3 INTRODUCTION The Government of India felt the need for a permanent agency to expedite the publication of standards and development of test facilities in parallel when the work on the preparation of the standards is going on, as the development of improved safety critical parts can be undertaken only after the publication of the standard and commissioning of test facilities. To this end, the erstwhile Ministry of Surface Transport (MOST) has constituted a permanent Automotive Industry Standard Committee (AISC) vide order No.RT-11028/11/97-MVL dated September 15, The standards prepared by AISC will be approved by the permanent CMVR Technical Standing Committee (CTSC). After approval, the Automotive Research Association of India, (ARAI), Pune, being the secretariat of the AIS Committee, has published this standard. For better dissemination of this information ARAI may publish this document on their Web site. In the joint meeting of Tractor Manufacturers and Test Agencies held at ARAI in December 2012, it was agreed that there is a necessity for a detailed testing procedure for Conformity of Production to CMVR for Agricultural Tractor to be prepared, which will cover the following: Scope of Procedure Initial Quality Assessment of Vehicle Manufacturer Product Conformity Arrangements Frequency of COP& Sample selection Compliance Certificate Extended COP Consequences of Failures This document also serves the purpose of all the information related to Conformity of Production for CMVR certification in document and will serve as guide for the Tractor manufacturer to get the details of references to all applicable regulations and standards at one place. This document has been prepared by referring following Indian and International test standards. AIS 017 (Part 2) AIS-037 EEC Directives- 2003/37/EC ( Annexure IV) A draft prepared by the panel, constituted by ARAI, will be submitted to the AISC. Panel had discussed the issues in several meetings. AISC has already finalized the technical specification formats indicating the technical details of the vehicle to be type approved in the form of AIS-007 and has already been implemented. SCOPE 1.1 The conformity of production procedure aims to ensure that each Agricultural Tractor produced is in conformity with the specification, performance and marking requirements of the approved type / Model. 1.2 Procedures include inseparably the assessment of quality management systems, referred as Initial Quality Assessment as set out in section 5 and verification and production-related controls, referred to as Product Conformity Arrangements and set out in section This procedure replaces all other conformity testing of agricultural tractors like Batch testing as per IS This procedure should be taken in consideration as per definition & classification of Type of models as per AIS 017, Part-2 i.e., Type approval procedure for Agricultural Tractors which is completely aligned as per European type approval framework. Hence Conformity of Production assessment shall be based specifically on a particular Type of tractor models as described in AIS 017 Part-2 as declared by the manufacturer at the time of type approval. 1.5 All variant, options models classification available before the implementation of this standard will continue unless an amendment as per transitional provisions mentioned in AIS 017 part-2 has been taken by the manufacturer with in the time lines as may be notified by Ministry of Road transport while notifying AIS 017 part This procedure is not applicable for Conformity of Production and certification of other farm machinery like Tractor operated combine, Dozer, Loader, Back hoe, Power tillers, Trailers and construction machines 2. DEFINITIONS 2.1 Agricultural Tractor : - as per AIS-053 & AIS 017 (Part 2) 2.2 Type Approval (T/A) : It is the establishment of initial compliance of tractor model/variant(s) for evaluating proto/ initial production of model(s) and its variant(s) to the provisions of CMVR. 2.3 Provisions : The requirements related to the construction of Agricultural Tractors notified in the CMVR (to ensure road-worthiness of vehicle), either directly or through a reference to Notified Standards. 8 2.4 Notified Standard : A standard referred to in CMVR or notified separately under the provisions of CMVR, which specifies details of requirements to be complied with. This may be in the form of An Indian Standard issued by BIS A standard prepared by the AISC Any other Standard notified by MOST. 2.5 Quality Management System means a set of interrelated or interacting elements that organisations use to direct and control how quality policies are implemented and quality objectives are achieved. 2.6 Audit means an evidence-gathering process used to evaluate how well audit criteria are being applied; it should be objective, impartial and independent, and the audit process should be both systematic and documented. 2.7 Corrective Actions means a problem-solving process with subsequent steps taken to remove the causes of a nonconformity or undesirable situation and designed to prevent their recurrence. 2.8 Physical Tests Actual measurement of performance, fitment, functioning, installation and verifications on test sample (Overall dimensional checks, noise, brake, steering, lighting installation, safety items fitment & functionality checks, general specification verifications ) 2.9 Testing / Approval agency means an organization specified in Rule 126 of CMVR for certification of compliance to the provisions or any other testing agency approved by the CMVR Technical Standing Committee for the purpose of testing of parts / components /systems / vehicles Competent authority means either the Testing / Approval agency or a designated authority; or an accreditation body acting on their behalf Technical Service means an organisation or body designated by the Testing / Approval agency as a testing laboratory to carry out tests, or as a conformity assessment body to carry out the Initial assessment and other tests or inspections, on behalf of Testing / Approval agency, it being possible for the Testing / Approval agency itself to carry out those functions; Procedure for the assessment of Technical service shall be referred as in Annex - B. 3. COP TEST AGENCY 3.1 The test agencies specified in Rule 126 of CMVR as amended from time to time will be responsible for carrying out the COP compliance audit in addition to the Type Approval tests. 9 4. GENERAL GUIDELINES 4.1 The Tractor manufacturer should inform the concerned Test Agency Details about existence of satisfactory arrangements / procedures / Quality Management Systems for ensuring effective control so that vehicles, systems, components or separate technical units when in production conform to the approved type Tentative Production plan for a particular Type (as per AIS 017 part-2) of Tractor models including its variants/versions (with respect to the Type Approval Certificates and the previous COP compliance Certificate if applicable), within 4 month from the start of production/import of type approved Tractor models or resumption of production/import of a tractor or start of the COP period for that Tractor model Stoppage of production/ Import of a specific model, in case this has not been anticipated at the start of the COP period, should be intimated to the test Agency before stoppage of production/ Import. In case of resumption of production of a model, after a stoppage of production, the manufacturer shall inform the test agencies, within three months of the resumption of the production Manufacturer should request the Test Agency with a time table or seek their time table for verification of COP compliance audit of the due tractor models Manufacturer should provide all the assistance required by the Test Agency for completing the verification, inspection, tests. If there have been revisions after the previous COP/Type Approval, the latest updated documents of the technical specifications, procedure of Pre-Delivery Inspection (PDI), runningin and servicing of the Tractor, shall also be submitted before the COP audit tractor selection. A Tractor is considered to be produced when the Tractor has passed the final inspection stage as declared by the manufacturer. 4.2 The testing agencies shall conduct the Initial Quality Assessment & Verification of Product conformity Arrangements for a particular Type of Tractor models. After verification of QMS & Process Audit including Product Conformity Arrangements, in case of any gaps observed or doubt of any non-compliance to CMVR rules the test agency may select identified test sample from technical feature matrix and CEA/Test Model Selection Criteria as mentioned in AIS 017 (Part 2) from the production line of the Manufacturer or applicant, to verify / Test Conformity of Production for already type approved tractor model for specifications and performances to the provisions of CMVR (up to date). However this selection of test vehicle should be limited to Audit during continued verification arrangements (Since actual COP conformation will be required at that time). 4.3 Agricultural Tractors of same range of models / variant(s) produced in plants of the same Manufacturer at different locations are to be considered in total for COP volume calculations purposes and offered for COP. 10 4.4 Pre-delivery inspection will be carried out by the manufacturer, before start of inspection / Verification / testing, as per the procedure / COP methodology mentioned in Annex A and as amended from time to time, on the selected Tractor model, under the control of the test agency. 4.5 The facilities with the manufacturers or elsewhere, meeting the specified requirements for testing of COP according to this document, may be used for COP, by the test agency. 5. INITIAL QUALITY ASSESSMENT OF VEHICLE MANUFACTURER / TYPE APPROVAL APPLICANT:- 5.1 On receipt of information as mentioned in clause 4.0 above, the test agency within 6 month verify the existence of satisfactory arrangements and procedures established by the manufacturer for ensuring effective control so that vehicles, systems, components or separate technical units when in production conform to the approved type. 5.2 The requirements referred to in point 5.1 shall be verified to the satisfaction of the Test Agency granting type-approval. The Test Agency shall be satisfied with the initial assessment and the product conformity arrangements in section 6.0 taking account as necessary of one of the arrangements described in points to or a combination of those arrangements in full or in part as appropriate The initial assessment and/or verification of product conformity arrangements shall be carried out by the Test Agency granting the approval or appointed body acting on behalf of the approval authority When considering the extent of the initial assessment to be carried out, the Test Agency may take account of available information relating to: The manufacturer s certification described in point 5.2.4, which has not been qualified or recognised under that point; In the case of components or separate technical unit s type-approvals, quality system assessments performed in the component or separate technical unit manufacturer s premises by vehicle manufacturer(s), according to one or more of the industry sector specifications satisfying the requirements in harmonised standard EN ISO 9001:2008. Alternately Conformity of production certificates for all the components or separate technical units type approvals as per AIS 037 (as applicable under rule 124A) to be verified by the test agency to ensure the compliance adherence The initial assessment and/or verification of product conformity arrangements may also be carried out by the another test agency as notified under rule 126, or the appointed body designated for this purpose by the test agency where the base type approval certificate has been issued In such a case, the test agency/appointed designated body (as per 5.2.3) who have completed the Initial Quality assessment shall prepare a statement of Page 10 of 23

11 compliance outlining the areas and production facilities it has covered as relevant to the vehicles, systems, components or separate technical units to be type-approved On receiving an application for a compliance statement from the Test agency granting type-approval, the approval authority of another Test agency /appointed designated body shall send forthwith the statement of compliance or advise that it is not in a position to provide such a statement The statement of compliance shall include at least the following: Group or company (e.g. XYZ automotive); Particular organisation (e.g. Indian division); Plants/sites (e.g. Engine plant 1 (State-1) vehicle plant 2 (State-2)); Vehicle/component range (e.g. All category A1 models); Areas assessed (e.g. Engine assembly, body pressing and assembly, vehicle assembly); Documents examined (e.g. Company and site quality manual and procedures); Date of the assessment (e.g. Audit conducted from 18 to ); Planned monitoring visit (e.g. October 2014) The Test agency shall also accept the manufacturer s suitable certification to harmonised standard EN ISO 9001:2008 or an equivalent harmonised standard as satisfying the initial assessment requirements of point 5.2. The manufacturer shall provide details of the certification and undertake to inform the Test agency / designated authority of any revisions to its validity or scope. 5.3 For the purpose of subsequent type-approval, the initial Quality assessments carried out for earlier type approvals for systems,components and separate technical units of the vehicle need not be repeated but shall be complemented by an assessment covering the locations and activities relating to the assembly of the whole vehicle not covered by the former assessments only. 6.0 PRODUCT CONFORMITY ARRANGEMENTS 6.1. Every vehicle, system, component or separate technical unit approved pursuant to CMVR rule / Standard as mentioned in various CMVR rules shall be so manufactured as to conform to the approved type by meeting the requirements of those CMVR rules & standards as mentioned there in. 6.2 After Initial Quality Assessment of Vehicle Manufacturer / Type Approval Applicant pursuant to CMVR rules, the test agency shall verify the Page 11 of 23

12 existence of adequate arrangements and documented control plans, to be agreed with the manufacturer for each approval, to carry out at specified intervals those tests or associated checks necessary to verify continued conformity with the approved type, including, where applicable, tests specified in CMVR Rules/ AIS 017 and test mentioned as their in The holder of the type-approval shall, in particular: Ensure the existence and application of procedures for effective control of the conformity of products (vehicles, systems, components or separate technical units) to the approved type; Have access to the testing or other appropriate equipment necessary for checking conformity to each approved type; Ensure that test or check result data are recorded and that annexed documents remain available for a period of up to 10 years to be determined in agreement with the test agency; Analyse the results of each type of test or check, in order to verify and ensure the stability of the product Characteristics, making allowance for variation in industrial production; Ensure that for each type of product, at least the checks and the tests prescribed in CMVR rules & standards as mentioned there in are carried out; Ensure that any set of samples or test pieces giving evidence of nonconformity in the type of test in question gives rise to a further sampling and test or check. All the necessary steps shall be taken to restore the production process to ensure conformity with the approved type; In the case of vehicle type-approval, the checks referred to in point shall at least consist in verifying the correct built specifications in relation to the approval and the information required for certificates of Conformity. 6.4 If further audit or check results are deemed not to be satisfactory in the opinion of the test agency granting whole vehicle type-approval, the manufacturer shall ensure that conformity of production is restored as soon as possible by corrective actions to the satisfaction of the test agency granting whole vehicle type-approval and to the satisfaction of the test agency granting type-approval of the system, component or separate technical unit. 7.0 CONTINUED VERIFICATION ARRANGEMENTS 7.1. The test agency which has granted type-approval may at any time verify the conformity of production control methods applied in each production facility by means of periodic audits. The manufacturer shall for that purpose allow access to the manufacturing, inspection, testing, storage and distribution sites and shall provide all necessary information with regard to the quality management system documentation and records. 13 The normal approach for such periodic audits shall be to monitor the continued effectiveness of the procedures laid down in sections 5 and 6 (Initial Quality Assessment and Product Conformity Arrangements) of this standard Surveillance activities carried out by the technical services (qualified or recognised as required in point 5.2.4) shall be accepted as satisfying the requirements of point with regard to the procedures established at Initial Quality Assessment The normal frequency of these Reviews / verifications by the test agency (other than those referred to in point ) shall be at least once in a 3 years and not more than 5 years to ensure that the relevant conformity of production controls applied in accordance with sections 5 and 6 are reviewed over a period consistent with the climate of trust established by the test agency At every review, the records of tests, checks and production records, and in particular the records of those tests or checks documented as required in point 6.2, shall be available to the inspector In case of any doubt or further conformity required, the inspector may select random samples out of the particular type of vehicle to be tested in the manufacturer s laboratory or in the facilities of the technical service/test agency, in which case only physical tests (Overall Dimensional checks, weighments, Steering Effort, Brake, Noise, Lighting Installation, Safety component COP documents verification) shall be carried out. The minimum number of samples may be determined according to the results of the manufacturer s own verification plan Where the level of control appears unsatisfactory, or when it seems necessary to verify the validity of the tests carried out in application of point 7.2, the inspector shall select samples to be sent to the test agency to perform physical tests in accordance with the requirements set out in CMVR Rules & standards mentioned there in Where unsatisfactory results are found during an inspection or a monitoring review, the test agency shall ensure that all necessary steps are taken to restore conformity of production by manufacturer as rapidly as possible. 7.6 If a particular type of tractor model conforms as per conformity of Production compliance norms continuously in two consecutive COP validation programmes, next COP testing of that model may be exempted by test agency as per clause EXEMPTIONS FROM COP 8.1 In the following case, Tractor models are exempted from COP tests: A batch of new/modified Tractor produced for field trials up to a maximum of 200 Tractors Page 13 of 23

14 9. COP CERTIFICATE If the Tractor meets the requirements of COP, the test agency will issue a COP certificate to the manufacturer. The certificate for COP will cover the Tractor model and its variants Produced/planned to be produced during the COP period. 10. EXTENDED COP TESTS 10.1 In case of Nonconformity to COP procedures of a tractor model, the test agency shall immediately inform the manufacturers about this In such case, the manufacturer should offer adequate number of Tractors for random selection to have two numbers for extended COP testing for the specific Non-conformance in COP. The sample selection of Tractors for extended COP, shall be immediately within one month unless its production/ Import is not then scheduled. In that event, the samples should be offered for random selection from the first lot of production / Import within one month of start of production/ Import The test agency should endeavour to complete further testing of the samples of the Tractor selected according to Para 10.1/ or 10.2 within one month from the date of selection of the samples. If the Tractor selected as per Para 10.1/ or 10.2 meet the requirements of COP, the test agency will issue a COP certificate to the manufacturer. 11. CONSEQUENCES OF FAILURE 11.1 If the Tractor fails to meet the requirements of extended COP, the testing agency shall send the copies of the test report to the nodal agency and the manufacturer The manufacturer can subsequently identify the reason for not meeting the COP. After necessary corrective measures, manufacturer should inform the same to the concerned test Agency and offer the rectified tractor model for testing. The test agency will carry out a complete test as per the relevant type approval procedure on this rectified Tractor. If the modifications are only in the production process without involving any design change, it should meet the COP norms If test sample does not confirm to COP requirements as per clause 11.1 & 11.2, the test agency may withdraw the Type Approval / COP compliance certificate for that model. 18 ANNEX - B PROCEDURE FOR THE ASSESSMENT OF THE TECHNICAL SERVICES 1. Purpose of this Annex 1.1. This Annex establishes the conditions according to which the assessment procedure of the technical services shall be conducted by the competent authority referred in Clause These requirements shall apply mutatis mutandis to all technical services, irrespective of their legal status (independent organisation, manufacturer or approval authority acting as technical service). 2. Principles of assessing Assessing shall be characterised by reliance on a number of principles: Independence which is the basis for the impartiality and objectivity of the conclusions, An evidence-based approach which guarantees reliable and repro ducible conclusions. Auditors shall show trust and integrity. They shall respect confidentiality and discretion. They shall report truthfully and accurately findings and conclusions. 3. Skills required of the auditors 3.1. The assessments may only be conducted by auditors having the technical and administrative knowledge necessary for such purposes The auditors shall have been trained specifically for assessment activities. In addition, they shall have the specific knowledge of the technical area in which the technical service will exercise its activities Without prejudice to points 3.1 and 3.2 of this Annex, the assessment shall be conducted by auditors independent of the activities for which the assessment is conducted. 4. Application for designation 4.1. A duly authorised representative of the applicant technical service shall make a formal application to the competent authority that includes the following: (a) General features of the technical service, including corporate entity, name, addresses, legal status and technical resources; Page 18 of 23

19 (b) A detailed description including curriculum vitae of the personnel in charge of testing and of the managerial staff as evidenced by the skills both educational and professional; (c) In addition to the above, technical services which use virtual testing methods shall provide evidence of their ability to work in a Computer- Aided environment; (d) General information concerning the technical service such as its activities, its relationship in a larger corporate entity if any, and addresses of all its physical location(s) to be covered by the scope of designation; (e) An agreement to fulfil the requirements for designation and the other obligations of the technical service as applicable in the relevant Directives; (f) A description of the conformity assessment services that the technical service undertakes in the framework of the applicable regulatory acts and a list of the regulatory acts for which the technical service applies for designation, including limits of capability where applicable; (g) A copy of the quality manual of the technical service The competent authority shall review for adequacy the information supplied by the technical service. 5. Resource review The competent authority shall review its ability to carry out the assessment of the technical service, in terms of its own policy, its competence and the availability of suitable auditors and experts. 6. Subcontracting the assessment 6.1. The competent authority may subcontract parts of the assessment to another designation authority or ask for support from technical experts provided by other competent authorities. The subcontractors and experts have to be accepted by the applicant technical service The competent authority shall take into account accreditation certificates with adequate scope in order to complete its global assessment of the technical service. 7. Preparation for assessment 7.1. The competent authority shall formally appoint an assessment team. The former shall ensure that the expertise brought to each assignment is appropriate. In particular, the team as a whole: (a) Shall have appropriate knowledge of the specific scope for which designation is sought; and Page 19 of 23

20 (b) Shall have understanding sufficient to make a reliable assessment of the competence of the technical service to operate within its scope of designation The competent authority shall clearly define the assignment given to the assessment team. The task of the assessment team is to review the documents collected from the applicant technical service and to conduct the on-site assessment The competent authority shall agree, together with the technical service and the assigned assessment team, to the date and schedule for the assessment. However, it remains the responsibility of the competent authority to pursue a date that is in accordance with the surveillance and reassessment plan The competent authority shall ensure that the assessment team is provided with the appropriate criteria documents, previous assessment records, and the relevant documents and records of the technical service. 8. On-site assessment The assessment team shall conduct the assessment of the technical service at the premises of the technical service from which one or more key activities are performed and, where relevant, shall perform witnessing at other selected locations where the technical service operates. 9. Analysis of findings and assessment report 9.1. The assessment team shall analyse all relevant information and evidence gathered during the document and record review and the on-site assessment. This analysis shall be sufficient to allow the team to determine the extent of competence and conformity of the technical service with the requirements for designation. 10. Reassessment and surveillance Reassessment is similar to an initial assessment except that experience gained during previous assessments shall be taken into account. Surveillance on-site assessments are less comprehensive than reassess ments The competent authority shall design its plan for reassessment and surveillance of each designated technical service so that representative samples of the scope of designation are assessed on a regular basis. The interval between on-site assessments, whether reassessment or surveillance, depends on the proven stability that the technical service has reached When, during surveillance or reassessments, non-conformities are ident ified, the competent authority shall define strict time limits for corrective actions to be implemented When the corrective or improvement actions have not been taken within the agreed timeframe or are not deemed to be sufficient, the competent authority Page 20 of 23

21 shall adopt appropriate measures, such as conducting a further assessment or suspending/withdrawing the designation for one or more of the activities for which the technical service has been designated When the competent authority decides to suspend or withdraw the desig nation of a technical service, it shall inform the latter by registered mail. In any case, the competent authority shall adopt all the necessary measures to ensure the continuity of the activities already undertaken by the technical service. 11. Records on designated technical services 11.1.The competent authority shall maintain records on technical services to demonstrate that requirements for designation, including competence, have been effectively fulfilled The competent authority shall keep the records on technical services secure to ensure confidentiality Records on technical services shall include at least the following: (a) Relevant correspondence; (b) Assessment records and reports; (c) Copies of designation certificates.
