Ordinances: These are clarifications of items discussed which may have not been clear at the meeting or misunderstood. Highlighted items in green, reasoning below in parentheses: Regards, Captain Blank Page 4 SPECIAL RECOVERY SERVICES Constitutes any action that is not normally associated with roadside towing. Winching, righting an overturned vehicles or other services required when a vehicle is not on any portion of a travelled roadway or shoulder is considered Special Recovery Services. Winching a vehicle onto a flatbed, with damaged wheels or transmission is not ( Clarified to prevent people from being charged an additional winching fee if flat tires prevented the vehicle from rolling smoothly) Page Services to be furnished; possession of special equipment. C. At the request of the Fire Chief or his designee, another tow agent on the list, may be called to assist with the recovery if the on-call Tow Agent does not have

(Air Bags, Struts etc.) Should this occur, the on-call Tow Agent will be the primary tow operator, with the secondary assisting in the process. (At the request of the Fire Chief after a recent fatal accident this was requested. Specialized equipment may be needed in special circumstances; this is not the norm, but the exception) Page Minimum Standards of Performance (5) Within ten calendar days of the expiration of each rotation period, the official tower shall submit to the Chief of Police or his designee, a copy of all of the invoices for services rendered to any owner or operator of a damaged or disabled vehicle on a form of invoice provided by the Township. The invoice shall be a four (4) part copy to be distributed as follows: (Changed five calendar days to ten. This is due to the fact that towing rotation ends at midnight on Tuesdays. 5 days makes in Sunday, which was unfair to towers. This gives the towers till the end of the following week) Page 17 E. Minimum storage requirements. (1) Every official tower shall maintain an inside building and <or> outside secured storage area Licensed Site meeting the following requirements ( Or should be removed, Towers need to have an inside storage space)

37 Mahwah Police Department Inter-Office Memo (b) The location of the storage area shall be located within the limits of the Township or must be within 3 5 miles from the border of the Township. Vehicles cannot be stored in New York State. Lettering on yard location must be a minimum of 10" tall, visible from the roadway. The sign must be properly affixed to fence structure or building; plastic ties are unacceptable. The storage area shall have appropriate signage subject to the following minimum requirements: - Name of towing company - Letters 10 inches in height - Visible from the roadway where located - Properly affixed to building or fence With proper Hardware (I made a sign with 5 letters and it was hard to read. Made one with 5 high and it was much easier. To prevent signs being attached with wire or strings which could break and fall off) Page 19 prominently post the hours WITH PROPER SIGNAGE. during which the facility will be open <on weekends> (REMOVE) (Only talked about weekend hours, clarified to have all hours posted on signage) vehicles 3 DAYS AFTER GOING OFF ROTATION The building shall be within sight distance and/or within 500 feet of the entrance of the storage area. On the application for a

38 Mahwah Police Department Inter-Office Memo towing license, the applicant shall list all business hours required pursuant to the subsection for the calendar year of the license in question, which shall not be changed during the calendar year. The building must be staffed during times of operation WHEN ON TOWING ROTATION. (To better serve the public, so that they can retrieve their car towed and not incur any additional tow fees, convenience for the party who had the accident ) (h) The applicant shall, with its application, submit proof of ownership or COMPLETE COPY OF lease of the storage area. ( A completed lease will have all terms and conditions of property) (l) Inside storage shall be capable of storing no less than two vehicles with each having an overall length of 245 long by 96 Wide per license. ( This was spoken at length in the ordinance meeting. These measurements are of a full size ford 2015 F350 Pick-up, 4 door cab, with an 8 foot bed). This appears to be the passenger vehicle on the road)

(b) The following is the fee schedule for towing services: CLASS 1 Tow Charge $ Police impound (towing of car to police impound facilities) $ Road service charge* $ $ if vehicle cannot be repaired and is towed from roadway ONLY ONE ROAD CHARGE 10% Special recovery services $80.00 $ per Hour *If Road service requires fuel, cost of fuel is not to exceed pump price plus hour CLASS II Vehicles (1) Charge covers all actions necessary and related to towing $ Road Service Special recovery services : $150 $125 per

40 Mahwah Police Department Inter-Office Memo CLASS III Vehicles (2) Charge covers all actions necessary and related to towing $175. $ Road service for Class III vehicles: $85.00 Special recovery services $200 per hour. CLASS IV Vehicles Class IV vehicles and shall be inclusive of the use of heavy-duty under reach equipment (3) Charge covers all actions necessary and related to towing. : $ Road service for Class IV vehicles: $95.00 Special recovery services: $300 per hour. Special recovery services of Class II, III and IV vehicles shall be charged at the respective rates below. This charge shall only be used in situations deemed necessary, and a notation of fact should be noted on the official tower's bill. Said charge shall not apply to winching a vehicle onto a flatbed vehicle. (9) Special recovery services.

This charge shall only be used in situations deemed necessary, and a notation of fact should be noted on the official tower's bill. Said charge shall not apply to winching a vehicle on to a flatbed vehicle when the vehicle is on a travelled portion and or shoulder of a roadway ( Done to clean up and place tow fees into classifications to make it easier to determine what fees are associated with which tow class) Fees adjusted to what was spoken about at the meeting with fees. $ with admin fee included versus $ if Township decides to add it in addition to tow fee)\ (Clarification of winching again) Page 26 There shall be no storage charge for the first 24-hour period following towing of any vehicle to the tower s storage premises. Storage Facility Capacity Inside and/or outside building (secured) per 24- hour period is $40.00 D. The above portion of Section X(B) (NOT SURE WHAT THIS WAS?) above does not regulate towing or storage of Class II, III and IV vehicles. Such services shall be provided and referred by the official tower(s) at the following rates (Cleaned up and clarified first 24 hours no charge for towing)
