Art.1 Objectives Art.1 Obiective This Directive aims at approximating the laws of the Member States relating to emission standards and type-approval procedures for engines to be installed in non-road mobile machinery. It will contribute to the smooth functioning of the internal market, while protecting human health and the environment. Prezenta hotărâre se aplică motoarelor destinate a fi instalate pe maşini mobile nerutiere pentru stabilirea procedurilor de aprobare de tip în scopul limitării emisiilor de gaze şi particule poluante provenite de la aceste motoare. Prezenta hotărâre contribuie la buna funcţionare a pieţei interne, asigurând protecţia sănătăţii persoanelor şi a mediului. 1

2 Art.2 Definitions For the purposes of this Directive: non-road mobile machinery shall mean any mobile machine, transportable industrial equipment or vehicle with or without body work, not intended for the use of passenger- or goods-transport on the road, in which an internal combustion engine as specified in Annex I section 1 is installed, alin.1) Definiţii Pentru aplicarea prezentei hotărâri, termenii şi expresiile de mai jos semnifică după cum urmează: 1) maşină mobilă nerutieră - orice maşină mobilă, echipament industrial mobil sau vehicul prevăzut ori nu cu caroserie, care nu este destinat transportului rutier de pasageri sau de mărfuri, pe care este instalat un motor cu combustie internă, descris la pct. 1 din anexa nr. 1; type-approval shall mean the procedure whereby a Member State certifies that an internal combustion engine type or engine family with regard to the level of emission of gaseous and particulate pollutants by the engine(s), satisfies the relevant technical requirements of this Directive, alin.2) 2) aprobare de tip - procedura prin care autoritatea competentă certifică faptul că un tip sau o familie de motoare cu combustie internă este conform cu cerinţele tehnice prevăzute în prezenta hotărâre, referitoare la nivelul de emisii de gaze şi particule poluante produse de motor; engine type shall mean a category of engines which do not differ in such essential engine characteristics as specified in Annex II, Appendix 1, alin.3) 3) tip de motor - categoria de motoare identice prin caracteristicile esenţiale ale motorului descris în subanexa 1 la anexa nr. 2; engine family shall mean a manufacturer s grouping of engines which, through their design, are expected to have similar exhaust emission characteristics and which comply with the requirements of this Directive, alin.4) 4) familie de motoare - clasificare de motoare stabilită de producător, conform căreia motoarele, inclusiv prin proiectarea lor, trebuie să aibă toate caracteristicile similare în privinţa emisiilor poluante şi să satisfacă cerinţele prezentei hotărâri; - parent engine shall mean an engine selected from an engine family in such a way that it complies with the requirements set out in sections 6 and 7 of Annex I, alin.5) 5) motor reprezentativ - motorul ales dintr-o familie de motoare, care satisface cerinţele prevăzute la pct. 6 şi 7 din anexa nr. 1; 2

3 engine power output shall mean net power as specified in section 2.4 of Annex I, engine production date shall mean the date when the engine passes the final check after it has left the production line. At this stage the engine is ready to be delivered or to be put on stock, placing on the market shall mean the action of making an engine available for the first time on the market, for payment or free of charge, with a view to distribution and/or use in the Community,(replaced by art.1par. 1(a) of DIRECTIVE 2002/88/EC) manufacturer shall mean the person or body who is responsible to the approval authority for all aspects of the type-approval process and for ensuring conformity of production. It is not essential that the person or body is directly involved in all stages of the construction of the engine, approval authority shall mean a Member State s competent authority or authorities responsible for all aspects of type-approval of an engine or of an engine family, for issuing and withdrawing approval certificates, for serving as the contact point with the approval authorities of the other Member States, and for verifying the manufacturer s conformity of production arrangements, alin.6) alin.7) alin.8) alin.9) alin.10) 6) puterea motorului - puterea netă aşa cum este prevăzută la pct. 2.4 din anexa nr. 1; 7) data de fabricaţie a motorului - data la care motorul a trecut de controlul final după ce a părăsit linia de fabricaţie. În acest stadiu motorul este pregătit pentru a fi livrat sau depozitat; 8) introducere pe piaţă - acţiunea de a face disponibil pe piaţă pentru prima dată, contra cost sau cu titlu gratuit, un motor în vederea distribuirii şi/sau utilizării sale în România ori într-un stat membru al Uniunii Europene; 9) producător - persoana fizică sau juridică responsabilă în faţa autorităţii competente care emite certificatul de aprobare de tip, pentru toate aspectele legate de procesul de aprobare de tip şi pentru asigurarea conformităţii producţiei. Această persoană poate să nu fie implicată direct în toate etapele de construcţie a motorului; 10) autoritate competentă - organ al administraţiei publice centrale responsabil cu toate aspectele privind aprobarea de tip pentru un motor sau o familie de motoare, eliberarea sau retragerea certificatelor de aprobare de tip, asigurarea legăturii cu alte autorităţi competente din statele membre ale Uniunii Europene şi verificarea măsurilor luate de producător în vederea asigurării conformităţii producţiei cu tipul aprobat; 3

4 technical service shall mean the organization(s) or body(ies) that has (have) been appointed as a testing laboratory to carry out tests or inspections on behalf of the approval authority of a Member State. This function may also be carried out by the approval authority itself, information document shall mean the document set out in Annex II that prescribes the information to be supplied by an applicant, information folder shall mean the total folder or file of data, drawings, photographs, etc. supplied by the applicant to the technical service or the approval authority as prescribed in the information document, information package shall mean the information folder plus any test reports or other documents that the technical service or the approval authority have added to the information folder in the course of carrying out their functions, index to the information package shall mean the document in which the contents of the information package, suitably numbered or otherwise marked to clearly identify all pages, are listed. - replacement engines shall mean a newly built engine to replace an engine in a machine, and which has been supplied for this purpose only (added by alin.11) alin.12) alin.13) alin.14) alin.15) alin 16) 11)serviciu tehnic organism sau organisme desemnat/desemnate de autoritatea competentă pentru a efectua încercări, respectiv inspecţii, în numele său. Această funcţie poate fi asigurată şi de autoritatea competentă, după caz; 12)fişă de informaţii - document prevăzut în anexa nr. 2, care conţine informaţiile ce trebuie furnizate de solicitant; 13)dosar tehnic de informaţii - ansamblul complet de date tehnice, desene, fotografii etc, furnizate de solicitant serviciului tehnic sau autorităţii, conform prevederilor fişei de informaţii; 14)dosar de aprobare de tip - dosarul tehnic cu informaţii însoţit de rapoartele de încercări sau de alte documente pe care serviciul tehnic sau autoritatea competentă Ie-a adăugat în cursul executării funcţiei sale; 15)index al dosarului de aprobare de tip - documentul care prezintă conţinutul dosarului de aprobare de tip, corespunzător numerotat sau marcat astfel încât fiecare pagină să fie uşor identificată; 16)motor de schimb - un motor nou-construit, destinat să înlocuiască motorul unui echipament şi care a fost furnizat numai în acest scop; 4

7 shall mean a manufacturer with a total yearly production of fewer than units..(added by art.1par. 1(b) of DIRECTIVE 2002/88/EC) inland waterway vessel shall mean a vessel intended for use on inland waterways having a length of 20 metres or more and having a volume of 100 m3 or more according to the formula defined in Annex I, Section 2, point 2.8a, or tugs or pusher craft having been built to tow or to push or to move alongside vessels of 20 metres or more, (added by art.1par.1of This definition does not include: (added by art.1par.1of - vessels intended for passenger transport carrying no more that 12 people in addition to the crew, - recreational craft with a length of less than 24 metres (as defined in Article 1(2) of Directive 94/25/EC of the European Parliament and of the Council of 16 June 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft (*), (*) OJ L 164, , p. 15. Directive as last amended by Regulation (EC) No 1882/2003 (OJ L 284, , p. 1). - service craft belonging to supervisory authorities, alin.22) alin.23) alin.23), pct.1 alin.23, pct.2 alin.23, serie mică - un producător a cărui producţie totală anuală este mai mică de de unităţi. 23) navă pentru navigaţia interioară - o navă destinată utilizării pe căile navigabile interioare, avand o lungime de 20 m sau mai mare şi un volum de 100 m 3 sau mai mare, conform formulei definite la anexa nr. 1, secţiunea 2, pct. 2.8.a sau un remorcher sau un împingător construit pentru a remorca, împinge sau a efectua manevre la nave cu lungimi de 20 m sau mai mari. Definiţia nu include: 1.navele destinate transportului de pasageri pentru cel mult de 12 persoane în afară de echipaj, 2.ambarcaţiunile de agrement cu o lungime mai mică de 24 m (conform definitiei din art. 1, alin. (2) din Hotărârea Guvernului nr. 2195/2004 privind stabilirea condiţiilor de introducere pe piaţă şi/sau punere în funcţiune a ambarcaţiunilor de agrement, care transpune în legislaţia naţională Directiva 94/25 privind ambarcaţiunile de agrement, 3.navele de serviciu aparţinând autorităţilor de control, 7

8 pct.3 - fire-service vessels, alin.23, pct.4 - naval vessels, alin.23), - fishing vessels on the fishing vessels register of the Community, - sea-going vessels, including sea-going tugs and pusher craft operating or based on tidal waters or temporarily on inland waterways, provided that they carry a valid navigation or safety certificate as defined in Annex I, Section 2, point 2.8b. 9 Art.3, align.1) Application for type-approval 1. Application for engine or engine family type-approval shall be submitted by the manufacturer to the approval authority of a Member State. An application shall be accompanied by an information folder, the contents of which are given in the information document in Annex II. An engine conforming to the engine type characteristics described in Annex II, Appendix 1, shall be submitted to the technical service responsible for conducting the approval tests. Art.3, alin.1) Cererea în vederea obţinerii aprobării de tip (1) Pentru obţinerea aprobării de tip pentru un motor sau o familie de motoare, producătorul înaintează autorităţii competente o cerere însoţită de dosarul tehnic de informaţii al cărui conţinut este prezentat în fişa de informaţii prevăzută în anexa nr. 2. Un motor reprezentativ, care corespunde caracteristicilor motorului tip prevăzute în subanexa 1 la anexa nr. 2, trebuie pus la dispoziţie serviciului tehnic responsabil cu efectuarea încercărilor în vederea aprobării. Art. 3, align.2) 2. In the case of an application for type-approval of an engine family, if the approval authority determines that, with regard to the selected parent engine, the submitted application does not fully represent the engine family described in Annex II, Appendix 2, an alternative and, if necessary, an additional parent engine which is determined by the approval authority shall be provided for approval according to paragraph 1. Art.3, alin.2) (2) Dacă tipul motorului reprezentativ al unei familii de motoare ales pentru aprobarea de tip nu reprezintă caracteristicile familiei de motoare prevăzute în subanexa 2 la anexa nr. 2, atunci se va alege un alt motor reprezentativ pentru a fi supus aprobării de tip, conform alin. (1). Art.3, align.3) 3. No application in respect of one engine type or engine family may be submitted to more than one Member State. A separate application shall be submitted for each engine type or engine family to be approved. This Directive shall not invalidate any approval granted prior to the date mentioned in Article 3 pursuant to Directive 97/68/EC nor prevent extensions to such approvals under the terms of the Directive under which they were originally granted.(added article 2 of Directive 2001/63/EC) Art.3, alin.3) (3) Pentru fiecare motor sau familie de motoare ce trebuie aprobată, se face o singură cerere care se transmite unei singure autorităţi competente în vederea aprobării de tip. Fiecare tip de motor sau familie de motoare care trebuie aprobată face obiectul unei cereri distincte. 9

10 Art.4, align.1) Type-approval procedure 1. The Member State receiving the application shall grant type-approval to all engine types or engine families which conform to the particulars in the information folder and which meet the requirements of this Directive. Art.4, alin.1) Procedura de aprobare de tip (1) Autoritatea competentă care primeşte o cerere acordă aprobarea de tip pentru toate tipurile sau familiile de motoare care sunt conforme cu informaţiile conţnute în dosarul tehnic de informaţii şi care satisfac cerinţele prezentei hotărâri. Art.4, align.2) Art.4, align.3) 2. The Member State shall complete all applicable sections of the type-approval certificate, the model being given in Annex VII, for each engine type or engine family which it approves and shall compile or verify the contents of the index to the information package. Typeapproval certificates shall be numbered in accordance with the method described in Annex VIII. The completed type-approval certificate and its attachments shall be delivered to the applicant.(amended by art.1par. 2(a) of Directive 2002/88/EC) Annex VIII shall be amended in accordance with the procedure referred to in Article 15. (added by art.1par.2(a)of Corrigendum to Directive 2004/26/EC) 3. Where the engine to be approved fulfils its function or offers a specific feature only in conjunction with other parts of the non-road mobile machinery, and for this reason compliance with one or more requirements can be verified only when the engine to be approved operates in conjunction with other machinery parts, whether real or simulated, the scope of the type-approval of the engine(s) must be restricted accordingly. The type-approval certificate for an engine type or engine family shall then include any restrictions on its use and shall indicate any Art.4, alin.2) Art.4, alin.3) (2) Autoritatea competentă completează toate rubricile corespunzătoare ale certificatului de aprobare de tip prevăzut în anexa nr. 7, pentru fiecare tip de motor sau familie de motoare care se aprobă şi stabileşte sau verifică conţinutul indexului din dosarul de aprobare de tip. Certificatele de aprobare de tip sunt numerotate conform metodei descrise în anexa nr. 8. Certificatul de aprobare de tip completat şi anexele la acesta se transmit solicitantului. Anexa nr. 8 se modifică în conformitate cu procedura prevăzută la art. 15. (3) În cazul în care motorul supus aprobării îşi îndeplineşte funcţia sau prezintă anumite caracteristici numai atunci când este conectat cu alte elemente ale maşinii mobile nerutiere şi, din această cauză, conformitatea cu una sau mai multe cerinţe ale prezentei hotărâri nu poate fi verificată decât atunci când motorul supus aprobării este conectat cu celelalte elemente ale maşinii, în regim real sau simulat, domeniul încercărilor care stau la baza emiterii certificatului de aprobare de tip se limitează corespunzător. Art.4, align.4) point a) 4. The approval authority of each Member State shall: (a) send monthly to the approval authorities of the other Member States a list (containing the particulars shown in Annex IX) of the engine and engine family type-approvals it has granted, refused to grant or withdrawn during that month (amended by art.1par. 2(b) of DIRECTIVE 2002/88/EC) Art.4, alin.4), lit. a) (4) Autoritatea competentă: a) trimite lunar instituţiilor similare din statele membre o listă a aprobărilor de tip ale motoarelor sau ale familiilor de motoare pe care Ie-a acordat, refuzat sau retras în cursul lunii respective, care conţine informaţiile specificate în anexa nr. 9; Art.4, align.4) point b) (b) on receiving a request from the approval authority of another Member State, send forthwith: Art.4, alin.4), lit. b) b) la primirea unei solicitări transmise de o autoritate competentă dintr-un alt stat membru trebuie să trimită acesteia: a copy of the engine or engine family type-approval certificate with/without information package for each engine type or engine family which it has approved or refused to approve or withdrawn, and/or Art.4, alin.4), lit. b), pct.i) i) o copie a certificatului de aprobare de tip a motorului sau a familiei de motoare în cauză şi/sau un dosar de aprobare pentru fiecare tip de motor sau familie de motoare care a făcut obiectul aprobării, refuzului sau retragerii acesteia; şi/sau the list of engines produced according to type-approvals granted, as described in Article 6(3), containing the particulars shown in Art.4, alin.4), lit. b), ii) lista motoarelor fabricate în conformitate cu aprobările de tip acordate, conform prevederilor art. 6 alin. The approval authority of each Member State shall yearly, or in addition on receiving a corresponding application, send the Commission a copy of the data sheet as shown in Annex XI related to the engines approved since the last notification was made.(amended by art.1par. 2(c) of DIRECTIVE 2002/88/EC) Art.4, alin.4), lit. b), pct.iii) Art.4, alin.5) iii) o copie de pe declaraţia prevăzută la art. 6 alin. Compression ignition engines for use other than in propulsion of locomotives, railcars and inland waterway vessels may be placed on the market under a flexible scheme in accordance with the procedure referred to in Annex XIII in addition to paragraphs 1 to 5. (added by art.1par.2(b)of Corrigendum to Directive 2004/26/EC ) Amendments to approvals 1. The Member State which has granted type-approval must take the necessary measures to ensure that it is informed of any change in the particulars appearing in the information package. The application for the amendment or extension of a type-approval shall be submitted exclusively to the approval authority of the Member State which granted the original type-approval. Art.5, align.3) 3. If particulars appearing in the information package have changed, the approval authority of the Member State in question shall: Art.5, alin.3) (3) Dacă datele incluse în dosarul de aprobare de tip au fost modificate, autoritatea competentă trebuie: issue revised page(s) of the information package as necessary, marking each revised page to show clearly the nature of the change and the date of re-issue. Wherever revised pages are issued the index to the information package (which is attached to the type-approval certificate) shall also be amended to show the latest dates of revised pages, and Art.5, alin.3), pct.a) a)să elibereze, dacă este necesar, pagina/paginile revizuită/revizuite a/ale dosarului de aprobare de tip, indicând în mod clar pe fiecare pagină revizuită natura modificării şi data ultimei emiteri. The revised certificate shall show clearly the reason for revision and the date of re-issue. 14 If the approval authority of the Member State in question finds that an amendment to an information package warrants fresh tests or checks, it shall inform the manufacturer thereof and issue the documents mentioned above only after the conduct of successful fresh tests or checks. Art.5, alin.4) (4) Dacă autoritatea competentă consideră că modificarea unui dosar de aprobare de tip necesită noi încercări sau noi verificări, informează producătorul cu privire la aspectele apărute şi eliberează documentele prevăzute la alin. The manufacturer shall affix to each unit manufactured in conformity with the approved type the markings as defined in section 3 of Annex I, including the type-approval number. Art.6, alin.1) Conformitatea (1) Producătorul trebuie să aplice pe fiecare motor fabricat în conformitate cu tipul aprobat marcajul conform prevederilor pct. 3 din anexa nr. 1, inclusiv cu numărul aprobării de tip. Art.6, align.2) 2. Where the type-approval certificate, in accordance with Article 4(3), includes restrictions on use, the manufacturer shall deliver with each unit manufactured, detailed information on these restrictions and shall indicate any conditions for fitting it. Where a series of engine types is delivered to one single manufacturer of machinery, it is sufficient that he will be provided with only one such information document, at the latest on the delivery date of the first engine, which additionally lists the relevant engine identification numbers. Art.6, alin.2) (2) În cazul în care certificatul de aprobare de tip, conform art. 4 alin. (3), include restricţii de folosire, producătorul trebuie să întocmească pentru fiecare motor fabricat un document cu informaţii detaliate asupra acestor restricţii şi să precizeze condiţiile pentru instalarea acestuia. Dacă o serie de motoare de acelaşi tip este livrată unui singur producător de maşini, este suficient ca acesta din urmă să primească, cel mai târziu la data livrării primului motor, un singur document cu astfel de informaţii, care include o listă cu numerele de identificare ale tuturor motoarelor care vor fi livrate. 15 following each additional date the authority may stipulate, a list which contains the range of identification numbers for each engine type produced in accordance with the requirements of this Directive since the last reporting was made, or since the requirements of this Directive were first applicable. Where not clarified by the engine coding system, this list must specify correlations of the identification numbers to the corresponding engine types or engine families and to the type-approval numbers. Additionally, this list must contain particular information if the manufacturer ceases to produce an approved engine type or engine family. TYPE-APPROVALS STAGE I (ENGINE CATEGORIES A/B/C) Member States shall refuse to grant type-approval for an engine type or engine family and to issue the document as described in Annex VII, and shall refuse to grant any other type-approval for non-road mobile machinery in which an engine is installed: after 30 June 1998 for engines of a power output: A: 130 kw P 560 kw, B: 75 kw P < 130 kw, C: 37 kw P < 75 kw, if the engine fails to meet the requirements specified in this Directive and where the emissions of gaseous and particulate pollutants from the engine do not comply with the limit values as set out in the table in section of Annex I.(amended by art.1par. 4(c) of DIRECTIVE 2002/88/EC Art.9), alin.2) (2) APROBAREA DE TIP ÎN FAZA 1 (CATEGORIILE DE MOTOARE A, B ŞI C) Autoritatea competentă refuză să elibereze aprobarea de tip pentru un tip de motor sau o familie de motoare şi să emită certificatul de aprobare de tip prevăzut în anexa nr. 7 şi refuză acordarea oricărei alte aprobări de tip pentru maşini mobile nerutiere pe care este instalat un motor, după data de 30 iunie 1998, cu o putere încadrată în categoriile prevăzute la lit. a), b) şi c), dacă respectivele motoare nu satisfac cerinţele prezentei hotărâri şi dacă nivelul emisiilor de gaze şi de particule poluante nu se încadrează în valorile limită prevăzute în tabelul de la pct din anexa nr. 1: a) categoria A: 130 kw P 560 kw; b) categoria B: 75 kw P < 130 kw; c) categoria C: 37 kw P < 75 kw.
