1 Barry Peak Senior Forensic Consultant, BSME, ASE, ACTAR, CFEI, CVFI 2628 Port Industrial Drive, Suite 705, Jacksonville, Florida Professional Summary: Mr. Peak has over fifteen years as a Mechanical Expert and Certified Accident Reconstructionist with extensive experience in vehicular accident reconstruction, the determination of mechanical defects and the determination of fire cause and origin in vehicles. He has extensive experience and training in multiple accident reconstruction scenarios including passenger vehicles, motorcycle, pedestrian, low speed collisions, staged collisions, and commercial vehicle/heavy truck reconstruction evaluations. Mr. Peak is also a certified ASE (National Institute for Automotive Service Excellence), Master Automotive Technician, and a Medium/Heavy Truck Technician certified in brakes and air brake systems. To become ASE certified, he passed a battery of challenging examinations covering all vehicular components. He has also worked as a full-time mechanic where he performed service on a broad range of vehicles. Mr. Peak has conducted hundreds of mechanical failure inspections, to include brake failures, steering system failures, sudden accelerations, wheel/tire failures, suspension failures, transmission failures, electrical system failures, and engine failures. These inspections were performed on multiple types of vehicles including commercial vehicles, farm equipment, passenger vehicles, and motorcycles. In addition to vehicular inspections, he has experience in the investigation of Mechanical Defects in Consumer and Industrial Products and product failure analysis. Prior to completing his Mechanical Engineering degree, Mr. Peak worked in the field of law enforcement, where he specialized in traffic enforcement, traffic accident investigation, and traffic homicide investigation. This background, together with his career as a mechanical expert and certified accident reconstructionist, has given him extensive experience testifying in court on cases involving vehicle accidents in both the criminal and civil arenas. Mr. Peak also has experience in the field of vehicle design, having worked with Ford Motor Company in their prototype division at the proving grounds in Naples, Florida. Here he assisted engineers in the development and evaluation of prototype vehicles. I was hired to determine what caused the crack. Wright Specialty Insurance Company, Uniondale, New York Pipe Failure A fire suppression system pipe failed at a hotel located in Orlando, Florida causing flooding and damage to the building. I was hired to determine the cause of the failure. The inspections were completed including a lab examination. It was determined the failure was caused by an impact to the sprinkler head mounted to the pipe which caused a fracture to occur near a T flange section of the pipe. York Risk Services, Columbus, Ohio Vehicle Injury Analysis A minor vehicle collision occurred, and injury claims were made. I was hired to analyze the collision forces and determine if these accelerations would be consistent with causing the claimed injuries. The acceleration involved in this collision was shown to be less than 0.1g and the change in velocity was less than.08 miles per hour. With this information it was determined that these forces and accelerations were comparable to, or less than, those experienced during activities of daily living. Cheung-Truslow & Uehlein LLC, Framingham, Massachusetts Vehicle fire 2

3 An owner parked his BMW X-5 in his condominium s garage immediately after picking it up from the dealership for warranty work. The BMW caught on fire and burned down his condominium along with 2 others. I was hired to determine the origin and cause of the fire. After inspections and teardown of the engine it was found that the valve cover gasket was improperly replaced during the warranty work resulting in an oil leak and the subsequent fire. Acceptance Insurance Company, Tampa, Florida Vehicle Fire A vehicle fire was reported while the owner was driving the vehicle. I was hired to determine the origin and cause of the fire. After inspections the vehicle was found to have aftermarket wiring in the origin of the fire related to the aftermarket stereo system. This wiring was not properly fused and an overheating of the wiring system likely caused the fire in the trunk area of the vehicle. Frohlich, Gordon and Beason P.A., Port Charlotte, Florida A two-vehicle collision occurred, and I was hired by perform a vehicle accident reconstruction. Two vehicles were traveling in opposite directions during a heavy rain storm and the roadway had puddling on the roadway. The question was which vehicle crossed the center line and caused the collision. Inspections and an imaging of the airbag control module from a Chevrolet truck were performed. It was determined that the Chevrolet truck lost control due to hydroplaning on the wet roadway and crossed the center line into the path of the other vehicle. State Farm Insurance Company, Phoenix, Arizona A two-vehicle collision occurred, and I was hired to determine if the damages to the vehicle were consistent with the reported collision. After reviewing photographs, police report and witness statements provided by the client it was determined that the damages were not consistent with how the reported collision occurred. York Risk Services Group, Inc., Lake Mary, Florida Commercial A commercial vehicle vs. a passenger vehicle collision occurred and I was hired to determine the speed of the vehicles and if the commercial vehicle driver could have perceived and reacted prior to the collision to avoid the collision. After inspections and review of the information sent by the client it was determined that the commercial vehicle was traveling at or slightly above the posted speed limit and that the commercial vehicle driver should have been able to perceive and react prior to the collision and avoid the collision.
