2 Dear Friends and Fellow Cattlemen, On behalf of our family I would like to welcome you to our Fall 2014 Elite Female Sale. I appreciate your interest in our cattle program and our catalog, but I am sincere in hoping that you will join us at the ranch on October 21st. I don t believe you will able to fully grasp the power of this offering without witnessing it first hand. We have endured four years of drought, but we have stayed dedicated to our goals, and with our embryo transplant program, are able to make this offering today. Finally on June 4th of this year, we received a substantial rain and have been blessed with adequate moisture throughout the growing season. Our cattle have responded and bloomed to a level that is even shocking to me. While most are holding on to all the good ones in order to restock and rebuild, we are sharing the joy of our bounty. When I first told people that we were selling almost all of our registered cows, everyone asked if I would someday be able to rebuild. That is precisely what we are looking to do. We have a great inventory of embryos and we are working to increase our herd of recipient cows in order to follow our program of only propagating the very best. I hear the same comment from everyone - You are keeping the ones I want. When we were taking pictures for the sale this summer I let Seth have most of the Best Ones! Many heifers are selling that were not intended to be let go females that would be our potential future donors. I am also keeping many of the old donors and letting go of their best heifers. This offering features a blend of the proven cows, and in the case of the Eldorado heifers, some of the most exciting and futuristic genetics we have ever produced. Our lead-off female, C-Bar Abigrace 255Z, sired by the breed s leading calving ease bull, Conquest, is the most powerful female we have ever offered to sell. The warranties and guarantees set forth in the Terms and Conditions are in lieu of all other warranties, either expressed or implied, and the remedies provided therein shall be the sole and exclusive remedy for the Buyer, or any party claiming through Buyer, for any breach of warranty or guarantee therein provided, and all other obligations or liabilities. All cattle in this sale are offered according to the laws of the State wherein the sale is conducted. The right to bid, as provided under law, is reserved for all sellers unless otherwise announced. 1. BIDDING The Auctioneer in charge will settle any disputes as to bids, and his decision on such matters shall be final. 2. TERMS Terms of sale are cash unless satisfactory credit arrangements have been made with Sale Management prior to sale. 3. PURCHASER S RISK Each animal becomes the risk of the Buyer as soon as sold, but it shall be the obligation of the Seller to see that animals are fed and cared for free of charge to Buyer, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs sooner. 4. CERTIFICATE OF REGISTRY A transferred certificate of registry will be furnished to the Buyer for each animal. 5. HEALTH All animals are eligible for interstate shipment, except as otherwise announced. Interstate health papers will be furnished for each animal requiring tuberculosis and brucellosis tests in accordance with Federal Regulations. 6. ANNOUNCEMENTS Any changes from information of any kind in the sale catalog or related materials will be announced from the auction block and such announcements shall take precedence. 7. BREEDING GUARANTEE The nature and extent of the Breeding Guarantee is set forth in section 10 of the Red Angus Assocation of America s Sale Terms and Conditions. 8. DEFAULT In the event the Buyer defaults on payment, the Buyer shall be responsible for all costs, including attorney s costs, incurred by Sale Management or Seller in connection with collecting, or attempting to collect, payment due. 9. SELLER S SEMEN RIGHTS The Seller reserves the right to 1/3 semen interest in every bull sold, unless specified differently in the sale catalog. Any semen collected for the Seller will be at their cost and the Buyer s convenience. 10. LIABILITIES All persons who attend the sale do so at his or her own risk. The Seller, and the Sale Manager assume no liability of accidents that may occur. It is to be clearly understood that the Sale Manager and their representatives act only as a medium between the Buyer and Seller. 11. CONTRACT The above terms and conditions shall constitute as a contract between the Buyer and Seller for each sale animal and shall be equally binding upon both.
