1 Memorandum To: County Judge Veronica Escobar, Commissioner Anna Perez, Commissioner Sergio Lewis, Commissioner Willie Gandara, and Commissioner Daniel Haggerty From: Parks and Land Management Date: October 11, 2011 Re: Approve and Authorize Lease/Purchase with Yamaha for Golf Carts for Action Item Approve and authorize the Buy Board option for the lease/purchase of 100 electric golf cars from the Yamaha Golf-Car Company and authorize staff to accept the offer and move forward with the financing options to formalize this acquisition. Fiscal Impact The Buy Board option is $63 per car over 48 months with a onetime trade-in payment for 64 cars at $35,750. Background Information The Court authorized various investments into its. The Court funded these investments in order to increase course revenue. The final upgrade to the course is the replacement of its fleet of golf carts. Staff explored this need over the past two years. During budget hearings, staff recommended the lease of the fleet rather than a direct purchase of the cars. The current fleet has deteriorated. It is impracticable to try to replace the fleet in an incremental manner. That practice has not worked in prior years. 1

2 October 13, 2011 In July 2011, the Court authorized staff to explore Buy Board for this lease/purchase arrangement. During budget hearings, the Court authorized staff to proceed with this acquisition in the new fiscal year. Staff proposed a series of fee increases projected to generate approximately $45,000 per year in additional revenue. Staff recommends acceptance of the trade in offer with a onetime payment of $35,750 for 64 of the Club Car DS cars in the Golf Course fleet. This pays for the first year s lease and gives the Golf Course time to evaluate additional revenue sources from lessons, increased golf car utilization, and additional revenue from green fees. The Purchasing Department received proposals from Club Car, Yamaha, and EZ Go through Buy Board. After carefully evaluating all the proposals and payment options, staff selected the Yamaha Proposal as offering the County the best value under the lease/purchase scenario. Approval of this action allows staff to accept this proposal and to move forward to set up the appropriate financing option. 2

At this time, Yamaha District Sales Manager David Stewart has all 64 Club Car DS Cars presold to dealers. These 64 Club Car DS Cars are made up of (50) Fifty, 2004 Cars and (14) Fourteen, 2001 Cars. The total sale amount for these cars is $35, ($ per car). Yamaha Golf Car Company will either present a check to the County of El Paso / for the trades or the County of El Paso / may use this amount towards the lease of the new fleet of (100) One Hundred, 2012 Yamaha Drive Electric Cars. The lease terms have been outlined within the financing options on the following page.

This agreement constitutes the entire agreement between the parties specified above and supersedes any previous agreements between the parties whether oral or in writing. 8 Yamaha Standard Factory Warranty 2012 Yamaha Drive Golf Car Warranty Yamaha Golf Car Company herby warrants that any new 2012 Yamaha Drive electric or gas golf car purchased from an authorized Yamaha Golf Car dealer in the United States will be free from defects in material and workmanship for FOUR (4) YEARS from the date of purchase, subject to the stated limitations DURING THE PERIOD OF WARRANTY, any authorized Yamaha Golf Car Dealer will free of charge, repair or replace, at Yamaha s option, any part judged defect by Yamaha due to faulty workmanship or material from the factory. Parts used in warranty repairs will be warranted for the balance of the vehicle s warranty period. All parts replaced under warranty become property of Yamaha Golf Car Company. A copy of the complete warranty can be presented by or hard copy at golf courses request. GENERAL EXCLUSIONS, from this warranty shall include any failures caused by the following: I. Abnormal strain, neglect or abuse, including lack of proper maintenance and use contrary to the Owner s Manual Instructions. II. Accident or collision damage. III. Installation of parts or accessories that are not original equipment. IV. Fading, rust or deterioration due to exposure or ordinary wear and tear. V. Modifications or alterations that affect the cars condition, operation, performance, or durability, or which makes the car serve a purpose other than use as a two-person golf course vehicle. VI. Damage due to improper transportation. VII. Acts of God, i.e. lightening, hail damage, flooding, fire, etc. WARRANTY COVERAGE: Year 1: The first year of warranty shall cover the entire vehicle except for the Specific Exclusions below. Year 2: The second year exclusions are the YDRA battery, body parts, seats, mats, bumper assembly, bag carrier, scorecard holder, trim and the Specific Exclusions below. Year 3: The third year exclusions include the second year exclusions, plus the control cables and electrical system (except electronic speed controller, battery charger, and electric motor), and the Specific Exclusions below. Year 4: The fourth year of the warranty covers only the electric motor, speed controller, battery charger, and transaxle on the YDRE and the engine, clutch system (except drive belt), and the transaxle on the YDRA. SPECIFIC EXCLUSIONS: I. Any parts replaced due to normal wear or routine maintenance, including oil and air filter elements, tire wear, spark plugs, starter and clutch drive belts. II. Any charges incurred in transporting a golf car or charger to and from an authorized Yamaha Golf-Car Dealer for service or in performing field service are also excluded from this warranty. III. Gasoline powered golf car starting batteries on vehicles equipped with a golf course GPS device, or any other device with a high parasitic current draw, unless the vehicle is equipped with an optional factory installed deep cycle starting battery. I HAVE READ AND AGREE TO THE ABOVE CONDITIONS SET FORTH IN THIS WARRANTY: Initial Yamaha Four (4) ~ Year Limited Golf Car Battery Warranty Yamaha Golf Car Company hereby warrants to the original Retail Purchaser of lessee or a Yamaha YDRE Golf Car, PTV or electric utility vehicle from an Authorized Yamaha Dealer, that the Trojan Batteries charged with a Yamaha Battery Charger will be free for defects in material and workmanship, and will provide a 36-hole performance for a period of four (4) years, 1000 rounds or 20,000 amp hours discharged from date of purchase, whichever events occurs first, subject to the terms and conditions of the complete warranty within the warranty. At the time of delivery, Yamaha Golf- Car will take possession of the (50) Fifty, 2004 Club Car DS Cars and the (14) Fourteen, 2001 Club Car DS Cars. Yamaha Golf Car Company is very excited to be working hand in hand with our new dealers, K.N. Enterprises located in Las Cruces and Albuquerque. K.N. Enterprises will be responsible for warranty and repair work to your new fleet of Yamaha Golf Cars. If you have not had the pleasure of working with K.N. Enterprises in the past, I have no doubt that you will find the owner Kipp Nall and his service team to be a huge asset to your facility. During delivery of the new fleet of Yamaha Golf Cars, Yamaha District Sales Manager, David Stewart will be present to answer any questions for the staff regarding the golf cars. Yamaha Golf Car Company will provide all labor for new car set up which will include tops and all accessories for all fleet cars. It is the responsibility of the County of El Paso / to provide the proper insurance for the new fleet of 2012 Yamaha Drive Golf Cars.
