Code and shall read as follows: Civil Infraction. A. Anyone violating the terms of this chapter shall be deemed to have committed a civil infraction and shall be issued a notice of civil infraction pursuant to the procedure set forth in RCW Chapter B. The maximum penalty shall be $250.00, not including statutory costs, fees and/or assessments. 13. Savings Clause. Former Colville Municipal Code Sections , , (c) and (c) which are repealed by this ordinance shall remain in full force and effect until the effective date of this ordinance. 14. This ordinance shall take effect and be in force five (5) days from its passage, approval and publication.
