1 (Attachment) Docket Number June 2018 Ministry of Land, Infrastructure, Transport and Tourism Japan Civil Aviation Bureau Aviation Safety and Security Department Air Transport Safety Unit Subject: The Technical Standard to Prevent Objects Falling off Airplanes (Draft) and The Detailed Regulations of the Technical Standard to Prevent Objects Falling off Airplanes (Draft) (Notice of proposed rulemaking) 1.Background Although we have taken preventive actions against parts departing from airplanes and falling ice blocks in the operation of airplanes (hereinafter referred to as falling objects ), including thoroughly performing maintenance and inspection of airplanes, we still have to take further actions to protect people s lives and properties from being damaged, considering recent incidents of falling objects in September It is essential to take actions to prevent falling objects in order to enhance the functions of airports in the Tokyo metropolitan area by establishing new flight routes and to accommodate the increase in the number of foreign visitors to Japan due to the 2020 Tokyo Olympics and Paralympics. In this situation, the Japan Civil Aviation Bureau (JCAB) revises the Ordinance for Enforcement of the Civil Aeronautics Act (Ordinance of the Ministry of Transport No. 56 of 1952) for necessary measures taken by domestic air carriers, aerial work service operators, and foreign international air carriers (hereinafter referred to as operators ) to prevent objects falling off airplanes with a maximum takeoff weight more than 5,700 kg. Based on the revision of the ordinance, JCAB enacts The Technical Standard to Prevent Objects Falling off Airplanes and The Detailed Regulations of the Technical Standard to Prevent Objects Falling off Airplanes, and revises other regulations related to falling objects prevention. 2.Summary of the Technical Standards (1)-1 Construction of Engineering management System Operators shall construct a system to collect the information of falling objects, analyze and assess from the engineering aspect, and based on these results, they shall develop countermeasures (inspection, maintenance and others) and implement them. Specify matters to provide instructions to contractors, if applicable, to have the contractors take corrective actions. 1

2 (1)-2 Accomplishing engineering documents effective to prevent falling objects Operators shall accomplish engineering documents (Corresponding to the latest version of the s in Appendix 1 through 6) issued by aircraft and component manufacturers that are considered effective to prevent falling objects; provided, however, that this shall not apply to the case of implementing equivalent measures acknowledged by these manufacturers which are acceptable. In addition to the documents in the preceding paragraph, the operators shall conduct engineering assessments themselves and proactively accomplish ones that are considered effective as a means to prevent falling objects. (1)-3 Other measures In addition to the measures in (1)-2 and (1)-3, operators shall implement effective measures in Appendix 7; provided, however, that this shall not apply to the case of implementing equivalent measures acknowledged by Director of Air Transport Safety Unit which are acceptable. In addition to the measures in the preceding paragraph, in regard to the actions in preventing falling objects, operators shall examine and assess the area where Parts Departing from Aircraft (hereinafter referred to as PDA ) occurred and the area prone to cause ice accumulation by the operators themselves, and based on these results, they shall develop countermeasures (inspection, maintenance and others) and implement them. It is preferable that operators provide JCAB with the outline of the countermeasures considered important in sharing the information with other operators. In case a PDA occurs, if it is classified in the Category I or Category II, examine and assess each individual case. If a PDA is classified in the Category III, develop measures considering the analysis of how it occurred, such as weight, frequencies, etc. Category I II Table: Category of PDA Description Parts of 1000cm 2 or larger in size (area) or 1kg or more in weight (any material) Non-metallic parts from 100cm 2 to 1000cm 2 in size (area) or those from 0.2kg to 1kg in weight, or; Metallic parts from 100cm 2 to 1000cm 2 in size (area) or from 0.1kg to 1kg in weight; The following parts are classified in the category II regardless of weight, material, or size. 2

3 III - Rubber seals of 100cm or more in length: - Total loss of exterior light Any parts other than the above (2)Educational Training Operators shall provide educational training subjects in accordance with the content of measures to prevent falling objects (include the other measures), the content of duties and experience, etc. for flight crew, maintenance staff, and ground handling staff. The provisions of the preceding paragraph apply in the case where educational training is entrusted. 3.Amendment of other regulations regarding measures to prevent falling objects (1)Revision of Circular Notice Safety Review for Permission for Air Transport Services and Aerial Work Services The Minister of Land, Infrastructure, Transport and Tourism confirms an operation plan that domestic air carriers and aerial work service operators develop in accordance with the standards and permits under Article 100 and 123 of the Civil Aeronautics Act (Act No. 231 of 1952). (2)Revision of Circular Notice Safety Review for Permission for International Air Transport Services by Foreign Nationals and Surveillance Activities for Foreign Air Carriers, etc. and Instruction Notice Safety Review for Permission for International Air Transport Services by Foreign Nationals and Transport of Passengers and Cargos Departing from or Arriving in Japan (Related to Safety) The Minister of Land, Infrastructure, Transport and Tourism confirms an operation plan that foreign international air carriers developed in accordance with the standards and permits under Article 129 of the Civil Aeronautics Act. The Minister of Land, Infrastructure, Transport and Tourism permits transport of passenger and cargo departing from, or arriving in Japan by any aircraft having the nationality of any foreign state under Article of the Civil Aeronautics Act, whenever necessary to take measures to prevent falling objects considering the frequency of the transport, only when the measures are taken in accordance with the standards. NOTE: Operations for the standards related to falling objects prevention In the case of applying for permission as prescribed in the preceding paragraphs, operators shall submit documents stating appropriate implementation of the preventive 3

4 measures in accordance with the standards as soon as practicable with the signature of the representative clearly responsible for the measures in the course of duties, to the Minister of Land, Infrastructure, Transport and Tourism. 4.Proposed Schedule Promulgation: July 2018 Enforcement: 1 January 2019 Any person who intends to obtain a license for air transport services under Article 100 of the Civil Aeronautics Act and any person who intends to obtain a license for aerial work services under Article 123 of the Act 2 March 2019 Any person who intends to obtain a license for international air transport services by foreign nationals under Article 129 of the Act 3 Transitional Measures Among any person who has obtained a license for air transport services, aerial work services or international air transport services by foreign nationals at the time of enforcing the standards, transitional measures are provided for that the operators shall submit operation plans in which matters related to falling objects prevention are described in accordance with the standards within 2 weeks after each date of the enforcement of the standards. 4

In addition, confirm that the panels of the potable water and lavatory waste service doors are properly closed. (Inspection of leaking and functioning of the potable water service and drain system) Inspect leaking and functioning of the potable water service and drain system on a regular basis. In particular, conduct regular cleaning of the drain valves on the fuselage, which are prone to cause ice accumulation.
