3 Introduction Pupil transportation is an essential part of the overall school program, which requires constant supervision and direction. Perhaps no other phase of the school program is more closely observed by the public or has a greater tendency to mold public opinion about the schools than the school bus system. The success of any school district pupil transportation service operation depends largely upon the quality of performance and degree of dedication displayed by those involved. State statutes and regulations are only minimum requirements. The Community R-VI Board of Education is required by state statute to adopt and enforce policies that ensure pupil safety while being transported. The Board of Education will authorize a transportation system as recommended by the superintendent and incompliance with Section , Missouri School Laws, which states, the board of education shall provide transportation to and from school for all pupils living more than three and one-half miles from school and may not provide transportation for all pupils. The board of education may provide transportation for pupils living less than one mile from school at the expense of the district. The law also provides for the transporting of special populations as needed. This handbook has been prepared to provide present and prospective drivers with information regarding the laws, rules and guidelines which will aid them to safely operate a school bus. This book is not intended to take the place of any State or Federal motor vehicle laws or other official publications. Every driver should have a copy of this handbook and be thoroughly familiar with the contents. In addition to this handbook drivers should also be familiar with school district and/or company policies. 1

4 Definition of a School Bus Operator A school bus operator is an individual who operates a school bus in the transportation of school children and who receives compensation for such service ( , RSMo). Student Eligibility to Ride the Bus A. Students eligible for transportation shall include all students K-12 residing one (1) mile or more from school. B. Special provisions will be made as needed for the transporting of handicapped students. General Requirements for Approval of School Bus Transportation(DESE) A. All transportation of pupils furnished by a school district shall be authorized in accordance with the law. B. School bus routes over which school buses travel shall be approved by the school district s board of education no later than the end of October for their initial approval and no later than the end of June for the final approval of modifications made during the school year. C. All vehicles used for transporting pupils shall carry liability and property damage insurance. D. There shall be on file in the appropriate school district office copies of current contracts, bonds, driver s physical examination certificates, school bus permits, and maps of school bus routes. E. Public school district boards of education shall provide for proper accounting of pupil transportation data and shall prepare and submit to the State Board of Education necessary reports for apportioning state transportation aid and for statistical purposes. 1. A listing shall be made of pupils scheduled to be transported on each board of education s approved routes on the second Wednesday of the month for the months of October and February. 2. The school district listing of pupils scheduled to be transported by route must be signed and maintained by the superintendent of the schools or an appointed designee. F. No school district shall receive state transportation aid for any pupil transported in a vehicle or over a school bus route which has not been approved by the public school district board of education or for any pupil transported in a vehicle whose driver does not meet the school bus driver qualifications as stated in section (2) of this rule. G. If a lock is to be placed on an emergency exit of a school bus, it shall be designed in a manner so that the engine cannot be started with the emergency exit locked. H. Public school district board of education shall forbid drivers to pull any type of trailer behind a school bus. 2

5 I. Only those signs and lettering allowed by law or rule shall be written on or attached to a school bus, except for safety-related signs or lettering which, if used, shall be placed on the rear of the bus, in no way obstructing the driver s view. J. Emergency evacuation drills on school buses shall be required for all students at least once per semester. The first drill must be completed annually prior to October 31. The board of education shall prescribe emergency evacuation drill requirements for all other students. K. Board of education shall require operators of school buses to conduct and prepare a record of daily pretrip inspection for each school bus. School Bus Driver Regulations A. Drivers of the school district shall maintain a current CDL with a P and S endorsement. Drivers shall be duly licensed in accordance with Missouri statutes and board policy. According to the Federal Commercial Motor Vehicle Safety Act of Drivers cannot have more than one license. 2. Drivers are to notify employer of violation of motor vehicle traffic law within 30 days after conviction, suspension of license, revocation, cancellation, lost right, disqualification. 3. Drivers are to notify employer of past history (10 years) as operator of a commericial motor vehicle. 4. Employer shall not allow person with suspended license or more than one license to operate a commercial motor vehicle. B. To obtain a school bus endorsement, you must: Pass the knowledge and skills test for obtaining a CDL with passenger (P) endorsement (for vehicles that transport 16 or more including the driver) or a Class E (For Hire) license for vehicles that transport 15 or less including the driver. 1. Pass a knowledge test for an S endorsement. 2. Pass a driving skills test in a school bus of the same vehicle group as the school bus applicant will drive. 3. Take your written and skills test results to the local license bureau to apply for a new CDL or Class E license with an S endorsement. 4. Meet driving history review requirements (completed at the time of application). 5. Pay the applicable fees for a new license and the required fees for the written and/or skills test. C. Renewing your license-the S endorsement is now part of the driver s license process, when the license is renewed the S endorsement is also renewed (after a driving history is run by the local license bureau). 3

6 D. A driver who is over 70 years of age must renew their driver s license annually and are required to submit proof of a school bus skills test to retain the S endorsement on their driver license at time of renewal. E. The term school bus operator shall not include any person who transports school children as an incident to employment with a school district, such as a teacher, coach, administrator, secretary, school nurse, or janitor, unless such person is under contract with or employed by a school district as a school bus operator (Section , RSMo). F. School bus operators and drivers of school buses that transport 16 or more including the driver are required to have an S endorsement. All school bus operators must have the proper driver s license for the vehicle they are operating. Driver Requirements Drivers shall undergo a physical examination in accordance with Missouri Pupil Transportation Laws, Regulations, and Standards, which state that the examination shall be given by a physician licensed in medicine or osteopathy, be completed within 90 days in the beginning of the school year and placed on file in the administration office. A. The Community R-VI School District as directed by the Ominus Transportation Employee Act of 1991, requires a Commercial Driver s License to have a pre-employment, post-accident, random, and reasonable suspicion drug and alcohol test. These drug and alcohol tests are required to meet the Federal requirements of 49CFR and 382. The Community R-VI School District will require and provide for pre-employment, post-accident, random, and reasonable suspicion drug and alcohol tests of all school bus drivers, mechanics, and safety sensitive positions. B. Drivers shall be familiar with the Missouri Pupil Transportation manual of the State Department of Education, and shall be governed by these regulations. C. Drivers shall be responsible to the board of education and to the administration for the discipline and safety of students. D. Drivers shall be in good physical and mental health. E. Drivers shall be free from communicable disease. F. Drivers must be able to distinguish between the colors of red, green, and yellow. G. Drivers shall be neat, clean abstain from the use of tobacco in the bus, shall not engage in the use of alcohol, narcotics, or drugs at any time which might influence the normal operation of the bus, and conduct themselves in a manner that will positively influence students. H. Drivers shall immediately report any damage to the bus as soon as possible. I. Unless a written pass is given by school personnel, no student shall be unloaded or picked up at a place other than the assigned bus stop or school. J. No student shall be allowed to leave the bus to ride to school or to ride home in a private vehicle unless a request is made by a responsible member of the immediate family of the child. 4

7 K. Drivers shall not stop at unauthorized places for purposes of students purchasing food, beverages, or other such items. The bus driver would be held personally liable if a child should be injured under these circumstances; school liability insurance would not apply. L. Drivers will fuel buses without students loaded to prevent them from running out of fuel in route. Buses should remain half full at all times. M. Employee Absentee Requests must be completed prior to an employee absence and preapproved by administration. N. Every school bus used to transport children to or from school must be inspected within sixty days prior to operating the bus during the school year ( , RSMo). A safety inspection sticker must be placed on the buses windshield to show approval. O. The board of education must require operators of school buses to conduct and prepare a record of the daily pretrip inspection for each school district (5 CSR (1)(K)). P. Emergency evacuation drills on school buses are required for all students in K-6 grades at least once per semester. The first drill must be completed prior to October 31. The public school district board of education shall prescribe emergency evacuation drill requirements for all other students (5 CSR (1)(J)). Q. When stopping, the school bus must be visible for at least five hundred feet in each direction on a highway with no shoulder and a speed limit greater than sixty miles per hour. The bus must be visible for at least three hundred feet in each direction on other roadways ( , RSMo). R. Handicapped children who have special transportation needs must have those needs detailed in the child s IEP (Individualized Educational Plan) under Related Services. These needs may include the requirement for a handicapped aide on the bus with the child, door-to-door service, transportation for a handicapped child living less than one mile from school, and transportation for special education summer school. S. There is no speed limit established just for school buses. The posted speed limit applies to school buses unless the school board policy requires a speed less than the posted speed limit. The speed limit is 60 m.p.h. if not posted ( (4), RSMo). T. On an annual basis, each school district shall provide training in at least eight hours of duration to each school bus driver employed by the school district shall provide special instruction in school bus driving. U. Every motor vehicle transporting passengers, for hire, every school bus... whether loaded or empty, shall, upon approaching any railroad grade crossing, other than a crossing that is specifically exempted from the stopping requirement by order of the division of motor carrier and railroad safety of the department of economic development, be brought to a full stop within fifty feet, but not less than fifteen feet, from the nearest rail of such railroad grade crossing, and shall not proceed until due caution has been taken to ascertain that the course is clear, except that such full stop shall not be required at a streetcar crossing within a business or residence district, nor at a railroad grade crossing protected by a watchman or traffic officer on duty or by a traffic control signal (not railroad flashing signal) giving positive indication to approaching vehicles to proceed, nor 5

8 when the division of motor carrier and railroad safety has ordered the placement of an exempt sign at the crossing. Substitute Drivers Drivers will call the mechanic/transportation supervisor to schedule a substitute driver for planned absences after receiving prior authorization from administration. Substitute drivers must be preapproved by the Community R-VI Board of Education. Plan for Emergency Dismissal of School In case of an early dismissal due to weather or other circumstances, drivers will be notified first to allow ample time to prepare buses and arrive at school. Disabled Bus Procedures 1. Stop the bus as far to the right as possible (on the shoulder, if available.) 2. Secure the bus, activate hazard/warning lights and set the parking brake. 3. Keep children in the bus. If location of the bus is unsafe, remove the children to a safer location. 4. Place triangular reflectors a minimum of one hundred feet in both the front and rear of the bus. 5. Call or radio administration giving bus location and description of breakdown. Student Discipline Student discipline will follow the Code of Conduct outlined in the current Student Handbook. Bus Accident Procedures The driver of a school bus or multi-purpose school vehicle involved in an accident is subject to the requirements of all state laws. Conduct After An Accident Immediately following the involvement of any school bus or multi-purpose passenger vehicle involved in an accident resulting in death, personal injury or property damage, the driver shall report the accident to the nearest available law enforcement agency having jurisdiction at the location of the accident. The law enforcement agency having jurisdiction at the scene of the accident has the responsibility of contacting the Division of Motor Vehicles. The investigating police officer shall file an accident report with the Division of Motor Vehicles within 15 days if the accident is considered reportable as stated above. Property damage is considered a reportable accident. 6

9 A copy of all school bus accident reports should be forwarded to the Office of Pupil Transportation at the Division of Motor Vehicles. If you are involved in an accident, remain calm. This will enable you to assess the situation with a clear mind. Without delay, write down all the necessary information and observe the following procedures: 1. Stop the vehicle immediately, no matter how trivial or unimportant the accident may seem. Do not move the vehicle unless authorized to do so, or unless its location may result in further danger. 2. Set parking brake, activate four-way flashers, and turn off engine. If driver must exit bus, remove the keys. 3. Evaluate the accident scene to determine if the vehicle needs to be evacuated. If bus is evacuated, make certain all passengers are in a safe place. 4. Check for injuries. If there are severely injured passengers, make them comfortable, but do not move them unless it is absolutely necessary. 5. Notify local authority and provide the following information: a. Location of accident b. If there are any injuries 6. Protect the scene, set out emergency triangular reflectors. 7. Obtain names of all passengers on board and make notation of each passenger s seating location. 8. When another vehicle is involved, obtain driver s name, license number and state of issue, insurance company name and a list of passengers. 9. If there are witnesses, get their name, address and telephone number. 10. Remain at the scene of the accident until a law enforcement officer tells you to proceed. 11. Do not release students to anyone without proper authorization, ie. law enforcement, superintendent or his/her designee. 12. In making any statements, be accurate and factual. a. Make no admission of fault, b. Make no accusations, and c. Do not discuss accident with anyone other than a law enforcement officer, Superintendent, or designee. Post-Trip Inspection At the end of a driver s a.m. and p.m. route, he/she must complete a post-trip inspection. This is the final inspection before the vehicle inspection report is completed and signed. Overview: It is recommended that whenever a vehicle is parked for a certain period of time, such as after the morning run, before next run or trip, a vehicle overview be done. For example: 1. Inside of bus: Check to see that no passengers remain on the bus. Also check for damage and items left behind. Before bus leaves again, check lighting systems and brakes. 7

10 2. Outside of bus: When parked - walk around bus to check for damage, fluid leaks, tires, etc. Before bus leaves again, check again for damage, fluid leaks, tires, etc. Get into a daily routine for your inspection. This will help you remember to check each item. The Bus Stop A school bus only stops at designated stops established by the local school board to load or unload students. Students should be instructed that there is only one designated bus stop for them to board or leave the bus and any change in the procedure must follow school district policy. 1. Students should arrive at the bus stop at least 5 minutes prior to the scheduled arrival of the bus. 2. Students should stand at least 10 feet from the point where the bus will stop. 3. Students should board the bus in an orderly fashion, using the handrail and go directly to their seat. 4. Students must be instructed not to pick up anything dropped within the 10 foot Danger Zone. Students must get the driver s permission to pick up any item within this zone. 5.Students become the responsibility of the school district when they board the bus in the morning and cease to be the responsibility of the school district when they disembark from the bus. Loading 1. The driver shall decrease speed when approaching the stop and activate the amber warning lights a minimum of 100 feet prior to the stop. 2. The driver shall stop the bus as far to the right of the highway as possible, yet remain on the traveled portion of the roadway. The bus should be stopped in a position at least 10 feet from students and/or which allows students to cross approximately 10 feet in front of the bus. Be sure the bus is visible by both lanes of traffic. 3. As the driver approaches a school bus stop, he/she must check oncoming traffic, traffic to the rear of the bus, and to both sides of the bus to ascertain whether traffic is stopping. When the bus has come to a complete stop and the driver feels it is 8

11 safe to load students, the driver will open the service door thereby activating the red flashing lights. At this point the driver will signal to the students that they may load. Students should never be allowed to cross in back of the bus. Students shall board in single file, using the hand rail, and go directly to their seats. THE BUS WILL REMAIN STATIONARY UNTIL ALL STUDENTS ARE SEATED. 4. Before proceeding, the driver shall check all mirrors to ensure no students remain near the bus. Unloading 1. As the driver slows on the approach to a school bus stop, the amber warning lights shall be activated a minimum of 100 feet before the stop. 2. Students shall remain seated until the bus has come to a complete stop. The driver shall check all traffic to the front, rear, and side of the bus to ensure traffic has stopped before opening the service door. 3. Continue to check traffic after opening the door. All students to exit the bus when it is safe to do so and all traffic is stopped. 4. Before proceeding, the driver shall check all mirrors to ensure no students remain near the bus. Students who cross the roadway should walk approximately 10 feet (5 paces) in front of the bus to allow the driver and the student to see each other. At that point, the driver shall recheck to be sure all traffic has stopped and then signal the students to cross. When students reach the center of the road, they should re-check traffic. 5. Students shall not, at any time, cross the roadway BEHIND the bus. 6. When unloading, the students should leave the bus in an orderly manner, in single file front to rear, using the handrail and taking one step at a time out the door. 7. Before proceeding, the driver shall check all mirrors, handrail and service door area to make sure no students remain near the bus and no clothing or student body parts are caught in or on the bus. 9

12 Drug & Alcohol Testing/Background Checks The school district check is conducted for all new school bus drivers, effective June For bus drivers, the background check shall be conducted on drivers employed by the school district or employed by a pupil transportation company under contract with the school district ( , RSMo) and coordinated through the Department of Elementary and Secondary Education. Employee Records The school district or school bus contractor should retain documentation for all school bus drivers of an annual physical, 8 hours of annual training, and (for new hires after June 2005) the criminal history background check results ( , RSMo). Annual Highway Patrol Inspections , RSMo Inspection of school buses-items coveredviolations, when corrected, notice to patrol-spot checks authorized.- A. The owner of every bus used to transport children to or from school in addition to any other inspection required by law shall submit the vehicle to an official inspection station, and obtain a certificate of inspection, sticker, seal or other device annually, but the inspection of the vehicle shall not be made more than sixty days prior to operating the vehicle during the school year. The inspection shall, in addition to the inspection of the mechanism and equipment required for all motor vehicles under the provisions of sections to , include an inspection to ascertain that the following items are correctly fitted, adjusted, and in good working condition: 1) All mirrors, including cross view, inside, and outside; 2) The front and rear warning flashers; 3) The stop signal arm; 4) The crossing control arm on public school buses required to have them pursuant to section , RSMo; 5) The rear bumper to determine that it is flush with the bus so that hitching of rides cannot occur; 6) The exhaust tailpipe shall be flush with or may extend not more than two inches beyond the perimeter of the body or bumper; 7) The emergency doors and exits to determine them to be unlocked and easily opened as required; 8) The lettering and signing on the front, side and rear of the bus; 9) The service door; 10

13 10) The step treads; 11) The aisle mats or aisle runners; 12) The emergency equipment which shall include as a minimum, a first aid kit, flares or fuses, and a fire extinguisher; 13) The seats, including a determination that they are securely fastened to the floor; 14) The emergency door buzzer; 15) All hand hold grips; 16) The interior glazing of the bus. B. In addition to the inspection required by subsection 1 of this section, the Missouri state highway patrol shall conduct an inspection after February first of each school year of all vehicles required to be marked as school buses under section , RSMo. This inspection shall be conducted by the Missouri highway patrol in cooperation with the department of elementary and secondary education and shall include, as a minimum, items in subsection 1 of this section and the following: 1) The driver seat belts; 2) The heating and defrosting systems; 3) The reflectors; 4) The bus steps; 5) The aisles; 6) The frame. C. If, upon inspection, conditions which violate the standards in subsection 2 of this section are found, the owner or operator shall have them corrected in ten days and notify the superintendent of the Missouri state highway patrol or those persons authorized by the superintendent. If the defects or unsafe conditions found constitute an immediate danger, the bus shall not be used until corrections are made and the superintendent of the Missouri state highway patrol or those persons authorized by the superintendent are notified. D. The Missouri highway patrol may inspect any school bus at any time and if such inspection reveals a deficiency affecting the safe operation of the bus, the provisions of subsection 3 of this section shall be applicable. 11

Notwithstanding the provisions of section to the contrary, a violation of this section shall be a class C misdemeanor , RSMo Text messaging and using a hand-held mobile device while operating a motor vehicle prohibited, when--exceptions--definitions--violation, penalty. 1. Except as otherwise provided in this section, no person twenty-one years of age or younger operating a moving motor vehicle upon the highways of this state shall, by means of a hand-held electronic wireless communications device, send, read, or write a text message or electronic message. 2. Except as otherwise provided in this section, no person shall operate a commercial motor vehicle while using a hand-held mobile telephone. 3. Except as otherwise provided in this section, no person shall operate a commercial motor vehicle while using a wireless communications device to send, read, or write a text message or electronic message. 4. As used in this section, "electronic message" means a self-contained piece of digital communication that is designed or intended to be transmitted between hand-held electronic wireless communication devices. "Electronic message" includes, but is not limited to, electronic mail, a text message, an instant message, or a command or request to access an internet site. 7. As used in this section, "hand-held electronic wireless communications device" includes any hand-held cellular phone, palm pilot, blackberry, or other mobile electronic device used to communicate verbally or by text or electronic messaging, but shall not apply to any device that is permanently embedded into the architecture and design of the motor vehicle. 8. As used in this section, "making or taking part in a telephone call" means listening to or engaging in verbal communication through a hand-held electronic wireless communication device. 9. As used in this section, "send, read, or write a text message or electronic message" means using a hand-held electronic wireless telecommunications device to manually communicate with any person by using an electronic message. Sending, reading, or writing a text message or electronic message does not include reading, selecting, or 12

15 entering a phone number or name into a hand-held electronic wireless communications device for the purpose of making a telephone call. 10. A violation of this section shall be deemed an infraction and shall be deemed a moving violation for purposes of point assessment under section The state preempts the field of regulating the use of hand-held electronic wireless communications devices in motor vehicles, and the provisions of this section shall supercede any local laws, ordinances, orders, rules, or regulations enacted by a county, municipality, or other political subdivision to regulate the use of hand-held electronic wireless communication devices by the operator of a motor vehicle. 12. The provisions of this section shall not apply to: 1) The operator of a vehicle that is lawfully parked or stopped; 2) Any of the following while in the performance of their official duties: a law enforcement officer; a member of a fire department; or the operator of a public or private ambulance; 3) The use of factory-installed or aftermarket global positioning systems (GPS) or wireless communications devices used to transmit or receive data as part of a digital dispatch system; 4) The use of voice-operated technology; 5) The use of two-way radio transmitters or receivers by a licensee of the Federal Communications Commission in the Amateur Radio Service. 5 CSR Pupil Transportation in Vehicles Other Than School Buses PURPOSE: Section , RSMo, authorizes vehicles other than approved school buses to be used for transportation of students. This rule establishes standards for transportation in other than approved school buses. 1. Requirements for transportation of students in vehicles designed for transporting more than ten (10) passengers including the driver. A) After July 1, 2001, newly purchased, newly leased, newly placed into service, newly contracted vehicles or vehicles replaced under contracted services with a rated capacity, as defined by the manufacturer, to carry more than ten (10) passengers including the driver that are used to transport students to or from school or to 13

16 transport students to or from any place for educational purposes or school purposes shall meet state and federal specification and safety standards applicable to school buses. Contract common carriers meeting federal Department of Transportation standards may be used for field trips as outlined in section (3) of this rule. 2. Requirements for transportation of students in vehicles designed for transporting ten (10) passengers or less including the driver. A) The number of passengers, including students and driver, that may be transported at any one (1) time shall be limited to the number the manufacturer suggests as appropriate for that vehicle in accordance with section , RSMo, or if not posted in the vehicle, then limited to the number of seat belts in the vehicle. B) The driver and each passenger shall be properly secured with the appropriate seat restraint at all times while the vehicle is in motion. C) Motor vehicles designed for enclosed passenger transportation may be used subject to approval by the local board of education. D) Motor vehicles shall be licensed according to law and shall display a current state safety inspection sticker. E) The driver of a district owned or district contracted vehicle shall have a valid Missouri operator s license for the motor vehicle and comply with section , RSMo, and 5 CSR (2)(A)1-3, not to include a parent or guardian transporting only their children under a written contract with the district and who is not compensated by the district. The parent or guardian shall have a valid Missouri operator s license for the vehicle operated as per 5 CSR (2)(A). (Class P and Class S) F) The driver of a privately owned vehicle who is not compensated by the school district to transport students to and from school or school related events shall have a valid Missouri operator s license for the vehicle operated as per 5 CSR (2)(A). This shall include any person who transports school children as an incident to employment with a school or school district, such as a teacher, coach, administrator, secretary, school nurse, or janitor unless such person is under contract with or employed by a school or school district as a school bus operator as per section (19), RSMo. Compensation shall be defined for the purpose of this section as any reimbursement received by the driver that exceeds the average cost of 14

17 operating a car per mile as established by the American Automobile Association. G) Motor vehicles shall have liability insurance coverage in accordance with section , RSMo, and as required by the local board of education. H) When transportation service in motor vehicles other than those licensed as school buses is contracted, there shall be a written contract between the district and the individual or firm providing the service. 3. Requirements for Transportation of Students in Authorized Common Carriers. A) Authorized common carriers shall only be used to transport students to and from field trips or other special trips for educational purposes and shall not be used to transport students to and from school. Authorized common carriers, as used in this rule, are over-the-road intercity-type coaches equipped with reclining seats, air conditioning and restroom facilities, and holding authority from the Missouri Department of Economic Development, Division of Motor Carrier and Railroad Safety, or the Federal Regulations. Motor Carrier Safety Administration B) There shall be a written contract between the district and individual or firm providing the vehicle. C) All contracts with authorized common carriers shall include: 1. Proof of liability insurance in the amount of five (5) million dollars per accident; and 2. Proof of safety inspection and compliance with applicable federal Motor Carrier Safety Regulations.
