2 TOWN OF CARRBORO ENVIRONMENTAL ADVISORY BOARD SUMMARY Meeting on October 4 th, 2018, 7:00 pm, Town Hall Basement Conference Room Board Members Guests Staff Bruce Sinclair Sammy Slade Maddie (UNC MPA Program) Laura Janway Tim Turner (chair) Ben Skelton (vice-chair) (absent) Jeanette O Connor Administrative Matters The EAB approved the minutes for September 6 th, discussed potential electric vehicle ready requirements for the Land Use Ordinance, and prepared comments for the 203 S. Greensboro Project. Maddie, a student from the University of North Carolina (UNC) Master of Public Administration (MPA) program, attended the meeting. The EAB discussed the process for requesting the addition of electric vehicle (EV) ready requirements to the LUO. Bruce Sinclair presented a petition from Chapel Hill s Transportation and Connectivity Advisory Board to add EV Ready Requirements to the Chapel Hill LUMO. Bruce Sinclair agreed to draft a memo recommending the Town to amend the LUO by adding EV ready requirements. In the next meeting, the EAB will review the EV ready requirements memo and vote on further action. Tim Turner volunteered for an action item to update the EAB review comments checklist. Review Comments The EAB prepared review comments on the 203 Project. The comments included suggestions regarding: Solar Panels Stormwater Control Stormwater Quality Green Roof Plant Species Choices Shading Requirements EV Charging Energy Efficiency Bird Collision Concerns Passive Solar Design Motion was made by Sinclair, seconded by O Connor to approve the 203 S. Greensboro Project comments pending final revisions. Adjourn The motion to adjourn was made by O Connor, seconded by Sinclair. The meeting was adjourned at 9:02 pm. 3 To: Subject: David Andrews, Carrboro Town Manager Patricia McGuire, Carrboro Planning Director Sammy Slade, Board of Alderman EAB Liaison Petition to add Electric Vehicle Ready Requirements to the LUMO Meeting Date: December 13, 2018 Recommendation: The Environmental Advisory Board (EAB) petitions the Board of Alderman to start a process to amend the Land Use Management Ordinance (LUMO) to add Electric Vehicle Readiness requirements. The EAB has researched and developed the text below for new developments: Whereas, the Town of Chapel Hill Transportation Advisory Board with concurrence from the Chapel Hill Environmental Stewardship Board petitioned the Chapel Hill Town Council to consider modifying the LUMO to include provisions for, under certain circumstances, either installation of a minimum number of operating EV-capable parking spaces or a minimum number of parking spaces pre-wired to facilitate upgrade to full EV-capability in the future; Whereas, both of the Town of Carrboro and Town of Chapel Hill are leaders in environmental protection and carbon reduction efforts; Whereas, both of the Town of Carrboro and Town of Chapel Hill have similar environmental goals; Whereas, many other governmental entities have adopted similar regulations (See references); Whereas, many building and trades organization have drafted guidelines for implementing EV readiness (See references); Whereas, Vision 2020, dated December 5, 2000 outlines Town goals to mitigate climate change, lower carbon emissions and increase energy efficiency that align with this proposal, namely 5.50 Energy 5.51 The town should publicly promote every available means of energy conservation. The town s own alternative and renewable energy targets should include passive and active solar, and composted waste co-generation to fuel public vehicles and the heating of town facilities 5.52 The town should set a goal of reduced energy costs in all town buildings and increased fleet mileage for all town vehicles. Whereas, the Town of Carrboro adopted the Community Climate Action Plan, Dated January 24, 2017 with various provisions that align with this proposal, namely,

4 Transportation Recommendation #1: 50% Challenge (Page 28), Reduce Greenhouse Gas Emissions from Motor Vehicle Use by 50% by Carbon Free in 10 Years, Page 76, Year 5 Purchase an Electric car. Whereas, the EAB has been recommending the following provisions in many SUP/CUP/rezoning reviews for almost a year with generally positive feedback from applicants, Whereas, recommendations from the EAB are not legally enforceable, Whereas, the EAB passed a motion to forward the proposal to Town government on Nov xx, 2018, Therefore resolved, The EAB requests the following provisions be added to the Town of Carrboro LUMO. EV Ready Requirements i These requirements apply to new or expanded parking lots and parking structures and developments which require a CUP or SUP or rezoning. They are not required retroactively for existing parking lots. 1. In parking lots with more than 50 spaces, EV charging stations installed in at least 3% of all parking spaces used by the project. o Minimum of two EV charging station parking spaces for each project. At least one of which must be ADA compliant, per NCDOT s guidelines. o Provide a Level 2 charging capacity ( volts) or greater o Comply with the relevant regional or local standard for electrical connectors, such as SAE Surface Vehicle Recommended Practice J1772, SAE Electric Vehicle Conductive Charge Coupler so that they are compatible with all types of chargers o EV charging station spaces must be separate from and in addition to preferred parking spaces for green vehicles 2. Signage for parking of electric vehicles shall include: o o o Information on the charging station to identify voltage and amperage levels and any time of use, fees, or safety information. As appropriate, directional signs to effectively guide motorists to the charging station space(s). Station(s) reserved for electric vehicles 3. 20% of all total parking spaces will be made EV Ready for charging stations, meaning:

The Board of Aldermen has set a public hearing for January 22, 2019 and has requested Planning Board and Environmental Advisory Board review prior to the hearing. INFORMATION The Town has received a request from OWASA to consider a text amendment to the Land Use Ordinance to allow the construction of a new sodium permanganate facility to be placed near University Lake for improved water quality production (Attachment C). OWASA facilities are classified under use category Community or Regional Utility Facilities. A draft ordinance has been prepare, that if adopted, would allow such facilities in the R-10 zoning district subject to specific performance standards. A public hearing has been set for January 22, The Board of Aldermen must receive public comments before adopting amendments to the Land Use Ordinance. Orange County and Planning Board are also needed, and staff has identified the Environmental Advisory Board as another advisory board for referral based on is purview. RECOMMENDATION Staff recommends that advisory boards review the draft ordinance (Attachment B) and adopt a recommendation for inclusion in the public hearing materials for January 22, A recommendation template has been provided for the boards to use (Attachment A).

VOTE: AYES: ( ) ABSENT/EXCUSED: ( ) NOES: ( ) ABSTENTIONS: ( ) Associated Findings By a unanimous show of hands, the membership indicated that no members have any financial interests that would pose a conflict of interest to the adoption of this amendment. Motion was made by and seconded by that the of the Town of Carrboro finds the proposed text amendment, consistent with the provisions in Carrboro Vision2020 to work with OWASA to develop policies and infrastructure relating to the use and production of the finished water supply. Furthermore, the of the Town of Carrboro finds the proposed text amendment, is reasonable in the public interest because it provides for improved water quality production. 8 Attachment B - 1 of 2 AN ORDINANCE AMENDING THE LAND USE ORDINANCE RELATING TO COMMUNITY OR REGIONAL UTLIITY FACILITIES **DRAFT ** THE BOARD OF ALDERMEN OF THE TOWN OF CARRBORO ORDAINS: Section 1. Section (The Table of Permissible Uses) is amended by adding the letters Z, S opposite use classification Community or Regional Utility Facilities under the R- 10 Zoning District to indicate that this use is permissible in this district with a zoning permit or special use permit, subject to the supplementary use regulations in Subsection Section 2. Article XI (Supplementary Use Regulations) is amended by adding a new section as follows: (a) Community or regional utility facilities that: i) support the production of a finished water supply, ii) are within 200 feet of a raw water source, and iii) are no larger than 2000 square feet in building area and no taller than 25 feet in height are allowed in the R-10 zoning district with a zoning permit, provided that such facility otherwise satisfies the requirements of the Carrboro Land Use Ordinance, including the outdoor lighting requirements in Section (b) A community or regional utility facility that supports the production of a finished water supply that is larger or taller than the maximums stated above, or that cannot meet one or more of the provisions below, may be allowed in the R-10 Zoning District with a special use permit issued by the Board of Adjustment upon satisfaction of the considerations required by section (c) At least one on-site parking space, shall be provided, with additional spaces as needed to accommodate the number of vehicles likely to be present at the facility on a regular basis. (d) The facility shall be surrounded by a Type A buffer on all sides unless: i) the facility is located more than 500 feet from any property boundary line, or ii) existing trees satisfy the definition of a Type A buffer, in which case such trees shall be identified on the site plan and shall be maintained in order to comply with this requirement. (f) A community or regional utility shall not generate any noise, smoke, odor, vibration, electrical interference, or other disturbance that is perceptible beyond the boundaries of the lot where the facility is located or that adversely affects the use of adjoining or neighboring properties. (g) No outdoor storage shall be permissible. (h) Any community or regional utility facility shall have signage identifying the operator of the facility and providing a telephone number or other contact information for the operator. Section 3. Section Use of the Designation Z, S, C, in Table of Permissible Uses is amended by adding a new subsection (s) that reads as follows: Page #1

9 Attachment B - 2 of 2 (s) Notwithstanding the foregoing, the permit requirement for use classification Community or Regional Utility Facilities in the R-10 Zoning District shall be determined by the supplementary use regulations in Section Section 4. All provisions of any town ordinance in conflict with this ordinance are repealed. Section 5. This ordinance shall become effective upon adoption. Page #2
