1 This document is a quarterly monitoring report regarding the use of police stop and search powers in the Leicestershire Constabulary area under Section 1 Police and Criminal Evidence Act 1984, Section 23 Misuse of Drugs Act 1971 and Section 47 of the Firearms Act The monitoring report covers the period 1 October 2011 to 31 December The report also contains data for the first three quarters of 2011 as well as cumulative data for quarters one, two, three and of It is the fourth in a series of quarterly monitoring reports that are required in accordance with an agreement made between Leicestershire Constabulary and the Equalities and Human Rights Commission pursuant to Section 23 of the Equality Act The agreement between the parties commenced on 14 th April 2011 and is due for review in September This report will be shared with the Equalities and Human Rights Commission, Leicestershire Police Authority, the Stop Search Reference Group and the Police Advisory Group on Race and Equality (PAGRE). The report will be disseminated to other key stakeholders inside and outside the organisation. 2 Actions to be taken by Leicestershire Constabulary 1. To specify in writing in a policy statement the criteria that are to be used in all cases by all officers of Leicestershire Constabulary in exercising S and S powers that conform precisely to an up- to- date Police and Criminal Evidence Act 1984 Code of Practice A This policy is made clear in all communications to staff and is explored in detail during stop search training which is being rolled out to all front line staff, managers, supervisors and intelligence staff. The Stop Search Reference Group has provided some guidance as to the contents of a force policy and procedure and is considering policy options. This process has been delayed due to recent changes made to process and practice. A Force Policy on Stop and Search has now been written. It has been shared with the Stop Search Reference Group for comment and will be debated at the Gold Group meeting on 17/7. 2. To include in such a policy the adoption of a specific formal aim of reducing race disproportionately in the use of stop and search Reducing race disproportionality will be included as a formal aim within the revised force policy on stop search and in the interim is an aim that is monitored by the force s Executive Group. This aim is also included in the terms of reference of the Stop Search Reference Group, which the force supports. 3. To set and work towards achieving the following targets:- The number of searches per 1000 Black people for every search per 1000 White people should not exceed 3.1 These aims have been agreed with Leicestershire Constabulary and are being measured in accordance with the terms of this agreement. The number of searches per 1000 Asian people for every search per 1000 White people should not exceed 1.0 These are to be measured by self-defined ethnicity using stop and searches of persons under stop and search powers. The calculation will exclude those who self define their ethnicity as: White and Black Caribbean White and Black African White and Asian The population data to be used is the 2011 Census, or if these are not available the Population Estimates by Ethnic Group as published by the Office for National Statistics

3 4. To designate an ACPO rank officer to be responsible for the force seeking to achieve the target agreed or set in accordance with point 3 above. Assistant Chief Constable Steph Morgan is the nominated ACPO officer responsible for the force seeking to achieve the targets agreed in point 3 above. 5. To monitor every three months the use of S and S powers within the area of Leicestershire Constabulary, subject to any changes in legislation designed to reduce bureaucracy, and to analyse the product of that monitoring by:- Reasons given for each such use, Reference to the specific location, The time of day, The gender and ethnicity of the officer using the power, The gender and ethnicity of the person who is stopped or whose vehicle is stopped, What was found, Whether any arrest followed as a direct result of the use of S and S power, and (if so) the class of criminal activity to which the arrest related, Comparison with the gender and ethnicity of the persons arrested (without use of such powers) in the same area over the same period, and Identifying all and any disproportionality in the use of the S and S powers over such period, and taking reasonable steps to identify the causes of such disproportionally. 6. To record centrally all complaints (within the meaning of section 12 of the Police Reform Act 2002,) about the use of such S and S powers whether made orally or in writing or by electronic means and to follow up on such complaints by identifying whether sufficient and reasonable grounds existed for the use of the power. Any complaint where racial discrimination is alleged, suggested or apparent on a preliminary review conducted by an Inspector will be formally investigated with a view to identifying whether racial discrimination was a factor. Monitoring is in place and quarterly analysis commenced for the period 1 January 2011 to 31 March See pages 6-8 for data tables relating the period Q1-1 January 2012 to 31 March Following a meeting with Phil Pavey, EHRC it has been agreed to provide aggregate data on a cumulative basis to build 4 quarters of data so the aforementioned tables now includes cumulative data for Q1, Q2, Q3 and Q4 of 2011 and Q 1 of All complaints (within the meaning of Section 12 of the Police Reform Act 2002) about the use of stop and search powers, whether made orally, in writing or by electronic means are centrally recorded. An improved scanning process has been introduced to ensure that all complaints which relate directly or indirectly to stop search are captured and categorised correctly. A full review of all complaints from 2009 and 2010 has been completed to verify previous statistics. In the reporting period of 1 October 2011 to 31 March complaint has been recorded by the Force in relation to Stop Search. 7. To address any case in which a person or vehicle has been stopped and searched where it is not entirely clear that the stop and search was in accordance with the S and S powers and the PACE Code A. The importance of the role of supervisors checking stop search forms is being highlighted in stop search training currently being delivered to frontline officers including supervisors. A supervisor must check stop search forms for completeness and sufficiency of grounds. If the supervisor is not satisfied with the stop search form or the grounds they are responsible for clarifying this with the officer concerned and making a record of any supervisory action taken. This process now takes place electronically and this has sped up the process and provides a more auditable trail for each stop search record

4 The details of every stop and search form are centrally inputted onto a database, the grounds are reproduced verbatim and a copy of every form can be viewed within the Force database. A revised management information and performance framework is being designed to provide detailed information and the ability to map stop search activity against crime and anti-social behaviour. There are associated costs and time restrictions on these developments. The Force has now commissioned DMU to undertake research into Leicestershire s stop search activity. A report is due by the end of this year. 8. To discuss with a representative group of stakeholders a published report of the outcome of the monitoring and analysis referred to at point 5 and to record their views on the impact of the use of S and S powers on the local community. Detailed stop search data is shared with the Stop Search Reference Group at its monthly meetings. The Stop Search Reference Group consists of individuals directly or indirectly affected by stop search. Members include race equality specialists, a Police Authority member and members of the public. The group is independently chaired and Phil Pavey from the EHRC attended its meeting on 21 st February Phil Pavey is due to attend the Gold Group on 17/7. 9. To discuss the outcome of the monitoring and analysis referred to at point 5 and the consultation referred to at point 8 within the ACPO command group in the force and with a nominated officer of the Commission. Ongoing monitoring and discussion of stop search data and related issues takes place on a monthly basis at the monthly Stop Search Gold Group and at Executive Group. 10. To undertake an equality impact assessment on the use of the S and S powers within one month of the publication of each alternate quarterly report. 11. To forbid all officers from indicating either formally or informally any quantitative target for, or expectation as to, the number of uses of the S and S powers by any other officer or officers in any period of time; to include this in the force policy and to communicate the instruction force-wide. This assessment was completed in April This has been communicated clearly by ACC Morgan in an intranet message published on 13 th January 2011 as previously submitted. The message has been viewed nearly 4000 times. The strapline It s the quality not quantity of stop searches that counts, contained in the message has been used in a number of other communications. This message is reinforced by stop search training and will be included in the revised stop search policy. Work to identify (and remove) any mechanisms that may indicate quantitative measurements of stop searches have been successful. An ongoing internal communications plan continues to reinforce quality over quantity. This includes repeated intranet messages and briefings to response officers and is reinforced on stop search training sessions. 12. To undertake a training programme for relevant officers on the proper use of its S and S powers in accordance with PACE Code A and the impact on good The Force has undertaken an extensive consultation and learning needs analysis in formulating its stop search training. Officers attend a 2 day - 4 -

5 race relations and equality of opportunity on the abuse of the power, in accordance with best practice and guidance from ACPO, the NPIA and the Home Office. The Chief Constable and the Commission will use reasonable endeavours to agree the content of the training which shall be determined by the Chief Constable in the absence of such agreement. Timescale: Training to be completed by the end of September 2011 search course which includes the 2 hour stop search element. This includes a video introduction from the Chief Constable. A comprehensive audit trail of course development, feedback from the pilot course and subsequent feedback is available. All officers within the Force have now been trained. The only ongoing training is for new recruits. It is hoped that DMU will provide addition, objective evaluation of the effectiveness of stop search training. The Force is looking at the need for further training in the medium term but will make a decision after the DMU evaluation. Actions not to be taken by Leicestershire Constabulary 13 Using previous proven criminal conduct alone as a factor in determining whether or not to use S and S powers 14 Requiring formally or informally any officer to conform to an expectation or individual target as to the overall number of uses of S and S powers These issues are specifically mentioned in the policy and explored within the training programme. To date no information has emerged to suggest these actions have been taken. 15 Permitting officers in any way to use S and S powers merely to seek to obtain intelligence. 16 Any use in any context by any officer of the number of occasions on which another officer has used S and S powers as an indicator of the performance of that officer for purposes such as recommendations for commendations, annual performance review or similar. 17 The fabrication of any ground for the use of S and S powers - 5 -

6 EHRC Quarterly Update EHRC Quarterly Update 1 Reasons for stop search Table 1-1 below shows that for the most recent quarter, stop/searches carried out by Leicestershire Constabulary are primarily for drugs (54.1%), followed by stolen property (29.0%). This is in keeping with previous quarters; however the total number of searches has fallen by 26%. Black disproportionality is highest for offensive weapons at 9.2. It is also high for going equipped for criminal damage (7.9). Asian disproportionality is comparatively low across all reasons but the highest disproportionality ratio is 3.8 for drugs. 7 2 Reference to the specific locations The tables below demonstrate that the disproportionality ratio varies greatly across LPU s. Table 2-1 shows that the ratio for black people ranges from 0.0 (Rutland LPU) to 22.8 (Blaby LPU). For Asian people, the ratio ranges from 0.0 (Melton & Rutland LPU s) to 35.0 (Oadby & Wigston LPU). 9 Table 3-1 shows that two-thirds of stop/searches (66.2%) are carried out during the night time hours, although the proportion varies across LPU s. The Counties BCU stop/search a slightly higher proportion of people at night than the City BCU. This is similar to previous quarter s data. 10 4 Category of items found This data is not available at present 5 The gender & ethnicity of officer using the power Data from table 5-1 shows that female officers carried out a higher proportion of stop/searches on black & Asian people than male colleagues. This also leads to higher disproportionality ratios, although the black/white disproportionality ratio is lower than the previous quarter.
