There was an allegation regarding misuse of a county owned vehicle involving a former employee of the Department. Deputy Inspector General Larry Haut, CFE, CIGI, CGAP completed this investigation. The investigation was expanded to review policies, procedures, and practices regarding the use of vehicles by other Department employees. Our office worked with management to evaluate and recommend additional practices and controls. Management s response is attached to this report. 4 Date: May 13, 2016 To: Mack Young, Director, Domestic Animal Services From: Deputy Inspector General Larry Haut, CIGI, CFE and CGAP Subject: Case File # ; Investigation of Allegation Misuse of County Owned Vehicle Summary of Investigative Findings The Internal Audit/Inspector General Department s Public Integrity Unit (PIU) received a hotline allegation regarding potential Fraud, Waste and Abuse. The allegation was received as an anonymous hotline tip. Allegation I want to complain about an animal control officer.he lives at. in Cape Coral. He s always bringing his work van home. Friday and Saturday, it was parked at his house all night, but he leaves for work at 7 AM. He does this all the time, using county gas, tools, insurance etc. Bet you can trace his tolls over the bridge and see how much he does this. The investigator was able to determine the identity of the Animal Control Officer (ACO) by utilizing the address information furnished by the complainant. An investigation was opened as case # , and it was performed in compliance with the Quality Standards for Investigations included within the Principles and Standards for Offices of Inspector General as adopted by the Association of Inspectors General (AIG). Background A. Lee County Government (BOCC) provides vehicles to certain agencies and their employees, only for the performance of official duties. The Fleet Management Department assigns and maintains county owned vehicles. B. The BOCC has established a written uniform policy for the purpose of assignment of twenty-four (24) hour vehicles to BOCC agency employees. Fleet Management Policy and Procedure Number FV-028 relates to the Subject of Take Home Vehicles. The 1
5 policy was approved on by Assistant County Manager Pete Winton and by Fleet Department Manager Marilyn Rawlings. C. Department Directors may assign county owned vehicles on a 24 hour basis to full-time employees meeting the criteria established in this policy. No employee is authorized to drive or park a County vehicle at or near an employee s home unless the 24 hour vehicle assignment has been approved. D. The Policy/Procedure also establishes the following aspects: 1. Criteria for Approval 2. Procedure Assignment 3. Usage 4. Liability 5. Department Director s Responsibilities 6. Employee s Responsibilities Department Directors are responsible for identifying the mission critical positions to be recommended for 24 hour vehicle assignment, and they provide appropriate justification for such assignment. All 24 hour vehicle assignments must be made on a written form which must be sent to Risk Management and Fleet Management. Temporary assignments which do not exceed 30 calendar days can also be requested by using the form. All current assignments must be re-justified and approved under the established criteria prior to December 31 of each calendar year. There are authorized and unauthorized uses referred to in the written policy. Unauthorized uses may warrant disciplinary action. E. According to the Director of Fleet Management, their records reflect that no written authorization forms for 24 hour vehicle usage were received for any employee of Domestic Animal Services, including Animal Control Officers, from 2012 through F. Fleet Management records reflect that from 2012 to 2015; vehicle number had been assigned to the Animal Control Officer referred to in the anonymous hot line complaint. The vehicle is a 2010 GMC- Model 2500 Van, with a Mavron Animal Transport insert, Model # AT-350. Conclusions The investigation concluded the following: 2
6 A. Substantiated: The subject Animal Control Officer s Government vehicle was used a minimum of 50 occasions during his off-duty status and on weekends. B. Substantiated: County monies were expended on gasoline and the subject ACO s vehicle incurred additional mileage while he was off-duty. C. Substantiated: No evidence was provided that the subject employee was authorized to park his assigned vehicle at or near his home on the noted occasions. D. Substantiated: Fleet Management Policy and Procedure- Number FV-028 was violated. E. Substantiated: The subject employee was using the vehicle for non-authorized purposes. The subject employee terminated employment with Lee County prior to the conclusion of the investigation. Case # was subsequently closed with action responses from the Animal Services Director and Assistant County Manager. Observations and Recommendations During the period under review, Animal Services assigned vehicles to individual Animal Control Officers. The Department did not have written records or policy and procedures to monitor vehicle usage, including: A. Temporary assignments or exchanges of vehicles between employees. B. Documentation of employees using their vehicles for unofficial purposes; including commuting between home and work. Recommendation We recommend that the Animal Services Director and managers implement safeguards and controls to minimize the opportunity for misuse of official vehicles. Suggested actions include: A. Written department policy and procedures regarding the usage of vehicles, including availability and usage of vehicles during off-duty periods. B. Periodic formal employee acknowledgement of the Department and County vehicle usage policy. Our office discussed the Observations and Recommendations with the current Animal Services Director and the Assistant County Manager. We noted the positive results that could accrue from creating written policies regarding usage of county vehicles and providing them to agency personnel. Department Action in Response 3
7 In November 2015, Animal Services management instituted two new forms entitled: A. Daily Vehicle Sign-Out/In sheet: This form reflects information on Date in/date Out, times utilized, and which staff member is utilizing which vehicle. It does not reflect mileage or trip location information. B. Weekly Vehicle Inspection Sheet: This form reflects vehicle item inspection as being OK, N/A, or Needs Repair. It also includes the date of inspection, vehicle ID number, mileage at the time of the inspection, and the officer performing the Inspection. Investigative Methods A. Records Reviewed 1. The investigator obtained, reviewed, and analyzed records from the Lee County Fleet Management Department. These included written Policies and Procedures, vehicle assignments for Lee County Domestic Animal Services (LCDAS), fuel purchase locations, as well as fuel purchase records for the vehicle assigned to the subject ACO including the cost, number of gallons, dates and times that the fuel was purchased. 2. The investigator obtained, reviewed, and analyzed records from the Lee County Department of Transportation- Leeway Office. They maintain records reflecting vehicles that utilize toll bridges and transponders in Lee County. 3. The investigator obtained, reviewed and analyzed records pertaining to ACO s payroll, attendance, field assignments and work schedule. B. Detail of Records Reviewed: From the Lee County Fleet Management Department - For vehicle #049749, which had been assigned to the subject since his employment in Fuel Usage - Operation Cost Search Reports : These reflect the time, location, date, vehicle mileage, gallons, and cost for each occasion that fuel was purchased for the vehicle. 2. Equipment History -Work Order Search Reports : These reflect date in and date out, as well as cost, for vehicle servicing and repairs when the Vehicle was out of service. From the Payroll Department Lee County Clerk of the Courts Finance Department: 1. Kronos - Time in and Time out records reflect the specific dates and hours worked by the employee and approved by his supervisor. 4

Payroll Biweekly Report - indicates total hours worked, classification of hours worked; including regular time, overtime, night differential time, vacation time, sick leave, comp time, etc. From The Lee County Department of Transportation - Leeway Office: 1. Transponder Reports for Vehicle # which reflect only westbound travel over two different toll bridges from Fort Myers to Cape Coral during various periods in 2012 to September The bridges are the Midpoint Bridge (MPB) and the Cape Coral Bridge (CCB). The reports indicate date and time. Transponder records were not retrievable for the following periods: May 2012 to December 2012, and June 2013 to August From The LCDAS: The following documents were obtained and compared to records received from the other parties. 1. Daily Activity Reports - for the subject Animal Control Officer reflecting his field calls from June 15, 2012 to November 7, Field Operation Schedules - for various periods during 2012 thru 2014 (some periods not available). These reflect assigned days and shifts for individual Field Employees, including the Animal Control Officers. C. Interviews/Contacts The following individuals provided information to IG/PIU pertaining to Lee County government and agency policies, procedures and vehicle utilizations at Animal Services: 1. Marilyn Rawlings, Director, Lee County Fleet Management 2. Donna Ward, Former Director, (LCDAS) 3. Glenn Johnson, Former Operations Manager, (LCDAS) 4. Anthony Backhurst, Field Operations Supervisor, (LCDAS) 5. Dave Harner, then Acting Director (LCDAS), and Assistant County Manager See Exhibit 1 for additional detail on these interviews: Summary of Case Supporting Material 5
9 A comparison of the vehicle usage and Kronos payroll records from 2012 thru 2014 reflects the following findings for the subject ACO s vehicle: A. The vehicle was utilized on the following days/times that the assigned Animal Control Officer was off-duty. 1. Vehicle Usage on at least 50 Off-Duty and not Scheduled to Work Days. 2. Vehicle Usage on at least 3 Off-Duty Comp Time Days. 3. Vehicle Usage on at least 2 Off-Duty Holidays. 4. Vehicle Usage on at least 2 Off-Duty Vacation Days. 5. Vehicle Usage on at least 18 days after the end of his shift. See Exhibits 2, 3 and 4: B. A review of the subject s Daily Activity Reports determined that for the 57 off-duty days, there were no field calls on 56 of those days. On one day (6/24/2013) there was a field call at 12:09 AM. C. The subject s vehicle was in use on 52 occasions during the weekend or on the day next to the weekend adjacent to the 57 off-duty days. A breakdown of specific days of the week reflects vehicle usage as follows: 1. Fridays - 14 (Includes 6 after-duty hours usages) 2. Saturdays Sundays Mondays -11 D. There were 24 occasions noted when the subject s vehicle crossed a toll bridge into Cape Coral during off-duty days, and his daily assignment sheets reflected no field calls for that day: (MPB- Midpoint Bridge: CCB- Cape Coral Bridge). See Exhibit 2 for additional detail. E. There were 18 identifiable occasions when the vehicle crossed a toll bridge into Cape Coral after regular work hours. On 13 of these occasions, the toll crossing was shortly after his shift (i.e. 20 minutes to an hour). On 5 of these occasions, the vehicle crossed the bridge on Friday evening prior to an off-duty weekend. See Exhibit 3 for additional detail. The above incidents also involved additional costs for gasoline, vehicle mileage, and vehicle wear and tear for non-duty related usages. 6
10 A comparison of off-duty fuel purchases, scheduled work days and Kronos records for six other ACO s indicated that: A. Three of the ACO s had little or no indication of fuel purchases for their assigned vehicles during off-duty days. B. Three employees in positions similar to the subject employee each had a minimum of 50 days when fuel purchases and extra mileage was incurred on their assigned vehicle during their off-duty days. See Exhibit 5 for additional detail. 7
11 Exhibits EXHIBIT 1: Interview Summaries: 1. Marilyn Rawlings: The BOCC has a written policy pertaining to Take Home Vehicles. This is Policy Number FV-028 which was approved on June 6, It established a uniform policy for the assignment of 24 hour vehicles to BOCC employees. It states that Department Directors may assign County vehicles on a 24 hour basis to full-time employees meeting the criteria established in this policy. No employee is authorized to drive or park a county vehicle at or near an employee s home unless the 24 hour vehicle assignment has been approved. A written authorization form must be prepared and filed with County Management. 2. Donna Ward stated the following relating to vehicle usage and vehicle take-home policy. Officers on the third shift (11:00 p.m. to 8:00 a.m.) could take their work vehicles home with supervisory permission. Supervisors and on call employees also could take the vehicles home under certain conditions. The designated on-call animal pickup employee, if needed, could take their vehicle home. Other than that, the policy was that vehicles were not to be taken home or used on non-work days. 3. Glenn Johnson: A specific vehicle was assigned to a specific individual employee for official use only. They were not provided as take-home vehicles. Vehicles could be taken home if and only when approved by a supervisor. The third shift (11:00 p.m. to 8:00 a.m.) employees were the most likely to be authorized to take vehicles home depending on circumstances. Most of the time the third shift employees would return their vehicle to the office. Tony Backhurst was the supervisor who normally approved vehicle take-home requests. 4. Tony Backhurst: Officers on the third shift (11:00 p.m. to 8:00 a.m.) could on occasion and with specific supervisory approval, take their individually assigned work vehicles home. This could be for situations such as: Employees occasionally work the 2 nd shift today and the 1 st shift tomorrow. This scenario was not too common. Animal Control Officers working other shifts were required to leave the vehicle at the office when they went off-duty. Animal Control Officers were also required to leave their assigned vehicles at the office on days that they were off from work. They were not authorized to use their vehicle for anything except officially assigned duties. Tony and Angel Cruz had assigned vehicles 24/7, except when they were on vacation. On-call Investigators could take their assigned vehicles home. 5. Dave Harner, Acting Director, LCDAS, was interviewed. The following was discussed: The issue of off-duty Animal Control Officers and the applicable rules and 8
12 regulations pertaining to taking assigned vehicles home. We also reviewed some documentation and findings pertaining to this investigation s subject employee. Dave subsequently provided additional records pertaining to on-call designations, work assignments, attendance and vehicle assignments. This topic concerned Dave since he took over as Acting Director, and he had indications that the controls and safeguards relating to potential abuse of the Countywide policy may have been a problem. Dave expressed concerns pertaining to what the records showed regarding the subject employee. We discussed expanding our review beyond the subject employee. We also discussed that we would work together on what kinds of controls and safeguards could be implemented relating to vehicle usage for all Animal Services employees.
