2 MEMO TO: Newport City Council FROM: Deb Hill, City Administrator DATE: October 4, 2018 SUBJECT: Mayor/Council Background: It s been since 2006 since the mayor/council had a salary increase. A salary increase was proposed two years ago but was turned down. A change in council salary must be approved before a general election year. Discussion: Four surrounding communities were contacted for comparison: Current: Newport pop Mayor - $4380 Council - $3792 Comparisons: St. Paul Park pop Mayor - $4350 Council - $3800 Note There is a $35 stipend only if one is assigned to the planning commission or parks and rec committees. Afton pop Mayor - $3368 Council - $2244 Bayport pop Mayor - $5274 Council - $3516 Oak Park Heights pop Mayor $6780 Council - $5760 Suggested increase: Mayor - $4380 to $5040 ($365 to $420) Council - $3792 to $4380 ($316 to $365) 3

5 ARTICLE III. - SNOWMOBILES AND ALL-TERRAIN VEHICLES Sec Applicable law and rules. M.S.A , rules and regulations governing snowmobiles and all-terrain vehicles promulgated by the commissioner of natural resources, M.S.A. ch. 169, and articles I and II of this chapter shall apply to the operation of snowmobiles and all-terrain vehicles upon streets and highways, except for those provisions relating to required equipment and except for those which by their nature can have no application. (a) The following terms as used in this section shall have the meanings stated: (1) "Motorized golf cart" means a vehicle commonly known as a golf cart, having at least four wheels, and either an electric or a gas motor. (2) "All-terrain vehicle" or "ATV" means a motorized flotation-tired vehicle of not less than three low pressure tires, but not more than six tires, that is limited in engine displacement of less than 1,000 cubic centimeters and includes a class 1 all terrain vehicle and class 2 all-terrain vehicle. A class 1 all-terrain vehicle has a total dry weight of less than 1,000 pounds. A class 2 all-terrain vehicle has a total dry weight of 1,000 to 1,800 pounds. (3) "Utility task vehicle" or "UTV" means a side-by-side, four-wheel drive, offroad vehicle that has four wheels, is propelled by an internal combustion engine with a piston displacement capacity of 1,200 cubic centimeters or less, and has a total dry weight of 1,800 but less than 2,600 pounds. (4) "Designated Roadways" means city streets, avenues and alleys not specifically excluded in this ordinance. It does not mean United States or Minnesota trunk highways or Washington County highways or county state-aid highways unless permitted by county ordinance. (b) No person shall operate a motorized golf cart, ATV or UTV under this ordinance: (1) If under the age of sixteen (16) years; (2) Except on designated roadways and from sunrise to sunset, unless equipped with original equipment headlights, taillights, and rear-facing brake lights; (3) In inclement weather or when visibility is impaired by weather, smoke, fog, or other conditions, or at any time when there is insufficient visibility to clearly see persons and vehicles on the roadway at a distance of five hundred (500) feet; (4) Unless the vehicle is equipped with a rear view mirror as provided in Minnesota Statutes ; (5) With a passenger or passengers unless each such passenger is seated on a seat specifically designed for the transport of passengers. 6

6 (c) Motorized golf carts shall display the slow-moving vehicle emblem provided for in Minnesota Statutes , when operated on designated roadways. (d) The operator of a motorized golf cart, ATV or UTV under permit on designated roadways shall have all the rights and duties applicable to the driver of any other vehicle under the provisions of Minnesota Statutes 169, except when those provisions cannot reasonably be applied to a motorized golf cart, ATV or UTV. (Code 1997, ) Sec Time of operation. (a) (b) Generally. Except as otherwise provided in this section, a snowmobile or all-terrain vehicle may be operated within the city only during the following times: (1) 7:00 a.m. through 10:00 p.m. on Sundays through Thursdays; (2) 7:00 a.m. through 12:00 midnight noon on Fridays and Saturdays, and on any day preceding a state recognized holiday. Exception. A snowmobile or all-terrain vehicle may be operated during times other than those permitted under subsection (a) of this section for the purpose of returning to the residence of the operator by the most direct route. (Code 1997, ) Sec Places prohibited. No person shall operate a snowmobile or all-terrain vehicle within the city in any of the following places: (1) Upon private property without written permission of the owner or persons entitled to possession and use of the property; (2) Upon any school grounds, park property, playgrounds, or recreation areas, except as and at such times as the proper authorities may authorize or designate; (3) Upon any street or alley except that portion ordinarily used for vehicular traffic; (4) Upon any public sidewalk or walkway. (Code 1997, ) Sec Noise. No person shall operate a snowmobile or all-terrain vehicle so as to create unreasonably loud, unnecessary, or unusual noise so as to unreasonably interfere with the peace and quiet of other persons. (Code 1997, ) Sec Speed.

7 No person shall operate a snowmobile or all-terrain vehicle upon any street or highway within the city at a speed in excess of 15 miles per hour. (Code 1997, ) Sec Parking. No person shall leave or allow a snowmobile or all-terrain vehicle to be or remain unattended on any street, highway, or public property while the motor is running or with the keys in the ignition switch.
