A mirror with no added lead and very low emission of volatile oranic components, that can be dangerous. 30% of the glass used is made of recycled materials and produced by companies with certified credentials of quality, health and environment. 164 CONDIZIONI GENERALI DI VENDITA 1 Il Cliente con la trasmissione dell ordine accetta integralmente le presenti condizioni di vendita. Gli ordini sono validi se accettati con la nostra conferma d ordine scritta. Eventuali deroghe dovranno essere concordate in precedenza. Qualsiasi vendita fatta dagli Agenti, è soggetta alla nostra approvazione. Per ordini con importi netti inferiori a 500 verrà addebitato un contributo per le spese di spedizione pari a 20. Non si accettano annullamenti d ordine e in tale evenienza potremmo esigere gli oneri sofferti. 2 I termini convenuti per la consegna non sono impegnativi. Un eventuale ritardo non da diritto ad annullamento dell ordine né ad un risarcimento danni. La decorrenza dei termini si intende prorogata se il cliente non rispetta gli accordi stabili tra le parti o se insorgono cause indipende ti dalla ns. volontà, compresi eventuali ritardi dei ns. fornitori. Potremmo sospendere in qualunque momento l esecuzione della fornitura o cambiare i termini di pagamento convenuti, in caso di mutamento delle condizioni patrimoniali del cliente. 3 I prezzi si intendono franco ns. stabilimento e potranno subire variazioni in ragione dell aumento dei costi o variazioni repentine del tasso di cambio della nostra moneta. 4 I pagamenti sono validi se fatti direttamente alla sede o a persona da noi atorizzata, netti di sconto e nei termini pattuiti. Trascorso il termine del pagamento, senza bisogno di avviso decorrerà l interesse calcolato al tasso ufficiale di sconto vigente con maggiorazione di 5 punti, nonchè il rimborso delle spese sostenute. Nessuna contestazione sollevata dal compratore potrà giustificare il rifiuto del pagamento nei termini convenuti. La merce resta di proprietà di Blue Design srl fino al pagamento totale della stessa e dopo l avvenuto buon fine dei titoli eventualmente emessi. 5 La merce viaggia a rischio e pericolo del Cliente, anche se trattasi di fornitura assunta con la condizione di resa franco destino. Eventuali reclami per danni da trasporto devono essere fatti al momento della consegna direttamente al vettore e quindi alla nostra sede. Non si accettano reclami oltre 8 giorni dalla data di ricevimento. 6 Eventuali resi dovranno essere autorizzati e comunque provvisti dell imballo originale. Nel caso di errori o difetti comunicati entro 8 giorni e da noi riconosciuti, provvederemo alla sostituzione escluso ogni obbligo di indennizzo. Il verificarsi delle situazioni ai punti 5 e 6 non da comunque diritto di sospendere arbitrariamente o modificare i pagamenti pattuiti. 7 Non si accettano in alcun caso addebiti di alcun genere o eventuali sconti e deduzioni. Risarcimenti concordati saranno regolati tramite nota di accredito da noi emessa. 8 Per qualsiasi controversia è competente il foro di Siena. 9 Ai sensi e per gli effetti della L. 675/96 il Cliente autorizza Blue Design srl al trattamento dei dati personali mediante l utilizzo di mezzi manuali, automatizzati ed elettronici per le seguenti finalità: adempimenti contabili, fiscali, di controllo e derivanti da obblighi contrattuali; gestione finanziaria e revisionale, gestione dei rapporti con la clientela, finalità connesse agli obblighi di legge; acquisizione di informazioni utili a valutare gli eventuali rischi connessi alla conclusione o esecuzione del contratto. 164

165 GENERAL SALES CONDITIONS 1 By submitting the order, the Client fully accepts these terms of sale. Orders are valid if accepted by our written order confirmation. Possible exceptions must be previously agreed. Any sale made by Agents is subject to our approval. For any order with nett amount lower than 500 there will be a delivery cost of 20. We do not accept order cancellations and in such cases we are entitled to require refund charges. 2 The agreed delivery terms are not binding. Any delay does not entitle the Client to order cancellation or damage compensation. Delivery might be postponed if the Client does not respect the agreements between the parties or due to causes beyond our control, included delays by our suppliers. We may suspend the supply anytime or change the agreed payment terms, in the event of a change in the financial circumstances of the Client. 3 Prices are ex-works and are subject to changes due to increased costs or sudden changes in the exchange rate of our currency. 4 Payments are valid if made directly at our head offices or anyone authorized by us, net of discount and compliant to the agreed terms. Once the term of payment has expired, the interest rate calculated at the official rate increased of 5 points will become effective, as well as the administrative fees refund. No objection raised by the buyer may justify his/her refusal to pay according to the agreed terms. The goods remain the property of Blue Design srl until full payment and after the successful case of possibly issued bonds. 5 Goods are transported at Client s risk even if delivered with condition of free of charge return. Possible complaints for transportation damages must be made upon delivery to the carrier and then to our head office. No claims are accepted after 8 days from receipt of the goods. 6 Any return must be authorized and supplied with the original packaging. In case of mistakes or defects communicated within 8 days from receipt of the goods and acknowledged by us, defective goods will be replaced excluding any compensation obligation. The occurrence of the situations in paragraphs 5 and 6 will not entitle the Client to arbitrarily suspend or modify the agreed payments. 7 We do not accept under any circumstance charges of any kind or discounts and deductions. Agreed compensations shall be regulated by a credit note issued by us. 8 Any dispute will be settled by the Court of Siena. 9 Pursuant to the effects of Law 675/96 the Client authorizes Blue Design srl to process personal data through the use of manual, automated and electronic means for the following purposes: accounting, tax, audit and contractual obligations; financial management, customer relationship management, purposes connected with legal obligations; acquisition of information to assess the potential risks associated with the conclusion or performance of the contract. 165
