= Direction = Vehicle =Vehicle = Pedestrian On Monday, July 3, 07 at approximately 846 hours, Newton units responded to the intersection of Washington Street and Lowell Avenue for a motor vehicle accident involving a 04 red Nissan Versa (MA: JH86) and a 04 white BMW RADV (MA: Y456). One of the parties involved sustained potential serious injuries. I was asked to respond to the scene and further investigate this accident. I arrived on scene with Captain Anastasia and Sgt. Babcock of the Newton Police Traffic Bureau. Sgt. Healy along with other Newton units secured the scene prior to our arrival. Lowell Avenue was closed from Washington Street to Foster Street (both directions). The Westbound lane of Washington Street closest to Lowell Avenue was closed from 889 Washington Street to 9 Washington Street. The weather at the time of my arrival was clear and the road surface was dry. It was still daylight out at the time of my arrival. I observed a red Nissan Versa parked in the middle of Lowell Avenue at Washington Street with heavy front end damage. I was informed by the officers on scene that the vehicle had not been moved since the operator brought it to a stop immediately after the accident. There was contact damage in the area of the front right bumper, fender, and hood. The vehicles bumper had been removed from the roadway by the Newton Fire Department prior to my arrival and stored in the back seat of the vehicle. I performed a field test of the vehicles directionals, headlights, steering, and brake system. They all appeared to be in proper working order. The registration for the vehicle is active. The vehicles position was marked in the roadway. = Direction = Vehicle =Vehicle = Pedestrian along the inside lane curbing at Lowell Avenue. The motorcycle had moderate damage to the left rear area caused by the impact with MV. The motorcycle also had damage from an apparent skid on its right side after it fell to the roadway. I was informed by the officers on scene that the motorcycle had not been moved from its final rest location. There was debris surrounding the motorcycle on the roadway and roadside, including its license plate and rear storage compartment. The motorcycles position on the roadway was marked. As part of the investigation, measurements were taken at the accident scene by myself and Sgt. Babcock. MV (Nissan sedan) collided with MV (BMW motorcycle) in the intersection of Washington Street and Lowell Avenue. MV travelled 78ft inch on Washington Street (Westbound) from the original point of impact before a secondary collision with a fixed street light pole. The distance for MV from the point of impact to final rest is 79ft in. I observed skid marks (front and rear tire) and fresh scrapes in the roadway from MV. As a result of the MV crashing into the fixed light pole, the impact caused the operator to become separated from MV. The operator impacted the fixed pedestrian signal on the light pole and travelled 33ft 5in until he came to a final rest on Washington Street (Westbound) along the curb area of a crosswalk. Both vehicles were removed from the roadway by Todys towing. Pictures of both vehicles, along with pictures from the scene were taken and submitted to the IT Bureau. Prior to my arrival, the seriously injured party that was operating the motorcycle was transported to Brigham and Womens Hospital in Boston. He was identified as Rick Valdez (DOB: //966). It was reported by other Officers on scene that as a result of the accident Valez was in and out of consciousness and had a potential head injury. Officer J. March responded to the hospital to check on the well-being of Mr. Valdez. Officer J. March also retrieved the helmet and jacket Mr. Valdez was wearing at the time of the accident as possible evidence. The following items were placed in Support Services for safekeeping for Mr. Valdez: () black motorcycle helmet, () Scorpion Exo jacket, () black bag, () lap top, and misc. paperwork. Ms. Wang stated around 845 hours, she was leaving work at Aroma Day Nail Salon located at 899 Washington Street, Newton. Ms. Wang was operating a 04 red Nissan Versa (MA: JH86) as she excited the parking lot area next to the nail salon. Ms. Wang had three co-workers in the vehicle at this time: Anna Huang (DOB: 0/7/985), Niki Huang (DOB: 6//997), and Jolia Chen (5/5/99). Ms. Wang stated she took a right out of parking lot and entered the left travel lane on Washington Street heading Westbound. Ms. Wang stated as she was traveling Westbound, she heard the GPS in her vehicle tell her to take a right hand turn onto Lowell Avenue (Northbound). Ms. Wang stated she activated her right directional, looked to her right for traffic in the right lane, and did not see any vehicles. = Direction = Vehicle =Vehicle = Pedestrian Lowell Avenue, a motorcycle appeared on her right in the lane next to her. Ms. Wang stated she was unable to avoid hitting the motorcycle. The front passenger bumper/fender area of her vehicle crashed into the rear left side of the motorcycle. Ms. Wang stated after the collision she brought the vehicle to a stop on Lowell Avenue. No injuries were reported by any of the occupants of MV on scene. There was no air bag deployment in the vehicle and Ms. Wang stated she was wearing a seatbelt at the time of the accident. On Wednesday, July 05, 07, I spoke with Mr. Valdez as he was picking up his stored property in Support Services. Mr. Valdez stated he didnt remember much from the accident. Mr. Valdez stated he was operating MV Westbound on Washington Street. As Mr. Valdez approached the intersection of Washington Street and Lowell Street, he stated he saw a flash out of his peripheral on his left side. Mr. Valdez stated he has numerous injuries including a neck sprain, concussion, bruised shoulder, injured ribs, and other bruises/minor injuries. On Wednesday, July 5, 07 I spoke with Patricia Ruta. Ms. Rutas information was given to me by Officer J. March as a potential witness to the accident. Ms. Ruta states she was dropping someone off on Lowell Avenue near a building down from the intersection. Ms. Ruta stated she heard the accident and by the time she looked over the only thing she saw was a party flying through the air (this party would be the operator of MV). Ms. Ruta stated she did not approach the accident scene. After my investigation, it is determined that Ms. Qian Wang is responsible for the accident. Mr. Valdez had the right of way while he was traveling on Washington Street (W) when Ms. Wang entered his travel lane. Ms. Wang was mailed Massachusetts Uniform Citation R8438 for City Ordinance 9-75 (Failure to Use Care While Turning).
