2 Notice Enforcement 4277, 2018 Page 2 of 36 THE CORPORATION OF THE CITY OF DAWSON CREEK BYLAW 4277, 2016 A of the Corporation of the City of Dawson Creek (hereinafter called The City ) to regulate the enforcement of Notices in the City. WHEREAS, the Local Government Notice Enforcement Act Chapter 60 [SBC2003] as amended from time to time empowers the City to, by bylaw, designate those bylaws for which bylaw notice enforcement may be used as means of bylaw enforcement; AND WHEREAS A bylaw is required to authorize the enforcement of bylaw notices in conjunction with Dawson Creek Notice Dispute Adjudication Registry; NOW THEREFORE the Municipal Council of The Corporation of the City of Dawson Creek in open meeting assembled enacts as follows: SECTION 1 - INTRODUCTION 1.1 This bylaw may be cited as Notice Enforcement 4277, SECTION 2 - DEFINITIONS 2.1 In this bylaw the following terms have the following meanings: Act means the Local Government Notice Enforcement Act. Enforcement Officer means a person or persons appointed from time to time by resolution of City Council pursuant to 36 of the Police Act, the purpose of which is to enforce regulatory bylaws of the municipality. City means The Corporation of the City of Dawson Creek. Registry means the Notice Adjudication Registry established pursuant to this. SECTION 3 - TERMS 3.1 The terms in this bylaw have the same meaning as the terms defined in the Act. SECTION 4 - BYLAW CONTRAVENTIONS 4.1 The bylaws and bylaw contraventions designated in Schedule B attached hereto and forming part of this bylaw, may be dealt with by bylaw notice. 4.2 The penalty for a contravention referred to in subsection 4.1 is as follows: a. The amount set out in Column A4 of Schedule B except when subsections 4.2.b or 4.2.c apply; b. The Early Payment set out in Column A5 of Schedule B if received by the City within 14 days of the person receiving or being presumed to have received the notice; or

3 Notice Enforcement 4277, 2018 Page 3 of 36 c. The Late Payment set out in Column A6 of Schedule B if received more than 31 days after the person received or is presumed to have received the Notice. SECTION 5 - OFFENCE AND PENALTY 5.1 The penalty for a contravention referred to in SECTION 4 - BYLAW CONTRAVENTIONS is referenced in Schedule B. SECTION 6 - PERIOD FOR PAYING A DISPUTED NOTICE 6.1 A person who receives a bylaw notice must, within 14 days of the date on which the person received or is presumed to have received the bylaw notice: a. pay the penalty, or b. request dispute adjudication, by filling in the appropriate portion of the bylaw notice indicating either a payment or a dispute and delivering it, either in person during regular office hours, or by mail, to the City. 6.2 A person may pay the indicated penalty after 30 days of receiving the notice, subject to the applicable surcharge for late payment in accordance with Subsection 4.2.b, but no person may dispute the notice after 14 days of receiving the bylaw notice. 6.3 Where a person was not served personally with a bylaw notice and advises the City, in accordance with the requirements of 25 of the Act, that they did not receive a copy of the original notice, the time limits for responding to a bylaw notice under SECTION 5 - OFFENCE AND PENALTY subsection 5.1 and SECTION 6 - PERIOD FOR PAYING A DISPUTED NOTICE subsection 6.2 of this do not begin to run until a copy of the bylaw notice is redelivered to them in accordance with the Act. SECTION 7 - BYLAW NOTICE DISPUTE ADJUDICATION REGISTRY 7.1 The Registry is established as a bylaw notice dispute adjudication system in accordance with the Act to resolve disputes in relation to bylaw notices. 7.2 The civic address of the Registry is the City of Dawson Creek A St Street, Dawson Creek, BC, V1G 3V Every person who is unsuccessful in a dispute adjudication in relation to a bylaw notice or a compliance agreement under the dispute adjudication system established under this section must pay the City an additional fee of $25 for the purpose of the City recovering the costs of the adjudication system. SECTION 8 - SCREENING OFFICERS 8.1 The position of screening officer is established. 8.2 The following are designated classes of persons that may be appointed as screening officers:

4 Notice Enforcement 4277, 2018 Page 4 of 36 a. Chief Officer; b. Development Services Manager; c. General Manager of Development Services; and d. Any person appointed to the position of Screening Officer by the General Manager of Development Services. Council may appoint Screening Officers from these classes of person by name of office or otherwise. SECTION 9 - POWERS, DUTIES AND FUNCTIONS OF SCREENING OFFICERS 9.1 The powers, duties and functions of screening officers are as set out in the Act, and include the following powers: a. Where requested by the person against whom a contravention is alleged, communicate information respecting the nature of the contravention, the provision of the bylaw contravened, the facts on which the contravention allegation is based, the penalty for a contravention, the opportunity to enter into a compliance agreement, the opportunity to proceed to the bylaw notice dispute adjudication system and the fee or fees payable in relation to the bylaw notice enforcement process; b. To communicate with any or all of the following for the purposes of performing their functions under this or the Act: (i) (ii) (iii) (iv) the person against whom a contravention is alleged or their representative; the officer issuing the notice; the complainant or their representative; the City s staff and records regarding the disputant s history of bylaw compliance. c. To prepare and enter into compliance agreements under the Act with persons who dispute bylaw notices, including to establish terms and conditions for compliance that the Screening Officer considers necessary or advisable, including time periods for payment of penalties and compliance with the ; d. To provide for payment of a reduced penalty if a compliance agreement is entered into, as provided in Schedule B ; and e. To cancel bylaw notices in accordance with the Act or City policies and guidelines. 9.2 The bylaw contraventions in relation to which a Screening Officer may enter into a compliance agreement are indicated in Schedule B. 9.3 The maximum duration of a compliance agreement is one year.

5 Notice Enforcement 4277, 2018 Page 5 of 36 SECTION 10 - BYLAW ENFORCEMENT OFFICERS 10.1 The persons who act in the job positions or titles listed in Column A3 of Schedule A to this are designated Enforcement Officers for the purpose of enforcing the bylaws listed in Column A2 of Schedule A opposite the respective job position. SECTION 11 - FORM OF BYLAW NOTICE 11.1 The City may from time to time provide for the form or forms of the bylaw notice, provided the bylaw notice complies with 4 of the Act. SECTION 12 - ADMINISTRATIVE 12.1 Schedule A and Schedule B is attached to this bylaw and forms a part of this bylaw If any provision of this bylaw is declared or held to be illegal, invalid, or ultra vires, in whole or in part, then the provision shall not apply and the remainder of this bylaw shall continue in full force and effect and be construed as if it had been enacted without the illegal, invalid, or ultra vires provision.
