Link to news from: SENATE CONSIDERS $1 BILLION LIHEAP BOOST U.S. Senate Committee on Finance has proposed an Economic Stimulus Package includes $1 billion in emergency funding for the federal Low Income Home Energy Assistance Program (LIHEAP). The funds would be split 50-50, with $500 million in formula funding provided immediately to states, and $500 million in contingency funding for release at the President s discretion (if passed, state governors and administrators would likely urge an immediate release). As this issue of NEON went to press, Democratic leaders failed to overcome a Republican filibuster and advance the stimulus package. They are likely to return to negotiations and work on a slimmer bill. NEFI will continue to support the inclusion of additional LIHEAP funding, which continues to benefit from broad bipartisan support. New England Senators Reed (D-RI), Collins (R-ME) and Sanders (I-VT) lead the effort to secure additional LIHEAP funding. They were joined by nearly all Northeast/Mid-West Senate Democrats and some prominent Republicans, including Snowe (R-ME), Sununu (R-NH), Dole (R-NC) and others. As was reported in last week s issue of NEON, in a letter to Congress NEFI and PMAA endorsed the original proposal to add $3.62 billion to the program. In negotiations behind closed doors, Congressional leaders were forced to settle for $1 billion over fears that the larger amount would stall the stimulus package. 2 The $1 billion would be added to the $2.43 billion already released in FY08. That would put funding on-par with the FY06 level, when Senators Reed and Collins lead a nearly identical and successful (NEFI-endorsed) push for a LIHEAP supplemental. Bush released the final budget of his presidency on Monday, a $3.1 trillion goliath for Fiscal Year 2009 (FY09), which begins on October 1st. It includes nearly $600 million in defense spending and homeland security. Funding for the wars in Iraq and Afghanistan were not included and are expected at a later date. The budget was instantly criticized by Congressional Democrats and social services advocacy groups for cuts to several domestic programs, including Medicare and Medicaid. Funding for programs of interest to NEFI members: Low Income Home Energy Assistance Program (LIHEAP) - $2 billion $1.7 billion formula funding for states and $300 million dollars in contingency funding, which is released at the President s discretion. This amount is 22 percent less than was appropriated in FY08. NEFI will continue to advocate for $5.1 billion as authorized by Congress in the Energy Policy Act (EPAct) of Weatherization Assistance Program (WAP) - $0 (yes, zero) dollars For the first time, the Bush administration has recommended to Congress that funding for weatherization assistance be zeroed out (no funding requested). $227 million was appropriated in FY08. NEFI will continue to advocate for $700 million as authorized by Congress in the EPAct of Northeast Home Heating Oil Reserve - $10 million The President has proposed doubling the previous funding level for the Northeast Home Heating Oil Reserve, from $5 million in FY07 to $10 million in FY09. No funding was provided for FY08 because the reserve had enough carry over funding to remain solvent. NEFI will endorse the recommended funding increase. Commodity Futures Trading Commission (CFTC) - $130 million NEFI does not believe that $130 million is an adequate funding level for the federal watchdog responsible for monitoring and regulating the energy futures markets. While it is an increase of $18 million over FY08, the budget request pales in comparison to the $913 million requested for its sister agency, the Securities and Exchange Commission (SEC). NEFI has urged a drastic increase in funding to empower the CFTC with the personnel, infrastructure, technology and resources necessary to vigorously enforce current and future transparency and accountability requirements.
3 Leaking Underground Storage Tank (LUST) Trust Fund $72 million The LUST fund would receive $72 million with an additional $31 million to be available via state and Tribal Grant Assistance (STAG) funding. The LUST fund has consistently been underfunded since Congress imposed new mandates on state UST inspection agencies in The EPAct of 2005 authorizes $200 million per year through 2009, and marketers pay $140 million in Lust taxes annually. Even with the $3 billion held in the fund, marketers are now being forced to pay higher state UST fees to cover the federal shortfall. The complete budget can be viewed online by clicking here. The Democratic controlled Congress is likely to only consider the non-controversial and non-partisan funding requests, and will likely try again to carve their own path for military, energy and social services spending. Last year, the non-defense elements of the Bush budget were largely ignored, resulting in vetoes or veto threats to most Congressional appropriations bills. In the end, an Omnibus Appropriations bill was necessary to fund the fed in FY2008. A similar course is likely this year, considering the Administration is weak on political capital and the Presidential and Congressional elections are now underway. HOUSE BILL WOULD REDUCE STRATEGIC PETROLEUM RESERVE (SPR) Representatives Nick Lampson (D-TX), and Chet Edwards (D-TX) introduced H.R. 5146, legislation that would require the government to sell 13 million barrels of oil in the Strategic Petroleum Reserve (SPR) by September 30, 2008, and redirect the proceeds to fund energy research projects. The Energy Policy Act of 2005 authorized the President to expand the reserve to one billion barrels which currently contains 698 million barrels. Recently, the Department of Energy (DOE) announced plans to add another 11 million barrels over the next six months. Reps. Lampson and Edwards argue that the SPR is a waste of money and that the oil being stored there could be sold in the open market to raise funds for alternative energy programs. The DOE argues that the SPR provides protection to the American people in case of severe supply disruptions. Regulatory Developments NEWS FROM NEFI WASHINGTON, D.C. ANNUAL EPCRA TIER II INVENTORY REPORTING DEADLINE NEAR The EPA s annual Emergency Planning & Community Right-to-Know Act (EPCRA) Tier II reporting deadline is just around the corner. Each year, petroleum marketers must submit to local emergency response authorities an EPCRA Tier II Inventory Reporting Form that identifies the location and quantity of hazardous materials located at bulk plants and certain retail sites. EPCRA Tier II reports must be filed for bulk plants, marinas and fleet fueling facilities that stored more than 10,000 pounds of hazardous chemicals at any time during the 2007 calendar year with local or state emergency response authorities no later than March 1, Retail fueling facilities with storage capacity less than 75,000 gallons of gasoline and/or 100,000 gallons of diesel fuel are exempt from the annual Tier II inventory reporting. Retail facilities above these thresholds must submit EPCRA Tier II reports. Fuels that must be reported under EPCRA include: gasoline (CAS # ), diesel fuel (CAS # ), kerosene (CAS # ), fuel oil (CAS # ), propane (CAS # ), ethanol (CAS # 64175) and aviation fuels including aviation gasoline, Jet A and JP 8 (CAS Mixtures). Most states have adopted the federal regulations and follow the new exemption thresholds. However, a few states (including Vermont, Ohio, Missouri, New Jersey, Louisiana, Nevada, Oregon and California) have promulgated their own reporting requirements or have chosen to follow the old reporting threshold of 10,000 pounds for retail fueling outlets. Marketers should contact their state emergency planning authority, (usually the state fire marshal) to determine the status of reporting in their states. NEFI will issue a comprehensive members-only compliance kit on Tier II reporting requirements before the end of the week!
4 DOT CHANGES SHIPPING PAPER & PLACARDING REQUIREMENTS FOR ETHANOL BLENDS The U.S. Department of Transportation s Pipeline and Hazardous Material Safety Administration (PHMSA) issued a final rulemaking on January 28th that requires new shipping paper entries and placards for gasoline blended with ethanol. PMAA, PTSA and the NTTC strenuously opposed the rule changes. The rule is significant because it requires changes in shipping papers and placards for certain ethanol blends. PHMSA said the changes are necessary because alcohol blends require different emergency response techniques than straight gasoline. Under the new requirements the shipping paper entries for ethanol blends are as follows: Blends Current Shipping Paper Entry Shipping Paper Entry Under New Rule Gasoline up to 10% ethanol content Gasohol, 3, NA1203, PG II Gasohol, 3, NA1203, PG II Gasoline, 3, UN1203, PG II Gasoline over 10% & up to 20% ethanol Gasohol, 3, NA1203, PG II Ethanol and Gasoline Mixture, 3, UN3475, PG II E-85 Flammable liquid, n.o.s., 3, UN1993, PG II Ethanol and Gasoline Mixture, 3, UN3475, PG II Alcohol up to 5% Gasoline Alcohols, n.o.s., 3, UN1987, PG II Alcohols, n.o.s., 3, UN1987, PG II Denatured Alcohol, 3, NA1987, PG II Ethanol and Gasoline Mixture, 3, UN3475, PG II New placards will also be required for gasoline blended with ethanol in concentrations over 10%. Under current regulations, PHMSA allows cargo tanks vehicles with multiple compartments containing different fuels to display a single placard representing the fuel with the lowest flashpoint. Generally, the placard 1203 is used to cover all petroleum distillates contained within a multi-compartment cargo tank. Under the PHMSA rule, this placard will no longer be permitted for ethanol blended with gasoline in concentrations over 10%. Instead, compartments with ethanol blends over 10% must be marked with a 3475 placard. Moreover, anytime a compartment contains an ethanol blend over 10%, each compartment in the cargo tank vehicle must be individually placarded to the specific fuel it contains. Marketers may still display a single placard for the fuel with the lowest flashpoint in a multiple compartment vehicle if the gasoline blend being transported is 10% ethanol or less. In addition, PHMSA is allowing ethanol blended with 5% gasoline (E-95) to be marked with the 1987 placard instead of the new 3475 placard. Compliance with the rule is required by 1/28/10. Voluntary compliance is effective immediately. PMAA: VOTE DELAYED ON TEMP COMP MANDATE FOR RETAIL MOTOR FUEL STATIONS The Petroleum Marketers Association of America ( has informed petroleum marketers that the National Conference on Weights and Measures (NCWM) has decided to not schedule an official vote on retail motor fuel automatic temperature compensation (ATC) this year. The next possible official vote will be in July of Over twenty PMAA association executives and marketers, along with representatives from API, NACS, NATSO and SIGMA attended the January 28-29, 2008, NCWM meetings in Albuquerque, NM. Without question, retail motor fuel ATC was the most prominent topic of discussion at the meeting. Monday s open hearings on ATC lasted nearly six hours and nearly all of the testimony opposed or raised questions about the proposed Handbook 130 and Handbook 44 changes related to ATC. On Tuesday, January 29th, the NCWM Laws and Regulations Committee decided that the ATC provisions were not ready for an official vote and decided to classify the ATC changes as informational in Essentially, the informational classification means NCWM will seek more testimony and research during 2008.
5 PMAA President Dan Gilligan attended the meetings and compliments NCWM leaders for making the right decision. I think many NCWM members are beginning to understand that the press has really exaggerated and mischaracterized the facts concerning temperature and retail prices. NCWM officials are searching for the truth and more study is certainly needed, he said. The delayed vote is a major victory for PMAA and the national Partnership for Uniform Marketing Practices (PUMP) Coalition, of which it is a member. Other national members of the PUMP Coalition include the American Trucking Association (ATA), National Association of Convenience Stores (NACS), National Association of Shell Marketers (NASM), National Tank Truck Carriers, Inc., (NTTC), National Association of Truck Stop Operators (NATSO), Service Station Dealers of America and Allied Trades (SSDA-AT), and the Society of Independent Gasoline Marketers (SIGMA). Many state-level retail motor fuel groups were also involved in the effort. NEFI had endorsed a statement in late 2007 by the Northeastern Weights & Measures Association (NEWMA), of which it is a member, urging the national group to postpone any consideration of ATC until comprehensive regulatory impact studies were done, answered questions were addressed, and the industry was given adequate opportunity to provide input on its effects on the market and the consumer. OUR BIO-FUTURE News From the World of Renewable Energy MASS. RESEARCH FIRM SEES $7 TRILLION INVESTMENT IN CLEAN ENERGY BY 2030 Massachusetts-based Cambridge Energy Research Associates (CERA) said that as much as $7 trillion dollars in investments could move toward clean energy technologies by 2030, according to a report issued this week. Entitled Crossing the Divide: The Future of Clean Energy, the firm says the report provides an integrated framework for understanding the current and future role of renewables and clean energy technologies, and the implications for company strategies and the competitive landscape. The report claims to provide a realistic and multi-dimensional look at clean energy sources, including biofuels, wind, biomass, geothermal power, solar, hydro, nuclear, and carbon capture and storage technologies. BUSH LEAVES ETHANOL TARIFF ALONE AT URGING OF SENATOR, CORN INDUSTRY After a statement of concern by U.S. Senator Chuck Grassley (R-IA), a prominent ethanol industry advocate from a corn producing state, President Bush opted to continue his support for the tariff on imported ethanol for the remainder of his final term. The 54 cents per gallon tariff was left in the President s (final) budget his week. Advocates say the tariff protects the U.S. ethanol market from being flooded with cheap Brazilian ethanol. Speaking at a biofuels conference last week, Energy Secretary Samuel Bodman said that the ethanol industry has grown sufficiently to compete in the free market without protection, leading many to believe the administration would do away with the tariff on imported ethanol and spurring advocates like Grassley into action to oppose the move. DOE ANNOUNCES $114 MILLION FOR BIO-REFINERY PROJECTS The Department of Energy (DOE) has announced that it would spend up to $114 million in fiscal years for four small-scale bio-refinery projects in Colorado, Missouri, Oregon, and Wisconsin. The DOE said that the 10-percent scale bio-refineries would use a wide variety of feedstocks and test conversion technologies to provide data needed for commercial-scale bio-refineries. The facilities will help advance President Bush s goal of making cellulosic ethanol cost-competitive by 2012 and reducing U.S. gasoline consumption by 20 percent by 2017, DOE said. The DOE anticipates selecting
6 a second round of small-scale projects in the spring, brining the total investment up to $200 million. For the press release and a complete list of projects selected, click here. Shane Sweet, Executive VP & CEO, along with NEFI VP s Tracy Goodwin, VP and Director of Events and Jim Collura, VP for Government Affairs attended the 2nd Planning Committee Meeting for September s Visions Conference (see article above). The meeting, held on Thursday, January 31st at the Sheraton Bradley Airport Hotel, was facilitated by Craig Snyder of Wesson Energy. Don Craft of Global Companies, LLC acted as the meeting s Chairman. The attendees began the process of building the framework for Visions 08, focusing on track development and attendance-building goals. Shane Sweet joined Peter Romano of the Independent Oil Marketers Association of New England (IOMANE) in an early February with the air quality group NESCAUM on Stage II vapor recovery. Discussed: Widespread Use Issues, including clarification of key issues, Northeast requirements for stage II and interplay with widespread use, discussion of states ability to phase out Stage II, use of recent EPA memos related to Stage II, Stage II equipment removal requirements and Stage II for new stations or those that undergo major modifications. NESCAUM expects participation from technical and management staff from the Vermont DEC, Maine DEP, New Hampshire DES, Massachusetts DEP, Connecticut DEP, Rhode Island DEM and NYS DEC, and EPA Region 1. Tracy Goodwin has been hard at work reformulating the 2008 Spring Energy Conference to Ireland, Northern Ireland and Scotland. Jim Collura attended last week s successful LIHEAP Action Day on Capitol Hill, sponsored by the National Fuel Funds Network. Collura coordinated meetings for nearly the entire Massachusetts Congressional Delegation, and was joined by Boston-area LIHEAP advocates during the meetings. NEFI Government Affairs Committee Chairman Chris Keyser joined the trip, and accompanied by Rob Underwood and Sherri Cabrera of PMAA, met with the Vermont Congressional delegation. Also participating in the event were Oil Heat Institute of Rhode Island Executive Julie Gill and Fuel Merchants Association of NJ Executive Eric Degesero, each of whom also met with their respective delegations. NORA NORA News Contact: Mary-Rachel Keyser NORA CONTINUES TO TACKLE OILHEAT INDUSTRY CHALLENGES HEAD-ON The challenges in the industry are probably as great as ever. The high price of oil has changed the business in almost every way, from customer credit, to the company s credit, to publicity. As we exit the season, the industry is going to have to think on how we work with our customers and keep them loyal through the summer. While there are no easy solutions, the key to these situations is to be on the customer s side. It will require execution and vision by the industry, and its employees. We know that everyone in the industry is concerned with the prices, and unfortunately, the tools to handle it and respond are limited. First, we need to work to try to save the customer s money. The high prices for both gasoline and heating oil have had a big impact on many household budgets. The best we can do is help them control these prices in future years. One way to do that is help them move into better and more efficient equipment. A high efficiency unit may be a big investment for a homeowner. However, with prices around $3 per gallon, there is a quick return on these investments. To facilitate and help customers understand the efficiency of equipment, NORA completed a research project with NYSERDA and Brookhaven National Laboratory to understand how new equipment will reduce energy use in a home, especially for boilers supplying heat and hot water. The trick now is to translate this so that customers can understand this efficiency and make an intelligent decision to improve their home heating system. NORA is currently wrapping up a computer program that will allow companies to compare the existing heating system in the home, integrate heat load, and compare it to new systems. It will give payback times over 10 and 20 years and illustrate the savings graphically. This will be a terrific way for companies to explain savings, and those customers who want to or need to save money will be helped by their Oilheat company. NORA also encourages companies to look closely at bioheating. While, this fuel will not provide cost savings to customers, it will show our customers that we have a long term idea to move ourself away from the fluctuating prices of international oil, and that this clean homegrown fuel that is also renewable is available to them.
