INSTRUCTIONS Sealed Tenders shall be addressed to: Town of Osoyoos 8707 Main Street Box 3010 Osoyoos BC V0H 1V0 Attention: Jim Dinwoodie, Director of Operational Services The Tender envelope shall be clearly marked ". It is the Tenderer's responsibility to ensure that the Tender is in the hands of the Owner no later than 2:00pm (Pacific Time) on Thursday, April 19, Acceptance or Rejection of Tenders The Owner reserves the right to reject any or all Tenders and to waive irregularities and formalities at his discretion. The lowest Tender will not necessarily be accepted. Without limiting the generality of the foregoing, any tender may be rejected for any of the following reasons: Incomplete Tender; Obscured or irregular erasures or corrections in the Tender Form; Prices omitted or unbalanced; Evidence of inadequate capacity to perform the contract; Evidence of previous failure to perform adequately on similar work. The Owner may accept a Tender by issuing a "Notice of Acceptance" Tender Line Painting Page 3 of 14

4 2. GENERAL CONDITIONS Please price the following traffic marking requirement. a) The bidder is required to view the work to be done and to satisfy himself of the practicability and other details of such work. b) All work must be done in a manner and to a standard acceptable to the Director of Operational Services or delegated representative. All work is to be coordinated so as to create a minimum of inconvenience to traffic and pedestrians. See installation guideline pages. c) The Town will not allow work to be done in the downtown area or on main traffic routes during peak traffic times. The contractor must schedule his work on such days, or at such time when traffic flows are at a minimum. d) No painting will be done during inclement weather or at a time of day when drying time may be delayed. e) The Town reserves the right to add to the quantities or delete any portion that may not be required or that they may desire to have done by others. f) The Contractor will provide all the necessary equipment, material, labour, supervision and all other items necessary to complete the marking included in this quotation. All work is to be carried out within the limits of the Town of Osoyoos and shall not include work, which is the responsibility of the Ministry of Transportation and Infrastructures. g) The Contractor shall hold a current and valid business License for the Town of Osoyoos. h) At the time of submitting a bid, the Contractor shall specify all equipment that is intended to be used to complete the work. This information shall be accurate and complete enough to enable the Town to assess the capability of the equipment. Work references may also be submitted. i) Before beginning the work, the Contractor must provide proof of a paid up Comprehensive General Liability Insurance policy in the minimum amount of $2,000, This policy must include liability for over spray and wind drifting. j) The Town reserves the right to accept or reject any quotation and the lowest or any tender may not necessarily be accepted. k) The Contractors Responsibilities pertaining to WORKSAFEBC must be signed. l) The work shall be completed on or before June 15, Tender Line Painting Page 4 of 14

5 3. STANDARDS AND PROCEDURES a) Layout New Road markings requiring contractor layout: Oleander Drive curve at Acacia Court (Yellow centre line curve) Unless approved by the Director of Operational Services, no marking shall be noticeably different from the existing in terms of size, length, location, colour, etc. b) Workmanship Tangent lines shall be straight, and curved lines shall have a constant radius. Paint must be applied to meet Ministry of Transportation and Infrastructure specifications (minimum 16. mil. Wet, drying to a minimum of 12. mils). For all center lines and crosswalks use glass bead, reflectorized paint. There shall be no over spray in the line width. The Contractor shall be responsible for finding a site for cleaning out his equipment and disposing of waste materials. c) Protection of Work The Contractor shall be responsible for providing traffic control including the setting out of all the necessary barricades, cones and speed warning devices necessary to carry out and protect the work from the traffic and pedestrians. 4. CLEANING It will be the responsibility of the Contractor to ensure that all areas to be painted are clean and free of debris and any extra sweeping and cleaning required shall be the responsibility of the Contractor. 5. MEASUREMENTS AND PAYMENTS The unit prices tendered will be in effect for All quantities shown in this quotation are approximated. Actual payment by the Town to the Contractor shall be made on the following basis: a) Single solid white or yellow lines and broken white traffic lane lines, crosswalks, parking stalls and stop bars will be based on scaled distances from official Town plans, and/or actual measurement of total traveled length multiplied by the unit price in the quotation. b) Directional arrows, school markings, and handicap symbols will be in accordance with the quotation. c) No payment will be made for layout and it is the Contractor s responsibility to assess the difficulty of following the existing markings Tender Line Painting Page 5 of 14

6 d) Any work found to be unacceptable by the Town of Osoyoos shall be redone at the Contractor s expense, including removal of paint by an approved method and repainting. e) No payment will be made until the work is 100% complete and until the contractor has provided, along with his invoice, a WORKSAFEBC clearance certificate. 6. CONTRACTOR S RESPONSIBILITIES The Contractor shall ensure compliance on his part and on the part of all his Sub-Contractors with the Worker s Compensation Act and the Occupational Health and Safety Regulations (the Regulation) there under. In the event that the Contractor refuses or fails to comply with an order or regulation under the Workers Compensation Board Occupational Health and Safety Regulation, or with the Basic Safety Outline Below, the Town of Osoyoos may terminate the Contract. The Contractor shall be registered with the WORKSAFE BC. All major contractors are designated as Principal Contractors as defined in the WORKSAFE BC OH & S. Regulation Section If work overlaps or adjoins, one contractor will be principal contractor and others will be classified as sub-contractors. Principal Contractors Responsibilities: a) Requires all works, subcontractors and others coming onto the Site to comply with the Regulation. b) Ensures all works receive pre-employment safety orientation, guidance and training applicable to the type of work they perform. c) Initiates and implements conditions that provide a safe and healthy place of work; d) Provides a first aid program which meets or exceeds the requirements of the regulation; e) Provides ongoing health and safety inspection and review of equipment and employees; f) Responds to identified hazards related to practices, materials and substances; g) Ensures personal protective equipment is available and used; h) Provides appropriate measures and actions to protect the public; i) Initiates, reports and takes immediate action to investigate accidents and incidents that require notification the Workers Compensation Board Tender Line Painting Page 6 of 14
