1 S T A T E O F M I C H I G A N BEFORE THE MICHIGAN PUBLIC SERVICE COMMISSION * * * * * In the matter, on the Commission s ) own motion, regarding the regulatory reviews, ) revisions, determinations, and/or approvals necessary ) Case No. U for the VILLAGE OF BARAGA to fully comply with ) Public Act 295 of ) ) At the March 29, 2018 meeting of the Michigan Public Service Commission in Lansing, Michigan. PRESENT: Hon. Sally A. Talberg, Chairman Hon. Norman J. Saari, Commissioner Hon. Rachael A. Eubanks, Commissioner ORDER Public Act 295 of 2008, as amended by Public Act 342 of 2016 (Act 342), MCL et seq. (Act 295), requires all providers of electric service in the state to establish renewable energy programs by filing renewable energy plans (REPs) with the Commission. On July 1, 2009, the Commission determined that the Village of Baraga s (Baraga) initial REP in Case No. U was in compliance with Act 295. Section 22(3) of Act 295 provides that within one year after the effective date of Act 342, the Commission shall review each electric provider s REP. This review occurs after an opportunity for public comment. On March 28, 2017, the Commission issued an order directing Baraga to file its application for a biennial REP review by November 30, 2017, in this docket.
2 On November 28, 2017, Baraga filed an application seeking review of its REP. The Commission Staff (Staff) reviewed the application and filed a letter in the docket indicating that the 2017 REP provided the information as suggested by the Commission s Filing Requirements and Instructions for REPs for Municipally-Owned Electric Utilities as set forth in the August 23, 2017 order in Case No. U The Staff also found that Baraga expects to meet the renewable energy standard through its wholesale power supplier, WPPI Energy, and the expected incremental cost of compliance to its customers will not exceed the retail rate impacts described in Section 45(2) of Act 295. To calculate the renewable energy credit requirement, Baraga will use the average of the previous three years of electricity sold to its retail customers. Further, the Commission provided an opportunity for public comments; no comments were received. On the basis of this review, the Staff recommends the Commission find Baraga s REP in compliance with Act 295. THEREFORE, IT IS ORDERED that: A. The renewable energy plan filed by the Village of Baraga is in compliance with the requirements of Public Act 295 of B. The Village of Baraga shall file an annual report with the Commission describing the status of compliance with the requirements of Public Act 295 of 2008 by June 30, 2018, and annually thereafter until further order of the Commission. 3 The Commission reserves jurisdiction and may issue further orders as necessary. Any party desiring to appeal this order must do so in the appropriate court within 30 days after issuance and notice of this order, pursuant to MCL To comply with the Michigan Rules of Court s requirement to notify the Commission of an appeal, appellants shall send required notices to both the Commission s Executive Secretary and to the Commission s Legal Counsel.
