2 Overview of benchmarking initiatives historical review State Regulation of WSS sector in Bulgaria State Regulation of Bulgarian WSS operators started with adoption of special law on WSS services and the establishment of specialized directorate within the State Energy and Water Regulatory Commission Establishment of legal framework for key performance indicators for the WSS sector 2005: adoption of the law atr.9, para 2 of the Law of Regulation of the water supply and sewerage services regulates particularly the key quality indicators 15 key indicators; 2006: adoption of the by-law annex No 1 of the Ordinance of long-term rates, terms and conditions for the formation of the annual target levels of quality water and wastewater services regulates the sub-indicators of the 15 key indicators 49 sub-indictors. 2006: SEWRC issued Guidelines to the implementation of the above Ordinance, annex No 2 of the guidelines regulated 72 performance indicators.

3 Overview of benchmarking initiatives Key indicators in the practice The key indicators and its sub-indicators are part of the business plans of WSS operators. Business plans must be approved by the SEWRC. Final term to achieve key indicators 2016 Periods of business plans: years business plans; years business plans. Annual reports on the implementation of business plans of WSS operators + off and on-site inspections of the WSS operators.

5 Overview of main performance indicators, laid down by the law Benchmarks, which point standards/targets against which activity can be measured 1. level of coverage with water supply services; 2. quality of the drinking water; 3. continuousness of the water supply (continuousness of the water supply and duration of the interruptions); 4. general losses of water in the water supply systems and terms for their reduction; 5. breakdowns of the water supply system; 6. pressure in the water supply system; 7. level of coverage with sewerage services; 8. quality of the untreated waste waters and of the treated waste waters; 9. breakdowns of the sewerage system; 10. floods in properties of third persons, caused by the sewerage; 11. exploitation indices of efficiency; 12. financial indices of efficiency; 13. term for answer to written complaints of the consumers; 14. term for joining of new consumers to the WSS systems; 15. number of the personnel compared to number of the serviced consumers.

6 Institutions involved and its role Scope Initiative description State Energy and Water Regulatory Commission (SEWRC); it is a state regulator for Bulgarian WSS operators it approves the business plans of WSS operators; the prices of WSS-services of WSS-operators; and performs off-& on-site inspections of WSS operators; and reports and analytical studies of the activity of WSS operators. type of data collected: metric data in excel-files, received both on paper and CDs/ s; purpose of data collection: check the activity of WSS-operators & if it correspond to the standards laid down in the legislation. use for utility benchmarking: achieving the target level, set forth by law, WSS-operators shall provided a minimum level of WSS services quality, required by the state and society. Characteristics Status Closed options, both provided on paper and CDs/ s. - the benchmarking system is operational since 2008 but particularly implementation of performance key indicators for each WSS operator Coverage 100% of Bulgarian WSS operators are covered since 2008.

7 Plans and expectations Main plans and intentions in the future with regard to benchmarking / performance indicator systems in Bulgaria for WSS-operators: The SEWCR considers changing the law and by-law in regard to the number of observed key and sub-key indicators - presently the final number is too large: 15:49:72 - Reducing the number of present key indicators + including possible new key indicators, which correspond to best EU practice.
