Article 1 st : The present decree determines the import conditions of 2 nd hand vehicles in Gabonese Republic. Article 2: Is to be considered as: second hand vehicle: all automobile vehicle, moped, motorcycle, tricycle of less than six month of age from the date of first circulation abroad and having more than 6000 kilometers. Second hand importer: every physical or moral person established in Gabon who imports at professional or on occasional title second hand vehicle. Article 3: Can only be imported in Gabon: 1. For cars of category A,B, and D Vehicle having 3 years old maximum after their first circulation abroad; 2. For cars of category C and E: Vehicles having 6 years old maximum after their first circulation abroad Article 4: These disposition do not apply to: Special engines of public work, stevedoring, farming and forest engine Collection cars Cars for religious, associations known for public interests Car brought by Gabonese leaving abroad and returning to Gabon, with one car per person Used cars for diplomatic, administrative or technical personnel of embassies, consulates or international accredited organizations in Gabon. Used vehicles specially made for handicap persons with one vehicle per person However, except for special engine for public work, stevedoring, farming and forest engine, collection cars the rest of the vehicle cannot be sold before two years after their circulation on the national territory.

6 Article 5: all importers of used vehicles affected by this decree should provide, when entering national territory, the following original documents: Bying invoice or equivalent; Freight invoice; Bill of lading or equivalent; Original registration certificate Last attestation of technical control delivered by accredited organism at the country of origin; Liquidation bulletin; CGC waiver; Interpol control document; Import attestation of three months at least for moral person; Tax regularization for moral person; Technical approval delivered by the transport department stating the existence of a stocking place enough for professional importers; Article 6: In case of a dispute or a doubt on the real age or technical state of a vehicle, an accredited expert by the transport department will be provided by Custom department: When a fraud will be found: The expert costs will be for importer s charge The vehicle will declared to have been imported in violations of present decree dispositions; Article 7: All used vehicle imported or declared to be imported in violation of the present decree will be seized and destroyed on importer s charge. It can also be returned to imported country at importer s charge. Article 8: All used vehicle is submitted to an antipollution control when entering national boundaries, conformed to the enforced texts. Article 9: the matriculation of all imported used vehicles is subject to the providing of technical visit delivered by one accredited control center. Article 10: for transitional period, all owners of vehicle under custom, imported in violation of the enforced past legal dispositions, have a time of three months to proceed to the operation of customs formalities release.
