River Street Special Village Board Meeting Montgomery, Illinois May 22, 2014 Village President Brolley called the meeting to order at 9:00 a.m. followed by the Pledge of Allegiance. Public Participation A. Public Comments (Two Minute Opportunity). Bill Xinos, 2756 Hamman Way in Aurora, is the owner of 1100 S. Lake Street in Montgomery. He stated that he has heard that the Board is considering a request from CBS to allow a billboard to be moved on Route 30 in exchange for eliminating one on Mr. Xinos property. He said he would lose about $10,000 and he doesn t think it is right to make that type of change. President Brolley clarified that the sign request will be discussed again at a Board Meeting in July. Resolution Initiating the Submission of a Public Question to Impose a Non-Home Rule Sales Tax for the Village of Montgomery. Trustee Sperling moved to approve Resolution Initiating the Submission of a Public Question to Impose a Non-Home Rule Sales Tax for the Village of Montgomery. Trustee Marecek seconded this motion. 6 Yea. 0 No. Motion carried. Trustee Sperling, Trustee Lee, Trustee Heinz, Trustee Jungermann, Trustee Marecek, Trustee Bond voting yea. President Brolley stated that if he were able to vote on this item, he would vote in favor of it also. B. Ordinance 1616 Regarding a Property Tax Rebate (Waiver of First and Passage on Second Reading). This is the first draft of an ordinance regarding a property tax rebate. Attorney Andersson said the Board needs to decide certain items that need to be filled in: the percent to be rebated; how many years the rebate will be given; and the actual amount of the rebate per residence. He explained that it would be virtually impossible to calculate individual rebates for each residence, so an amount per residence will be stipulated and everyone will receive the same rebate amount. Trustee Bond suggested eliminating the last two whereas clauses. Board members were in agreement with this. Trustee Bond suggested a 15% rebate for a five-year period. Trustee Jungermann said he would like a 10% or 15% rebate for five years. Trustee Lee said that is fine with him. Trustee Marecek would like to see the rebate period longer, but will agree with five years. President Brolley explained that future Boards can review and renew the rebate, and stated that would be his intent if he is still on the Board in five years. Director VanVooren calculated the rebate amount to be $45 per residence based on a $200,000 house. Trustee Bond said there is a passage in the ordinance that mentions rental properties and asked if the rebate can be withheld if it is a crime hot spot. Attorney Andersson explained that concept is covered in Item H, where it says if any property not in compliance with Village regulations or is the subject of code enforcement proceedings, it is not entitled to the rebate. Criminal violations attach to people, not properties, so the best way to word the ordinance is to address code violations. Trustee Marecek asked if owners of an apartment complex can get the rebate. Attorney Andersson said the rebate is for all residential properties, including multi-family, but the person who pays the taxes gets the rebate, not the tenant. Only one rebate per PIN is allowed, so an apartment complex

Board members agreed to proceed with the ordinance in this form, and amend it later if other issues arise. Trustee Bond moved to approve Ordinance 1616 Regarding a Property Tax Rebate (Waiver of First and Passage on Second Reading). Trustee Marecek seconded this motion. 6 Yea. 0 No. Motion carried. Trustee Bond, Trustee Sperling, Trustee Lee, Trustee Heinz, Trustee Jungermann, Trustee Marecek voting yea. President Brolley stated that if he were able to vote on this item, he would vote in favor of it also. He also explained that this Special Village Board Meeting was scheduled in order to allow all Board members to be present and vote on these two ordinances. Items for Discussion A. Senior Advisory Committee. President Brolley said Trustee Heinz has been running the senior lunch program for many years, and he would like to make this arrangement more formal and appoint people to a committee to assist with this. Trustee Heinz said he has seven volunteers who are willing to serve on the committee. Trustee Marecek said he thinks it is a good idea to formalize the committee. Attorney Andersson reminded Board members that if it is a formal committee, it will be subject to the Open Meetings Act and members will be required to take the OMA training. 17 ORDINANCE NO AN ORDINANCE FOR YEAR 2014 REGULATING WAGES OF THE VILLAGE OF MONTGOMERY, KANE AND KENDALL COUNTIES, ILLINOIS BE IT ORDAINED by the President and Board of Trustees of the Village of Montgomery, Kane and Kendall Counties, Illinois, as follows; WHEREAS, the Village of Montgomery is not a home rule municipality within Article VII, Section 6A of the Illinois Constitution and, pursuant to the powers granted to it under 65 ILCS 5/1-1 et seq.; and, WHEREAS, the State of Illinois has enacted An Act Regulating Wages of Laborers, Mechanics and Other Workers Employed in any Public Works by the State, County, City or any Public Body or any Political Subdivision or by any one under Contract for Public Works, 820 ILCS 130/0.01 et seq. as amended (hereinafter referred to as The Act ); and WHEREAS, the aforesaid Act requires that the Village Clerk of the Village of Montgomery investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said Village of Montgomery employed in performing construction of public works, for said Village of Montgomery. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Montgomery, Kane and Kendall Counties, Illinois, as follows: SECTION ONE: To the extent and as required by An Act regulating wages of laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the Village of Montgomery is hereby ascertained to be the same as the prevailing rate of wages for construction work in this County as determined by the Department of Labor of the State of Illinois as of June of the current year, a copy of that determination being attached hereto and incorporated herein by reference. As required by said Act, any and all revisions of the prevailing rate of wages by the Department of Labor of the State of Illinois shall supersede the Department s June determination and apply to any and all public works construction undertaken by Kane County. The definition of any terms appearing herein which are also used in the aforesaid Act shall be the same as in said Act.

18 SECTION TWO: Nothing herein contained shall prohibit the Village of Montgomery from investigating and ascertaining the prevailing rate of wages for categories of workers not expressly covered by the published determination of the Department of Labor, nor prohibit incorporating those rates so ascertained into the published determination of the Department of Labor, provided that those rates ascertained by the County shall be clearly indicated as such. SECTION THREE: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of Kane County to the extent required by the aforesaid Act. SECTION FOUR: The Village of Montgomery Clerk shall publicly post or keep available for inspection by any interested party in the main office of the Village of Montgomery this determination or any revision of such prevailing rate of wages. A copy of this determination or of the current revised determination of prevailing rate of wages then in effect shall be attached to all contract specifications. SECTION FIVE: The Village of Montgomery Clerk shall mail a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates. SECTION SIX: The Village Clerk shall promptly file a certified copy of this Ordinance with both the Secretary of State Index division and the Department of Labor of the State of Illinois. SECTION SEVEN: The Village Clerk shall cause to be published in a newspaper of general circulation within the area a copy of this Ordinance, and such publication shall constitute notice that the determination is effective and that this is the determination of the public body.

19 SECTION EIGHT: EFFECTIVE DATE This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. The Village, Covenantor, Developer and each Owner may individually be referred to as a "Party" and collectively referred to as "Parties." WITNESSETH WHEREAS, the Parties (or their predecessors) previously entered into a certain Annexation Agreement (the Agreement ) with regard to the Property; and, WHEREAS, the Parties have agreed to amend the fence provisions regarding the Property to allow for the installation of a fence on the Lots; and

46 Page 2 WHEREAS, the Parties are entering into this Amendment to memorialize the alteration to the Agreement of the Parties as to the permissibility of fences on the Lots; and WHEREAS, Section 23(d) of the Annexation Agreement specifically allows for lot by lot amendments; and WHEREAS, all notices required by law relating to this Amendment have been given to the persons or entities entitled to such notice pursuant to the applicable provisions of the Illinois Compiled Statutes; and WHEREAS, the Corporate Authorities of the VILLAGE have duly affixed the time for a public hearing on this Amendment and pursuant to legal notice have held such hearing thereon all as required by the provisions of the Illinois compiled Statutes; and WHEREAS, the Corporate Authorities of the VILLAGE have duly held all public hearings relating to this Amendment, all as required by the provisions of the VILLAGE S ordinances and the Illinois Compiled Statutes; and WHEREAS, in accordance with the powers granted to the VILLAGE by the provisions of 65 ILCS 5/ through , inclusive, relating to Annexation Agreements, the parties hereto wish to enter into a binding Amendment to the Agreement with respect to the Property and to provide for various other matters related directly or indirectly to the annexation of the Property as authorized by the provisions of said statutes; and NOW, THEREFORE, in consideration of the mutual covenants, agreements and conditions herein contained, and by authority of and in accordance with the aforesaid statutes of the State of Illinois, the parties agree as follows: 1. SUB-SECTION 9(A)(2)(i) AMENDED. Section 9(A)(2)(i) of the Agreement shall be deleted and the text thereof shall read as follows: i. Fences are hereby prohibited, in the areas delineated on the Preliminary Plat, as either Villa or Townhome areas, except for the Lots identified on Exhibit B attached hereto wherein a fence in conformance with the specifications of the Annexation Agreement for the Property, as amended hereby, shall be permitted. 2. SUB-SECTION 9(A)(5) AMENDED AS FOLLOWS: hereto. Exhibit J shall be replaced in its entirety with the revised Exhibit J attached

47 Page 3 3. REMAINDER OF AGREEMENT UNAFFECTED; AMENDMENT INTEGRATED IN AGREEMENT. A. The Parties hereby agree and acknowledge that the remaining provisions of the Agreement which are not referenced or amended by this Amendment shall remain in effect for the term of the Agreement. For purposes of construing the provisions of the Agreement, the Parties agree that this Amendment shall be fully integrated into the Agreement from and after its execution by the Parties. 4. MISCELLANEOUS A. Headings: The article headings are inserted for convenience only, and in no way define, limit or describe the scope or intent of any article or section of this Amendment. B. Governing Law and Venue: The Agreement, as amended, and the covenants and undertakings made hereunder, are performable in Kendall County, Illinois, and shall be governed by the laws of the State of Illinois. Any legal proceeding of any kind arising from the Agreement, as amended, shall be filed in the Circuit Court for the Sixteenth Judicial Circuit, Kendall County, Illinois. C. Mutual Assurances: The Parties shall do all things necessary or appropriate to carry out the terms and provision of the Agreement, as amended, and to aid and assist each other in carrying out the terms and objectives of the Agreement, as amended, and the intentions of the Parties as stated herein. Such actions shall include, but not be limited to, giving of such notices, holding public hearings, enactment by the Village of such resolutions, ordinances, or other measures as may be necessary to enable the Parties compliance with the provisions of the Agreement, as amended. D. Amendment: This Amendment, together with the underlying Agreement, and the exhibits attached thereto, may be amended only by the written agreement of the Parties, and execution of all required ordinances and after provided public notice as provided by law. The Parties agree that the Agreement, as amended, may be further amended, at any time, including after sales of homes have begun on an individual lot basis, without requiring the consent of the OWNERS for the lots that have been previously sold or conveyed. E. Entire Agreement: The Agreement, as amended, together with all exhibits referenced in the Agreement, as amended and attached thereto, contain all agreements, understandings, and covenants of the Parties. F. Conflict: In the event there is a conflict between the terms and provision of the body of the text of the Agreement, as amended, with the applicable Village codes, ordinances, or regulations, the terms and provisions of this Agreement shall control and prevail. Except as specifically provided otherwise in this agreement, all parties shall perform their obligations under this agreement in

48 Page 4 accordance with all applicable State, Federal and County laws, rules, ordinances and regulations and all Village Ordinances, resolutions and rules and regulations at the time of reference. G. Counterparts. This Amendment may be signed in counterparts. H. Incorporation of Recitals.
