78 Bridgestoe Americas Tire Operatios, LLC Off Road Tire Limited Warraty - effective: jauary 1, 2012 LIMITED WARRANTY The followig warraty cotais certai rights ad obligatios that pertai to Bridgestoe ad Firestoe braded off-the-road (OTR) tires. Please review these rights ad obligatios carefully. DEFINITION This Limited Warraty covers all Bridgestoe ad Firestoe braded OTR tires as desigated i Bridgestoe ad Firestoe OTR product listigs (price books ad catalogs). It does ot iclude, amog others, agricultural tires, aircraft, light costructio tires, or tires marked NA (ot adjustable). ELIGIBILITY Every OTR tire bearig the ame Bridgestoe or Firestoe ad with a complete serial umber molded i the sidewall is warrated to be free from maufacturig defects withi the maufacturer s cotrol. If a examiatio by a authorized Bridgestoe or Firestoe OTR represetative shows that ay such tire failed as a result of maufacturig defects, it will, at the optio of Bridgestoe Americas Tire Operatios (BATO), either be repaired at o charge, or a credit will be issued toward the purchase price of a replacemet tire, beig a comparable Bridgestoe or Firestoe OTR product. This credit will be determied by applyig the lesser of the percetage of remaiig tread depth (RTD%) ad the maximum age based credit show i the followig chart. Customer is resposible for the disposal of all adjusted tires. This warraty coverage is for OTR tires used withi published desiged specificatios for Bridgestoe ad Firestoe tires. Ay use outside such specificatios automatically voids this warraty. Please cosult Bridgestoe or Firestoe data books, maiteace mauals, etc. for desig specificatios. This warraty does ot apply to used or NA (ot adjustable) tires. TIME PERIOD This warraty applies to Bridgestoe ad Firestoe brad OTR tires for a maximum period of five years (60 moths) from date of maufacture. The date of maufacture ca be determied by the secod ad third digits i the serial umber code. For o-serial cotrolled tires, the date of maufacture ca be determied from the productio lot code. LIMITATIONS This Limited Warraty is applicable to the origial purchaser ad is ot assigable to subsequet purchasers. No Bridgestoe or Firestoe dealer, aget, or represetative has the authority to make or imply ay represetatio, promise or agreemet which i ay way varies or exteds the terms of this warraty. Ay tire, o matter how well maufactured, may fail i service or become userviceable due to coditios beyod the cotrol of the maufacturer. This Limited Warraty is uder o circumstaces a represetatio that a tire failure caot occur. 48 moths 20% Maximum Credit 60 moths > 60 moths This limited warraty gives you specific rights ad you may also have other rights which may vary from jurisdictio to jurisdictio. To the extet that the provisios of ay applicable legislatio expressly replace, elimiate, amed or prohibit ay term or terms cotaied herei, such term or terms shall be accordigly replaced, elimiated, ameded or exteded, as the case may be, i accordace with such legislatio. LIMITED WARRANTY EXCLUSIONS - ALL OTR TIRES AND TUBES All OTR tire ad tube warraties are subject to the followig exclusios: 1. Tires purchased more tha 60 moths from the date of maufacture. 2. Tires for which alterative warraties or guaratees have bee egotiated. 3. Tire used uder chais. Damage resultig from misuse, improper moutig, misapplicatio, use of o-approved rims, improper iflatio, overloadig, ruig flat, misaligmet or imbalace of wheels/ rims, defective brakes or shock absorbers, abuse, willful damage, oil, chemical actio, fire or other exterally-geerated heat, use of studs, water or other material etrapped iside the tire, vehicle damage or road hazards (such as rock cuts, puctures, cut separatios, impacts, flex breaks). 5. Claims for irregular wear or rapid tread wearout are ot covered by this limited warraty. 6. Ay tire which is operated above its to-mile-per-hour (TMPH) or Toe-kilometer-per hour (TKPH) ratig. 7. Tires mouted with o-approved tubes or o-rigs. 8. Used, Repaired, or Retread tires. 9. Ay modificatios to the tire (added butress shoulders, regroovig, reluggig, etc.) void all warraties. 10. Ay material added to the tire (tire fill, sealer, balacer, etc.) is ot covered by this limited warraty ad will ot be compesated for i case of credit beig issued for the tire. 11. Use of a solid type fill (such as urethae) voids all warraties. 12. Ay costs associated with the repair of tires are ot covered uless previously approved by BATO. 13. Costs of moutig ad balacig followig pro-rated replacemet or repair of tires or tubes, ad applicable federal, state, provicial, ad local taxes, are ot covered uder this warraty. 14. Cost of disposal of warrated tires. Disposal of tires is the sole resposibility of the customer. 15. ALL OTHER WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED TO THE EXTENT PERMITTED BY LAW. 16.
