Roadway Traffic Hazard Warranty - 5 Years Separator, Reflective Arcs and Asphalt Mollies For fixed installations of products at specified areas, QWICK KURB, INC. (hereinafter QWICK KURB ) provides a comprehensive Warranty for Product Performance (that is, the covered products will maintain their functionality) to the original purchaser for a period of five (5) years. Subject to limitations stated herein, the Warranty covers listed products rendered non-functional even if caused by normal vehicular roadway traffic. A separate Warranty may cover damage from snowplows. This Warranty does not apply to a competitive bid project unless the conditions of the bid require the Warranty of all bidders. SPECIFIED LOCATION This Warranty applies to units on fixed installations, and is effective provided that QWICK KURB gives specific written coverage identifying the installation by location. To avail itself of this Warranty, the purchaser must, before purchase is made, supply QWICK KURB with a detailed drawing of the traffic design and specific location of the intended installation, and receive this Warranty with that location identified below and with the specific signature from QWICK KURB that the Warranty is approved. The Warranty in no way implies approval or an opinion of the suitability or configuration of the installation or behavior of traffic at the location; the Warranty is confined strictly to covered products. Units at the installation identified below are approved under this Warranty. NOTE: it is not necessary for experienced users under annual contracts to identify projects. In the lines above, describe the location and installation in detail (state, county, city, road name, and position on the road),. COVERED PRODUCTS: The products covered by this Performance Warranty are new QWICK KURB units as follows: L60 KURB; L61 and L62 END KURB; L65 Reflective Arc ; S65 Securing Arc and FS50 Cloverleaf Molly for asphalt. TERM: The five (5) year term of this Warranty extends from the date product was shipped to the initially registered purchaser including such purchaser whose purchase is made through an authorized QWICK KURB dealer or distributor. REPLACEMENT OR REPAIR During the Warranty period, the obligation of QWICK KURB is limited to repairing or replacing, as QWICK KURB shall elect, any covered unit. Purchaser shall give QWICK KURB reasonable opportunity to examine the installed, non-functional units on site, unless Purchaser determines that non-functional units need to be removed immediately for safety reasons. In this exception Purchaser shall document promptly in written form a description of the product failure to include if possible photographs of the nonfunctional units while still installed, and Purchaser will store such products for examination by QWICK KURB. REPLACEMENT SCHEDULE QWICK KURB will replace or repair non-functional units by granting price credits against current prices as follows: through first two years 100%, i. e., free of charge; third year through fifth year 60%. WHAT IS NOT COVERED This Warranty does not cover units moved to a location different than the original installation; storage, shipment, removal, maintenance or installation done in a manner inconsistent with the instructions in the QWICK KURB Installation Manual(s), including use of achoring devices other than those QWICK KURB supplies unless pre-approved in writing by QWICK KURB ; color fading; modifications to the units not performed by authorized QWICK KURB technical personnel; damage from but not limited to metal-tracked equipment, chemical or other spills, vandalism, acts of God, etc.; units where QWICK KURB vertical markers are used at intervals greater than seven meters; vertical markers and flexes. Except as described herein, QWICK KURB makes no express or implied Warranty whatsoever with respect to product maintenance or suitability of installation. QWICK KURB disclaims any liability for incidental, or consequential damages to the extent permitted by law. The customer remedies described herein shall be exclusive of any other remedies. The Warranties described herein are for the exclusive benefit of the initially registered purchaser, and are not assignable except as provided otherwise (sales through dealers may be assignable at locations specified above). ( QWICK KURB ) warrants each new unit to be free from defects in workmanship and material for a period of two (2) years for fixed installations from the date of shipment to the initially registered purchaser. During this warranty period, the obligation of QWICK KURB is limited to repairing or replacing, as QWICK KURB may elect, any part or parts of such product determined to be defective in material and/or workmanship. This warranty does not extend to any unit which has been relocated to an installation away from its original installation, which has been subjected to abuse, misuse, improper installation, which has been inadequately maintained or stored, or which has been modified by anyone other than QWICK KURB factory or authorized warranty service personnel. This warranty does not cover travel expenses, the cost of specialized equipment for gaining access to the product, or labor charges for removal, handling or re-installation of the product. THERE ARE NO OTHER WARRANTEES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT, SHALL QWICK KURB BE LIABLE FOR ANY LOSS OF PROFITS OR ANY INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY SUCH DEFECT IN MATERIAL OR WORKMANSHIP.
