2 Fuel Charges Adjustment for XWDISCOs for the month of May 2018 DECISION OF THE AUTHORITY IN THE MATTER OF FUEL CHARGES ADJUSTMENT FOR THE MONTH OF MAY 2018 FOR EXWAPDA DISCOS 1 Pursuant to the provisions of Section 31(7) of the Regulation of Generation, Transmission and Distribution of Electric Power Act 1997, (NEPRA Act) read with the mechanism/formula determined by the Authority in the tariff determinations for Ex WAPDA DISCOs for the FY and notified in the official gazette, the Authority has to make adjustments in the approved tariff on account of any variations in the fuel charges on a monthly basis 2 In order to make adjustments in the approved tariff of the ExWAPDA DISCOs due to variations in the fuel charges for the month of May 2018, necessary information as to the details of the actual fuel charges etc was obtained from Central Power Purchasing Agency Guarantee Limited (CPPAG) 3 Notwithstanding the fact that the monthly adjustment on account of fuel charges variation is made in pursuance of the provisions of section 31(7) of the NEPRA Act as well as on the basis of a mechanism/formula already determined by the Authority in its annual tariff determinations for ExWAPDA DISCOS, yet in order to provide and opportunity of hearing to the consumers, the salient features and details of the proposed adjustments in the approved tariff were published in newspapers on June 22, 2018 and also uploaded on NEPRA's Website for information of all concerned 4 Accordingly, the Authority conducted a public hearing in the matter on June 27, 2018 at NEPRA Tower, Attaturk Avenue (East), G5/1, Islamabad The date of hearing was mentioned in the advertisement published in newspapers and also uploaded on NEPRA's website whereby participation in the hearing and filing of comments/ objections from any interested person were invited Separate notices were also sent to the interested / affected parties Written Comments were also received from M/s Anwar Kamal Law Associates (AKLA) vide letter dated June 26, M/s AKLA, in its written comments reiterated the points submitted earlier through its various communications The Authority observed that all the relevant points / issues raised by AKLA pertaining to FCA have not only been addressed in the monthly FCA decisions of the Authority but also a detailed reply alongwith documentary evidence in this regard was sent to AKLA vide Authority's letter dated December 27, 2016; however, AKLA reiterated the previously raised issues in the instant letter without considering the Authority's response thereof 6 On the date fixed for the hearing, representatives from CPPAG, National Power Control Center (NPCC), NTDC, General Public and media were present; however, no representative from WAPDA Power Privatization Organization (WPPO), Sui Southern Gas Company Limited (SSGCL), Sui Northern Gas Pipelines Limited (SNGPL), Ministry of Energy and Ministry of Finance attended the hearing despite service of notice The honorable Senator Mr Fida Muhammad, Chairman Senate Committee on Power, also attended the hearing 7 The Authority has gone through the information provided by CPPAG seeking monthly fuel adjustment vide letter dated June 14, 2018 and due diligence is done accordingly From 1

3 Fuel Charges Adjustment for XWDISCOs for the month of May 2018 perusal of the information so provided by CPPAG, the actual pool fuel cost for the month of May 2018 is 66123/kWh, against the reference fuel cost component of 52908/kWh as indicated in the AnnexureW of the Authority's determination pertaining to the Ex WAPDA DISCOs for FY The actual fuel charges, as reported by CPPAG, for the month of May 2018 increased by 13215/kWh (AnnexLEI) as compared to the reference fuel charges 8 As per data submitted by CPPAG, XWDISCOs purchased GWh from small and captive power plants during May 2018 CPPAG claimed million fuel cost of this energy which was slightly higher than the NEPRA working of million Accordingly, for the purpose of instant adjustment of May 2018, cost of million has been considered 9 Further, fuel costs of coal based power plants ie Port Qasim and Sahiwal coal and based QATPL (Bhikki) have also been adjusted as per the Authority's approved rates 10 Similarly for Nuclear Power Plant ie ChashmaII, the Authority vide its decision dated June 20, 2018 revised the FCC of ChashmaII downward from 09348/kWh to 06869/kWh wef March 2018 Accordingly, the fuel cost of ChashmaII has been adjusted, based on the revised FCC of 06869/kWh, while working out the FCA of May 2018, alongwith adjustment of previously allowed fuel costs for the months of March and April 2018, resulting in a decrease of 154 million in total fuel cost of May CPPAG also claimed 1,048 million for QATPL (Bhikki) for operation on Simple Cycle during the months of December 2017 and January 2018 CPPAG has provided its working in this regard However, as per the Authority's approved rates the amount of adjustment works out as 940 million; the same has accordingly been considered while working out FCA of May CPPAG further claimed previous adjustment of 234 million for NPGCL (GENCOIII), however, only provided detailed working of 69 million as against the claimed amount of 234 million Accordingly, the amount of 69 million has been considered while working out the FCA of May CPPAG also included cost of JPCL (GENCOI) and NPGCL (GENCOIII), based on prices The Authority although has allowed operation of JPCL and NPGCL on vide its decision dated April 12, 2018 Considering the fact that operations of JPCL and NPGCL has already been allowed on, the Authority has decided to include the fuel cost of these plants on on provisional basis as claimed by CPPAG, subject to its adjustment once the Authority approves the revised fuel price adjustment mechanism 14 CPPAG also included an amount of 828 million and 1,175 million on account of previous adjustments for Rousch power Plant and Uch power plant respectively However, no details in terms of the nature and the period to which these adjustment pertains were provided 15 Upon inquiry during the hearing, CPPAG, regarding adjustment of 1,175 million pertaining to UCH Power Plant, submitted that the same is on account of GIDC and invoices 2

4 Fuel Charges Adjustment for XWDISCOs for the month of May 2018 in this regard have been provided to NEPRA The Authority, however, observed that the amount as per the invoices provided by CPPAG for the months of March, April and May 2018 works out as 884 million instead of claimed amount of 1,175 million Accordingly, for working out FCA of May 2018, the amount of 884 million has been considered 16 Regarding adjustment of 828 million pertaining to Roush Power Plant, CPPAG during the hearing submitted that the claimed amount could not be verified, therefore, may not be considered for the FCA of May 2018 Accordingly, the adjustment of 828 million pertaining to Rosuch Power Plant has not been included while working out the FCA of May The Authority has observed discrepancies in the data submitted by CPPAG, therefore, CPPAG should make best possible efforts to ensure that no such discrepancy arise in future 18 CPPAG reported NTDC transmission losses of GWh ie 174% during May 2018 on overall generation of 12,117 GWh including energy generated and delivered at 132kV level directly to DISCOs However, NTDCL, through its metering data, reported T&T losses of GWh ie 2896% during May 2018 based on energy of 10,338 GWh transmitted through NTDCL network at 500kV and 220kV level 19 As per the determination of NTDCL, for the FY & FY dated May 11, 2017, notified on July 27, 2018 vide SRO No 721 (1)/2018, the Authority has determined annual losses target of 280% for NTDCL for its 500 KV and 220 KV network only 20 The Authority observed that losses reported by NTDCL for May 2018 were 2896%, based on energy delivered through NTDCL system, which are higher than the Authority's allowed threshold of 280%, however, accumulative losses of NTDCL from August 2017 till May 2018 works out as 2896%, which are 0096% higher than the allowed annual threshold of 280% Accordingly, for working out the FCA for May 2018, losses in excess of allowed limit of 280% on accumulative basis have not been considered; meaning thereby that impact of extra losses is not being passed on to the consumers 21 The Authority noted that it had directed CPPAG, in its FCA decisions of February, March, and April 2018, to provide plant wise reconciliation on monthly basis for the energy reported by NTDCL in its metering data vis a vis energy reported by CPPAG in its monthly FCA data; alongwith reasons and supporting documents for any differences thereof CPPA G has submitted the reconciliation for the months of January, February, March and May 2018, which are under consideration of the Authority CPPAG is directed to provide the reconciliation for April 2018 as well without further delay 22 The Authority also in its previous FCA decisions had been directing CPPAG to provide the monthly FCA data on a specified format in addition to the format on which CPPAG is currently submitting its FCA requests However, the same has not been provided with currently monthly FCA data The Authority took serious notice of this noncompliance by CPPAG and again directs CPPAG to submit the monthly FCA data on a specified format in addition to the format on which CPPAG is currently submitting its FCA requests 3

5 Fuel Charges Adjustment for XWDISCOs for the month of May The Authority, after incorporating the aforementioned adjustments, has reviewed and assessed an increase of 12212/kWh in the applicable tariff for XWDISCOs on account of variations in the fuel charges for the month of May 2018 as per the following details: Actual Fuel Charges Component for May 2018 Corresponding Reference Fuel Charges Component Fuel Price Variation for the month of May 2018Increase Rs 65120/kWh 52908/kWh 12212/1(Wh 24 In view of the aforementioned, the Authority has decided that adjustment as referred to in Para 23 above; a Shall be applicable to all the consumer categories except lifeline consumers b Shall be shown separately in the consumers' bills on the basis of units billed to the consumers in the month of May 2018 c XWDISCOs shall reflect the fuel charges adjustment in respect of May 2018 in the billing month of July 2018 d While effecting the Fuel Adjustment Charges, the concerned XWDISCOs shall keep in view and strictly comply with the orders of the courts notwithstanding this order AUTHORITY Hirnayat Ullafi Khan Member Rehm tulla Member Saif Chattha Member 7 Brig (R) Tariq Saddozai Chairman 4
