4 Division 1 Interpretation Definitions 1.01 In Division 2, unless the context otherwise requires: "bus lane" means a section of laned roadway that is reserved for the exclusive use of buses by the placement of traffic control devices; "structure" means (a) the Nelson Bridge, being that structure which spans the West Arm of Kootenay Lake at Nelson; (b) the Okanagan Lake Bridge, being that structure which spans the Okanagan Lake at Kelowna; (c) the Agassiz-Rosedale Bridge, being that structure which spans the Fraser River Between Agassiz and Rosedale; (d) the Pattullo Bridge, being that structure which spans the Fraser River and connects the City of New Westminster with the Municipality of Surrey; (e) the First Narrows Bridge, being that structure which spans Burrard Inlet at its first narrows and connects the City of Vancouver with the Municipality of West Vancouver and the District of North Vancouver; (f) the Ironworkers Memorial Second Narrows Bridge, being that structure which spans Burrard Inlet at its second narrows and connects the City of Vancouver with the District of North Vancouver; (g) the Oak Street Bridge, being that structure which spans the North Arm of the Fraser River and connects the City of Vancouver with the Municipality of Richmond; (h) the Knight Street Bridge, being that structure which spans the North Arm of the Fraser River in the vicinity of Mitchell Island and connects the City of Vancouver with the Municipality of Richmond; (i) the Port Mann Bridge, being that structure which spans the Fraser River and connects the Municipality of Coquitlam with the Municipality of Surrey; (j) both tubes of the George Massey Tunnel, being that structure which passes under the South Arm of the Fraser River and connects the Municipality of Richmond with the Municipality of Delta; (k) the Annacis Bridge, being that structure which spans the main channel of the Fraser River in the vicinity of Annacis Island in the Municipality of Delta; (l) the East Channel Bridge, being that structure which spans the Annacis Channel of the Fraser River and connects the Municipality of Delta with the City of New Westminster and the Municipality of Richmond; (m) the Queensborough Bridge, being that structure which spans the North Arm of the Fraser River in the City of New Westminster; (n) both tubes of the Cassiar Connector Tunnel, being that structure which passes underground from Adanac Street to Triumph Street and connects the Trans Canada Highway from First Avenue to the Ironworkers Memorial Second Narrows Bridge in the City of Vancouver. 6 -- Sections of Division 2 -- All structures: restrictions 2.01 Concerning all structures: (a) Obedience to traffic control devices. The driver of a vehicle upon or within a structure shall obey the instructions of an applicable traffic control device, except when otherwise directed by a peace officer or authorized member of the Ministry of Transportation and Highways. (b) Production of licence or permit. The driver of a vehicle upon or within a structure shall, upon request by a peace officer or by an authorized member of the Ministry of Transportation and Highways, produce any licence or permit issued under the Motor Vehicle Act or the Commercial Transport Act, and shall allow the same to be taken in hand by the authorized person for the purpose of inspection. (c) U turns. No person shall make a U turn, or otherwise reverse the direction in which a vehicle is proceeding, while driving or operating a vehicle upon or within a structure, unless otherwise directed by a peace officer or by an authorized member of the Ministry of Transportation and Highways. (d) Parking. (i) No person shall stop, stand or park a vehicle upon or within a structure except when it is necessary to comply with a traffic control device or with the direction of a peace officer or authorized member of the Ministry of Transportation and Highways. (ii) In the event of a breakdown or other disablement of a vehicle upon or within a structure, any peace officer or duly authorized member of the Ministry of Transportation and Highways may arrange for the necessary towing of the vehicle, or the supply of gasoline, or such other assistance as may be necessary; and all charges in such connection shall be paid for by the driver or operator when it is removed from the structure. (iii) In the event of a vehicle being unlawfully stopped, parked or left standing upon or within a structure, any peace officer or duly authorized member of the Ministry of Transportation and Highways may remove or cause the said vehicle to be removed, whether attended or unattended, from the place where it is found, and all charges and costs in connection with such removal or the storage of the vehicle shall be paid by the owner or operator of the vehicle before it is returned to the owner or operator. (e) Size and weight limitations. The driver of an oversize and (or) overweight vehicle, operated by virtue of a special permit issued by the Minister of Transportation and Highways, may be permitted to proceed upon or within a structure only at specified hours and upon certain days of the week, subject to the approval of the Ministry of Transportation and Highways, or may be directed to another route, where an alternate route exists, by a peace officer or by an authorized member of the Ministry of Transportation and Highways. (f) Slow moving vehicles. When approaching a structure, the driver of a slow moving vehicle which would impede the normal and reasonable movement of traffic upon or within the structure shall, when directed by a peace officer or by an authorized member of the Ministry of Transportation and Highways, drive the Page 6 of 25

7 (g) vehicle to a designated parking area, and shall not proceed until so directed by an authorized person. Prohibited traffic. No person shall operate or cause any of the following to be upon or within a structure, except by virtue of a special permit issued by the Minister of Transportation and Highways: (i) animals which are being led, ridden or driven, and vehicles drawn by animals; (ii) push carts, wheelbarrows or similar devices; (iii) vehicles or loads which, in the opinion of an authorized member of the Ministry of Transportation and Highways, would endanger persons or property or render the use of a structure unsafe. [am. B.C.Reg. l4/78.] Farm vehicles, bicycles and pedestrians 2.02 Concerning the Port Mann Bridge, the George Massey Tunnel and the Cassiar Connector Tunnel: (a) Prohibited vehicles. Except by virtue of a special permit issued by the Minister of Transportation and Highways, no person shall operate a farm implement or farm machine, whether self-propelled or towed, or any vehicle incapable of maintaining a speed of 60 km/h upon or within a structure. (b) Bicycles. No person shall operate a bicycle upon or within any part of a structure. (c) Pedestrians. Pedestrians shall not be permitted upon or within any part of a structure. [am. B.C.Regs. 14/78; 27/92.] Slow vehicles and bicycles 2.03 Concerning the Ironworkers Memorial Second Narrows, Oak Street, Knight Street, Okanagan Lake, Annacis, East Channel, Queensborough and Pattullo bridges: (a) Prohibited vehicles. No person shall operate a vehicle during the hours of 7 a.m. to 9 a.m. and 3 p.m. to 6 p.m., Monday to Friday, inclusive, which is unable to maintain the normal speed of traffic upon the structure or its approaches, except vehicles engaged in emergency maintenance work. (b) Bicycles. No person shall operate a bicycle upon or within that part of a structure intended for use by motorized vehicular traffic. [am. B.C.Regs. 325/75; 105/86; 210/94; 290/96.] Explosives 2.04 Concerning the First Narrows, Ironworkers Memorial Second Narrows, Oak Street, Knight Street, Queensborough, Port Mann and Pattullo bridges: Explosives. No person driving a vehicle which is transporting explosives of a quantity requiring an Explosives Transportation Permit shall enter upon or within or attempt to cross over or through a structure without first having obtained a police or Ministry of Transportation and Highways escort. [am. B.C.Regs. 325/75; 105/86; 290/96.] Explosives, flammables and corrosives 2.05 Concerning the Agassiz-Rosedale, Okanagan Lake, Nelson, Pattullo, First Narrows, Ironworkers Memorial Second Narrows, Oak Street, Knight Street, Queensborough and Page 7 of 25

8 Port Mann bridges: Explosives and flammable or corrosive commodities. Any person driving a vehicle which is transporting a load or part load of any commodity listed in (i), (ii), (iii) and (iv) below; or a vehicle transporting empty tanks which have contained any of the commodities listed in (i) below that have not been thoroughly cleaned with steam or filled with water, may be required to proceed upon or within a structure only during specified hours and upon certain days of the week; such hours and days to be designated by the Ministry of Transportation and Highways and notification given by the erection of suitable signs on the structure approaches: (i) gasoline, distillate or kerosene in tanks, drums, barrels or cans; (ii) oxygen, acetylene or butane; (iii) fuel oil, road oil, hot road mix, lubricating oil or grease, solid or liquid asphaltum; (iv) explosives or corrosive liquids. 9 -- Sections of Division 2 -- Pedestrians 2.06 Concerning the Agassiz-Rosedale, Okanagan Lake, Nelson, Pattullo, First Narrows, Ironworkers Memorial Second Narrows, Knight Street, Annacis, East Channel, Queensborough and Oak Street bridges: Pedestrians. (i) No pedestrian shall use the roadway, but shall proceed upon the sidewalk where one is provided for that purpose. (ii) No pedestrian shall loiter upon or within the structure. (iii) No pedestrian shall climb upon or enter upon or within any part of the structure not intended for use by pedestrians. [am. B.C.Regs. 325/75; 105/86; 290/96.] Parking 2.07 Concerning the First Narrows, Ironworkers Memorial Second Narrows, Oak Street, Knight Street, Queensborough, Port Mann and Pattullo bridges, the George Massey Tunnel and the Cassiar Connector Tunnel: Parking. No person shall stop, stand or park a vehicle upon or within a structure for the purpose of replacing a flat tire. [am. B.C.Regs. 325/75; 105/86; 27/92; 290/96.] Prohibited vehicles, bicycles and tire chains 2.08 Concerning the First Narrows Bridge: (a) Prohibited vehicles. No person shall operate a vehicle having a gross weight in excess of kg, except buses, upon the structure or its approaches after September 30, (b) Bicycles. No person shall operate a bicycle upon that part of the structure or its approaches intended for use by motorized vehicular traffic. (c) Tire chains. No person shall operate a vehicle equipped with a tire chain or chains upon any part of the structure or its approaches. [en. B.C.Reg. 325/75; am. B.C.Regs. 790/75; 14/78.] Emergency vehicles 2.09 Emergency vehicles. Notwithstanding any traffic control devices in place, marked emergency vehicles as defined in the Motor Vehicle Act may enter, use and leave a bus lane without the necessity of sounding sirens or displaying flashing lights. 12 -- Sections of Division 3 -- Definitions and abbreviations 3.01 Definitions and abbreviations: "combustible liquid" any liquid which gives off a flammable vapour at a temperature above 26 C, and at or below 65 C; "containers" drums, barrels, cylinders or other shipping containers (other than tank vehicles) used to transport explosives or other dangerous articles; "dangerous articles" explosives, compressed gases, flammable or corrosive commodities, poisonous materials; "flash point" the lowest temperature at which a liquid gives off a flammable vapour; "gross weight" the total weight of containers and contents; "N.O.S." not otherwise specified; "net weight" the weight of the contents of packages or containers; "shipping paper" a way bill, bill of lading or invoice; "tank vehicle" any tank motor vehicle with cargo tank or portable tank used to transport liquids or gases. [am. B.C.Reg. 14/78.] Quantity limitations 3.02 Quantity limitations: (a) Transportation of dangerous articles shall be in accordance with the schedule and specified subsections indicated therein. When more than one subsection is indicated, each shall apply unless one section obviously takes precedence over another. (b) When 2 or more dangerous articles are transported on or in the same vehicle at the same time, their combined weight or quantity shall not exceed the maximum allowed for the article having the highest weight or quantity limitation. (c) Where volume (litres) is known, it shall take precedence over gross weight in limiting quantity per vehicle. [am. B.C.Reg. 14/78.] Permits 3.03 Permits: Notwithstanding any of the provisions of these regulations, the Minister of Transportation and Highways may issue a written permit for the transportation of otherwise prohibited dangerous articles in specified amounts and under specified conditions and time of night through the George Massey Tunnel and the Cassiar Connector Tunnel. 13 Acids loading limitations and restrictions 3.04 Loading limitations and restrictions for acids: When acids or other corrosive liquids and flammable solids or oxidizing materials are transported in the same vehicle at the same time, neither material may be loaded above or adjacent to the other. Combustible liquids 3.05 Combustible liquids: (a) Combustible liquids with flash point at or below 35 C shall be transported in containers of not more than 205 litres capacity. Transport of containers having capacity in excess of 205 litres shall be governed by regulations for tank trucks as given below. (i) No tank truck, whether empty or loaded, shall enter the tunnel if that vehicle is used to carry a combustible liquid with flash point at or below 35 C or any substance thinned with such a combustible solvent. (b) Combustible liquids with flash point above 35 C may be carried in tank trucks, provided that accompanying shipping papers state that the flash point is above 35 C. [am. B.C.Reg. 14/78.] Compressed gases 3.06 Compressed gases: (a) No vehicle shall enter the tunnel if its load includes any compressed gas referenced to this subsection in the Schedule. (i) Empty containers which last contained a compressed gas referenced to this subsection in the Schedule shall not be carried through the tunnel. (ii) No empty tank vehicle shall enter the tunnel if that vehicle is used to carry compressed gases referenced to this subsection. (b) Compressed gases referenced to this subsection in the Schedule may be transported in lots of 45 kg gross weight per vehicle, provided that gross container weight does not exceed 4.5 kg. (i) Empty containers which last contained a compressed gas referenced to this subsection in the Schedule shall not be transported through the tunnel when the above quantity limitations are exceeded. (ii) No empty tank vehicle shall enter the tunnel if that vehicle is used to carry any compressed gas referenced to this subsection. (c) Compressed gases referenced to this subsection in the Schedule and used as fuel for vehicle accessories may be transported in lots of 45 kg gross weight per vehicle, provided that gross container weight does not exceed 22 kg. (i) Empty containers which last held a compressed gas referenced to this subsection in the Schedule may be transported through the tunnel only when the above quantity limitations are not exceeded and when all valves on containers are securely closed. (d) Transport of compressed gases referenced to this subsection in the Schedule is not restricted, regardless of quantity or size of containers, except that no tank vehicle whether empty or loaded shall enter the tunnel if that vehicle is used to carry any compressed gas referenced to this subsection in the Schedule. 14 Corrosive liquids 3.07 Corrosive liquids: (a) Corrosive liquids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 225 litres of 450 kg gross weight, provided that containers have a capacity not exceeding 70 litres. (i) There are no restrictions on empty tank vehicles or empty containers last used to carry liquids referenced to this subsection in the Schedule, provided that accompanying shipping papers show them to be empty (residue less than 70 litres). (b) Corrosive liquids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 450 litres or 900 kg gross weight, provided that containers have a capacity not exceeding 70 litres. (i) There are no restrictions on empty tank vehicles or empty containers referenced to this subsection in the Schedule, provided that accompanying shipping papers declare them to be empty (residue less than 70 litres). (c) Corrosive liquids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of kg gross weight, regardless of size of container, or kg net weight in a tank vehicle. 15 -- Sections of Division 3 -- Explosives 3.08 Explosives: No vehicle shall enter the tunnel if its load includes any explosive devices or materials, except as follows: (a) small arms ammunition; not in excess of 4.5 kg gross weight; (b) blasting caps or igniters; not more than 100 caps; (c) common fireworks or firecrackers; not exceeding 45 kg gross weight per vehicle. B.C.Reg. 14/78.] Flammable liquids 3.09 Flammable liquids: (a) Flammable liquids referenced to this subsection in the Schedule may be transported in quantities up to 385 litres or 450 kg gross weight per vehicle, provided that they are in glass or earthenware containers of 4.5 litres capacity or less, or in metal containers of 23 litres capacity or less. (b) Flammable liquids referenced to this subsection in the Schedule may be transported in quantities up to 770 litres or 900 kg gross weight per vehicle, provided they are in glass or earthenware containers of 4.5 litres capacity or less, or in metal containers of 23 litres capacity or less. (c) Flammable liquids referenced to this subsection in the Schedule must be transported in glass or earthenware containers of 4.5 litres capacity or less, or in metal containers of 23 litres capacity or less. (i) Such liquids are restricted to a maximum quantity per vehicle of 385 litres or 450 kg gross weight if the flash point is not known or is 6 C or less. (ii) When accompanying shipping papers state that the flash point is above 6 C the maximum quantity allowed per vehicle is 770 litres or 900 kg gross weight. (d) Flammable liquids referenced to this subsection in the Schedule may be transported in quantities up to kg gross weight per vehicle, provided that they are in glass or earthenware containers of 0.6 litres capacity or less, or in metal containers of 1.2 litres capacity or less. (e) Notwithstanding subsections 3.09 (a), (b), (c), and (d), no tank vehicle, whether empty or loaded, used to transport any flammable liquid or substance thinned with a flammable liquid, shall enter the tunnel. (i) There are no restrictions on transport of empty containers which last held a flammable liquid, provided that accompanying shipping papers state that they are drained and securely closed. (f) Flammable liquids referenced to this subsection in the Schedule and having a flash point above 26 C may be transported through the tunnel in containers of capacity 205 litres or less, providing accompanying shipping papers state that the flash point is above 26 C. (i) Flammable liquids referenced to this subsection in the Schedule and having a flash point above 35 C may be transported through the tunnel in containers of more than 205 litre capacity or in tank trucks, provided that accompanying shipping papers state that the flash point is above 35 C. 16 (ii) Flammable liquids when transported through the tunnel must be at least 3 C below their flash point temperature. [am. B.C.Reg. 14/78.] Flammable solids 3.10 Flammable solids: (a) Flammable solids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 450 kg gross weight, provided that they are in containers of capacity not greater than 16 kg. (b) Flammable solids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 900 kg gross weight, provided that they are in containers of capacity not exceeding 16 kg. B.C.Reg. 14/78.] Oxidizing materials 3.11 Oxidizing materials: (a) Oxidizing materials referenced to this subsection in the Schedule are restricted to a maximum quantity of 450 kg gross weight per vehicle, provided that they are in containers of capacity not exceeding 16 kg. (b) Oxidizing materials referenced to this subsection in the Schedule are restricted to a maximum quantity of 900 kg gross weight per vehicle, provided that they are in containers of capacity not exceeding 16kg. (c) Oxidizing materials referenced to this subsection in the Schedule are not restricted, regardless of quantity or size of containers. [am. B.C.Reg. 14/78.] Poisonous articles 3.12 Poisonous articles: (a) No vehicle shall enter the tunnel if its load includes any poisonous gas or liquid referenced to this subsection in the Schedule. Empty containers which last contained a poisonous gas or liquid referenced to this subsection in the Schedule shall not be transported through the tunnel. (b) Poisonous liquids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 225 litres or 385 kg gross weight, regardless of size of container. (i) There are no restrictions on the transport of empty containers which last contained a poisonous liquid referenced to this subsection in the Schedule, provided that accompanying shipping papers declare them to be empty. (ii) Empty tank vehicles which last contained a poisonous liquid referenced to this subsection in the Schedule are not restricted, provided that accompanying shipping papers show them to be empty (residue not exceeding 225 litres). (c) Poisonous solids referenced to this subsection in the Schedule are restricted to a maximum quantity per vehicle of 900 kg gross weight, provided that they are in containers of not more than 11 kg gross weight. 17 3.13 Miscellaneous: (a) Liquids referenced to this subsection in the Schedule are restricted to a maximum quantity of 205 litres per vehicle. (b) A tank vehicle used to transport a liquid referenced to this subsection in the Schedule shall not enter the tunnel. (c) An empty tank vehicle which last contained a liquid referenced to this subsection in the Schedule is not restricted, provided that accompanying shipping papers show it to be empty (residue not exceeding 205 litres). 25 Division 4 Setback and Sight Clearance Regulations Restriction on building placement 4.01 No person, being the owner, occupier or lessee of any land, shall without the consent of the minister, place or permit to be placed any building within a distance of 4.5 m from the property line fronting on any arterial highway within a municipality or on any highway in unorganized territory except that where a public lane or alley provides secondary access to the property the distance is reduced to 3 m. B.C.Reg. 15/78.] Sight triangle 4.02 Sight triangle means the area formed by a triangle in the angle formed by the right of way boundaries or boundaries produced and 2 points on those boundaries 6 m from the point of intersection, as shown cross hatched in the diagram following: [en. B.C.Reg. 15/78.] Restriction on placement of plants and fences 4.03 No person, being the owner, occupier or lessee of any land at the intersection of an arterial highway in a municipality or any highway in unorganized territory, and any other highway, shall, without the consent of the minister, place or permit to be placed or grow any tree, shrub, plant, fence or other structure with horizontal dimension exceeding 0.6 m within the sight triangle above an elevation such that an eye 0.9 m above the surface elevation of one highway cannot see an object 0.9 m above the surface elevation of the other highway. B.C.Reg. 15/78.] Removal of offending articles 4.04 Upon being satisfied by information on oath made before him that any building, fence or other structure with horizontal dimension exceeding 0.6 m has been placed or erected, or is in the course of being placed or erected, or that any shrub or tree has been placed or allowed to grow, in contravention of this regulation, any Provincial Judge may issue his warrant under his hand for the removal of such building, fence, other structure with horizontal dimension exceeding 0.6 m, shrub or tree, and may entrust the execution of such warrant to any peace officer or other person; and the person causing or permitting the offence aforesaid shall, on summary conviction, be liable to pay, in addition to any other penalty imposed by the Act, all the costs and expenses incurred in and about the removal of the cause of the offence. Any process issued under this section shall be deemed to have been effectively served upon the owner and lessee of the land upon which the offending building, fence, other structure, shrub or tree is located if the same is posted upon the said building, fence, other structure, shrub or tree.
