References to specific statutory Sections wherever used in this Title mean the Wisconsin Statutes and any future amendments, revisions or modifications thereof. (Ord (part): 12 of Ord. passed 9/11/72) State Statutes Adopted. A. State Traffic Forfeiture Laws Adopted. Except as otherwise specifically provided in this Title, all provisions of Chapters 340 to 348 of the Wisconsin Statutes and Chapter Trans 305 of the Wisconsin Administrative Code describing and defining regulations with respect to vehicles and traffic for which the penalty is a forfeiture only, including penalties to be imposed and procedure for prosecution, are adopted and by reference made a part of this Chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this Title and Code. Any future amendments, revisions or modifications of the statutes incorporated herein are intended to be made a part of this Code in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the state of Wisconsin. There are also adopted by reference the following Sections of the Wisconsin Statutes but the prosecution of such offences under this Title shall be as provided in Chapters 340 to 348 of the 3

4 Wisconsin Statutes and the penalty for violation thereof shall be limited to a forfeiture as provided in Section : (1) Negligent Operation Of Vehicle Off Highway. (Ord ; Ord (part); editorially amended per approval by Village Board 7/8/96; Ord (part); 1 of Ord. passed 9/11/72). 4

5 Chapter ENFORCEMENT OF REGULATIONS Sections: Enforcement Generally Deposits Notice Of Demerit Points And Receipt Officer's Delivering Penalties-- Oath And Bond Enforcement Generally. A. This Title shall be enforced in accordance with the provisions of Sections to , Chapter 299 and Section of the Wisconsin Statutes. B. Stipulation of Guilt or No Contest. Stipulations of guilt or no contest may be made by persons arrested for violations of this Title in accordance with Section (1) (b), Wisconsin Statutes, whenever the provisions of Section are inapplicable to such violations. Stipulations shall conform to the form contained on the uniform traffic Citation and complaint under Section , Wisconsin Statutes, and may be accepted within ten (10) days of the date of the alleged violation. Stipulations may be accepted by the Village Police Department. (Ord (a) and (b), 1985: 11(1) of Ord. passed 9/11/72) Deposits. Any person stipulating guilt or no contest under Section must make the deposit required under Section , Wisconsin Statutes, or, if the deposit is not established under such statute, shall deposit a forfeited penalty as provided in the schedule established by the Chief of Police and approved by the Village Board. Deposits may be brought or mailed to the office of the Police Department as directed by the arresting Officer. Deposits for parking or nonmoving violations shall be mailed or brought to the Village Police Department. (Ord (c), 1985: 11(2) of Ord. passed 9/11/72) Notice Of Demerit Points And Receipt. Every Officer accepting a forfeited penalty or money deposit under this Title shall receipt therefor in triplicate as provided in Section (3) (b), Wisconsin Statutes. Every Officer accepting a stipulation under the provisions of this Title shall comply with the provisions of Sections , , (1)(a) and (2), Wisconsin Statutes, and shall require the alleged violator to sign a statement of notice in substantially the form contained on the uniform traffic Citation and complaint promulgated under Section Wisconsin Statutes. ( 11(3) of Ord. passed 9/11/72) Officer's Delivering Penalties--Oath And Bond. Any Officer accepting deposits or forfeited penalties under this Title shall deliver them to the Village Clerk/Treasurer within twenty (20) days after receipt. Any Officer authorized to accept deposits under Section , Wisconsin Statutes, or this Title shall qualify by taking the oath prescribed by Section 19.01, Wisconsin Statutes, and filing an official bond in the sum of one thousand dollars ($ ) as described by Section ( 11(4) of Ord. passed (9/11/72). 5

6 Chapter ACCIDENT REPORTS Sections: Accident Reports Accident Reports. The operator of any vehicle involved in an accident shall within ten (10) days after such accident file with the Village Police Department a copy of the report required by Section , Wisconsin Statutes, if any. If the operator is unable to make such report any occupant of the vehicle at the time of the accident capable of making such report shall have the duty to comply with this Section. Such reports shall be subject to the provisions and limitations in Sections (4)(f) and , Wisconsin Statutes.( 7 of Ord. passed 9/11/72). 6

7 Chapter SPEED LIMITS Sections: Speed limits Speed limits. Established speed limits within the Village of Twin Lakes shall be the statutory speed limits as set forth in Section , Wisconsin Statutes. (Ord : 2 of Ord. passed 9/11/72). 7

8 Chapter SIGNS AND SIGNALS Sections: Erecting And Maintaining Signs And Signals Removal Of Unofficial Signs Or Signals Erecting And Maintaining Signs And Signals. The Department of Public Works is authorized and directed to procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the rules of the state highway division giving such notice of the provisions of this Title as required by state law. Signs shall be erected in such locations and manner as the Department of Public Works shall determine will best effect the purposes of this Title and give adequate warning to users of the street or highway. ( 9(1) of Ord. passed 9/11/72) Removal Of Unofficial Signs Or Signals. The Department of Public Works shall have the authority granted by , Wisconsin Statutes, and is directed to order the removal of a sign, signal, marking or device placed, maintained or displayed in violation of this Title or Section , Wisconsin Statutes. Any charge imposed on a premises for removal of such an illegal sign, signal or device shall be reported to the Village Board at its next Regular Meeting for review and certification. 9 Sections: Through Streets One-Way Streets. Chapter THROUGH HIGHWAYS AND ONE-WAY STREETS Through Streets. In the interest of public safety and pursuant to Section , Wisconsin Statutes, the following streets or portions thereof are declared to be through streets: A. North Lake Avenue from Main Street to Village limits; B. Burlington Avenue north from West Main Street to Village limits; C. Legion Drive from South Lake Street east to Village limits; D. Wilmot Road from South Lake Street to Village limits; E. East Lake Shore Drive from Wilmot Road to State Line Road; F. Lance Drive from Main Street west to Village limits; G. Musial Road from Lance Drive East to Lake Street; H. Main Street from Lake Street west to Village limits.(ord (part): 3 of Ord. passed 9/11/72) One-Way Streets. Pursuant to Section , Wisconsin Statutes, the following street and/or parts thereof are declared to be one-way streets, and no person shall operate any vehicle thereon except in the indicated direction. Emergency and snow plow vehicles/equipment are exempted from this provision. A. Waldeck Drive, east from south Waldeck Drive to Indian Point Road. This is from 405 to 454 Waldeck Drive. B. Frontage Road adjacent to and parallel to Lance Drive, eastbound from Bay View Avenue to its terminus approximately seven hundred and seventy five (775) feet to the east. 10 Chapter PARKING, STOPPING AND STANDING Sections: Definitions Parking Regulations And Penalties Citation Procedure Parking Limits Regulation Of Prohibited Parking Prohibited Parking--Fire Lanes Stop Streets Parking Limitations Handicapped Parking Zone Boat Launch Facilities Snow Emergency Temporary No Parking Zones Maximum Parking Time Stopping, Standing Or Parking Of Vehicles On Village Streets And Roadways School Bus Operators To Use Flashing Red Warning Lights Parking Of Large Motor Vehicles Definitions A. Non-Moving Violation shall mean any parking of a vehicle in violation of a statute or local Ordinance. B. Parking Citation shall mean the paper form designated by the Chief of Police required for use in enforcing the Non-Moving Violations created or adopted in this Chapter in accordance with of the Wisconsin Statutes. Such parking Citation shall contain: 1. A printed explanation of the procedure for either paying or contesting the Citation. 2. A printed warning that nonpayment may result in the suspension of current and the denial of future vehicle registrations for the registered owner of the vehicle cited. 3. The location, date and time of the violation. 4. The vehicle registration information, including the license plate number, state, expiration, vehicle make and year. 5 A specific reference to the Ordinance violated and the forfeiture associated with that violation. C. Suspending Authority shall mean the Twin Lakes Police Department who shall be responsible for submitting requests to the TVRP for registration suspension for unpaid parking Citations. The person authorized to sign suspension forms shall be the Chief of Police or his/her designee. D. TVRP shall refer to the Wisconsin Department of Transportation Traffic Violation and Registration Program. (Ord ) Parking Regulations And Penalties. A. Pursuant to , Wis. Stats., the Village of Twin Lakes has the authority to enact and enforce the parking regulations, also referred to as "Non-Moving Violations," in conformity with to , Wis. Stats.; and that in addition to those regulations directly referenced by statute, regulations restricting parking under this Title have been created; and that the penalties and provisions for those Ordinances and adopted statutes shall be governed by this Title in conformity with , Wis. Stats. B. Non-Moving Traffic Violation and Registration Program. Pursuant to the provisions of (4), Wis. Stats., the Village of Twin Lakes is authorized and elects to participate in the Non-Moving Traffic Violation and Registration Program (TVRP) of the Wisconsin Department of Transportation and pay the costs established by the Department under 85.13, Wis. Stats. Such costs shall, in turn, be assessed against persons charged with non-moving violations. The Chief of Police shall be responsible for complying with the requirements set forth in (4), Wis. Stats. 10

11 C. The penalty for violation of this Chapter shall be forfeiture in the amount set forth in Chapter of this Code in conformity with , Wis. Stats.; plus any applicable court costs which may be imposed by the Municipal Court in accordance with (1), Wis. Stats. for contested violations, plus any fees or charges authorized under (4)(d) for unpaid Citations where the vehicle registration has been submitted to the TVRP for suspension. (Ord ) Citation Procedure A. Upon issuance of a Citation, a person charged with a non-moving traffic violation under this Section may make a deposit of money to the Twin Lakes Police Department by mail, by electronic means authorized by the agency, or in person, in which case the Citation shall not be filed with or transmitted to the Municipal Court, and no further action is required of the person charged. B. A person charged with a non-moving violation under this Section has the option to contest the Citation by giving notice in writing to the Twin Lakes Police Department. The registered owner of the vehicle shall forfeit his/her right to contest the Citation if such notice is not received by the agency within 28 days of the initial notice date sent. C. If the person charged gives notice of his/her desire to contest the Citation, the Citation shall be submitted to the Municipal Court pursuant to , Wis. Stats., and the procedures under to , Wis. Stats., will apply. D. Notice. 1. If payment for the Citation is not received by the Twin Lakes Police Department within thirty (30) days of the date of issue and a request to contest has not been received by the agency, the forfeiture amount for the violation shall be double, and a notice will be sent to the last known address of the registered owner of the vehicle cited. 2. The notice shall include the date the Citation was issued, the license number of the vehicle involved, the place or manner in which the Citation may be paid, the means by which the Citation may be contested, and the date by which the person must pay or contest the Citation to avoid further action by the Police Department. E. If the Citation remains unpaid after fourteen (14) days of the first notice, and no request to contest the charge has been received, a second notice will be sent to the last known address of the registered owner of the vehicle cited. F. If, after fourteen (14) days of the second notice, the Citation remains unpaid and a request has not been received to contest the Citation, the Twin Lakes Police Department may proceed under , Wis. Stats., to suspend the registration and deny future registration until the amount of the forfeiture plus any authorized fees and costs are paid. G. If the person subsequently pays the forfeiture and any fees and costs, the Twin Lakes Police Department shall send written notification to the TVRP within three (3) working days that payment has been satisfied so that the suspension and/or refusal of future registrations will be lifted. H. In the event that a vehicle cited under this Section is a vehicle registered in a state other than Wisconsin and if the owner fails to pay any parking Citation, the Chief of Police shall be authorized to utilize a commercial collection firm to collect the outstanding forfeiture, along with any authorized fees or costs. I. Any vehicle parked in violation of Chapter may be towed at the direction of the Chief of Police, or their respective designees. The owner of a towed vehicle shall be responsible for all towing and storage charges in addition to any forfeitures. (Ord ) Parking Limits. When signs are erected in any block giving notice thereof, no person shall park a vehicle for longer than the period hereinafter specified. A. Between the hours of ten (10:00) p.m. to six (6:00) a.m.: 1. East side of Wilmot Avenue between Lavera Parkway and Sunset Trail; 2. East side of Wilmot Avenue at intersection of Wilmot Avenue and Lake Street. B. Between the hours of two (2:00) p.m. and two (2:00) a.m.: On South Lake Avenue from the intersection of Wilmot Road to Barry Street. (Ord (part) : 5(1) of Ord. passed 9/11/72). 11

12 Regulation of Prohibited Parking. No operator of any vehicle shall park or stop a vehicle otherwise than in obedience to traffic regulations, signs, signals or markings whether such vehicle is occupied or not, in any of the following places: A. Within an intersection. B. On a crosswalk. C. In any designated safety zone, or within fifteen (15) feet of a designated safety zone. D. On any sidewalk or sidewalk area, or area painted to indicate a sidewalk. E. Double-parking on the side of any street or roadway. F. Entrance to the fire station on the north side of East Main Street, or across the street from the fire station on the south side of East Main Street twelve (12) spaces, or five (5) spaces on the north side of East Main Street nearest the fire station in front of 248 East Main Street. This subsection shall not apply to operators of authorized emergency vehicles, which shall include privately owned motor vehicles used by members of the Twin Lakes Fire Department while en route to a fire or on an emergency call pursuant to orders of their Chief or other Commanding Officer. G. In front of school buildings between seven-thirty (7:30) a.m. and four-thirty (4:30) p.m. on school days. H. In any public or private alley, except for the purpose and time required to load and unload passengers or materials. I. Upon streets which have been marked or in places signed for angle parking, other than at the angle to the curb indicated by such marks or signs. J. Within twenty (20) feet of the approach to any stop sign or traffic control signal located at the side of a roadway or in any area of painted yellow curb unless otherwise indicated by signs or markings. K. Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic. L. At any place where official signs prohibit parking. M. Within four (4) feet of the approach or within four (4) feet beyond an alley or driveway. N. Contrary to posted rules in any public parking lots. O. Contrary to the restrictions on stopping and parking as enumerated in the provisions of Sections to of Wisconsin Statutes. (Ord ; Ord : Ord ; Ord (part): 5(2) of Ord. passed 9/11/72) Prohibited Parking--Fire Lanes. There shall be no parking in any fire lane, as indicated by the posting of no parking signs on said fire lanes. No parking signs shall be posted on fire lanes with the approval of the majority of the Village Board, and a master list of posted fire lanes shall be maintained by the Village Clerk/Treasurer/Treasurer at the Village Hall. (Ord ) Stop Streets. All vehicles shall come to a complete stop before entering or proceeding on streets or intersections that have posted stop signs. All stop signs shall be approved by a majority vote of the Village Board prior to posting, and a master list of all approved stop signs shall be maintained by the Village Clerk/Treasurer at the Village Hall.
