1 Town of Superior SUPERIOR NEWS Volume Issue Summer 2018 Superior Volunteer Firefighters I want to emphasize the word VOLUNTEER. There is nothing more valuable to a Community effort than the giving of your personal time. Our hours here on this earth are limited and we must pick and choose where to invest them. Compound that by the Risk of fighting fire and the Volunteer Firefighter is special indeed. The Superior Volunteers have freely given to the Community they serve, 987 hours of Training and Emergency Response time. That equates to a value of roughly $35,000 donated to the Town of Superior and Mineral County. Our training program here has allowed two of our own to move on to paid departments here in Montana and begin a lifelong career as a professional Firefighter. Many serve to give something back to the Community in protection of life and property. The Volunteers of Superior Fire, St Regis and West End clearly make a difference and all of us are proud of your efforts and accomplishments. 2 Page 2 SUPERIOR NEWS MONTANA JUNK VEHICLE QUESTIONS What is the Montana Junk Vehicle Law? In 1973 the Montana Motor Vehicle Recycling and Disposal Act was enacted for the establishment, control, operation and licensing of public and private motor vehicle wrecking facilities. This law requires commercial and county motor vehicle storage and wrecking yards to obtain an annual license, keep pertinent records and shield their junk vehicles from public view. This law also requires the control of junk vehicles in your yard, alley, etc. What is a Junk Vehicle? A junk vehicle is defined as any discarded, ruined, wrecked or dismantled motor vehicle, including component parts, which is not lawfully and validly licensed, and remains inoperative or incapable of being driven. A vehicle must meet all three parts of the definition to be classified as a junk vehicle. If I only have one junk vehicle do I need to shield it? Yes, all junk vehicles regardless of number must be shielded from public view. What is Public View? Public view is defined as any point 6 feet above the surface of the center of a public road from which a junk vehicle can be seen. A public road is any publicly owned or maintained highway, street, road or alley. Do I have to shield my vehicles if I m not in the commercial motor vehicle wrecking business? Yes, all vehicles that meet the three-part definition of a junk vehicle must be shielded from public view. How can I shield my junk vehicles from public view? You can move the vehicle to a location that will shield it, such as into a garage or behind a solid fence, hill or building. You may also construct shielding using permanent fencing materials. Certain construction specifications are required for proper shielding. If you intend to shield your vehicles, contact you County Junk Vehicle Program prior to construction. Placing tarps or plastics over the vehicles is not acceptable shielding. Can I do anything else other than removing or shielding the vehicle? Yes, you may repair the vehicle to make it operable, or license it. Either action will remove the vehicle from the classification of a junk vehicle. What if I no longer want to keep the vehicle? If the vehicle has value from its parts, contact a licensed private motor vehicle wrecking facility. Most commercial wrecking facilities will buy vehicles that have marketable parts. If the vehicle s value is low, they may haul it away free in exchange for its parts. Some vehicles have little or no parts value and the private wrecking facility may not be interested in hauling it. If this is the case, contact your local County Junk Vehicle Program. They will arrange to haul and dispose of your junk vehicle at no charge to you. Do I need to shield such items as engines, transmissions and fenders? Yes, any component part of a vehicle must also be shielded. How can I comply with the law if a junk vehicle has been abandoned on my property? Montana has specific laws regarding the disposition of abandoned vehicles. Contact your local law enforcement agency and request their help in contacting the owner or in obtaining authorization to have the vehicle removed. Do I need to obtain a motor vehicle wrecking facility license for my own junk vehicles? If you have four or more junk vehicles at any one location or if you buy, sell or deal in secondhand motor vehicle parts you may need to obtain a license. Information on the requirements for obtaining a Montana motor vehicle wrecking facility license can be obtained from the Mineral County Sanitarian or the Dept. of Environmental Quality. What are the penalties if I don t comply with the junk vehicle law? The junk vehicle statutes provide for criminal penalties of up to $250 and/or 30 days in jail. 4 Page 4 SUPERIOR NEWS RECYCLING The Town of Superior recycling bin is Open 10 am to 4 pm Wednesday and Saturday at the Town Shop at 449 Mullan Rd W. STREET AND ALLEY EXCAVATIONS Anyone who needs to dig in a Town Street or an Alley must contact the Town Clerk s Office and complete an application for a permit for the dig. The permit must be completed and approved prior to the dig. The permit will require the time, place (location) and purpose of the dig. A deposit is required at the time of the permit. The deposit will be returned upon inspection and approval of the finished repair. The street or alley that has been disturbed by the dig must be restored to the way it was before it was disturbed. If the disturbed area settles at a later time you are responsible to fill the area until no more settling occurs. The contractor or the person excavating must call 811 before you dig or the excavation will not be allowed. SEWER AND WATER CONNECTIONS Planning to make a new sewer or water connection to the Town s sewer or water system? Planning to make a reconnection to the Town s sewer or water system? IF SO, YOU MUST: 1. Contact the Town before you dig. Call Submit an application and the required fees prior to connection. 3. Dig 4. Public Works Connect to the water or sewer main. EXTRAS The schedule for the Council meeting Agenda and council packets is: All items to be on the Agenda and information for the council packets must be to the Town Clerk by the Thursday before the meeting at 2:00 p.m. This allows the information to be put in the packet and the Agenda posted. Someone may speak at a meeting about a non-agenda item during public comment. The Council can not take action on matters brought up under the public comment period until the item is scheduled on the Agenda for the next meeting. Agendas will be posted at the Town Hall, Post Office and Castles. The Agenda will also be posted on the Website. The annual audit for FY has been completed and submitted to the state. Construction of the HOME Grant senior housing project construction has begun. New gas tax funds will be used to patch streets in various location around town.. New playground equipment ordered for Frank James Park.
5 Page 5 GRASS AND WEEDS Owner(s) or Agents of Owner(s) are required to cut or remove weeds from property under their control and one-half (1/2) of any road or street abutting the property. It is the duty of the property owner(s) or their agents to maintain their property so that it shall not be considered a fire hazard or a public or private nuisance. Grass over 8 inches is considered weeds. If a complaint is filed the owner(s) or their agents have 10 days to cut or remove the weeds. If the weeds have not been cut or removed within the 10 days the Town can cut or remove the weeds and the property owner(s) or their agents will be billed. The charge is $ per hour with a $ minimum. YARD AND GARDEN WATERING CONSERVATION TIPS Water before 8 am or after 6 pm. Do not leave sprinklers or hoses running all day or night Install timers or underground sprinkling systems Use soaker hoses and trickle irrigation systems Avoid watering on windy days Avoid sprinklers that spray a fine mist, which increases evaporation Make sure sprinkler is placed so it only waters lawn or garden, not pavement Water trees & shrubs with deep root systems, longer & less often than shallow rooted plants Water in several short sessions rather than one long session Raise the lawn mower cutting height Use hose washers between spigots and water hoses to eliminate leaks Check hose, connectors and spigots regularly PARKS SPECIAL EVENTS The Town of Superior requires a permit for special events held in Town Parks. A deposit of $ must be submitted with the permit application. The park use permit application is available at the Town Office or on the Town s website. Special events in the parks require special event insurance. Please contact the Town for more information.
