Section Amending Article 19, Sec. 200 of the S.T.O. Section Incorporating Standard Traffic Ordinance STANDARD TRAFFIC ORDINANCE INCORPORATED. There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Bel Aire, Kansas, that certain standard traffic ordinance known as the Standard Traffic Ordinance for Kansas Cities, 2016 Edition, (STO) prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas. Sections 33 and 59 of the STO shall be amended as set forth in Chapter 12 of the Code of the City of Bel Aire. Not less than one (1) copy of the standard traffic ordinance shall be marked or stamped Official Copy as Adopted by the Ord. No., such ordinance number to be that associated with the annual recodification, with modifications indicated within, and to which shall be attached a copy of the recodification ordinance adopting the standard code, and Chapter 12, shall be filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge and all administrative departments of the City charged with enforcement of this Chapter shall be supplied, at cost to the City, such number of official copies of the Standard Traffic Ordinance similarly marked, as may be deemed expedient. Section Amending Sec. 33 of the Standard Traffic Ordinance. Section 33 of the Standard Traffic Ordinance is amended to read as follows: Traffic Chapter 12/City of Bel Aire, Ks. (2016) Page 187

2 (a) Standard Maximum Speed Limits. Except when a special hazard exists that requires lower speed for compliance with Section 32, or as otherwise provided for in this section, or in association with School Zones or Road Construction Zones, the limits specified in this section, or as hereinafter established, shall be maximum lawful speeds, and no person shall drive a vehicle at a speed in excess of such maximum limits: (1) Twenty (20) miles per hour in any business or industrial district; (2) Thirty (30) miles per hour in any residential district; (3) Twenty (20) miles per hour in any park; and (4) Fifty-five (55) miles per hour in all other locations. (b) Maximum Speed Limits for Operation of School Buses. No person shall drive a school bus to or from school or interschool or intra school functions or activities at a speed greater than 45 miles per hour on any roadway having dirt, sand or gravel surface, and in no event shall a school bus be driven to and from school or activities in excess of 55 miles per hour, notwithstanding any maximum speed limit in excess thereof. The provisions of this subsection shall apply to buses used for the transportation of students enrolled in community junior colleges or area vocational schools when such buses are transporting students to or from school functions or activities." (Ord. 446) (c) The maximum speed limits in this section may be altered as authorized in K.S.A , K.S.A , and K.S.A , and amendments thereto. Pursuant to K.S.A , and , the Governing Body, having determined on the basis of engineering and traffic investigations that the maximum speed limits established pursuant to K.S.A are other than is reasonable or safe under the conditions found to exist within the corporate limits of the city, hereby deems it necessary to alter the maximum speed limits established pursuant to K.S.A and amendments thereto, on the following roadway(s) located within the City of Bel Aire as follows: (1) 45 Miles Per Hour Speed Limit. The maximum speed driven upon the following streets shall be 45 miles per hour: (a) Rock Road within the corporate limits of the City of Bel Aire, Kansas from 45th Street North to 53rd Street North. (Ord. 446) (2) 40 Miles Per Hour Speed Limit. The maximum speed driven upon the following streets shall be 40 miles per hour: (a) Oliver Street from 37th Street North to 53rd Street North, (b) Woodlawn Street from 37th Street North to 53rd Street North, (c) 37th Street North from Woodlawn Street to Oliver Street, (d) 45th Street North between Webb Road to Oliver Street, and (e) 53rd Street North between Oliver Street and the east corporate limits of the City of Bel Aire, Kansas located one half mile east of Greenwich Road. 3 (a) Krueger Street within the corporate limits of the City of Bel Aire, Kansas from 45 th Street North to the point it turns into 47 th Street North, (b) 47 th Street North within the corporate limits of the City of Bel Aire, Kansas from Oliver Street to the point it turns into Krueger Street, (c) 46 th Street North within the corporate limits of the City of Bel Aire, Kansas from Glendale Street to Krueger Street, (d) 46 th Street North Circle within the corporate limits of the City of Bel Aire, Kansas for the block directly northeast of Krueger Street, (e) Glendale Street within the corporate limits of the City of Bel Aire, Kansas from 46 th Street North to 48 th Street North, (f) Harding Street within the corporate limits of the City of Bel Aire, Kansas from Krueger Street to 48 th Street North, and (g) Battin Street within the corporate limits of the City of Bel Aire, Kansas from Krueger Street to 48 th Street North. (Ord. 396) (4) 20 Miles Per Hour Speed Limit. The maximum speed driven upon the following streets shall be 20 miles per hour: (a) Danbury Street within the corporate limits of the City of Bel Aire, Kansas from Janesville Street to Woodlawn Street, (b) Gunnison Street within the corporate limits of the City of Bel Aire, Kansas from Danbury Street to Woodlawn access road and (c) Woodlawn access road within the corporate limits of the City of Bel Aire, Kansas from Perryton Street to Danbury Street. (Ord. 446) Section Adding Sec. 33a. School Zones to the Standard Traffic Ordinance. Pursuant to K.S.A , , and , the Governing Body, having determined on the basis of engineering and traffic investigations that the maximum speed limits established pursuant to K.S.A (4) are other than is reasonable or safe under the conditions found to exist within the corporate limits of the city, hereby deems it necessary to alter the maximum speed limits established pursuant to K.S.A (4) and amendments thereto, regarding establishment of designated school zones, on the following roadway(s) located within the City of Bel Aire, by adding Sec. 33a, School Zones, as follows: (1) Woodlawn Street from 700 feet North of the centerline of 48th Street North south to 50 feet North of the centerline of 48th Street North - During the hours of 7:45 A.M. to 8:15 A.M. and 3:10 P.M. to 3:40 P.M. on school days the speed limit on said street shall be 20 M.P.H. (2) 45th Street North from 50 feet East of the centerline of Edgemoor Street west to 350 feet West of the centerline of Edgemoor Street - During the hours of 8:00 A.M. to 8:40 A.M. and 3:20 P.M. to 4:00 P.M. on school days the speed limit on said street shall be 20 M.P.H. 4 Section Ordinance. Adding Sec. 104a. Careless Driving to the Standard Traffic Sec. 104a, Careless Driving, shall be added as follows: (a) No person shall operate or halt any vehicle in such manner as to indicate a careless or heedless disregard for the rights or safety of others, or in such a manner as to endanger, or be likely to endanger, any person or property. Any driver who does so shall be considered to be prima facie in violation of this section, provided, however, that this section shall not apply to a vehicle driven by a person upon property owned by him/her. (b) No person, while driving, shall engage in any activity which interferes with the safe control of his/her vehicle. (c) No person shall engage in any activity or commit any act which interferes with a driver's safe operation of a vehicle. (d) Every person convicted of Careless Driving shall be punished by a fine of not less than $50.00 and not more than $ Section Adding Sec. 175a regarding Prohibition of Excessive Sound Amplification Systems to the Standard Traffic Ordinance. Sec. 175a, Excessive Sound Amplification Systems Prohibited, shall be added as follows: (a) No person operating or occupying a motor vehicle on a street, highway, alley, parking lot, or driveway, whether public or private, shall operate or permit the operation of any sound amplification system from within the vehicle so that the sound is plainly audible at a distance of 50 or more feet from the vehicle. The motor vehicle may be stopped, standing, parked or moving on a street, highway, alley, parking lot, or driveway. apply: (b) Definitions. For the purpose of this Section, the following definitions shall (1) sound amplification system means any radio, tape player, compact disc player, loud speaker, mp3 device, or other electronic device used for the amplification of sound. (2) plainly audible means any sound produced by a sound amplification system from within or upon the vehicle, which clearly can be heard at a distance of 50 feet or more. Measurement standards shall be by the auditory senses, based upon direct line of sight. Words or phrases need not be discernible and bass reverberations are included. 5 (c) It is an affirmative defense to a charge under this section that the operator was not otherwise prohibited by law from operating the sound amplification system, and that any of the following apply: (1) The system was being operated to request medical or vehicular assistance or to warn of a hazardous road condition; (2) The vehicle was an emergency or public safety vehicle; (3) The vehicle was owned and operated by the City of Bel Aire or a gas, electric, communications or refuse company; or (4) The vehicle was used in authorized public activities, such as parades, fireworks, sports events, musical productions and other activities which have the approval of the Governing Body of the City of Bel Aire or the department of the City of Bel Aire authorized to grant such approval. (d) Violation of this section is punishable by a fine of not less than $50 or more than $200 or by imprisonment for six months, or both. Section Amending Sec. 59 of the Standard Traffic Ordinance regarding Stop Signs and Yield Signs. Sec. 59, Stop Signs and Yield Signs, shall be amended by adding subsection (d): (a) Preferential right-of-way may be indicated by stop signs or yield signs. (b) Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering it. After having stopped, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time when such driver is moving across or within the intersection or junction of roadways. Such driver shall yield the right-of-way to pedestrians within an adjacent crosswalk. (c) The driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions and, if required for safety to stop, shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering it. After slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time Traffic Chapter 12/City of Bel Aire, Ks. 6 such driver is moving across or within the intersection or junction of roadways. Such driver shall yield the right-of-way to pedestrians within an adjacent crosswalk. If a driver is involved in a collision with a vehicle in the intersection or junction of roadways or with a pedestrian in an adjacent crosswalk, after driving past a yield sign without stopping, such collision shall be deemed prima facie evidence of the driver's failure to yield the right-of-way. (d) Stop signs and yield signs, as enforced pursuant to Section 59 of the Standard Traffic Ordinance, shall be erected pursuant to this Code, ordinances and resolutions adopted by the governing body of the City of Bel Aire, Kansas which specify particular intersections as stop and yield intersections and providing for the erection of stop signs and yield signs. (Ord. 446) Section Amending Sec. 85 of the Standard Traffic Ordinance regarding Stopping, Standing or Parking Prohibited in Specified Places. Sec. 85, Stopping, Standing or Parking Prohibited in Specified Places, shall be amended by adding subsection (f): Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall: (a) Stop, stand or park a vehicle: (1) On the roadway side of any vehicle stopped or parked at the edge or curb of a street; (2) On a sidewalk; (3) Within an intersection; (4) On a crosswalk; (5) Between a safety zone and the adjacent curb or within thirty (30) feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings; (6) Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic; (7) Upon any bridge or other elevated structure upon a highway or within a highway tunnel; (8) On any railroad tracks; (9) On any controlled-access highway; (10) In the area between roadways of a divided highway, including crossovers; or (11) At any place where official signs prohibit stopping. (b) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers: (1) In front of a public or private driveway; Traffic Chapter 12/City of Bel Aire, Ks. 7 (c) (2) Within fifteen (15) feet of a fire hydrant; (3) Within twenty (20) feet of a crosswalk at an intersection; (4) Within thirty (30) feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the side of a roadway; (5) Within twenty (20) feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five (75) feet of said entrance, when properly signposted; or (6) At any place where official signs prohibit standing. Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers: (1) Within fifty (50) feet of the nearest rail of a railroad crossing; or (2) At any place where official signs prohibit parking. (d) Move a vehicle not lawfully under his or her control into any such prohibited area or away from a curb such a distance as is unlawful. (e) Stand or park a vehicle in areas designated as fire lanes upon public or private property. (f) The Governing Body having determined it to be in the best interest of the health, safety and welfare of the citizens of Bel Aire, Kansas, that vehicle parking be prohibited on the north side of Perryton Street, between Edgemoor Street and Auburn Street. Upon posting of signs prohibiting parking as provided in this section, any owner or operator of a vehicle parked in violation shall, upon being found guilty, be subject to a fine of not more than Twenty-five Dollars ($25.00) plus court costs and administrative fees. (Ord. 359) Section through Section Reserved Traffic Infractions and Traffic Offenses (a) An ordinance traffic infraction is a violation of any section of this Code that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. Supp (b) All traffic violations which are included within this Code, and which are not ordinance traffic infractions, as defined in subsection (a) of this section, shall be considered traffic offenses. (Ord. 446) Section Penalty for Scheduled Fines The fine for violation of any traffic infraction or any other traffic offense for which the Municipal Judge establishes a fine in a fine schedule shall not be less than $10.00 or more Traffic Chapter 12/City of Bel Aire, Ks. 8 than $ A person tried and convicted for violation of any traffic infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the Court not to exceed $ A person tried and convicted for violation of any traffic infraction or other traffic offense for which no fine has been established in a schedule of fines shall pay a fine fixed by the Court not to exceed $ (Ord. 446) Section Amending Article 5, Section 23 of the Standard Traffic Ordinance: Accident Involving Death or Personal Injuries; Penalties. Sec. 23, Accident Involving Death or Personal Injuries; Penalties, shall be amended by moving subsections (1) and (2) as shown under subsection (c) to subsection (b) as follows: (a) The driver of any vehicle involved in an accident resulting in injury to, great bodily harm to or death of any person or damage to any attended vehicle or property shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible, but shall then immediately return to and in every event shall remain at the scene of the accident until the driver has fulfilled the requirements of Section 25. (b) A person who violates subsection (a) when an accident results in: (1) Total property damages of less than $1,000 shall be punished as provided in Section 201. (2) Any person who violates this section which results in injury to any person or total property damages in excess of $1,000 shall be punished by imprisonment for not more than one year or by a fine of not more than $2,500.00, or by both such fine and imprisonment.. (c) The driver shall comply with the provisions of section Section Amending Article 19, Section 200 of the Standard Traffic Ordinance: Motor Vehicle Liability Insurance. Sec. 200, Motor Vehicle Liability Insurance, shall be amended by changing the phrase this act found at word 16 and 17 in subsection (a) to the Kansas Automobile Injury Reparations Act with no changes to sections (b), (c), (d), (e) or (f) of that Section 200. The amendment to subsection (a) shall be shown as follows: (a) Every owner shall provide motor vehicle liability insurance coverage in accordance with the provisions of the Kansas Automobile Injury Reparation Act for every motor vehicle owned by such person, unless such motor vehicle: (1) Is included under an approved self-insurance plan as provided in K.S.A (f); (2) is used as a driver training motor vehicle, as defined in K.S.A , and amendments thereto, in an approved driver training course by a school district or an accredited nonpublic school under an agreement with a motor vehicle dealer, Traffic Chapter 12/City of Bel Aire, Ks. 9 and such motor vehicle liability insurance coverage is provided by the school district or accredited nonpublic school; (3) is included under a qualified plan of self-insurance approved by an agency of the state in which such motor vehicle is registered and the form prescribed in subsection (b) of K.S.A , and amendments thereto, has been filed; or (4) is expressly exempted from the provisions of this act. 11 The intersection of Krueger Street and Battin Street is hereby designated as a three way stop intersection. When stop signs are erected and maintained giving notice thereof, drivers of vehicles shall stop when entering from Krueger Street and from Battin Street (Ord. 421) Section Yield Sign Locations When yield signs are erected and maintained the driver of vehicles approaching a yield sign shall, in obedience to such sign, slow down to a speed reasonable to the existing conditions and shall yield the right of way to any vehicle in the intersection or approaching on another street. Yield signs are specifically required to be erected and maintained at the following locations: The Northwest corner of HARDING STREET at its intersection with 40th Street. (Ord. 136) The Northeast and the Southwest corners of MEMPHIS STREET at its intersections with Auburn Street. (Ord. 136) The Northeast corner of 38th STREET NORTH at its intersection with Parkwood Street. (Ord. 136) The Southwest corner of 40th STREET NORTH at its intersection with Harding Street. 12 Section Definitions 1. For the purpose of this Article the term, "Gross Weight" shall mean the total weight of any truck or trailer or any other combination of vehicles being towed or pushed by a similar propelling vehicle. 2. For this purpose of this Article, "Residential District" means the territory contiguous to and including a street not comprising a business district when the property on such street for a distance of three hundred feet or more is in the main improved with residence or residences and buildings used for business. 3. For the purpose of this Article, the term "Trucks or Other Commercial Vehicles" means any truck, pickup truck, tractor or any vehicle whether self-propelled by an engine or motor or whether the same is towed behind or pushed ahead of a motor vehicle when such vehicle or combination of vehicles has a gross weight of eighteen thousand (18,000) pounds or more, including, but not limited to, any construction equipment such as motor patrols or graders, bull-dozers or caterpillar-type tractors. (Ord. 141; 142) Section Truck Routes Established That the Governing Body shall be authorized to designate and establish truck routes through the City for the use of trucks or other commercial vehicles. All such routes shall be marked by suitable signs to advise the traveling public of existence of such truck route or routes. (Ord. 141) Section Truck Route Requirements From after the designation of truck routes as provided in this Article, every truck or other commercial vehicle as defined herein, shall use and follow such prescribed route or routes while in the City and shall not use any residential street or other street except those designated and marked as truck routes. Provided, that when it may be necessary for any such vehicle to deliver or unload cargo or to load or receive cargo at any destination within the City and the same is not prohibited by this Code, such vehicle may leave the truck route at the street intersection nearest to the place of the truck route by the most direct street to said truck route. Provided further, that police officers of the City may direct the routing of such vehicles. (Ord. 141) Section Truck Routes Designated For the purpose of this Article, the following streets, roads and avenues within the City of Bel Aire, Kansas are hereby designated as truck routes: 1. 37th Street North; 2. 45th Street North; 3. 13 5. Rock Road; 6. Webb Road; and 7. Greenwich Road. (Ord. 190) Section Truck Route Permit Any owner or operator of a truck or commercial vehicle subject to this Article, which is principally garaged, parked or kept upon the premises or place of business of the owner or operator of such truck or commercial vehicle within the City of Bel Aire, Kansas may be granted a permit, to be issued by the Clerk of the City of Bel Aire, which will permit the owner or operator of such truck or commercial vehicle to operate such vehicle, for which the permit is issued, from a designated truck route to the place such vehicle is to be garaged, parked or kept upon the premises or place of business of the owner or operator of such vehicle, leaving the truck route at the street intersection nearest to the place along said truck route which is closest and most direct route to the street or streets over which permit holder may proceed to the place the truck or commercial vehicle is to be garaged, parked or kept. Said permit shall be issued for a period of one year for a non-refundable fee of five dollars ($5.00). Such permit shall be renewed each year. The granting of such permit does not permit the parking of the truck or commercial vehicle, for which the permit is issued, upon the streets of the City. The granting of the permit does not relieve the owner or operator of a vehicle from any other ordinance of the City which might be applicable. (Ord. 141) Section Unlawful Truck Parking It is unlawful, except when necessary to avoid conflict with other traffic or in obedience to traffic regulations or the direction of traffic control devices or a police officer, for any person or operator to park a truck with a manufactures' rated capacity of over 18,000 lbs., or a bus, truck tractor, road tractor, farm tractor, trailer or semi-trailer on any street in a residential district, as herein defined, for longer than four (4)hours; except that parking longer than four (4) hours is permitted when necessary for the loading and unloading of merchandise and a permit issued by the City Clerk is in the possession of the operator or in the vehicle at the time the vehicle is parked over four (4) hours. These permits shall be issued for each instance overtime parking is necessary. The City Clerk shall collect a fee of two dollars ($ 2.00) for each permit issued.
