1 CITY OF OVERLAND PARK, KANSAS RECREATION & PARKS SERVICES INSTRUCTIONS TO BIDDERS This bid is for a four (4) year lease and the company owns the equipment at the end of the lease. Bidders shall submit nomenclature and specifications of their equipment. There will be some equipment that includes a dollar buyout option at the lease end. Bidders agree to guarantee their equipment as 2019 production models and free from defects in workmanship and material for a four (4) year period from date of delivery to the City, and to replace or repair defective parts at no cost to the City. The equipment specifications shall not be construed as recommending any manufacturer's equipment over any other make provided that equal quality, parts supply and availability, reliability, and durability may be expected in performance. The City reserves the right to hold all bids for a period of sixty (60) days, from the date set for opening thereof before action thereon; likewise the City reserves the right to reject any or all proposals. The City also reserves the right to waive any or all technicalities. Bidders submitting proposals on equipment not conforming to the detailed specifications shall state variances on the proposal. The City of Overland Park, Kansas, reserves the right to accept or reject any and all bids submitted. The City reserves the right to waive technicalities on bids. All proposals shall be made on the forms provided with the specifications and shall be delivered to the City Clerk, City Hall, 8500 Santa Fe Drive, Overland Park, Kansas, and must be in sealed envelope marked: BID FOR: GOLF COURSE AND PARK TURF EQUIPMENT Prior to 2:00 p.m., Tuesday, February 12,

2 CITY OF OVERLAND PARK, KANSAS RECREATION & PARKS SERVICES EQUIPMENT SPECIFICATIONS GENERAL CONDITIONS : The General Conditions apply to all equipment specified herein. 1. All equipment shall be new, 2019 production models. 2. Appurtenances and/or accessories for the equipment not herein mentioned, but necessary to furnish a complete unit ready for use upon installation shall be included. 3. These specifications shall be construed as minimum. Should the manufacturer's current published data or specifications exceed these, they shall be considered minimum and furnished. 4. The City reserves the right to waive or take exception to these specifications, if it be to the City's greatest advantage or best interest. 5. The company providing the equipment shall maintain at least one well-integrated service shop for the maintenance and repair of the equipment, along with at least one location of service/repair parts inventory of such size, within the Metropolitan Kansas City Area, to keep the equipment out of service to a minimum. 6. Bidders must submit with their bid the latest printed specifications and advertising literature on the units they propose to furnish. 7. Bidder shall be prepared to give a complete demonstration of the merits of the equipment offered as directed by the City. The equipment so demonstrated shall be as complete as offered by the bidders for this bid. 8. Supplier hereby guarantees that for a period of four (4) years from the date of delivery, they will, at their own expense and without any cost to the City, replace all parts failures, perform maintenance schedules recommended by the equipment manufacturer, with the exception of daily maintenance to be performed by the Lessee, and make all repairs that may be required or are made necessary by for any reason, except for negligence of the Lessee. 9. All extra parts specified in lease should be considered City owned inventory. All extra parts that need to be purchased during the lease by the City should be given preferred or best possible cost to the City. 10. A copy of the lease agreement used to finance this package should be submitted from the Lessor. Bidder and its financer should be aware that, per City policy, the City will not accept a lease agreement requiring the City to indemnify another party. 11. Terms of this lease will begin on July 1, 2019 and end June 30,

18 CITY OF OVERLAND PARK, KANSAS RECREATION & PARKS SERVICES SERVICE AGREEMENT The City of Overland Park will be responsible for the following: Lubrication Daily setting of reel mowers and sharpening of rotary blades Monitoring of all fluid levels Keeping daily records Changing or replacing and repair of tires Notifying distributor of any problems Backlapping of reel mowers The Lessee will perform the following: It will be the responsibility of the distributor to cover all other maintenance that is not listed. distributor will be required to provide the following: In addition, the Required Submittals The distributor shall provide each location, for each piece of equipment, the following: Owner s Manual Maintenance Log Grease Chart Scheduled Visits The distributor will be required to visit each facility once a week to be scheduled with Supervisor. Distributor is required to be at the site within one half hour during times of aerification. 19

19 Call for Service When a service call is required, the Lessee will communicate to a single point of contact designated by the distributor. Within two hours of initial contact, the distributor is required to respond. A response can be by telephone, , text or on-site visit. From time of contact, the distributor has until close of the next business day (not including Saturday and Sunday) to make all necessary repairs. If repairs cannot meet the time schedule, the distributor must indicate when all repairs will be completed. At that time, the Lessee will determine whether a replacement is required and if so, it must be delivered by the end of the next business day. Service Plan Each bidder shall submit a detailed written description of how they propose to execute the required service agreement. It shall provide details on staffing levels, mobile equipment, etc. Grinding Two grindings shall be included, per year, per cutting unit, which includes relief grinding, at superintendent s discretion; 21 Tri-Plex Reels and 10 Fairway Mower Reels. Installation of s The distributor will install all mulch kits in the month of October. This will include all pieces of equipment that require a mulch kit, per equipment specifications. The distributor will disassemble all mulch kits during the month of March. The distributor is responsible for storing all kits at their location. Sprayers and Aerifiers The distributor will maintain the three Toro 5800 Sprayers and two Toro Pro Core 648 Aerators which the City already owns as part of the current lease agreement. Replacement parts will be charged to the City. Use of Shop Distributor to provide Safety Data Sheets for any hazardous material used or stored on site. All waste oil, antifreeze, etc. is to be hauled off by the distributor. Distributor to provide own tools for all maintenance and repairs. Any flammable material is to be stored in flammable room. On-site mechanic will be required to follow safe work practices and clean up work area before leaving. All fluids and grease shall be provided by the distributor. On site mechanic will need to comply with Hazardous Communications and City policies related to the workplace. (City will provide copies of appropriate policies.) Reasonable access will be provided for maintenance during business hours. Training Within the 1st 6 months, the distributor will provide one training session for each piece of equipment to be held at the Sykes/Lady Overland Park Turf Care Center. Distributor to provide one, bilingual training video for each model of equipment for each location. Distributor shall provide one set of service manuals and parts manuals for each piece of equipment located at each location. 20

25 CITY OF OVERLAND PARK, KANSAS RECREATION & PARKS SERVICES BID SUMMARY Each bidder shall submit a sample of their Lease Agreement clearly identifying any sections of the agreement that are non-negotiable. Bidder and its financer should be aware that, per City policy, the City will not accept a lease agreement requiring the City to indemnify another party. Each bidder shall submit a detailed written description of how they propose to execute the required service agreement. This bid is for a four (4) year lease and the company owns the equipment at the end of the lease. The equipment and accessories included in this proposal are 2019 production models, new and complete in every way. Delivery of the equipment, complete with accessories and parts, will be made on or before June 30, Lease will begin on July 1, 2019 and end June 30, Total bid shall include all federal, state, and local taxes and all transportation, dealer preparation, and handling charges.
