1 CITY OF CUPEIUINO PUBLIC WORKS DEPARTMENT Summary AGENDA ITEM 1 AGENDA DATE June SUBJECT AND ISSUE Adopt aresolution approving an agreement with Apple Inc for electronic waste disposal for FY and authorize the City Manager to renew the agreement for three 3 additional terms of one 1 year each on such terms as are mutually agreeable to the City and Apple Inc BACKGROUND On September the Council authorized the City Manager to execute a contract wherein the City and Apple Computer Inc partnered to provide an electronic waste disposal program for Cupertino residents at Apple s facility on Bubb Road Acceptable computers and associated equipment office equipment home entertainment electronics materials include all televisions and microwaves The facility is open Monday Wednesday and Friday from 8 00 am to 4 30 pm at no charge to residents and for the past three years an electronics drop been held on Earth Day weekend at the Apple headquarters facility offevent has Apple has invited Cupertino residents to these one special day events as well Apple vendors that only dispose of waste in an environmentally friendly manner Over the past 4 has hired years Apple has serviced Cupertino residents and collected over pounds of electronic waste Past participant survey results indicate a high level of customer satisfaction After completing the pilot program which ran from October 2002 through June the City Council approved an agreement with Apple for one year FY one year extensions which period concludes on June in addition to three This agreement continues electronics disposal services with Apple for the next fiscal year and provides for three one year extensions A new provision to the agreement would require the City to designate Apple as a Designated Approved Collector In this case the City would give Apple designated approved collector status which allows the collector to reduce some of the paperwork requirements previously required by the California Integrated Waste Management Board Specifically providing the names and addresses of unnamed drop offs was problematic as the information was not available The change in the legislation was intended to assist local jurisdictions and ease the burden of certain requirements Cupertino is entitled to name more than one designated approved collector should the need ever arise Printed on Recycled Paper

2 FISCAL IMPACT There is no fiscal impact since Apple is no longer charging the City for their services The California Integrated Waste Management Board adopted regulations to implement portions of the Electronic Waste Recycling Act of 2003 This landmark legislation established a funding system for the collection and recycling of certain electronic wastes A key element of the Act that affects e waste collectors and recyclers is the availability of recovery and recycling payments to approved participants for certain collection and recycling activities Since Apple has been certified as collector in this program they receive some funds for their program from the California Integrated Waste Management Board RECOMMENDATION Staff recommends that the City Council adopt Resolution No 07 Il approving the agreement with Apple Inc for electronic waste disposal for FY and authorize the City Manager to renew the agreement for three 3 additional terms of one 1 year each on such terms as are mutually agreeable to the City and Apple Inc Submitted by l73ud Director ofpublic Works J Approved David W Knapp City Manager for submission 2

3 DRAFT RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE EXECUTION OF THE AGREEMENT FOR AN ELECTRONIC WASTE PROGRAM WITH APPLE INC FOR THE DISPOSAL OF CONSUMER ELECTRONIC PRODUCTS AND COMPUTERS E WASTE WHEREAS the California Environmental Protection Agency has determined that cathode ray tubes are hazardous waste due to levels of lead and it is unsafe to dispose of them in landfills and WHEREAS facing cities today and E waste or electronic waste is the fastest growing waste problem WHEREAS Apple Inc has developed a program to dispose of and recycle e waste and provides an environmentally responsible opportunity for residents of Cupertino to recycle end of life computers and consumer electronic products NOW THEREFORE BE IT RESOLVED that the City Council of the City of Cupertino hereby approves an agreement between Apple Inc and the City of Cupertino for the disposal of e waste IT IS FURTHER RESOLVED that the City Council authorizes the City Manager to execute said agreement and applicable extensions on behalfofthe City of Cupertino PASSED AND ADOPTED at a regular meeting of the City Council ofthe City of Cupertino this 19th day of June 2007 by the following vote Vote Members ofthe City Council AYES NOES ABSENT ABSTAIN ATTEST APPROVED City Clerk Mayor City of Cupertino

4 g CUPERTINO EXHmIT A Electronic Waste Program Apple Inc and the City of Cupertino SCOPE OF SERVICES Apple in cooperation with the City of Cupertino will implement a program to provide an environmentally responsible opportunity for residents of Cupertino to recycle end of life computers and consumer electronics products The length of this agreement is one year July June At the end ofthat time both the City and Apple shall have the option of renewing the progranl for three one year terms corresponding to the fiscal year July 1 to June 30 Apple will accept at its facility located at Bubb Road electronic items residents wish to dispose of in an environmentally responsible manner Apple will also accept electronic items from the City that have previously been used at City facilities for the City s use The process Apple uses is designed to divert over 90 of the end of 1ife materials received through the program from landfill to other beneficial uses through reuse or recycling Acceutable Materials Computer equipment and associated equipment Computers CPUs and monitors with intact screens keyboards mice external hard drives floppy Qrives optical drives printers scanners Selected office electronics Fax machines small home copiers Selected home entertainment electronics Stereo equipment non wood speakers VCRs laser discs DVD players Televisions Microwaves Unacceutable materials Batteries and computer monitors with broken or cracked screens 1

5 Apple will arrange a convenient drop off location and process residents of Cupertino Below is an overview ofhow the process works at Bubb Road for 1 Resident pulls vehicle into designated location at Bubb Road 2 Apple will verify residency using government issued photo ill e g drivers license passport etc showing Cupertino address or other photo ill and documentation showing proof or residency utility bill 3 Apple will assist with the removal of equipment from the vehicle as appropriate 4 Apple will inventory equipment computer monitors and all other electronics materials accepted by the program received track and create an audit trail for all 5 Apple will provide the resident with a receipt and information on the disposition ofthe equipment brought in After collection from residents 1 Apple will consolidate and process the material for recycling ensuring Cupertino program related materials are tracked to ensure recycling that all Monitors and all other electronics materials collected through the program will be materials to palletized separately from Apple s internal recycling program ensure proper accounting for the program 2 Apple will ensure that all program materials are processed provides the maximum possible recycling ofthese materials in manner that Hours of operation will be Monday Wednesday and Friday from 8 00 am to 4 30 pm The hours and days will be subject to change based on volume of program internal Apple workload or as necessary to provide related traffic better customer service if determined by Apple and the City Apple will provide this service for up to 100 drop offs per day or the accumulations of Ibs per day of operation Apple also reserves the right to suspend this take back program with a 30 day notice to the City should business conditions make it uneconomical for Apple to continue to participate The City will also have the right to suspend the program with 3D day notice Apple acting as an authorized collector as defined by the California Integrated Waste Management Board CIWMB will provide a free and convenient collection program for Covered Electronic Devices CEDs as defined in SB20 50 and specified by the Department of Toxic Substance Control DTSC CEDs are currently defined as CRT 2

6 monitors lap top computers televisions and flat panel displays all with screen sizes of4 or greater when measured diagonally Apple will provide the labor for collection and tracking CED materials at no charge to the City of Cupertino Additionally Apple will provide labor for collection processing and tracking CED materials at no charge to the City and its residents and its residents of non This program is intended to provide residents of Cupertino an environmentally responsible manner to dispose of a reasonable amount of electronic equipment Apple reserves the right to decline to accept equipment in quantities that in its opinion would not be used in a single household i e which appear to come from abusiness since the program is designed and scaled for residential recycling The City of Cupertino s will designate Apple Inc Designated Approved Collector for Recovery and Recycling system of California Covered Electronic Waste CEW during the term ofthis Agreement June
