For the purpose of this by-law the following works shall have the meaning given herein:

1 A BY-LAW OF THE CORPORKTION OF THE TOWN OF CARLETON PLACE FOR ESTABLISHING AND MAINTAINING A SYSTEM FOR THE COLLECTION, REMOVAL AND DISPOSAL OF GARBAGE AND OTHER REFUSE IN THE SAID MUNICIPALITY WHEREAS Section ll(2) of the Municipal Act, S.O authorizes a municipality to adopt a by-law for the collection of waste within the said municipality and; WHEREAS it is deemed expedient that rules and regulations be made for establishing and maintaining a system for the collection, removal and disposal of garbage and other refuse within the Town of Carleton Place in the County of Lanark; NOW THEREFORE the Council of the Corporation of the Town of Carleton Place enacts as follows: I. DEFINITIONS For the purpose of this by-law the following works shall have the meaning given herein: a) "Waste" means any material which is surplus, is no longer in use or is to be discarded. b) "Permitted Waste1' means anywaste which is permitted into the landfill site other than those materials defined as Uncollectable Waste. c) "Uncollectable Waste" means: (1) (ii) (iii) (iv) (v) (vi) (vii) (viii) (ix) 00 (xi) (xii) (xiii) (xiv) (xv) Articles which are not bundled; Articles larger than 100kg or 1.5m long; Large quantities of construction or manufacturing waste; Stones, earth, stumps, etc; Large quantities of dry wall; Yard waste; Household hazardous wastes; Iron, steel or other scrap metal; Tires; Carcass of any animal; Liquid Wastes; Medical Wastes; Night soil and animal waste; Any explosive or highly combustible material; and Any material which has become frozen to the container and cannot be removed by shaking. d) "Bundle of Waste" means any permitted waste securely tied into a bundle having dimensions of x 60cm x 60cm or less and weighing 15kg or less. e) "Large Quantities" means more than two bundles. 0 "Street" means any public road allowance or any private lane commonly used by the public. g) "Household" means a separate residential dwelling unit as identified on the tax roll. h) "Munlcipal Waste Collection Sticker" means a sticker similar to that shown in Schedule A of this by-law printed on self adhesive fluorescent stock.

2 2. STORAGE, DISPOSAL AND TRANSPORTATION OF WASTE a) No person shall store waste on a property outside of a building and/or a closed container. b) No person shall locate a waste container in a front yard of a property. C) No person shall locate a waste container on a property without adequate screening from public view. Screening may consist of vegetation and/or acceptable fencing. d) No person shall store waste on a property for a period of time exceeding 14 days. e) Contravention of Item 2a), 2b) 2c) and/or 2d) may be corrected by Town staff by the removal of the waste. The cost of the removal of the said waste shall be charged to the owner of the applicable property. f 1 Property owners are responsible for the proper disposal of all waste generated from their properties. Owners may utilize the Municipal Waste Collection System for disposal of their permitted waste. Alternatively, owners may make separate arrangements with a waste hauler for the disposal of their permitted waste. 9) i) No person shall convey through the streets within the Town limits, any waste except in properly covered containers or in vehicles totally enclosed or covered with canvas or tarpaulins, so fastened down around the edges as to prevent any of the contents falling upon the streets and to protect the same from flies and to control, as far as possible, the escape of any offensive odours therefrom. ii) Any person who fails to observe c(i) and consequently causes waste materials to fall upon any street shall pick up the same immediately; otherwise Town employees will pick up the material and the guilty party charged with the expense incurred in so doing. h) No person shall deposit waste of any kind on any street, public property or public place or on any privately owned property without the property owner's permission. 3. MLlNlClPAL WASTE COLLECTION SYSTEM a) The Town shall provide each household and each industrial, commercial or institutional establishment with one collection of waste weekly. b) All waste, to be collected by the municipal system, shall be placed as closely as possible to the edge of the street adjacent to the owner's property but not so as to imped or interfere with the flow of traffic or maintenance of the roadway. No waste will be collected from private property. All waste shall be placed out for collection prior to 7:00 a.m. on collection day but not prior to 6:00 p.m. on the day preceding collection day. All waste containers and any waste not collect by the municipal contractor shall be removed from the edge of the street by the owner prior to 11 :00 p.m. on collection day. c) Only permitted waste shall be placed at the roadside for collection. All permitted waste, to be collected by the municipal system, shall be appropriately tagged with municipal waste collection stickers similar to that shown in Schedule A. Stickers shall be prominently displayed on the exterior of the waste or on the top article of waste within a reusable container. There is no limit to the quantity of waste which may be placed for collection provided all waste is appropriately tagged with stickers.

3 d) All permitted waste must be securely tied into bundles or contained within a suitable container. Single large articles may be placed separately at the roadside for collection provided 2 stickers have been placed on each large article. e) The Town will provide 60 municipal waste collection stickers to the owner of each household beginning July IS', of each year. The Town will also provide 36 municipal waste collection stickers to each commercial establishment. New households or commercial establishments, created during the year, will be provided with a proportionate number of stickers. Additional stickers may be purchased from the Town Hall and selected commercial outlets for $2.00 each. Stickers are non-returnable and no refunds will be provided. f ) No owner shall be obligated to purchase stickers and utilize the municipal waste collection system provided suitable alternative waste disposal arrangements are in place. 4. UNCOLLECTIBLE WASTE a) Uncollectible waste shall not be placed at the roadside for collection by the municipal system. b) Uncollectible waste, if placed at the road side, shall not be collected by the Town even if a sticker is attached. c) The following options are available for disposal of Uncollectible waste: TOWN OF CARLETON PLACE UNCOLLECTIBLE WASTE Waste not collected can be disposed of as follows: 0 Articles not bundled 0 Articles larger than 15 kg or 1.5m long Cl Construction or Manufacturing Waste 0 Stones, Stumps, etc 0 Household Hazardous Wastes (paint, oil, chemicals, batteries, etc) 0 Yard Waste (Grass, Leaves, Brush, etc) 0 Iron or Steel 0 Tires 0 Carcass of any animal Contact Private Waste Disposal Contractor Deliver to Hazardous Waste Depot June to September at Compost Facility - Saturday mornings from 8:00 a.m. to noon Deliver to Compost Facility - Saturday mornings between 8:00 a.m. to noon - May through October Deliver to metal container May - October at Compost Facility November - April at Public Works Yard Deliver to landfill site Contact Veterinarian For further information contact the PUBLIC WORKS DEPARTMENT

ENFORCEMENT a) Any person who contravenes any of the provisions of this by-law and the procedures with respect thereto is guilty of an offence and the enforcement and the penalty imposed thereunder shall be subject to the provisions of the Provincial Offences Act R.S.O. 1990, Chapter P.53 and any amendments thereto, and the penalty for the commission of any such offences shall be as provided for in the said Provincial Offences Act. b) This by-law shall be enforced by the municipal By-law Enforcement Officer and/or by an Officer of the Carleton Place Detachment of the Ontario Provincial Police. Should any section, subsection, clause or provision of this by-law be declared, by a court of competent jurisdiction, to be invalid, the same shall not affect the validity of this by-law as a whole or any part thereof, other than the part so declared to be invalid. 7. REPEAL By-law No and amendments thereto are hereby repealed in their entirety. 8. SHORT TITLE This By-law shall be cited as the Waste Collection By-law.
