3 I. PROPOSED TARIFF CHANGES AND PROPOSAL FOR COMMERCIAL SUBMETERING IN HIGH-RISE BUILDINGS A. Proposed Tariff Changes In this exhibit, SCE submits updated tariffs which reflect the proposals in this filing. Accordingly, the following rate schedules, which are contained in Appendix A of this Exhibit, include language changes consistent with the discussion in SCE-04 (Updated) and with the proposal indicated in Section I.B, below. In addition to the items noted above, and consistent with SCE s Application for Approval of Demand Response Programs, Goals, and Budgets for ,0F0F1 SCE s Demand Response (DR) programs and dynamic tariffs were designed to encourage customers to select the single best program or tariff that is best suited to each particular customer s situation. Furthermore, the selected program or tariff provides capacity incentives based upon each program s incentive structure. Accordingly, if SCE allowed customers to participate in multiple programs or tariffs (dual participation) without adjustments, customers could receive excess capacity benefits for the same load reduction. For example, if a customer was allowed to participate in both SDP and CPP, then they would receive (1) the SDP credits during the summer months (which were calculated based on the avoided capacity costs), and (2) the CPP credits during non-cpp events which were calculated as an offset to the high CPP charges that the customer will be attempting to avoid (which was also based on avoided capacity costs). Thus, this situation would result in duplicative customer incentives. To mitigate this situation, SCE can either limit dual participation or reduce the incentive credits so that the total incentives are equal to the capacity costs provided by the two programs in concert with 1 See A , p

5 each other. Given the administrative and billing system costs associated with reducing the incentives for the multiple combinations of DR programs and dynamic tariffs, SCE has adopted a guiding principle of encouraging customers to participate in one program or tariff and limiting opportunities for dual participation. The following tariffs have been revised to reflect this principle: Schedules GS-APS, GS- APS-E, RTP-2, TOU-BIP, TOU-GS-3, TOU-8, CBP, CPP, and DBP. In some cases, this principle may be balanced against those programs with strong existing dual participation. Accordingly, given the current participation requirements and potential negative consequences of eliminating all possibilities of dual participation, in selected situations, SCE has decided to allow dual participation in selected situations and to reevaluate all the participation requirements in F1F2 The details of SCE s dual participation rules are illustrated in Figures I-1 and I-2 below. 2 For example, participation in BIP (one of SCE s most significant demand response programs) currently allows for simultaneous participation on the DBP (part of the proposed Energy Options Program). 3

Other rate schedules are included in Appendix A to reflect the proposed rates contained within Exhibit SCE 4 (Updated). B. Proposed Commercial Submetering High Rise Buildings SCE proposes to modify Rule 1 Definitions, and Rule 18 Supply to Separate Premises and Use By Others, to allow submetering by master-metered customers of non-domestic tenants in high rise buildings. Submetered tenants will be subject to rates and charges no greater than those billed the master-metered customer for service supplied by SCE. 1. Background Pursuant to provisions of Rule 16, Service Extensions, Section B.3, for revenue billing, SCE s standard practice is to require a single meter for each tenant or enterprise operating in a nonresidential building or group of buildings or other development on a single Premises.2F2F3 Exceptions to this rule include: where required or allowed under SCE s tariffs; at the option of SCE for its operating convenience and consistent with its engineering design; when required by law or local ordinance; or when additional services are granted.3f3f4 Additionally, Rule 16, Section B.3.b allows for an alternative metering arrangement, as determined by SCE and as specified in Rule 18, Section B. SCE s policy is to individually meter all end-use customers unless there is a need for SCE to utilize one of the exceptions, or use alternative metering arrangements. An example of the alternative metering arrangement, relevant to the change proposed here, is that of a high rise building serving multiple nondomestic tenants (enterprises) where, consistent with SCE s engineering design or for SCE s convenience, service to the building is provided through a single retail meter, also referred to 3 As defined in Rule 1, Definitions. 4 Rule 16, Section B.2. 6

9 as a master meter. In this instance, the building owner (or the entity responsible for the single meter) is an end-use customer of SCE for electric service who provides power to tenants through the building s electrical distribution system. The SCE-metered customer, in this case, is referred to as the master-metered customer. Restrictions on the master-metered customer in such instances are provided under Rule 18. Rule 18, Supply to Separate Premises and Use By Others, Section B, provides that: Nonresidential Loads. In accordance with Rule 16, electric service shall be individually metered to each tenant in a non-residential building or group of buildings or other development on a single Premises with multiple tenants or enterprises. However, where, in the opinion of SCE, it is impractical to meter each tenant individually or where the Commission has authorized SCE to supply electric service through a single meter, SCE may provide service through a single meter subject to the provisions of Sections E and G below. Sections E and G essentially prohibit the metering and resale4f4f5 of the electricity provided by SCE to the master-metered customer (e.g., the building owner) to non-domestic5f5f6 (commercial) tenants, except where the charge for electric service is absorbed in the rental for the Premises or space occupied, is not separately identified, and does not vary with electrical usage. In other words, under existing rules, a building owner may pass on the cost of electricity to tenants through rent, but may not meter and bill the individual tenants for the electricity they actually use. 2. Recent Commission Action on Commercial Submetering On September 6, 2007, the California Public Utilities Commission (Commission) issued Decision (D.) in Application (A.) , Pacific Gas and Electric Company s (PG&E) 2007 General Rate Case (GRC) Phase 2 application to revise marginal costs, revenue allocation and rate design. Among other things, D adopted a settlement agreement on Commercial Building Master Meter Issues (PG&E Settlement) which would allow submetering and billing of tenants by building owners with an existing master meter.6f6f7 In approving the PG&E Settlement, the Commission added requirements of both PG&E and BOMA for customer communication and the study of 5 Rule 18 does allow resale where the energy is purchased at rates specifically applicable to resale service. 6 Rule 18 provides specific provisions relevant to domestic service which are not relevant here. 7 PG&E filed Advice 3115-E-A on December 27, 2007 to modify Rule 1 and Rule 18 pursuant to D

10 commercial submetering in PG&E s next GRC. Parties to the PG&E Settlement agreed that it is in the public interest that commercial building tenants receive price signals and have the opportunity to participate in dynamic pricing and energy conservation programs. Commercial submetering creates new options for the allocation of commercial building electricity costs and provides tenants with price signals and incentives for managing their electricity consumption and reducing costs, and offers the potential for eliminating the inequities among tenants that are inherent in square footage-based electricity cost allocation schemes. On February 28, 2008, the Commission adopted an all-party settlement in Phase 2 of San Diego Gas & Electric Company s (SDG&E) 2008 GRC which included a commercial submetering provision and was, in the Commission s words, substantially similar to what was adopted for PG&E in D F7F8 In its decision adopting the SDG&E settlement (D ), the Commission noted that the question of inconsistency with past Commission decisions prohibiting commercial submetering was no longer applicable. 3. SCE s Proposed Commercial Submetering Proposal SCE proposes to revise Rule 18, consistent with the settlements in PG&E s and SDG&E s GRCs and the rule changes approved for PG&E, to permit the submetering and billing of non-domestic tenants in high rise buildings by a master-metered customer. Rule 1, Definitions, is also revised to include a definition of the term high rise building. SCE is proposing no changes to the provisions of Rule 16 and Rule 18 governing the conditions under which a master meter is actually allowed. SCE s stated policy of individually metering end-use customers whenever possible is entirely consistent and supportive of the Commission s desire, as represented in D and D , of providing price signals and demand response programs to retail end-use customers. The revised Rule 18 would simply extend to non-domestic tenants in high rise buildings with master metering the same opportunities. 8 D at p

11 1 Under SCE s proposal, Rule 1, Definitions, would be revised to include the following 2 language: High Rise Building: A multi-story, multi-tenant building located on a single Premises generally comprised of three or more stories and equipped with elevators. Rule 18, Supply to Separate Premises and Use by Others, Section E.2, would be revised 6 as follows: E. Use by Others. A customer shall not charge for electricity received from SCE and used by another person, except: 2. Where the charge to domestic or nondomestic tenants is absorbed in the rental for the Premises or space occupied, is not separately identified, and does not vary with electrical usage, or where all of the following conditions are met for nondomestic service: a. Service is supplied to a single meter (master meter) located in a high rise building which is owned and managed by a single entity on a single Premises. b. The master-metered customer installs, owns and maintains electric submeters on its building s existing distribution system subject to all applicable safety rules, regulations, and general orders established by the State of California and its subdivisions and local governments and their subdivisions. c. The rates and charges billed by the master-metered customer to the nondomestic tenants for the electricity provided by SCE to the master-metered customer and used by such tenants will be the same as the rates and charges billed by SCE under the CPUC approved rate schedule servicing the mastermetered customer. d. Violation of any of these conditions shall result in either SCE s refusal to provide service in accordance with Rule 11.G., or the discontinuance of billing for metered usage of nondomestic tenants by the master-metered customer. Charges for electricity to nondomestic tenants shall thereafter be absorbed in the rental for the Premises or space occupied, and shall not be separately identified, nor vary with electrical usage. In such cases, where a customer subsequently converts to and receives service under an applicable submetering rate schedule or a master-metered customer provides submetering and billing to nondomestic tenants in a high rise building, tenant rental charges shall be reduced for the duration of the lease to reflect removal of the related energy charges. 4. Additional Requirements of SCE and BOMA in Implementing the Commercial Submetering Proposal In approving the PG&E / BOMA settlement authorizing commercial submetering, the Commission established requirements for both the utility and master-metered customer. SCE proposes 9

12 that these requirements be incorporated with this proposal. The basic motivation for allowing commercial submetering is to provide building tenants dynamic price signals and information about their individual energy usage and cost, and to give tenants the opportunity to participate in energy conservation and load management programs for managing and reducing their energy costs. D set forth rules governing the buildings that qualify for submetering, information that building owners must provide to tenants, the capabilities of meters that are installed, and the cost allocations that are permitted. These rules are summarized below: Authorization to submeter and bill tenants according to measured usage applies only under the following conditions in accordance with the revised Rule 18: Where service is supplied to a high rise building which is owned or managed by a single entity on a single premises (SCE s Rule 1 High Rise Building: A multistory, multi-tenant building located on single premises usually comprised of three or more stories and equipped with elevators); and Where a master-meter customer (building owner) installs, owns, and maintains electric submeters on its existing building s distribution system for cost allocation of dynamic pricing and/or conservation incentive purposes the cost of electricity allocated to the commercial building tenants will be billed at the same rate as the master meter billed by SCE under the CPUC approved rate schedule servicing the master meter. Tenant submetering and billing will be optional, subject to mutual agreement between owners and tenants and specified in leases. All attachments and devices on the customer's side of the master meter used to measure tenant electricity use for the purposes of billing and taking advantage of dynamic pricing and energy conservation opportunities shall conform to all applicable safety rules, regulations, and general orders established by state and local governments. Specifically, submeters must be installed and tested in accordance with 10

13 the Code of Regulations and have the capability to provide the same revenue quality billing measurements as the master meter serving the building. Building owners installing submeters should provide all tenants with the following information: The SCE rate schedule serving the master meter; The contact information for SCE; The contact information for the California Department of Food and Agriculture, Division of Measurement Standards meter complaint process; Notification that tenant controlled energy charges will be removed from rent when submetering commences; and Information concerning dynamic pricing options and all energy conservation and load management programs available for submetered tenant participation. Building owners installing submeters will be allowed to recover the costs of metering, billing, and information services, according to terms jointly agreed to by tenants and owners and specified in leases. The costs for such services will be optional for tenants and vary by the effort required to provide the services, and the features of the services elected by the tenant (e.g. real time tracking and monitoring of usage, warning systems, etc.). Tenant electricity bills should resemble SCE bills and include the following information: Tenant metered energy (kwh) and demand (kw) and associated charges by TOU period in the same level of detail as shown on SCE s bill to the building owner. Tenant allocations of customer charges plus energy and demand charges for common area usage, and other consumption exclusive of tenant measured usage. Such tenant allocations should be in accordance with allocation methods specified in leases (such as square footage of occupied space) and can not be based on tenant measured usage. 11

14 Charges for submetering, billing and information services. Sufficient information to permit tenants to replicate bill calculations. Tenant disputes regarding meter and billing accuracy should first be brought to the attention of the building owner. If a tenant is not satisfied with the response, and the issue is regarding meter accuracy, the tenant can contact the County Sealer of Weights and Measures and arrange for a meter test. If the issue has to do with billing accuracy, the tenant can contact SCE, and SCE will explain to the tenant how it bills the master meter customer. Building owners installing submeters are urged to support reporting requirements to provide the California Public Utilities Commission with information necessary for evaluating the effects of changing Rule 18 to allow submetering. For SCE s next Phase 2 GRC, SCE and BOMA will conduct a statistically significant survey regarding commercial building master metering experience to date. 12

For the above rate components, the summer season shall commence at 12:00 a.m. on June 1, and continue until 12:00 a.m. on October 1 of each year. The winter season shall commence at 12:00 a.m. on October 1 of each year and continue until 12:00 a.m. of June 1 of the following year. PTR Period: 2:00 p.m. to 6:00 p.m. during PTR events, non-holiday weekdays. Holidays are New Year's Day (January 1), Washington's Birthday (third Monday in February), Memorial Day (last Monday in May), Independence Day (July 4), Labor Day (first Monday in September), Veterans Day (November 11), Thanksgiving Day (fourth Thursday in November), and Christmas (December 25). 2. Multi-Family Residence: Apartments, mobilehomes, mobilehomes in a mobilehome park, condominiums, townhouses or a building of multiple occupancy which shares common walls and/or floors and ceilings with other residential dwelling units. 4. Peak Time Rebate: PTR is designed to provide incentives to eligible customers who contribute a measurable amount of reduced energy consumption during high energy usage time periods of 2:00 p.m. through 6:00 p.m. on non-holiday weekdays. PTR is an event-based program which provides compensation in the form of bill credits on the monthly bill to customers who reduce kwhs below their Customer Specific Reference Level (CSRL) during PTR Events. a. PTR Events: SCE may, at its discretion, call a PTR Event during nonholiday weekdays any time of the year. Peak Time Rebate: c. Notification of a PTR Event: One day prior to a PTR Event, customers will be notified of the event through multiple channels including Programmable Communicating Thermostat, call center greetings, CalTrans billboards, optional voice and text messages, as well as, mass media and public service announcements over local broadcast stations and other possible advertising. d. Customer Specific Reference Level (CSRL): The CSRL or the peak average usage level is the customer s average kwh usage during the 2:00 p.m. to 6:00 p.m. time period of the three (3) highest kwh usage days of the five (5) non-event, non-holiday weedays immediately preceding the PTR Event. The CSRL is used to determine the customers kwh reduction for each PTR Event in order to apply the PTR rebate. When calculating the CSRL, the three highest usage days during the 2:00 p.m. to 6:00 p.m. time period will be extracted from the five (5) prior non-event, non-holiday weekdays. Usage from 2:00 p.m. to 6:00 p.m. on these three days will be summed for each day then averaged to produce the CSRL. e. Calculation of Rebates: Rebates will be calculated based on the customer s calculated kwh reduction during a PTR Event using the customer s CSRL. (1) A rebate, in the form of a credit, will be applied to the customer s bill equal to $0.75 per kwh multiplied by the positive difference, if any, between the CSRL and metered usage during the PTR Event. (2) For customers who have a SCE authorized enabling technology, currently limited to a Programmable Communicating Thermostat, installed at their home which ensures automatic reduction of kwhs during PTR Events, the credit will equal $1.50 per kwh multiplied by the positive difference, if any between the CSRL and metered usage during the PTR Event. f. Emergency Removal from PTR Enabling Technology Activation: When a customer s household develops a serious medical condition which requires air conditioning and such condition is substantiated by a medical provider, under SCE s discretion, activation of the customer s enabling technology for air conditioning will cease. For customers not eligible for service under Schedule NEM, Net Energy Metering, and where customer-owned electrical generating facilities are used to meet a part or all of the customer's electrical requirements, service shall be provided concurrently under the terms and conditions of Schedule S and this Schedule. Parallel operation of such generating facilities with SCE s electrical system is permitted. A generation interconnection agreement is required for such operation. A-8

Customer-Owned Electrical Generating Facilities: b. For customers with a generation interconnection agreement that provides for the netting of generation and load, the charges for all retail rate components for such parallel generation customers shall be based only on the customer s net kwh consumption, without regard to the customer s choice of electricity provider, and shall be determined using kwh of Net Energy as defined and set forth below: (1) Net Energy: Net Energy is E S minus E F where E S is energy supplied by SCE and E F is energy generated by the customer and fed back into SCE's system at such times as customer generation exceeds customer requirements. Only if Net Energy is positive shall Net Energy charges be applied at the rates specified above. If the calculation of Net Energy yields a negative result, all such negative Net Energy shall be considered Net Energy transmitted and shall be treated as stated in Section (2), below. The components of Net Energy, E S and E F shall be separately recorded unless SCE and customer agree that energy fed back, E F, is negligible or zero, and so specify by waiver in the generation interconnection agreement. (2) Net Energy Transmitted: Net Energy transmitted occurs when the cumulative value of E F exceeds the cumulative value of E S during an entire billing period and is the amount by which the energy generated by the customer and fed back into SCE s system exceeds the energy supplied by SCE over an entire billing period. Such Net Energy transmitted will be purchased by SCE at a rate for payment equal to SCE s applicable standard offer energy payment rate filed with the Commission. A new rate for payment shall be effective for Net Energy transmitted on and after the effective date of each such filing. (3) Billing: Payment by SCE to the customer for Net Energy transmitted shall be included as a component of the customer's bill for service rendered under this tariff. c. Customer-owned electrical generating facilities used solely for auxiliary, emergency, or standby purposes (auxiliary/emergency generating facilities) to serve the customer s load during a period when SCE s service is unavailable and when such load is isolated from the service of SCE are not subject to Schedule S. However, upon approval by SCE, momentary parallel operation may be permitted to allow the customer to test the auxiliary/emergency generating facilities. Billing Calculation: A customer s bill is calculated according to the rates and conditions above. Except for the Energy Charge, the charges listed in the Rates section are calculated by multiplying the Total Delivery Service rates and the Generation rates, when applicable, by the billing determinants (e.g., per kilowatt [kw], kilowatthour [kwh], etc.), The Energy Charge, however, is determined by multiplying the total kwhs by the Total Delivery Service per kwh rates to calculate the Delivery Service amount of the Charge. To calculate the Generation amount, SCE determines what portion of the total kwhs is supplied by the Utility Retained Generation (URG) and the Department of Water Resources (DWR). The kwhs supplied by the URG are multiplied by the URG per kwh rates and the kwhs supplied by the DWR are multiplied by the DWR per kwh rate and the two products are summed to arrive at the Generation amount. The Energy Charge is the sum of the Delivery Service amount and the Generation amount. For each billing period, SCE determines the portion of total kwhs supplied by SCE s URG and by the DWR. This determination is made by averaging the daily percentages of energy supplied to SCE s Bundled Service Customers by SCE s URG and by the DWR. a. Bundled Service Customers receive Delivery Service from SCE and receive supply (Gen) service from both SCE s URG and the DWR. The customer s bill is the sum of the charges for Delivery Service and Gen determined, as described in this Special Condition, and subject to applicable discounts or adjustments provided under SCE s tariff schedules. b. Direct Access Customers receive Delivery Service from SCE and purchase energy from an Energy Service Provider. The customer s bill is the sum of the charges for Delivery Service determined as described in this Special Condition except that the DWRBC rate component is subtracted from the Total Delivery Service rates before the billing determinants are multiplied by such resulting Total rates; plus the applicable charges as shown in Schedule DA-CRS and subject to applicable discounts or adjustments provided under SCE s tariff schedules.
