5 MAHATMA PHULE KRISHKI VIDYAPEETH, RAHURI DISTRICT: AHMEENAGAR, PIN TERMS AND CONDITIONS OF AUCTION SALE OF UNSERVICEABLE UNIVERSITY VEHICLES, TRACTORS, FARM MACHINERY, AND EQUIPMENT, TYRES, TUBES, BATTERIES, ETC ) The Mahatma Phule Krishi Vidyakpeeth, Rahuri has appointed the Auction Committee. This Committee will supervise the auction sale and will give decisions in the matter on the spot. The decisions of the Committee will be final. 2) 25% of the amount of auction bid as earnest money or full payment shall be paid in cash by the highest bidder on the spot on the fall of the hammer. 3) If, on the fall of the hammer, the highest bidder fails to pay earnest money of full payment required, the bid shall forthwith be cancelled and the lot shall be re-auctioned. The auctioneer may in consultation with the Auction Committee refuse to accept the bid of any person without assigning any reasons, whatsoever. 4) In the event of any dispute arising as to the bid, the articles will again be put up at the highest proceeding bid. The decision of the auctioneer shall be final to all intents and purposes. 5) The highest auction bid will be subject to the approval of the Auction committee and the Auction Committee shall reserve the right to accept or reject the highest bid without declaring any reasons whatsoever. Such decision will be given by the Auction Committee on the spot at the time of auction. 6) The Auction Committee reserves the right to withdraw from the sale any lot or lots advertised for sale, without assigning any reason or rearrange the lots, as desired even after publishing the catalogue by the auctioneer. 7) The balance of the value of the bids accepted on the spot shall be paid by the auction purchaser to the Comptroller, Mahatma Phule Krishi Vidyapeeth, Rahuri within 10 (ten) days from the date of auction failing which, an 18% per annum (to be calculated on days basic) will be charged for the period not exceeding further 20 (twenty) days. 8) If the sale of the sale value of any lot or lots is not paid by the auction purchaser within the period stipulated in the above clause, the earnest money deposited referred to in clause (2) above will stand forfeited and sale will be treated as cancelled. 9) The stores purchased in the auction, shall be removed by the auction purchaser from the site within 30 (thirty) days from the date of auction. If deliveries are not taken within these thirty days, penalty of Rs.100/- (Rs. One hundred only) per day will be charged after expiry of the initial period till the last date of complete delivery. If the auctioned material is not removed within 60 (Sixty) days from date of auction, the Competent Authority of this University will reserve the right to cancel the auction in which case the earnest money shall stand forfeited and the amount of penalty for 60 days shall recoverable from the balance amount paid by the auction purchaser. 10) Deliveries will be made only during working hours on working days. The stores shall in every respect, remain at the risk of the auction purchaser from date of auction and the University shall not accept any liability for the safe custody for preservation there of from the date. 6 11) The auction purchaser shall collect copy of the delivery of the delivery order from the Registrar, Mahatma Phule Krishi Vidyapeeth, Rahuri after making full payment. 12) Should the original buyer wish to take delivery of the goods purchased through a representative, he must authorize the later by a letter of authority which shall be presented to the Registrar, Mahatma PhuleKrishi Vidyapeeth, Rahuri. The Registrar, MPKV, Rahuri may at his entire discretion de-cline to act any such authority letter unless the buyer satisfies the Registrar that the authority is genuine. Delivery by proxy will be at purchasers sole responsibility and risk and no claim shall be against the Registrar on any account whatsoever if delivery is effected to a wrong person. 13) Re-sale will not recognized by the Registrar who will issue order to pass the document of sale in the name of auction purchaser. 14) The buyer shall be responsible for any damage done to the premises in removing the goods bought by him. 15) It is to be clearly understood that all items are to be taken as they stand at time of the auction with all possible faults, breakages and errors of description, etc. All the goods are sold on the presumption that bidders have first inspected them and the principle of Caveat Emptor shall apply. No complaint will be entertained and no reliance must be placed on any description. 16) All disputes arising out of or in any way, touching or concerning these conditions whatsoever, will be referred to the Registrar, MPKV, Rahuri whose decision shall be final and binding. 17) No exemption certificate will be given to the buyer in respect of any taxes, octroi or any other charges from the Registrar, MPKV, Rahuri. 18) The successful bidder has to pay Maharashtra Sales Tax according to the provisions of the Bombay Sales Tax Act and Rules 59 over the total sale value accepted.
