2 Regulation Regarding All-Terrain Vehiles and Off-Road Utility Vehiles BE T RESOLVED that the akson County Board of Supervisors hereby adopt the following regulations regarding all-terrain vehiles and off-road utility vehiles operated on that portion of ounty roadways as designated by the Board of Supervisors..0 Purpose.02 Definitions.03 Operations on roadways.04 Restritions SECTON.0 PURPOSE The purpose of the resolution is to designate that portion of akson County roadways upon whih all-terrain vehiles or off-road utility vehiles may be operated. SECTON.02 DEFNTONS. All-terrain Vehile means a motorized vehile with not less than three and not more than six non-highway tires that is limited in engine displaement to less than one thousand ubi entimeters and in total dry weight to less than,200 pounds and that has a sear or saddle designed to be straddled by the operator and handlebars for steering ontrol. 2. Commission means the natural resoure ommission of the department. 3. Department means Department of Natural Resoures (DNR). 4. Off Road Utility Vehile means a motorized vehile with not less than four and not more than eight non-highway tires or rubberized traks that is limited in engine displaement to less than,500 ubi entimeters and in total dry weight to not more than 2,000 pounds and that has a sear that is of buket or benh design, not intended to be straddled by the operator, and a steering wheel or ontrol levers for ontrol. 5. Roadway means that portion of a highway improved, designed or ordinarily used for vehiular travel. SECTON.03 OPERATONS ON ROADWAYS. A registered all-terrain vehile or off-road utility vehile may be operated on gravel roads in akson County, owa as designated by the Board of Supervisors annually. Suh operation shall not begin until one-half hour after sunrise and must ease one-half hour before sunset. 2. These roadways may only be operated by all-terrain vehiles and off-road utility vehiles on the days set annually by the Board of Supervisors and must be ontained to the speifi roadways designated for eah day. 3. All designated roads shall be marked with proper signage on the speifi days that they are designated to be operated on. SECTON.04 RERCTONS. A person shall not drive or operate an all-terrain vehile or off-road utility vehile: a. At a rate of speed greater than 35 miles per hour or greater than reasonable or proper under all existing irumstanes b. n a areless, rekless, or negligent manner so as to endanger the person or property of another or to ause injury or damage thereto.. While under the influene of intoxiating liquor or narotis or habit-forming drugs. d. Without a lighted headlight, taillight, and properly funtioning, unaltered stok muffler as defined in setion 32.2 of owa Code. e. n any tree nursery or planting in a manner whih damages or destroys growing stok. f. On any publi land, publi ie or snow, or designated riding trail, in violation of offiial signs of the ommission prohibiting suh operation in the interest of safety for persons, property, or the environment. Any offier appointed by the ommission may post an offiial sign in an emergeny for the protetion of persons, property or the environment. g. n any park, wildlife area, preserve, refuge, game management area or any portion of a meandered stream, or any portion of the bed of a non-meandered stream whih has been identified as a navigable stream or river by rule adopted by the department and whih is overed by water, exept on designated riding areas and designated riding trails. This paragraph does not prohibit the use of ford rossings of publi roads or any other ford rossing when used for agriultural purposes; the operation of onstrution vehiles engaged in lawful onstrution, repair, or maintenane in a streambed; or the operation of all-terrain vehile on ie. h. Upon an operating railroad right-of-way. An all-terrain vehile may be driven diretly aross a railroad right-of-way only at an established rossing and, notwithstanding any other provisions of law, may, if neessary, use the improved portion of the established rossing after yielding to all onoming traffi. This paragraph does not apply to a law enforement offier or railroad employee of a utility with authority to enter upon the railroad right-of-way in the lawful performane of the employee s duties. 2. A person shall not operate or ride an all-terrain vehile or off-road utility vehile with a firearm in the person s possession. 3. a. A person shall not operate an all-terrain vehile or off-road utility vehile with more persons on the vehile than it was designated to arry whih is defined as fatory approved seat for eah and every rider. No passenger shall ride on any rak or argo area. b. Paragraph a. does not apply to a person who operates an all-terrain vehile as part of a farm operation as defined in owa Code Setion A person shall not operate an all-terrain vehile or off road utility vehile pursuant to this resolution unless the operator has a valid driver s liense, the all-terrain vehile or off-road utility vehile is registered and the operator has proof of insurane.
